The article presents the process of restructurization of Brazilian economy in the second half of the 20th century. The Author presents major economic programs implemented by the Brazilian government since 1950's until 2004 and shows the main assumptions of implemented reforms and their effects in the economy. The Author proves that structural changes, which can be noticed in the Brazilian economy, are fundamental for further strengthening of Brazil’s position in both South America and global economy.

The aim of the article is to present the essence and function of the municipality responsibility to the owner (perpetual usufructuary) of the real property related with the adoption or amendment of the local master plan pursuant to Section 36 of the Act on Spatial Planning and Development of 27 March 2003. The aim of the Author is also to highlight essential interpreting problems concerning Section 36 of the Act on Spatial Planning and Development which have been revealed under the ruling of the Supreme Court. The paper describes in detail which legal and financial results does the local master plan bring for a person when coming into force. The Act determines the extent of the allowable entitlement of the owner of the real property to make use of their right, but it also may influence the value of the real property included in such a plan. As a result, entering into force of the local master plan may affect the owner’s right to make use of the real property and decrease its value. The above implications constitute the basic reason for ascribing responsibility to municipality pursuant to Section 36 of the Act on Spatial Planning and Development. In attempt to analyze the legal character of the municipality responsibility pursuant to Section 36 of the Act on Spatial Planning and Development, it was also referred to rules of the Supreme Court. According to that some essential interpreting doubts were highlighted which were evident in the rules of the Supreme Court concerning the local master plan. They referred to: 1) the concept of damage and ways of assessing its value, 2) the stipulation for units entitled to assert their claims pursuant to Section 36 (1 and 3) of the Act on Spatial Planning and Development, 3) interpretation of requirements for municipality responsibility.

This article is about legal distinctnesses of Warsaw real estate with specific consideration to agricultural land situated within urbanized areas of greater Warsaw agglomeration. The Author allocates and presents scientific research on legal conflicts being occurred within Warsaw greater area administrative boundaries. As these regulations applicable to Warsaw area are not unite and transparent and as such do not represent an overall, unite system being finely balanced, the Author undertakes an attempt to determine on legal obstacles, complexity and its discrepancies. The range of study covers especially ownership and affranchisement issues, administrative jurisdiction and the past and most recent judgments constituting case law of administrative courts given by those courts in relation to agricultural land located within urbanized areas of greater Warsaw. In particular, the article is a case study how Warsaw zoning plans influence execution and performance of ownership title and perpetual usufruct title to agricultural land and Warsaw real estate in general. Author also undertakes in the said article key problems derived from complexity of legal issues of Warsaw real estate recovery in case law of administrative courts as well as in selected case law of civil courts, Supreme Court, Constitutional Tribunal and jurisprudence. A specific area of Author’s interest is agricultural land designated for urban and commercial use according to existing zoning plans and binding regulations on shaping of the agricultural system and their impact on development, management and use of such areas. The Author refers also to allowed manner of use of urban land of Warsaw greater area and its legal consequences for the entire system adjacent to agricultural real estate. The scope of scientific research covers also presentation of rules governing the changes in the amount of perpetual usufruct fees and its impact on owners and /or perpetual usufructors position in the light of the allowed use and land development within Warsaw agglomeration. The article refers to distinctnesses and various titles to land occurred within Warsaw urban boundaries (private property, freehold title of State Treasury and municipality) being a result of historical obstacles as well as forwards opinions and de lege ferenda proposals including methods of resolving legal conflicts and discrepancies within binding regulations.

Opis:
Real estate owners, whose right to use the property was infringed or heavily restricted, are entitled to request: compensation, buyout of the real estate or access to a replaceable real estate. These claims shall be subject to a limitation period. In a situation where a development plan of a given plot of land predicts a public road, the owner of that real estate is also entitled to compensation for a plot separated for the construction of the road which ex lege becomes a property of local self-government units. The claim is not subject to a limitation period.

Lack of general planning duty along with long time required for conduction of procedures concerning passing (introducing changes) in local area development plans lead to substantial difficulties in making location of numerous investment of public nature (public aim investments). Unfortunately the Act of 27th March 2003 on spatial planning and development (Journal of Laws of 2012 item 647 with subsequent changes) does not foresee any particular solutions. Therefore legislator decided to introduce particular regulations within this field. Decisions which approve of carrying out respective investments determining their location are to be solution to the above mentioned problems. The most frequently spatial planning and development regulations are not applied while issuing these decisions, although sometimes they are binding while making local plans, or issuing decisions on development conditions, as well as area development plans. Decisions which are issued within this scope can be determined as particular substitutes of spatial planning. However, it is worth to underline that the above mentioned acts determine also number of different issues connected with conditions of carrying out plans and can result in real estate expropriation at the area of planned undertaking, or at last some of them constitute consent to its construction.

The aim of the study is to evaluate the effect of local spatial management plans on legal forms of administrating agricultural real estates. In view of the extensive scope of the problem it was decided to focus on the concept of agricultural real estates; transfer of ownership right or perpetual usufruct right of agricultural real estates for purposes other than agricultural; the effect of a local spatial management plan on lease of agricultural real estates. Moreover, the paper also presents principles of changes in planned land use of agricultural real estates in the local spatial management plan and it was referred to the problem of exclusion of agricultural land from agricultural use as well as re-zoning fees. In conclusion the author states that e.g. adoption or a change in the spatial management plan and the location of an agricultural real estate in areas with planned land use other than agricultural does not impose in principle an obligation to cease agricultural activity and does not introduce the date for the exclusion of agricultural land from agricultural activity (unless the plan stipulates another manner of their temporal land management). However, already a change in the plan (the location of an agricultural real estate in areas with planned land use other than agricultural) results in a situation when the National Agricultural Constitution Act of 11 April 2003 is no longer binding. The author also presented her de lege ferenda conclusions concerning e.g. changes in spatial planning, implementation of greater protection of class IV agricultural land (if their cohesive area planned to have their land use changed exceeds e.g. 1 ha), reinforcement of the legal position of agricultural real estate lease in the case of planned land use for leased land other than agricultural in the local spatial management plan. In such a situation the lessee no longer is entitled to the preemptive right, which may be particularly unfair in relation to long-term dependent possessors, who introduced considerable improvements hoping for the potential acquisition of ownership.

The main objective of the article is to depict the financial aspects of the urban area development. The paper is divided into two major parts. The first one in theory presents legal determinants to provide the city budget with income from real estate management, and the financial results for adopting implementing rules concerned the city master plans. The second empirical part contains the analysis of the land development and spatial – landscaping transformations in Cracow. The authors also studied the real estate financial city reports in the marginal years available for research 2005–2010.

The Act of March 27, 2003, on spatial zoning plan and development, regulates establishing zoning plan fees. Thus, the executive bodies of the municipalities have legally created instruments to collect the fee if the conditions outlined in the Act are met. Amendments to this provision resulted in inaccuracies in establishing the fee. The zoning plan fee is established based on the increase in the value of the real property, taking into account two legal statuses. The real estate appraiser confirms the change in the value of the real property in the appraisal report, which constitutes evidence in the proceedings for determining the amount of the zoning fee.In practice, the determination of the zoning plan fee causes many misunderstandings and problems. The main reason for them is the difference in the value of the real property. It becomes the basis for the municipality’s claims against the property owner. Owners (perpetual usufructuaries), in most cases, take action to reduce the calculated difference in value. Most often, they question the correctness of the real estate appraisal and the way it was documented in the appraisal report.The article presents selected charges directed at real estate appraisers concerning the correctness of property valuation for this purpose, with a commentary supported by legal regulations and court rulings (judgments of the Supreme Administrative Court and the Supreme Administrative Court). In the paper, some findings of the Local Government Appeal Colleges are also indicated.

The paper presents issues pertaining to the amount of planning fees (fees charged for a planning application) in the context of the decision by the Polish Constitutional Tribunal dated 9 February 2010, file symbol P 58/08. Authors discuss the principles of setting such fees before the aforementioned decision was issued, and the new fee calculation principles following the implementation of the Tribunal’s judgement. The Tribunal decision in question produced the change in the regulations of law concerning the calculation of planning fees, which up to that date caused many problems and difficulties, not only for the agencies responsible for setting and collecting the fees, but also for real estate evaluators and appraisers, who performed land valuations for the purpose of calculating planning fees.
W niniejszym artykule przedstawiono problematykę wysokości opłaty (renty) planistycznej w ujęciu wyroku Trybunału Konstytucyjnego z dnia 9 lutego 2010 r. o sygn. akt P 58/08. Przedstawiono zasady określania wysokości przedmiotowej opłaty obowiązujące przed wydaniem w/w wyroku oraz zasady ustalania wysokości tej opłaty jako efekt realizacji tego wyroku. Wskazany wyżej wyrok spowodował zmianę przepisów prawa w zakresie ustalania wysokości opłaty planistycznej, które w praktyce budziły wiele trudności i problemów, nie tylko wśród organów właściwych do ustalania i pobierania tej opłaty ale również wśród rzeczoznawców majątkowych, którzy dokonywali szacowania gruntów na potrzeby określenia wysokości opłaty planistycznej.

The purpose of the article is to analyze of local spatial development plans as well as zoning and spatial development conditions and to determine the impact of these works on the development of the Smart City on the example of the city of Rzeszow. The comparative analysis will consist in showing the availability of local spatial development plans in the city of Rzeszow. The experimental database will be publicly available and up-to-date map portals. The research materials were obtained from the Geodetic and Cartographic Documentation Center in Rzeszow (Poland) in the years 2011–2019 were subject to analysis during a study visit of scientists from the Lviv National Agricultural University in Dublany (Ukraine). The City of Rzeszow was chosen for detailed research, because Rzeszow ranks 55 in the European Smart Cities ranking. It is worth noting the list included 6 Polish cities, including the City of Rzeszow. In Rzeszow Smart City the research was carried out on 23 districts of cadastral registration. In the Smart City of Rzeszow, decision on development conditions constitute a much larger number (7318) than the local spatial development plans (107). On the basis of the presented data, it was found that the most design work was carried out in 2016–2019. The article is of research nature, hence a lot of attention was devoted to the analysis of particular plans performed in the Rzeszow Smart City and on the graphic presentation of results.

Wymóg zabudowy planowej jest wyjątkiem od wolności zabudowy, jak również jest jej przeciwieństwem. Wyróżnia się trzy cechy charakteryzujące ten wymóg. Po pierwsze, wymóg zabudowy planowej, jako element specjalnego reżimu prawnego, jest ukształtowany dwuetapowo. Prawodawca w drodze ustawy określa ramy prawne tego reżimu prawnego, a następnie gmina ustanawia ten reżim prawny dla konkretnego obszaru. Po drugie, wymóg zabudowy planowej jest ograniczony ze względów przestrzennych lub czasowo-przestrzennych. Po trzecie, wyznaczenie wymogu zabudowy planowej nie skutkuje bezpośrednio powstaniem odpowiedzialności odszkodowawczej za zmniejszenie wartości nieruchomości. Odpowiedzialność ta powstaje dopiero wraz z uchwaleniem miejscowego planu zagospodarowania przestrzennego.
The requirement of planned development is an exception to the freedom of development, as well as it is the opposite of this freedom. Three features, which are characterizing this requirement. Firstly, the requirement of planned development, as an element of a special legal regime, is created in two stages. The legal provisions defines the framework of this special legal regime, and then the commune establishes this legal regime for a specific area. Secondly, the requirement of planned development is limited for spatial or spatio-temporal reasons. Thirdly, setting the requirement of planned development does not directly result in liability for damages for the decrease in the value of the property. This responsibility is connected with the passing the local spatial development plan.

The article presents the legal basis for action and decision support systems of the Polish Maritime Search and Rescue Service. Based on the course of a selected mission, the actual actions were compared with the IAMSAR recommendations, presenting the ways of communication and the latest training techniques for saving lives. Conclusions from the conducted analysis indicate that because of the knowledge and experience of rescuers the requirements for conducting a search and rescue action according to IAMSAR differ from the actual actions of rescue services.

Today, the issue related to spatial planning in rural areas takes on particular significance. In this context a reference to the views of Professor W. Pańko is justified, as they remain perfectly stable. The planning is an instrument promoted by EU which enables permanent and sustainable development of rural areas. The planning is an imminent and integral element of the notion covering the management, as it concerns spatial planning in any economy system. The issue of spatial planning in rural areas should be viewed from the point of view of its functions (synchronisation, coordination and information), where the two last ones takes on particular significance for development of them. The coordination function plays an important role for the policy to support development of rural areas from the Union and national resources; it is expressed in the contents of local master plans and relates to the coordination of actions, as well as the organisation of cooperation among entities operating on the areas in concern and bringing together their interests. The information function, their place and actions in which satisfies openness and transparency of planning procedures gives all entities the awareness of their place and actions in economic space and its value. Construction elements of the prescriptive model of spatial planning ensure logic link between documents which designs spatial management of a commune (strategies of commune development, the spatial development conditions and directions study, local master plans) aim to ensure the spatial order and the sustainable development of communes in rural areas. The process of using the specified mechanisms is a very comprehensive, long-lasting, time consuming and expensive process, therefore there is a huge gap between the prescriptive model and the actual process of spatial development of rural communes. Current prescriptive model of spatial planning gives almost the same attention to the organisation of agricultural space as the legal regulation of 70s of the XX century. This raises the question on the adequacy of the referred model to organise development processes of the current agriculture, as on the one hand the model (the study and the local master plan) seems all perfect, then costly and heavy, and on the other hand a stream of funds for development of rural areas it is intended not only for the agriculture, but also for the whole multi-functional rural area. As the notion of a rural area is not the same as the notion of an agricultural manufacturing space then the concept of multi-functional rural areas should be matched by its expression and reflection in the instruments of spatial planning. However, the provisions of the act on spatial planning and development fail to pay attention to this issue special interest. In the paper’s content the Author seeks to respond to the dilemmas on this matter.
