On the basis of the current legislation in relation to the issues of the second chapter of the Constitution (Human rights), the Constitutional Court of Georgia considers only the issue of the constitutionality of the content of normative acts and considers the appeals as inadmissible where the violation of rights is derived not from the content of the norm but its misuse in practice. This approach extends as well to those cases when the violation of a person’s rights is caused by incorrect interpretation of the norm by the court and improper use in the process of legal correlation. The Georgian Legislation does not grant to the Constitutional Court the authority to consider the indicated issue. The indicated issue is a legal problem to the extent that the initial point of the democratic states is to defend the human rights and correspondingly, the primary goal of the constitutional control should be the restoration of the human rights violated by the state structures (authorities). However, the recent precedential law gives us a possibility to make the conclusion that the General Courts in a number of cases define the law contrary to the Constitution, and the Constitutional law is powerless to restore the right of the person whose right was violated by the action of the judge of the court. The aim of this article is to analyze advantages and disadvantages of real-life constitutional appeals and prove importance of granting to the Constitutional Court of Georgia the authority of considering the “realistic” constitutional appeals.

The article focuses on Russian constitutional ideology with overview of its historical preconditions and analysis of recent significant cases of the Russian Constitutional Court. There is a discussion of gay activist Alekseyev’s case and “foreign agents’ law” case in constitutional practice as most significant examples of positivistic way of legal reasoning. The paper argues that legal positivism through its form – legal formalism is the main ideology in the modern constitutional practice in Russia. This ideology is based on the assumption that constitutional justice can find social truth. German positivistic and Soviet Marxist views have strongly determined the modern Russian constitutional discourse.

One of the politically momentous and legally precedential constitutional problems of recent years which had to be faced by the Polish constitutional court has been the dispute whether it is possible to exclude the applicable statute defining the organization and procedure of the CT proceedings as a basis for adjudication.An analysis of the judgment of the Tribunal addressing that issue proves that the Polish constitutional court excluded the possibility that the same regulation could serve simultaneously as the object of control and the basis for control proceedings.This results from the essence of constitutional control of the law which in such arrangement of its key elements would simply repeal itself, i.e. would lead to its own invalidation.Subordination of constitutional judges exclusively to the Constitution extends to all actions they perform in serving their office and other consubstantial manifestations of exercising the power to judge.This is a derivative of jurisprudential responsibilities of the Tribunal, which include both passing a final judgment as to compliance of challenged statutes, as well as other acts of application of law.Art. 195 (1) in fine of the Polish Constitution lays down a competence norm for a CT judge to refuse, in specific circumstances, to abide by the CT Act. One of the analytical assumptions is recognition of the finality of CT judgments.The possibility to exclude a provision of the CT Act is an action in the area of application of law.Determination of the legal framework for passing judgments has nothing in common with constitutional control of challenged statutes.Those actions derive from totally different orders and their goals are differe.

This article examines the process of the judicial Europeanization of the Polish Constitution. In Poland the judicial method of Europeanizing the Constitution is currently the primary way of adjusting constitutional norms to requirements resulting from EU law. The phenomenon of re-interpretation of constitutional provisions in light of the new and changing realities is a characteristic feature of contemporary constitutionalism. It has been a long time since most national constitutions have undergone significant textual changes. In Poland, the scope of judicial Europeanization of the Constitution is connected, to a great extent, with the inflexible procedure required for constitutional amendments. In this situation, these so-called “silent changes” of constitutional norms are the easiest and fastest way of reacting to requirements stemming from Poland’s EU membership. In the Polish case not only have the norms regarding the political system of the state changed, but also constitutional standards relating to the protection of fundamental rights and freedoms have undergone the process of the Europeanization. To some extent, these changes relate to procedural norms as well.

Constitutional change is inherently a significant social and political event which, given the assumed stability of the constitutional order in the state, should not happen too often. A significant effect of any change to the constitution should therefore be its systemic usefulness in the longer term - corresponding to the concept of the durability of constitutional change. The aim of this article is to present the theoretical determinants of this change from the perspective of its assumed durability, taking into account the circumstances related not only to the constitutionally formalized mode of amending the constitution, but also taking into account other systemic factors, i.e. mainly social, political and legal conditions of the functioning of a given constitution. As a result of the adopted research assumptions, the analysis carried out here is characterized by a functional approach and concerns the following detailed issues: the theoretical characteristics of constitutional change and the theoretical determinants of this change in the context of its assumed durability.
Zmiana konstytucji jest z natury rzeczy doniosłym wydarzeniem ustrojowym, które ze względu na zakładaną stabilność porządku konstytucyjnego w państwie nie powinno zdarzać się zbyt często. Istotnym skutkiem każdej zmiany konstytucji powinna być tym samym jej przydatność ustrojowa w dłuższej perspektywie czasowej - odpowiadająca pojęciu trwałości zmiany konstytucji. Celem tego artykułu jest przedstawienie teoretycznych uwarunkowań tej zmiany z perspektywy jej zakładanej trwałości, z uwzględnieniem okoliczności związanych nie tylko z konstytucyjnie sformalizowanym trybem nowelizacji konstytucji, ale z uwzględnieniem również innych czynników ogólnoustrojowych, tj. głównie społecznych, politycznych i prawnych uwarunkowań funkcjonowania danej konstytucji. W rezultacie przyjętych założeń badawczych przeprowadzona tutaj analiza charakteryzuje się podejściem funkcjonalnym i dotyczy następujących zagadnień szczegółowych: teoretycznej charakterystyki zmiany konstytucji oraz teoretycznych uwarunkowań tej zmiany w kontekście jej zakładanej trwałości.

The use of references to foreign law and jurisprudence by the constitutional courts around the world currently gains more and more attention from scholars. The admis-sibility and usefulness of conducting such a horizontal dialogue between various juris-dictions raises controversies in other countries, but not in Poland, where no significant academic discussion on the legal basis and justification for using comparative arguments in constitutional jurisprudence has been conducted. The reasons for this lack of contro-versy seem to lie in the roots of the 1997 Constitution, and the way in which the Polish legal system is constructed. The Polish Constitutional Tribunal is quite prone to using comparative references in its reasoning. However, it rarely clearly indicated their role or significance for the resolution of the case before it. The analysis of the case-law of the Tribunal indicates that references to foreign law concern constitutional provisions, legislation, and the judgments of other constitutional courts. The purpose of the refer-ences stresses the universality of particular constitutional norms and deciphering their meaning, as well as gathering data significant for the assessment of the proportionality of a national law, as well as at drawing inspiration from the decisions taken by foreign courts. However, the persuasive use of a comparative argument demands that the meth-odological problems which can be noticed in the case-law should be addressed. They in-volve in particular: the need to justify the choice of comparative material that is analysed, the fragmented nature of the analysis, and the lack of a clear indication what role these kind of arguments have in constitutional argumentation.

On February 17, 2008, Kosovo declared independence. Over twelve years after the adoption of the Declaration of Independence, the issue of universal, international acknowledgment of Kosovo still has not been resolved. The foundation for the establishment of the Republic of Kosovo was international society, which created the legal framework for the future statehood of Kosovo. The problem of the functioning of the constitutional judiciary was one of the key issues during the creation of the basic law of the Republic of Kosovo. This article s to analyze the constitutional position of the Constitutional Court of the Republic of Kosovo in the state system established under the Constitution of 2008. It presents the composition of the Court, its competence, and principles of organization and functioning. The solution applied in the Kosovo basic law fits into the broadly understood model of the European constitutional judiciary.
W dniu 17 lutego 2008 r. Kosowo ogłosiło niepodległość. Ponad dwanaście lat po uchwaleniu Deklaracji niepodległości kwestia powszechnego, międzynarodowego uznania Kosowa nadal nie została rozstrzygnięta. Fundamentem powstania Republiki Kosowa była społeczność międzynarodowa, która stworzyła ramy prawne przyszłej państwowości Kosowa. Problem funkcjonowania sądownictwa konstytucyjnego był jednym z kluczowych podczas prac nad powstaniem ustawy zasadniczej Republiki Kosowa. Niniejszy artykuł stanowi próbę analizy pozycji ustrojowej Sądu Konstytucyjnego Republiki Kosowa w systemie państwowym ukształtowanym pod rządami Konstytucji z 2008 r. Przedstawia skład Sądu, jego kompetencje oraz zasady organizacji i funkcjonowania. Rozwiązanie przyjęte w kosowskiej ustawie zasadniczej wpisują się w szeroko rozumiany model europejskiego sądownictwa konstytucyjnego.

The Polish May Constitution, formally recognized as the fi rst constitution in Europe, differed from the American Federal Constitution of 1787 and the French Constitution of 1791 in that that it had failed to create any legitimized foundations for a pro-revolutionary or modern state. Even worse, the Polish Constitution of 1791 did not provide for Polish citizenship, nor did it directly articulate the principle of the equality of citizens or for political equality, or proclaimed the fundamental rights.

The subject of the analysis presented in the text is an argument that tends to (and used to) be raised in the critical discourse on constitutionalism – the allegation of the so-called constitutional fetishism. The argument is to show why the constitutional discourse has lost its potential to explain and create social processes. The reason is that lawyers focus too much only on the content and interpretation of the provisions of the constitution, without considering a broader social context, which makes the constitutional discourse limited solely to legal issues with a simultaneous omission or underestimation of all other aspects of constitutionalism. This attitude of lawyers to the content of the constitution (or – in broader terms – to the provisions of law) is sometimes referred to even as idolatrous, hence the reference to the notion of fetishism in the religious sense. The aim of the text is to analyse the structure of this argument and to attempt to determine the impact it can have on constitutionalism.

This article addresses the problem of the ongoing constitutional transition in Ukraine that has been revived by the Maidan revolution of 2013–2014. The constitutional transition is increasingly seen as being key for solving what is apparently the greatest political crisis in the country’s history, for providing long-term stabilization of Ukraine’s constitutional order and ensuring democratic development. The article sheds light on a series of revolutionary causes of the current constitutional reform, against a broader context of preceding instrumentalization of constitutional politics and volatility of the constitutional process. Pre-revolutionary (presidential-parliamentary) and post-revolutionary (parliamentary-presidential) constitutional settings are compared, whilst the ramifications of re-transition to parliament- -dominated rule are also scrutinized. Finally, against the backdrop of an unfinished constitutional reform, the argument developed in the of the constitutional setting of Ukraine as both a desirable and necessary development to stabilize social-political and constitutional orders of the county.

W artykule stawiam tezę, iż można wyróżnić dwa sposoby rozumienia Rawlsow-skich constitutional essentials – uniwersalne i partykularne. Celem artykułu jest od-powiedź na pytanie, czy istnieje taka forma partykularnej interpretacji, która nie naruszałaby współwystępowania z uniwersalną. Odpowiedzi udzielam na podsta-wie analizy sposobu rozumienia wolności sumienia i religii zawartej w orzecznic-twie polskiego Trybunału Konstytucyjnego. Zidentyfikować można dwie formy par-tykularnej interpretacji. Pierwsza wzmacnia pozycję mniejszości, druga natomiast pozycję większości. Pierwsza forma może współistnieć z uniwersalistycznym con-stitutional essentials jeżeli niweluje faktyczne istniejące nierówności. Partykular-na interpretacja constitutional essentaials jest dopuszczalna, gdy pozwala na lepszą realizację idei autonomii.
In the paper I put forward a thesis that it is possible to distinguish two different ways of understanding Rawls’ constitutional essentials – universal and particularistic. The aim of the article is to provide an answer to the question whether there exists such a form of particularistic interpretation that does not compromise its coexistence with the univer-sal interpretation. The answer is based on an analysis of the understanding of freedom of conscience and religion contained in the judgments of the Polish Constitutional Tri-bunal. Two forms of particularistic interpretation may be identified. The first strength-ens the position of minorities, while the second of the majority. The first form may co-exist with the universalist constitutional essentials, provided that it eliminates the actual existing inequalities, whereas particularistic interpretation of constitutional essentials is acceptable when it allows for a better implementation of the idea of autonomy.

The subject of this article is the institution of the constitutional complaint, which is analysed in connection with European integration. It should be noted that Poland’s membership of the European Union has had a great influence, not only on the system of national law, but also on the jurisprudence of the Polish Constitutional Tribunal; therefore considerations are carried out here mainly in relation to the Constitutional Tribunal.            In examining the issue of the constitutional complaint, the following assumptions may be stated. First, the constitutional-complaint procedure, is in fact, the examination of the compliance of legal norms with the Constitution, any deviation being related to the entities initiating proceedings before the Constitutional Tribunal, Article 191(1)(6), of the Constitution[1], and to the material scope of the complaint, as determined in Article 79 of the Constitution. Second, there is no doubt that the constitutional complaint can become an important legal instrument shaping the jurisprudence of the Polish Constitutional Tribunal, which has to face constitutional issues related to European integration[2]. Following the example of the practice of other Member States, e.g. Germany, the Tribunal may use the institution of the constitutional complaint as a means of controlling the compliance of the secondary law of the European Union with the Constitution of the Republic of Poland.   [1] The Constitution of the Republic of Poland, Journal of 2 April 1997, Journal of Law 1997, No. 78, item 483, as amended. Court packing greatly threatens democracy. This paper examines, compares and draws conclusions from two attempts: The PiS government is near to packing Polish courts; President Roosevelt tried but failed to pack the U.S. Supreme Court in 1937. In most democracies a head of government with a legislative majority and strong party control can pack courts, giving complete control. The United States escaped; Roosevelt lacked complete party control. Poland is unlucky; PiS is strongly controlled. Peaceful domestic protest is necessary, but Poland’s hope is from EU-level institutional pressure, supported by major democracies, to reverse packing and prevent further seizure of power.

This paper aims at clarifying the report between the President and the Constitutional Court. If we take as a starting point the constitutional mandate of these two institutions it follows that their final mission is the same, i.e., the protection and safeguarding of the constitutional system. This paper, thus, will clarify the key points in which this report is expressed. Further, this paper examines the theoretical aspects of the report between the President and the Constitutional Court, starting from the debate over this issue between Karl Schmitt and Hans Kelsen. An important part of the paper will examine the Constitution of Kosovo, i.e., the contents of the constitutional norm and its application. The analysis focuses on the role such report between the two institutions has on the functioning of the constitutional system. In analyzing the case of Kosovo, this paper examines Constitutional Court cases in which the report between the President and the Constitutional Court has been an issue of review. Such cases assist us in clarifying the main theme of this paper. Therefore, the reader will be able to understand the key elements of the report between the President as a representative of the unity of the people on the one hand and the Constitutional Court as a guarantor of constitutionality on the other hand.
