According to article 430 of the Polish Civil Code anyone who, on his own account, entrusts an act to a person who, while performing the act, is under his manage- ment and is obliged to follow his instructions is liable for any damage caused due to a fault on that person’s part when performing the act. It means that the supervisor is liable only when a person who caused the damage, caused it “when performing the act” but is not liable if the damage was caused only “on the occasion of performance of the act”. The goal of this article is to analyze where is the borderline between the term “when performing” and “on the occasion of performing”. After a study of opinions presented by courts and theory of Polish civil law, in article was posed that the damage is caused “when performing the act” only if a delinquent acts in the aim of performing his duties or to protect the interests of supervisor and not if the performing of the duties merely creates to him a possibility of causing damage

Robots are one of important symbols of the technological revolution of the turn of the 20 thand 21 stcenturies. The article focuses on the analysis of the basis of civil liability for damage caused by intelligent robots, with particular emphasis on the Council Directive 85/37 of 25 July 1985 on the approximation of the laws, regulations and administrative provisions of the Member States regarding li- ability for defective products. The analysis of the creative case-law of the Court of Justice of the European Union shows that the directive provides a sufficient basis for attributing responsibility for intelligent robots.

The issue of doctors’ civil-law, administrative-law and criminal-law liability for negligence of adequate care in terms of providing healthcare services is multifaceted. It covers various actions and omissions. The analysis of the presented jurisdiction of courts of law shows that actions or omissions, which meet the criterion of negligence of adequate care, are diversified. They include, e.g., incorrect testification of medical records (or even a lack of relevant documentation), omission of giving comprehensive and intelligible information to patients and use of improper medical products. Patients claiming their rights to have healthcare services provided – based on current medical knowledge, according to the rules of professional ethics, with solicitude – use legal path (civil-law, administrative-law, criminallaw). These proceedings are not mutually exclusive.

The article discusses the framework of liability for anti-competitive conduct of a genuinely independent third party as set forth in relevant judgments. It refers to concepts of third party liability in the light of the principle of personal responsibility developed by doctrine and jurisprudence. The CJEU has set out important rules relating to liability of an undertaking for actions of its independent service provider. However, it still left some important issues unresolved. The paper focuses on the test for the attribution of anti-competitive conduct of a service provider and refers to its interpretation and application. It questions whether the introduced test provides sufficient legal certainty for undertakings. It briefs on the steps that must be taken by undertakings to distance themselves from an infringement and offers some suggestions how to limit or prevent exposure to liability
L’article traite du cadre de la responsabilité d’un tiers véritablement indépendante pour un comportement anticoncurrentiel, tel qu’énoncé dans les jugements pertinents. Il fait référence aux concepts de responsabilité d’un tiers à la lumière du principe de la responsabilité personnelle développé par la doctrine et la jurisprudence. La CJUE a énoncé des règles importantes relatives à la responsabilité d’une entreprise pour les actions de son prestataire de services indépendant. Cependant, certaines questions importantes n’ont toujours pas été résolues. L’article se focalise sur le test d’attribution du comportement anticoncurrentiel d’un prestataire de services et se réfère à son interprétation et à son application. Il s’interroge sur le point de savoir si le test introduit offre une sécurité juridique suffisante aux entreprises. Il fait un résumé des mesures à prendre par les entreprises pour se distancer par rapport à une infraction et propose des suggestions sur la manière de limiter ou d’empêcher toute exposition à la responsabilité.

The article presents a legal assessment of physiotherapeutic errors. It was not unimportant for this assessment that the regulation of the physiotherapist’s profession was proven, which made it possible to confirm that errors in physiotherapeutic art are in fact medical errors. In turn this allowed us to consider the possible criminal liability of this occupational group for medical errors. Final conclusions have finally confirmed that physiotherapists can be held liable for medical errors under Articles 156, 157 or 160 PC.

The opinion is an answer to a question submitted by the Marshal of the Sejm, whether a former Deputy is still entitled to immunity protection in case of acts committed within the scope of the mandate. According to the author, the former Deputy (or a Senator) may be held responsible for actions violating rights of the third persons which took place during the exercise of the mandate of that Deputy, but only upon a permission of an appropriate house of Parliament. The author notes that the loophole in legislation should be filled by an amendment.

The aim of this paper is to conduct a meta-analysis of the EU and CEECs civil liability institutions in order to find out if they are ready for the Artificial Intelligence (AI) race. Particular focus is placed on ascertaining whether civil liability institutions such as the Product Liability Directive (EU) or civil codes (CEECs) will protect consumers and entrepreneurs, as well as ensure undistorted competition. In line with the aforementioned, the authors investigate whether the civil liability institutions of the EU and CEECs are based on regulations that can be adapted to the new generation of robots that will be equipped with learning abilities and have a certain degree of unpredictability in their behaviour. The conclusion presented in the paper was drawn on the basis of a review of the current literature and research on national and European regulations. The primary contribution that this article makes is to advance the current of the research concerning the concepts of AI liability for damage and personal injury. A second contribution is to show that the current civil liability institutions of the EU as well as the CEECs are not sufficiently prepared to address the legal issues that will  start to arise when self-driving vehicles or autonomous drones begin operating in fully autonomous modes and possibly cause property damage or personal injury.

The clubs legal responsibility for the behavior of supporters is used by UEFA to in-fluence the content of sports competitions, ideally abstracted from demonstrating by spectators any non-football ideas. Nevertheless, the regulation of the national associa-tions-members of UEFA also assumes the responsibility of the clubs and, sometimes, the supporters themselves for the unacceptable behavior of the latter. The experience of regulation this issue by the Austrian Football Association demonstrates mentioned approach. Therefore, it is interesting to make a comparison: how much the regulated responsibility of supporters affects to the regulation by the association a strict liability of clubs for the behavior of fans. Using the practice of CAS, we may see a presumptive approach on the basis of an assessment of the situation by “a reasonable and objective observer” for the objective resolution of a dispute.

However for last 40 years disciplinary liability was generally out of scope of doctrine, recently it is noted constant increase of interest of that part of law. There are many reasons for that, including involving new professional groups and respective strictness and inconsistence of disciplinary provisions. The latter is aggravated by heterogenicity in various corporations and governing by substatutory regulations. Unfortunatelly, an unification of criminal law, being applied mutatis mutandi, is only partial remedy. In that elaboration author analyzed regulations between various corporations to extract basic and common rules and to denominate differences. The complexity augments fact that not only acts have binding effect, but also delegated regulations. That creates sophisticated network of law and professional knowledge, with additional problem of overlapping lex generalis and lex specialis in uncommon proportion. Above mentioned differences concern not only substantive law but also, if not even wider, procedural one. Interestingly, what author depicts, there is even not identical wording used in description of analogical names or definitions. Disciplinary liability, as cumulative to the criminal one, tends to protecting rights of accused person, as generally rule ne bis in idem is not in force. It concerns basic rights, like dignity and equality under the law. It is necessary strict cooperation and open discussion between professionals and legislator, as proper disciplinary liability rules need both protect society and allow to realize freely duties of practitioners.

Glosa analizuje wpływ niedawnego wyroku Sądu Najwyższego, w którym ustalono nowe wskazania dotyczące podstawy odpowiedzialności członka zarządu. Zgodnie z tym orzeczeniem syndyk może żądać naprawienia szkody w ramach odpowiedzialności kontraktowej przez dochodzenie roszczenia przewidzianego w art. 293 Kodeksu spółek handlowych. Wniosek ten istotnie różni się od przyjętego wcześniej stanowiska. Dotychczas bowiem sądy uznawały, że syndyk, jako osoba trzecia, może żądać odszkodowania tylko w ramach odpowiedzialności deliktowej. Rozważania w omawianym wyroku skupiają na kwestii uchwały wspólników niezbędnej do żądania odszkodowania. Niemniej pogłębiona analiza tego orzeczenia ujawnia dalej idące konsekwencje tego rozstrzygnięcia. W glosie podnosi się w szczególności, że nowe wskazania mogą oddziaływać na klasę zachowań powodujących powstanie odpowiedzialności członka zarządu, a także wpływać na termin przedawnienia.
The following paper examines the impact of the recent Supreme Court judgment which established new guidelines regarding the basis of director liability. According to the ruling, the receiver (syndyk) may demand damages under contractual liability by pursuing a claim provided for in art. 293 of Polish Company Code. This conclusion differs significantly from the previously adopted position. Until now, the courts have held that the receiver, as a third party, can demand compensation only under tort liability. The considerations in the discussed judgment are focused on the question of the shareholders’ resolution necessary to claim damages. However, a more thorough analysis reveals the far-reaching consequences of the ruling. In particular, the paper argues that the new guidelines may affect the class of behaviour which may give rise to director liability as well as the limitation period for damage claims.

Environmental protection is an area of interdisciplinary, in which the rule is the use of concepts relevant to the legal sciences, natural sciences, engineering, or chemical. Therefore, in practice, they may mean different things depending on the conceptual context in which they are used. The concept, which draws attention to the rights and duties of citizens, public authorities, or environmental organizations, is a responsibility in protecting the environment. The state authorities should support citizens in their efforts to protect and improve the environment. Ecological safety, which is to be provided by a public authority is a state of the environment that allows you to safely stay in it and use it. The instrument to ensure that safety is the protection of the environment, which acts as a directive interpretation when there are doubts as to the scope of duties, such duties, and how they are implemented.
