Opis:
This paper deals with handling abnormal situations raised on remotely controlled railway lines, in particular how to maintain an automatic operation that is a core function of such systems. Unlike conventional traffic control, in case of remotely controlled stations the operational personnel is not located on the stations, thus nobody can intervene in the railway traffic locally, if necessary. In addition, replacing staff with technical devices and automatism makes the number of potential failure modes even higher. The most critical event happens when the data connection between the control centre and the station is lost, so that the human supervision of the traffic terminates. This paper presents the human, technological and technical aspects of treating such failures and offers some potential solutions in order to maintain railway traffic and minimize disturbances.

Opis:
Using the example of an enterprise from the energy sector, the author demonstrates how companies restructure their assets through outsourcing. In the case of the analyzed energy-sector enterprise, the restructuring process was prepared conceptually, organizationally and technically with the use of an operational control system - in line with the transaction cost theory. Under the Coase theorem, the selection of one of two coordination mechanisms - hierarchical coordination or market coordination - is determined by factors such as asset specificity, transaction uncertainty and transaction frequency. An evaluation of the course and results of the process confirms many of the theoretical assumptions, the author says. Due to the specific features of energy-sector companies and the characteristics of business transactions made in such companies, key resources remain within the enterprise, while organizational units carrying out peripheral tasks not related to the company’s core business can be outsourced and moved outside the company’s structure. In the studied enterprise, a hybrid solution was used in formal and legal terms, Urbanek says, based on maintaining capital/ownership ties between the enterprise and businesses spun off from it. The author highlights the role of the operational control system as an instrument supporting decentralization and restructuring processes leading to outsourcing. Without the use of an operational control system, it would be impossible to overcome barriers typically encountered in such processes - mainly those created by people - and to carry out such far-reaching changes within such a short time, Urbanek concludes.

Artykuł traktuje o nowo wprowadzonych do polskiego prawa rozwiązaniach, w przedmiocie zwalczania zjawisk o charakterze terrorystycznym. W pierwszej części artykuł ogniskuje wokół problematyki kontroli operacyjnej, podejmując próbę jej analizy w odniesieniu do przepisów międzynarodowych praw człowieka, prawa konstytucyjnego oraz ustaw regulujących dotychczasowe funkcjonowanie tzw. kontroli operacyjnej. W dalszej części omówione zostały nowe kompetencje, szefa ABW oraz zmiany wprowadzone ustawą do k.k. oraz k.p.k. W końcowej części wyszczególniono ponadto zmiany wprowadzone przedmiotową ustawą do innych ustaw szczególnych (w tym do prawa lotniczego, odnoście dronów oraz prawa bankowego w przedmiocie dostępu do tajemnicy bankowej).
The article focuses on the implementation of new solutions in the field of counteracting terrorism in Poland. In the first part it discusses the issue of operational control, which is analysed in the context of international constitutional law, domestic constitutional law and law on operational control. Further on, it focuses on the new competence of the chief of ABW and the implementation of changes to Polish criminal and criminal procedure law. Last but not, it enumerates the changes to other branches of laws (to name but a few; aviation law in the context of drones and bank law in the aspect of access to bank secret).

Operational control is one of the most important powers of the state police services, including, since 2018, the State Protection Service (Służba Ochrony Państwa – SOP). The analysis of the title issue presented in the article leads to the conclusion that the shape of the operational control, which is a novum in the security service, which is the SOP, does not differ from the solutions used in regulating the operational powers of other Polish services, both in terms of the principles and procedure of applying control operational, and the (technical) ways of using this power in practice.

Zastosowanie kontroli operacyjnej w działaniach służb policyjnych i specjalnych, z możliwością powoływania się na zapisy zawarte w umowach i porozumieniach międzynarodowych, wymaga uporządkowania. Potrzebne są zmiany w zapisach w ustawach kompetencyjnych poszczególnych służb zgodnie z wyrokiem Trybunału Konstytucyjnego, a zwłaszcza wyraźne zawarcie w katalogu ściganych przestępstw przestępstwa finansowania terroryzmu, określonego w art. 165a kk jako podstawy do możliwości stosowania kontroli operacyjnej w działaniach wobec sprawców tych czynów. Zgodnie z treścią wyroku Trybunału Konstytucyjnego możliwość zastosowania kontroli operacyjnej przy powołaniu się na ściganie przestępstw na podstawie umów i porozumień międzynarodowych będzie możliwa wyłącznie wtedy, gdy umowa czy porozumienie zostanie wprowadzone do krajowego obrotu prawnego aktem rangi ustawy. Jednocześnie uporządkowania wymagają zapisy zawarte w poszczególnych bilateralnych umowach zawartych przez rząd RP, szczególnie w zakresie wyraźnego zaakcentowania nie tylko podejmowania wspólnych działań w obszarze przeciwdziałania i zwalczania terroryzmu, lecz także jego finansowania. Wydaje się jednak, że jeżeli chodzi o ten warunek, jego realizacja będzie trwała najdłużej. Mimo to przy renegocjacjach umów już zawartych bądź też negocjacjach nowych umów odnoszących się do zwalczania przestępczości, tak przedstawione zagadnienie należy mieć stale na uwadze.
The use of operational control in the activities of special and police forces, with the possibility of relying on provisions in contracts and agreements, requires urgent attention. Changes are required in the provisions in laws defining the competence of various departments in accordance with the judgment of the Constitutional Court, and especially clear inclusion in the register of prosecuted crimes – crimes of terrorism financing as defined in Art. 165a of the Penal Code as the basis for the applicability of operational control measures against perpetrators of these acts. According to the judgment of the Constitutional Court it will be possible to apply the operational control with reference to the persecution of crimes under international treaties and agreements only if the contract or arrangement is introduced into the national legal system by laws in the rank of an Act. At the same time provisions contained in various bilateral agreements concluded by the Polish government require ordering, especially by putting clear emphasis not only on joint actions in the area of preventing and combating terrorism, but also on its financing. It seems, however, as far as the latter stipulation is concerned, that its fulfillment will last longest. Nevertheless, such presentation of the problem should be constantly born in mind while re-negotiating the existing agreements on combating criminality or while negotiating new ones.

The changes in the broadly conceived criminal procedure which were introduced in recent years refer to the problems which are crucial from the perspective of the protection of human rights, such as the scope of the authority of the services due to operational control which is conducted secretly, the model of the functioning of the public prosecution service or the unlawful acquiring of evidence in a criminal procedure. The evaluation of these changes, conducted by the Ombudsman from the point of view of the constitutional standards of the protection of the rights of the individual is not positive. The new regulations reduce the quality of these standards and they do not contain sufficient guarantees of protection against the arbitrariness of the activities engaged in these terms by the organs of public authority. This phenomenon imposes a particular duty on the courts – which hear criminal cases – to see that the final decision in a criminal case respects the universal standards of the protection of human rights.

Opis:
Assurance of the supervised conditions in all processes affects directly both products and users safety and environmental influence. ISO 9001 and ISO 14001 standards in Operation point require from organisations to implement and control the planned processes by establishing processes’ criteria, assuring the supervised conditions and verifying processes’ conformity. Moreover, in Planning section it is required to plan the processes with the consideration of quality and environmental risk. Therefore research on the practical solutions of operational planning and control in the production processes are of the crucial meaning, especially from the perspective of the integrated fulfilment of the requirements. That is why the value of the paper is being constituted by the authorial methodology of identification of the key-operational criteria, including integrated risk assessment, using the computer support and being a starting point for assurance of the supervised conditions in the key-processes of high risk. The worked out methodology has been implemented in the processes of performance and completing the stirrups, which quality is of the huge influence on the work safety of the mine roadway supports in the mine workings. The aim of the analysis was to identify the operational parameters in the stirrups technological process, to estimate their meaning and to point at the key operational criteria from the point of fulfilling the quality and environmental requirements. Practical implication of the proposed methodology can be applied in case of any organisation which wants to improve the realised processes ensuring the computer supported supervised conditions.

Issues concerning terrorism appear to be highly popular and prone to public discussion. This concerns both comments of incidents and occurrences with terroristic backgrounds including looking for reasons of such a situation and attempts to prepare our state for pushing the attack and prevent it. Unfortunately, as one can notice this discussion takes place, in my humble opinion, in the atmosphere of unnecessary tense and commotion each time evoked by the peculiar character of the commented occurrence and relating it to a current situation in Poland, very often with political connotations. What is noticeable is the lack “cold blood and common sense’, which is significantly crucial to assess a particular threat, let alone real actions in the face of it. This article include a multitude of answers posed by potential participants, observes and listeners of such discussions. These questions especially concern designated organs fighting terrorism and their tasks. Moreover, they concern more advanced issues regarding a range of means and methods f work of operational and reconnaissance as well as investigation teams. The above considerations were preceded by an attempt to define the role of the state to assure public safety and the significance of this role for both administrational organs and the society itself. The issues included in this article shall constitute a possibility of, hopefully, objective adjudication of numerous issues cited in the comments in the introductory part.
Niezwykle popularne w ostatnim czasie w dyskusji publicznej są sprawy związane z terroryzmem. Dotyczy to zarówno komentarzy zdarzeń oraz incydentów o charakterze terrorystycznym, w tym szukania ich przyczyn, jak i podejmowanych prób wskazania stanu przygotowania naszego państwa do odparcia takich ataków lub przeciwdziałania im. Niestety, ta dyskusja odbywa się w atmosferze pewnego, niepotrzebnego, napięcia i wzburzenia wywoływanego, w zasadzie każdorazowo, charakterem komentowanego zdarzenia i odnoszeniem go do bieżących wydarzeń w Polsce, często w wymiarze czysto politycznym. Brakuje również zachowania „zimnej krwi”, jakże potrzebnej przy ocenie danego zagrożenia, nie wspominając już o realnym działaniu w jego obliczu. Niniejszy artykuł zawiera odpowiedzi na pytania potencjalnych uczestników, widzów i słuchaczy takich dyskusji, zarówno w kwestiach elementarnych, dotyczących organów właściwych w zakresie terroryzmu oraz ich zadań, jak i bardziej zaawansowanych, wskazujących na zakres środków i metod pracy operacyjno-rozpoznawczej i dochodzeniowo-śledczej. Rozważania zawarte w niniejszym artykule zostały poprzedzone próbą zdefiniowania roli państwa w zapewnianiu bezpieczeństwa publicznego oraz znaczenia tego zadania dla organów administracyjnych i samego społeczeństwa. Poruszone tu zagadnienia dadzą możliwość własnego, obiektywnego osądu spraw omawianych w przywołanych na wstępie komentarzach.

Opis:
Zagadnienia omawiane w niniejszym artykule dotyczą statusu normatywnego czynności operacyjno-rozpoznawczych w kontekście ustawy o Policji oraz kodeksu postępowania karnego. Podjęto próbę wskazania warunków, które rzutują na legalny charakter inwigilacji, a co za tym idzie – na skuteczne wykorzystanie materiału operacyjnego w procesie karnym. W tym celu scharakteryzowano niejawną aktywność Policji, wyszczególniając dopuszczalne metody operacyjne oraz definiując czynności operacyjno-rozpoznawcze w świetle literatury przedmiotu. Aby w pełni zobrazować problematykę poruszoną w artykule, przeanalizowano relację prawną między dowodem nielegalnym, o którym mowa w art. 168a kpk, a dowodem z czynności operacyjno-rozpoznawczych, na przykładzie zarządzonej kontroli operacyjnej. Praktyczny wymiar tych rozważań omówiono z punktu widzenia postępowania dowodowego, z uwzględnieniem ról i obowiązków procesowych prokuratora oraz sądu.
The issues discussed in this article refer to the normative status of operational and investigative activities in the context of the Police Act and the Code of Criminal Procedure. Namely, an attempt was made to demonstrate the conditions that affect the legal nature of surveillance, and thus the effective use of operational material in a criminal trial. For this purpose, the covert activity of the Police has been characterized by listing acceptable operational methods and defining operational and reconnaissance activities in the light of the literature on the subject. Therefore, in order to fully illustrate the issues discussed, an analysis was conducted of the legal relationship between the illegal evidence referred to in Art. 168a of the Code of Criminal Procedure and the evidence from operational and reconnaissance activities, on the example of an ordered operational control. The practical dimension of these considerations is discussed from the point of view of evidence proceedings, taking into account the procedural roles and responsibilities of the prosecutor and the court.

Artykuł przedstawia zasadnicze aspekty taktyki i techniki przestępczej zmierzającej do ograniczenia skuteczności podsłuchu procesowego oraz kontroli operacyjnej. Scharakteryzowano w nim najistotniejsze sposoby ochrony korespondencji przestępczej. Przedmiotowa problematyka jest zagadnieniem nadzwyczaj skomplikowanym z powodu specyfiki omawianych działań. Działania kontrwykrywcze zorganizowanych grup przestępczych nie stanowiły dotąd priorytetowego obszaru zainteresowania kryminalistyki. W artykule zwrócono uwagę na korzyści wynikające ze znajomości taktyki i techniki przestępczej w zakresie zapewnienia korespondencji poufności, w szczególności w kontekście prowadzonych prac legislacyjnych w przedmiocie realizacji czynności prokuratora w ramach kontroli nad czynnościami operacyjno-rozpoznawczymi.
The article presents the essential aspects of tactics and techniques applied by criminals with an aim to reduce the effectiveness of procedural eavesdropping and operational control. The most significant methods of protecting criminal correspondence were characterized. The above issues are exceptionally complicated, owing to the specifics of the activities to be discussed. To date, counter-detection activities of criminal organizations have not been within the main area of interest for forensics. The article highlights the benefits resulting from the knowledge of criminal tactics and techniques used to ensure the confidentiality of correspondence, in particular, in view of the ongoing legislative work pertaining to prosecutorial control exerted over operational and exploratory activities.

Opis:
The need of ensure the safety in the realised industrial processes results directly from their negative influence both on environment and workers’ health, and, as a result - the associated material losses. Safety management must be based on the risk management, results of which are the basis of risk acceptability assessment and taking action of the systemic character directed on risk minimisation. Those actions should guarantee technical condition of the used technological installations and monitoring and control equipment as well as organisational solutions, which in the effective manner are going to minimise the probability of occurrence of environmental and occupational accidents, and - in the case of their occurrence - minimise the influences. Therefore research on the practical solutions of process safety assurance, both in the regular conditions of work and in the time of the emergency are of the crucial meaning. That is why the value of the paper is being constituted by the authorial model of operational control, which aim is to guarantee the process safety from the perspective of the both: technical and occupational safety. The worked out model is the systemic tool giving the guidelines of operational management and allowing for the homogeneous management in the range of environmental safety and occupational safety and on the basis of - being the fundamental element of the model - risk management. The worked out model can be implemented in case of any organisation which wants to assure the safety of the realised processes by risk and system management.
