At the outset of his discussion of the background for the theory of restoration and conservation the author presents the situation of history of art in times when at the end of the nineteenth century the first programmes were formulated by restores and censervators. While reverting to those days a theory by A. Riegl which had enormous effect upon the history of art should be mentioned in the first line. Nonetheless, the attitudes taken by the overwhelming majority of researchers in those times were romantic by their nature which had its reflection in metaphysical tradition adopted in conceiving the sources of art as a „sacrum” for which a „temple museum” could be considered the only appropriate place. The elitarian character of history of art took its source from the above tradition and concept mentioned above and the prevailing views have led to both absolutisation and isolation of a historical prodect of art which in our days is regarded as a historical monument. The absolutised work of art was taken over from history of art by historical monuments protection which in turn grew to a source of an apparent conflict between an isolated historical monument and a given civilizational situation. More and more apparent became the crisis resulting from the above attitudes which gave birth to numerous reactions chiefly in the area of practical activities. The opposition, in the first line, arose at problems of reconstruction where the historic matter comes in touch with the modern civilizational system. According to the author both, i.e. protection of historical monuments of institutional character and history of a rt have proved unable to meet these changes in a due way and they further compete for that legaty left by the nineteenth century. Such a situation makes it indispensable to take some revolutionary measures. The chief problem consists in the concept alone of historical monument; its conceiving as a monument or relic of the past makes it impossible to handle it as an active component of a contemporary cultural and civilizational formation. On the other hand, however, elimination of term ’’historical monument” would necessitate the full reconstruction of a discipline known as historical monuments protecion which in turn would lead from its isolation to the most close interlocking with the cultural and civilization framework. There exists the need ihat the following questions be thoroughly vented: the problems of protection of historical monuments, i.e. all problems relating to historical monuments, the concept and the sense of the term ’’historical monument”, the objectives and purposes of activities connected with protection of historical monuments, the methods of operation and the tasks of institutions involved in historical monuments protection and preservation as well as the problem of their organization. It is an indispensable condition for the proper solution of problem of historical monuments protection to take into account the dialectal interrelations existing within the contemporary social and economic formation.

Ochrona i zagospodarowanie miast historycznych jest jednym najtrudniejszych problemów w konserwacji zabytków. Tradycyjne podejście – zakładające utrzymanie w formie niezmienionej zabudowy i zagospodarowania przestrzennego zespołów historycznych, nie jest możliwe we współczesnych warunkach. Zespoły staromiejskie muszą się modernizować i przekształcać, dostosowując do nowych funkcji, standardów i potrzeb. Współczesna teoria konserwatorska stara się te problemy rozwiązać – Rekomendacja o Historycznym Krajobrazie Miejskim przyjęta przez UNESCO jest pierwszym dokumentem doktrynalnym, który formułuje nowe podejście do ochrony miast historycznych.
The foundations of the heritage protection - its paradigm, have been created in the first half of the 20th century. This paradigm is officially still in force - primarily because we do not have a coherent concept, which could link the requirements of the traditional protection of historic monuments and the diversity of today’s circumstances. Therefore, international document that introduces new elements, deserves particular analysis. This document is the Historic Urban Landscape Recommendation, which formulates a new approach to heritage and its protection. HUL Recommendation was adopted by the General Conference of UNESCO - the most important international meeting on culture; this is the Recommendation – such a type of document should be implemented by the Member States (which is explicitly formulated in the text of Recommendation); its subject is historical city – the most important part of heritage. From this point of view, the HUL Recommendation deserves special attention.

To throw the light on some doubtful problems connected with the work of a conservator acting as an artist was the author’s intention in preparing of his article. For his considerations were taken into account both the art of the past and that modern seen from the point of view of their social function with regard to actual cultural requirements and basing on elements of the art and artistic production theory. Going on an assumption that the monuments of art affected by the action of time and under influence of local conditions are subjected to constant changes and destruction it may be generally stated that the scope of conservation in equal measures consists in protection and preservation of both the documentary and artistic values present in the works but also in the aesthetical and artistical preparation and arranging of the objects subjected to conservation for utilitarian purposes. As has already many times been emphasized in his theoretical publications and practically applied solutions by the late Professor J. E. Dutkiewicz the conservation so meant may, and in several cases should display an artistically active and creatively orientated attitude. As an obligatory rule in conservation should be accepted the striving to get the most precisely defined truth about the work of art — comprising the historical, material, content, and artistic truth in the object by itse lf representing an authentic record of the time, style, place and ideology. In his efforts aimed at the practical defining the precise truth about the work the conservator as an executor should possess a good deal of manual abilities and also be conscious in his choice of technological methods and possibilities of historical and style argumentation. As the manual abilities of a conservator are to be understood both the skill and artistry able to subordinate his activities to the final, purely artistic result. The problem, however, does not merely consist in the active apprehension of conservation as an one of artistic disciplines. A considerable number of works of art has come up to our days in fragmentary forms. In the proper elaboration, arrangement and organisation on a wall, within an interior, in a sculpture or picture of authentic elements are to be sought the possibilities and in some cases even the artistic and utilitarian sense of the conservator’s action. Since the conditionings of an existence are not only contemporary but also historical ones, in his search for authenticity in works which frequently enough is not linked with a single author or even the single historical period he must form these works purposefully, by his creative will, at the same time furnishing them with a documentary force and binding them with the context of the local artistic realities. A purposeful arrangement of an ancient work of art in a neighbourhood of modern elements or with a linkage to the new social, ideological, educational or utilitarian functions frequently results in a quite unexpected, artistically modern expression. And also in this respect it may be considered as the creative act from the other artistic disciplines differing only by its kind and „taste” of engagement. The conservator’s ex e cu tion in Poland, repudiating the formerly observed rules of the style purity, the ignoring of the cultural context of the work, the belief that the work of art represents a pure product of an artistic concept as such deserving the extension of its life, is rising nowadays to the level of an authentic artistical discpline with its strictly determined and unique, own peculiarities. As the expression of such approach to this profession may be considered the fact that those w illing to act as conservators are being trained mainly at the Academies of Fine Arts and within the final period of their studies specialising in their respective lines of the future activities. At the end of his article the author makes an attempt to determine the terms — fine arts and beautiful arts, relating them to the specialised section of the Union of Polish Artists which, according to its statuary outlines, is being understood as a kind of professional community. Within this community there is a place for different artistical orientations, including the s.c. applied art, to which the conservation is closely related being today lastingly connected with the programme of building the culture of the nation who has suffered such immense losses in her history.

Opis:
The expropriation of historical immovables for the sake of the State Treasury is a special legal instrument used in the name of collective interest and concern for the national heritage. The expropriation of immovables consists of the deprivation or limitation of ownership rights, the right of perpetual usage or other rights concerning immovables. Intervention into the right of ownership of historical immovables, which involves expropriation, should be realised in accordance with the binding law. The legal foundations for expropriation can be found in three types of regulations: the Constitution of the Republic of Poland, statutes and international public and European law. Decisions pertaining to a temporary seizure of historical immovables and expropriation have been divided between two organs of public administration: the voivodeship conservator of historical monuments and the starosta, with the former acting as the advisory and motionfiling organ, while the starosta conducts the expropriation procedure and makes decisions about the expropriation of the immovables. The expropriation of historical immovables conceived as legal institution, which is to guarantee the preservation of historical monuments by the state, is both correct and regular. Its application, however, calls for the observation of administrative procedures, which considerably increase the time of the procedure. As a consequence, it causes a considerable delay of conservation undertakings aimed at saving the original historical substance. In view of the fact that expropriation usually relates to the most damaged and neglected monuments, chances for the preservation of even the smallest fragment of the original are often slight, and the institution of expropriation, whose purpose is to salvage historical monuments, could contribute to a rapidly progressing and irreversible reduction of the original historical substance. The conservation milieu, mindful of scientific accomplishments and the postulates of the charter for the protection of historical monuments, strives at a preservation of the original historical substance as little altered as possible. It seems more correct, therefore, to opt for a less radical path – to persuade the owner to agree to conservation or sale. Expropriation, envisaged as a form of legal coercion, should be applied in exceptional cases, when the repertoire of other possibilities has been exhausted. On the other hand, it should not be avoided, keeping in mind the fact that historical monuments are supposed to survive not only for the sake of our generation, and that their protection, perceived as a public goal, justifies expropriation.
