Research background: The choice of financial services and remittances are important as they influence the livelihood of remittance recipients, who are mostly poor and financially excluded. In literature, extensive evidence suggests a positive impact of the size of remittances on access to financial inclusion and financial development of remittance-recipient countries. However, a concern of such studies is that they might provide a biased outcome as the available data of remittances tend to be formal, whereas informal remittances are difficult to observe. Hence, their evidence might not be applicable in developing countries where remittance transfer via informal channels is very popular. Purpose of the article: The main objective of this study is to examine the effect of the remittance channel (formal and informal) on the choice of formal, informal financial services of credit and savings of remittance recipients. Methods: As our dependent variable is a financial service which is a categorical variable (formal and informal), the paper will employ a multinomial logistic regression model to estimate the impact. The data employed in this analysis is from the Finscope survey conducted in Myanmar in 2013 and 2018. Myanmar is the best context for our study, as it is one of a big migrant-sending countries and a developing country whose financial sector is significantly underdeveloped. Findings & value added: Our findings show that formal remittances promote the use of formal financial services such as credit and savings. However, there is no evidence regarding women recipients` informal channels and formal financial services. Our evidence also suggests there is a need for the government to encourage migrant workers to transform informal remittances into formal ones by removing the barriers of formal remittance channels to promote the use of formal credit and saving among remittance-recipients who are poor and financially excluded.

The aim of the article is to present the idea of the functioning of Fin-Tech firms in the market for financial services, with particular emphasis on consumer finance. Globalization and technology cause changes in a number of markets, goods or services. An interesting situation exists in the financial markets, where there are not only institutions subject to restrictive regulations (eg. banks), but also many non-banks. Banks emphasize the concept of a level playing field for all market actors who provide similar services and take similar risks. The question is whether banks are sufficiently agile, flexible and cost competitive. Banks do not always keep up with changes, technology companies can therefore take over part of their clients. However, banks enjoy greater confidence, as safe traders, which are subject to regulation and supervision by the state. The activity of Fin-Tech firms raises questions about the level playing field, the assessment of competition and cooperation, as well as the desirability of subjecting these new competitors regulation of banks, insurance companies, investment firms, payment institutions and electronic money institutions.

The relevance of this research topic is due, on the one hand, the importance of studying the mechanisms of protection of consumers of financial services in martial law, and on the other – the presence of theoretical and practical legal issues related to state control in this area. According to its legal content, martial law is a special legal regime that can be imposed under certain conditions throughout Ukraine or in some of its territories. The basis for the imposition of martial law may be armed aggression or the threat of attack, as well as the threat to state independence of Ukraine and the territorial integrity of the country. In order to avert threats to national security, the relevant authorities, military administrations, military command and local self-government bodies are given the necessary powers during martial law. The purpose of the research is to conduct a comprehensive scientific analysis of theoretical, practical and regulatory issues of protection of consumers of financial services in martial law and develop proposals to improve existing legislation to harmonize national legislation with European Union law. The author notes that based on the analysis of emergency regulations of the National Bank of Ukraine aimed at protecting the rights of consumers of financial services in martial law, a number of conclusions can be drawn. Provisions on the protection of consumers of financial services in martial law should protect the interests of consumers by encouraging the provision of quality services and fair competition. Withdrawal from the market of those participants whose services are directly related to the financial institutions of the aggressor state, low quality and based on fraud and abuse, or those who seek to maximize profits in the short term to the detriment of long-term value to customers and shareholders in fact, one of the main purposes of such regulation.

The research confirmed that users of mobile banking use other sales channels for financial services more frequently and more intensively. The most popular functions using by mobile banking customers were checking accounts. Mobile banking is perceived as insecure, even more than internet banking. The most expected functionality of mobile banking is the ability to make NFC mobile payments for purchases in store.

Z jednej strony w literaturze naukowej pisze się coraz więcej o innowacyjnych usługach finansowych (wpływ informacyjnych i komunikacyjnych technologii na finanse), jednak z drugiej zapomina się o narastającej liczbie osób, które tracą dostęp do usług podstawowych. Prezentowany artykuł przedstawia problemy związane z wykluczeniem finansowym i próby jego przezwyciężania w skalach europejskiej oraz globalnej.
Financial exclusion becomes a peculiar problem in contemporary finance. From one point of view, in scientific literature there are growing number of publications concerned to innovative financial services (the influence of information-communication technologies on finance). From other side, there are not much publications uprising problems of people losing access to financial services. The presented article is an effort to discuss the problems of financial exclusion and attempts to overcome this phenomenon in European and global scale.

This study investigates the role of marketplaces and financial technology (fintech) in enhancing financial inclusion within the smart cities of the European Union (EU). Fintech, defined as the convergence of finance and technology, has been identified as a significant factor influencing financial inclusion. The research aims to determine how fintech can support the sustainable and balanced development goals set by the United Nations Sustainable Development Goals (UN SDGs) through the development of technology infrastructure within the smart city. The literature review provides a foundational understanding of financial inclusion and smart cities. This is followed by a comparative analysis using secondary data to examine the importance of fintech for existing smart cities in the EU. Our findings indicate that fintech substantially enhances financial inclusion in these urban settings. The social impacts observed include: reduced poverty levels, improved financial literacy, expanded access to financial services, and increased interactions between individuals and financial service providers. This study contributes to a deeper understanding of the relationship between fintech, marketplaces, and financial inclusion in the context of the EU’s smart cities.

An efficiently operating financial system is considered as an integral part of a well-functioning economy. It is the mechanism by which services are provided that allow the flow of purchasing power. Thus, this system creates the foundations of activity for entities using money, enabling the conclusion of economic transactions in which money performs various functions. The result of the existence of this system is the possibility of co-creation of money by non-financial economic entities (enterprises and households) and the flow of cash between them. In the light of many transformations taking place in the financial system, it is extremely important to ensure its stability. A properly functioning financial system significantly supports the achievement of the main goals of the central bank – maintaining a stable level of prices, and thus creating the basis for achieving long-term economic growth. Educational activities are of great importance in ensuring the stability of the financial system. The aim of the article is to present the role of economic education among young people, thanks to which they can better understand the complexities of the functioning of the financial system, the importance of its stability and prepare to make more conscious decisions as fully-fledged participants of the financial market. Understanding the specificity of the available financial instruments enables the minimalization of the risk associated with their selection / purchase. The accuracy of decisions made in adulthood depends on the knowledge of basic economic issues and the awareness of potential threats.

The article discusses the problem of the alternative financial services market functioning. This type of financial services is offered outside the regulated and supervised financial system. The aim of the article is a preliminary recognition and systematization of the most important factors influencing the decisions taken by individual financial consumers regarding the products and services of the alternative market. The article also aims to conduct the comparative analysis with regard to the use of the basic alternative financial services in countries with different levels of economic developments. The attempt made in the article of detecting appearing regularities on the market of basic alternative financial services in relation to the GDP per capita shows that the analysis in not giving explicit results and further research is required.
Artykuł podejmuje problem funkcjonowania rynku alternatywnych usług finansowych, czyli usług oferowanych poza regulowanym i nadzorowanym systemem finansowym. Celem jest wstępne rozpoznanie i usystematyzowanie najważniejszych czynników wpływających na podejmowanie decyzji w zakresie korzystania z produktów i usług rynku alternatywnego z punktu widzenia indywidualnych konsumentów finansowych oraz przeprowadzenie analizy porównawczej w zakresie wykorzystywania podstawowych produktów i usług finansowych oferowanych przez instytucje formalnego i alternatywnego rynku finansowego w krajach o zróżnicowanym poziomie gospodarczym. Podjęta próba wychwycenia prawidłowości występujących na rynku podstawowych produktów rynku alternatywnych usług finansowych w powiązaniu z PKB na mieszkańca wskazuje, że poszczególne analizy nie dają jednoznacznych wyników i wymagane są dalsze badania.

The crisis begun in 2007 exposed the weakness of the existing regulations, revealing challenges for legislators all over the world. Financial stability started to be understood as an essential value for the proper operation of the financial market. It has become important to address the question as to how to protect financial markets from more crises, or at least alleviate their effects. The idea of supervision of a financial market has undergone thorough transformation. Particular emphasis has been placed on protecting buyers of financial services. Adequate customer protection has been recognized as a sign of trust in the market and its stability and has gained systemic importance and relevance for the European financial system. There is a growing tendency to enlarge the group of subjects eligible for special protection. it is becoming an increasingly common idea that not only consumers but all non-professional customers should be protected. The idea is becoming widespread that the weaker party to a legal transaction can be not only a consumer [natural person] but also a non-professional market entity. Such a solution is certainly appropriate. Narrowing down the ‘consumer’ to a natural person may seem artificial and out of line with market realities, not to mention the serious consequences of bad financial decisions taken by non- professional financial market participants. Another important challenge facing the modern financial market is to establish a system of institutional safeguards to ensure security for all market entities and to enforce fair play rules. However, even the best provisions of substantive law, though necessary, may prove to fall short. Therefore, there is a pressing need for strong and competent both state and international institutions duly equipped with auditing and supervisory powers to deal with the present situation. They should also have the possibility of enforcing substantive laws in a way that allows for flexible responses to any emerging threat to the protected values. The shift towards a regulatory and supervisory method of protection sets a more serious tone for the supervision model adopted for the financial market. In it, the market is responsible not only for ensuring that the supervised entities operate correctly, but also for the quality of services that they provide.

Research background: Traditional financial institutions are facing new competitors - FinTech lenders. The development of these entities and their services depends on many factors, including the level of their acceptance and use by potential and/or current customers. This acceptance determines the ability to create desired financial results and defines the set of FinTech lenders' activities and also their environment aimed at shaping the offer which meets their consumers' expectations. The limited number of studies addressing the identification and assessment of the impact exerted by the adoption factors of lending services offered by FinTech lenders and the lack of such analyzes relating to these decisions made by consumers from Central and Eastern Europe argue for the need to conduct such research. Purpose of the article: Identify factors driving consumers' adoption of digital lending services offered by FinTech lenders in Poland. Methods: Critical analysis of the source literature, descriptive and comparative analysis, diagnostic survey, econometric methods (PCA, SEM used in the TAM). Empirical data come from the surveys carried out in May 2022 using the CAWI method and covering a representative sample of 1,000 Poles. Findings & value added: The study identified factors driving consumers' adoption of digital lending services, including perceived trust, risk, usefulness and financial health. It has been proven that the perceived ease of use and innovation do not represent the statistically significant constructs influencing the accepted adoption attitudes. The adopted research model shows a considerable power to explain the intention of using digital loans. The article is the first scientific study of this type discussing the identification of adoption factors for loan services offered by FinTech lenders operating on the Central and Eastern European market. The presented example of Poland being the leader in this dynamically developing market provides the background for conducting international comparative studies in the future.

Misselling (understood as proposing financial services to consumers while violating good practices) is considered by Polish law to be an act against consumers’ rights. It also shows, however, many similarities with some acts of unfair competition and/or unfair commercial practices, which as all refer to good manners as one of their legal circumstances. The article discusses the scope of good practices which should lead entrepreneurs to discover the real needs of the consumers regarding potential financial services and their obligation to inform the customer of all risks connected with the potential service. Regardless of many similarities between different legal acts, it is worth noting that the competition authority can protect consumers more efficiently when referring to misselling as a separate illegal act that contravenes good practices than when pointing to unfair competition or unfair competition practices.
W ustawie z dnia 16 lutego 2007 r. o ochronie konkurencji i konsumentów (uokik)1 obowiązuje od 17 kwietnia 2016 r. przepis art. 24 ust. 2 pkt 4. Na jego podstawie działanie niezgodne z prawem lub z dobrymi obyczajami polegające na proponowaniu konsumentom przez instytucje finansowe takich usług, które nie odpowiadają potrzebom konsumentów lub są prezentowane konsumentom w sposób nieadekwatny do charakteru tychże usług, zostało uznane za nowy rodzaj naruszenia zbiorowych interesów konsumentów. W pracy określono, w jakim zakresie regulacja ta różni się od dotychczas istniejących instrumentów ochrony praw konsumentów i pokrewnych instytucji, do których należą przykładowo zachowania niezgodne z zasadami współżycia społecznego, nieuczciwe praktyki rynkowe czy czyny nieuczciwej konkurencji. Ocena ta wynika z zastrzeżenia ustawodawcy, że ochrona zbiorowych interesów konsumentów (jakim jest misselling) przewidziana w ustawie nie wyłącza ochrony wynikającej z innych ustaw. All activities of the EU in the scope stabilization of the financial services should be closely correlated with the reforms in this area conducted in the world and the EU should actively participate in the construction of a new financial secure architecture. The actions, which should further stabilize the increasing phenomenon of crisis should include: reconstruction of the institutions created after the collapse of the Bretton Woods system, a new global mechanism for regulating the economic processes must be created, the development of new international economic policy, which will be based on the transnational regulations, further work on the new architecture of financial security, the introduction of strict regulatory measures and increase of security standards, close governance monitoring of the global banks that concentrate a huge mass of money.
