The article looks at the evolution of regulatory framework and size of investment fund market in the EU. The authors describe the three-stage evolution of the EU regulations determining the growth of the size of this market: (1) investor protection, (2) creation and strengthening the single financial market in the EU, and (3) protecting stability and integrity of the market. Particular attention is given to the last stage, as they claim that the post-crisis regulations allowed the EU single investment fund market to gain the trust of investors, which has resulted in its expansion and improved competitiveness.

In order to secure rights and guarantees provided by the legal system of the European Union, legal acts in the field of the criminal cooperation refer to the right to an effective remedy. Given that, two instruments are particularly important as they were the first to aim to set the standard and frame for the effective remedy conceptual framework: the Directive 2013/48/EU and the Directive (EU) 2016/343. The Authors analyse the legislation process within that context, the approach of Member States, (non)existing standards and related consequences, such as the possibilities of proper implementation of the right to the effective remedy into the national legal systems, verification of that process as well as the chances to achieve the harmonisation of minimal standards of the protection of fundamental rights in the area of criminal proceedings in the EU.

W artykule przedstawiono przegląd ważnych zmian wymagań wprowadzanych za pomocą nowego rozporządzenia Parlamentu Europejskiego i Rady (UE) 2023/1230 z dnia 14 czerwca 2023 r. w sprawie maszyn oraz w sprawie uchylenia dyrektywy 2006/42/WE, które z dniem 20 stycznia 2027 r. zacznie obowiązywać w Europejskim Obszarze Gospodarczym i zastąpi stosowaną dotychczas dyrektywę maszynową 2006/42/WE. Ważniejsze zmiany to: wprowadzenie precyzyjnych definicji i pojęć, np. „maszyna nieukończona”, klarownych wymagań dotyczących zdrowia i bezpieczeństwa oraz procedury oceny zgodności, uwypuklenie roli producenta przy przeprowadzaniu oceny ryzyka dla produktu objętego zakresem stosowania rozporządzenia, wprowadzenie zasady należytej staranności działania dystrybutora, określenie formy instrukcji obsługi, i wreszcie podkreślenie obowiązków Państw Członkowskich dotyczące nadzoru rynku.
After 15 years of validity of the Machinery Directive 2006/42/EC a big change awaits us. We will soon be obliged to apply Regulation (EU) 2023/1230 of the European Parliament and of the Council of 14 June 2023 on machinery. Replacing the directive with a regulation aims to avoid divergent implementation of the directives’ provisions and, consequently, inconsistent interpretation of the provisions at national level. The provisions of the regulation, due to the importance of regulations in the field of, for example, health and safety protection and conformity assessment, must be applied in a uniform manner by all entities throughout the European Union. An additional argument for the change was that the current regulations are not adapted to the technological changes that are dynamically occurring on the market. The provisions of the regulation will apply from January 2027.

The article provides an overview of consumer protection measures designed to ensure the rights of owners and users of virtual currencies. The authors state that there is an ongoing debate in the EU about the legal qualification of virtual currencies as financial instruments. It is contrary to the initial purpose of virtual currencies which was the payment function. The authors attempt to answer the question which EU law should cover the virtual currencies, MIFID2 or PSD2, as the legal qualification will be crucial for consumer rights. They claim that the position adopted by the European legislative should provide the fullest possible scope of consumer protection.

The article discusses basic, most significant – especially for the manufacturers of machinery – changes introduced by the new directive 2006/42/EC as compared to the 98/37/EC machine directive. The article states when the 2006/42/EC directive will enter into force, it discusses its extended scope, the relationship between the new machine directive and Council Directive 89/655/EEC, changes in procedures for assessing the conformity of machinery, major amendments and supplementary essential requirements, and major amendments and supplementary information related to annexes.

The purpose of this article is to attempt to investigate the issue of product placement, to analyze and systematize this innovative legal subject, from the point of view of European law. The aim of this study is also to present the difference between product placement and advertising. The major objective of this research is the introduction to the European regulations, as well as an examination of their history, in terms of both advertising and product placement itself, likewise demonstration that all the amendments of existing directives, regarding advertising and product placement, were directly dictated by the continuous technological progress, causing changes in the audiovisual sector, thereupon existing regulations had to be adapted, to provide equal rights for all European Union Members.

This contribution is a part of a pilot study on the mutual perception of politeness standards in Poland and in the Netherlands. In an online survey, we asked native speakers of Polish and Dutch to evaluate twenty utterances in terms of politeness. In the next step, the participants were asked to choose a term that, in their view, suits the evaluated utterance: is it, for example, a request, an order or maybe a suggestion? We examined how the respondents perceive the illocutionary force of different subtypes of directive speech acts in an informal context and whether there is a relationship between politeness and speech act names. The results show that there is a difference in how the Polish and Dutch respondents perceive the illocutionary force of speaker-controlled directive speech acts. However, there seems to be no link between the illocutionary force and the syntactic form of the evaluated utterances. The choice patterns of terms seem rather to be motivated by modality markers.

This article critically discusses how legal frameworks in the Czech Republic and Poland correspond to the requirements of ECN+ Directive with regard to the powers of NCAs. For that purpose, the authors analyse the obligations of EU Member States – within this scope – under this directive, as well as legal frameworks in the Czech Republic and Poland. Subsequently, the article compares the manner of regulating these issues in the national legal orders of these countries to the standard required by ECN+ Directive. The aim of this publication is to verify whether, and how, these two EU Member States meet those requirements, and to determine any potential differences in the approach taken by legislators in these EU Member States.

The article is devoted to the issue of the implementation of the Directive of the European Parliament and of the Council (EU) of 6 July 2016 on measures contributing to a high level of security of networks and information systems within the territory of the Union (the so-called NIS Directive) into the Polish legal system. In this context, the author analyses the Act on the National Cybersecurity System, presenting the system and its individual components. The subjects of consideration are the provisions of the Act on National Cybersecurity System of the Republic of Poland and other legal acts concerning the subject matter, which entered into force before the adoption of the analysed act. In conclusion, the author states that in some cases, it is necessary to amend individual legal acts in order to avoid ambiguities which lead to disruption of the system as a whole. The basic method used in this article is legal dogmatics and critical analysis of the scientific literature, documents and opinions of experts—practitioners.

The opinion discusses the compatibility of the government bill with the Directive 2011/24/EU of the European Parliament and of the Council, pointing out in particular the need to remove from the project and clarify the vague concepts of questionable issues. The author shows that the bill imposes numerous restrictions on patients, related both to the need to obtain prior authorization of healthcare and spending limits for a given year, as well as the constraints of a formal nature that may hinder the patients from using cross‑border healthcare serivces. In conclusion, it she notes that the objective to reduce the proportion of patients who wait for treatment would not be achieved.

The article focuses on Poland’s obligations arising from Article 6 of the Directive (EU) 2016/2284 of the European Parliament and of the Council of 14 December 2016 on the reduction of national emissions of certain atmospheric pollutants, amending Directive 2003/35/EC and repealing Directive 2001/81/EC[1]. The objective of the article is to present legal solutions adopted in the National Air Pollution Control Programme (further referred to as the NAPCP) in Poland. This is preceded by an analysis of this document in the context of other legal instruments for environmental protection, and an evaluation of its effectiveness.
Niniejszy artykuł skupia się na wskazaniu zobowiązań Polski wynikających z art. 6 dyrektywy Parlamentu Europejskiego i Rady (UE) 2016/2284 z dnia 14 grudnia 2016 r. w sprawie redukcji krajowych emisji niektórych rodzajów zanieczyszczeń atmosferycznych, zmiany dyrektywy 2003/35/WE oraz uchylenia dyrektywy 2001/81/WE[1]. Celem niniejszego artykułu jest zaprezentowanie rozwiązań prawnych przyjętych w krajowym programie ograniczania zanieczyszczeń powietrza (dalej: KPOZP) w Polsce, z wcześniejszym umiejscowieniem tego dokumentu na tle innych prawnych instrumentów ochrony powietrza, oraz ocena jego skuteczności.

Celem artykułu jest analiza podejścia do oceny eutrofizacji w świetle wymagań dyrektywy azotanowej, Ramowej Dyrektywy Wodnej (RDW) oraz przepisów polskich. W żadnym z tych aktów prawnych nie podaje się metodologii oceny zjawiska. Opracowany w 2005 r., w ramach Wspólnej Strategii Wdrażania RDW, projekt wytycznych do oceny eutrofizacji w kontekście europejskiej polityki wodnej oparty jest na zharmonizowanym podejściu do zagadnienia, uwzględniającym wymagania RDW oraz dyrektywy azotanowej i ściekowej. Oznacza to, że metodologia oceny eutrofizacji przyjęta w RDW powinna być zastosowana również w celu spełnienia wymagań pozostałych dyrektyw i, tym samym, przepisów polskich.
An analysis of approaches to the assessment of eutrophication in view of the requirements of nitrate directive, Water Framework Directive and Polish legal acts is presented in this paper. None of the acts gives the methodology of assessing the phenomenon. Draft guidelines for assessing eutrophication in the context of European water policies, prepared in 2005 within the Common Implementation Strategy of the WFD, are based on harmonised approach to the problem with the consideration of the WFD, nitrate directive and urban waste-water treatment directive. It means that the methodology of assessing eutrophication adopted in the WFD should be used in to fulfil the requirements of other directives and Polish regulations.

The 20 principles of the European Pillar of Social Rights adopted by the EU in 2017 include the right to access such basic services as water, sanitation, energy or transport. In the face of the climate crisis, the first of these rights is becoming a service which, due to the progression of global warming, could lose its universal and easily accessible nature. It seems reasonable to ask about the chances of developing a ‘right to water’ within the framework of the EU’s system, which would unambiguously oblige the public authorities to ensure access to this right. The trigger for this research was the ‘Right2Water’ European citizens’ initiative addressed to the European Commission in 2013, which contained postulates to recognise access to water as a human right. Ten years after the launch of this procedure, it is reasonable to acknowledge the verification of the actions taken by the EU and whether the evolving EU water policy can be assessed as being oriented towards ensuring the right to water for all EU-inhabitants. The aim of this paper justifies the use of legal-dogmatic research methodology. Regarding the analysis of legal acts, the rules of legal hermeneutics were applied, esp. grammar and teleological interpretation.

The authors criticize the claims relating to the functioning of the National Committee on Ethical Review of Animal Research made in the paper „Five years of difficult experiences with the Act of the protection of animals used for scientific or educational purposes dated of January 15, 2015” published in „Nauka” (3/2020) relating to the functioning of the National Ethics Committee on Animal Experimentation. The comment proves many statements of that paper blatantly false given either statistical data or legal regulations. It includes the duties of the National Ethics Committee, right of non-governmental organizations to participate in administrative proceedings, conflict of interest, and the approach of the National Ethics Committee to appeals from the decisions made by local committees. The authors prove that the paper’s suggestions of the alleged misconduct by the National Ethics Committee on Animal Experimentation are ill-founded and result from the poorly understood legal situation as well as lack of reference to relevant empirical data.

The article presents the history of the development, and the reasons for the creation of the SEVESO Directive, with particular emphasis on the latest Directive 2012/18 / EU of the European Parliament and the Council. The SEVESO III directive imposes detailed requirements on the plant operators regarding their control against major accident hazards related to dangerous substances. Individual countries of the European Union apply various requirements (following SEVESO III or more rigorous ones) for industrial plants. In Poland, the requirements of the SEVESO III Directive have been implemented in the Environmental Protection Act, and its executive acts. The SEVESO III Directive requires that the citizens of a given country have access to information about high and increased-risk establishments. In Poland, this requirement is met through the website www.mapy.geoportal.gov.pl. People can find information on establishments posing a risk of a serious industrial accident. The article presents how to use the portal and what information can be obtained there.

Opis:
The 2013 European Union Cybersecurity Strategy, the 2016 Directive, and the 2019 Regulation mark the next steps in strengthening the protection of cybersecurity by European Union bodies, linked to changes in member states’ laws. The rapid increase in threats, referred to as the “cyberpandemic”, requires prompt adaptation of legal instruments to new needs, but at the same time complicates ensuring consistency of multi-level regulation. The analysis of changes in the legal status in Poland shows that this concerns terminology, subject matter scope and the structure of cyber security systems. In order to reduce difficulties, it is worth considering introducing immediate amendments to those provisions in force which were negatively assessed during works on drafting new acts. Such a conclusion is prompted by the evolution of the definition of cybersecurity, which, according to the 2019 Regulation as well as the draft amendments to the Polish Act on National Cyber Security System and the draft of the new Directive, is to be understood as activities necessary to protect networks and information systems, users of such systems and other persons against cyber threats such as any potential circumstance, event or action that may cause damage, disruption or otherwise adversely affect networks and information systems. Another example is the maintenance of the distinction between key service operators and digital service providers in the 2019 EU Regulation and the 2021 draft amendment to the Polish law, although the 2020 NIS 2 directive draft recognizes that it has become irrelevant and replaces it with a distinction between essential and relevant entities. Also, other changes currently proposed are justified by the blurring of the boundaries between virtual and real space.

Research objective. Legislative processes are important due to the fact that little attention is paid by the market as well as market models of economic development to the issues resulting from the exploitation of the natural environment. Currently, the crucial actions to protect the natural environment include setting up legal regulations that would reduce the degradation of nature caused by consumer behavior. The aim of this article is to analyze and evaluate the selected legislative solutions pertaining to the protection of the natural environment in the European Union and Poland. The research problem and methods. The analysis of legislation and legal regulations pertaining to the environmental protection in the context of the selected issues spans the timeframe of 2015-2020. The conducted study pertains mainly to legal acts including regulations as well as directives. The process of argumentation. The function of the state in the economy was described to explain the role of the policy adopted for the environmental protection. Further in the considerations, the analysis included selected legal regulations observed by the EU member states. Evaluation was made in terms of incentives and other solutions in the area of economic instruments and other solutions facilitating the implementation of sustainable development premises. Research results. The sources of law of the European Union are an important constituent part of the national system of environmental protection. Domestic regulations are more and more frequently supplementary and executive in nature. The results of research show the selected suggestions and evaluate the legal solutions adopted within the analyzed timeframe. Conclusion, innovations, and recommendations. Legislative solutions should yield benefits both to the manufacturers as well as the economy. Ecological awareness is equally important, setting social responsibility for the environment as a model conduct.

Proverbs are fixed linguistic symbols reproduced by the speaker, which are characterized by a communicative purpose, given by the collective addressee – by a folk. They are purposeful speech actions, speech acts of which prompt to study the peculiarities of their pragmatics. The presence of independent illocutionary forces in proverbs transforms them into speech acts, which is also evidence of the discursive nature of proverbial semiosis. Depending on the intention, proverb statements can take on the semantic status of affirmation, ascertaining, promise, warning, threat, order, requirement, advice, еvaluation etc. It also singles out pragmatically shaped features of the Ukrainian paremia possessing genuine illocution for such speech acts as representatives, directives, or expressives. The thesis reveals the indirect speech acts in the Ukrainian paremia stock that are characterized by imbalance between illocution and illocutionary force.
Paremie to stałe jednostki językowe, odtwarzane przez mówcę w utartej formie. Ich funkcja zależy od celu komunikacji zapewnianego przez nadawcę zbiorowego, czyli naród. Paremie należą do docelowych aktów mówienia, co przekłada się na potrzebę zbadania ich pod kątem specyficznej pragmatyki. Obecność mocy illokucyjnej w paremiach powoduje ich przekształcenie w akty mówienia, co świadczy o dyskursywnej istocie semiozy paremicznej. W zależności od illokucji ukraińskie przysłowia mogą przybierać charakter stwierdzenia, konstatacji, zastrzeżenia, obietnicy, groźby, rozkazu, porady, oceny itp. Dla ukraińskich paremii charakterystyczna jest illokucja aktów mówienia: reprezentatyw, dyrektyw oraz ekspresyw. Konstatuje się obecność w paremicznym korpusie języka ukraińskiego złożonych aktów mówienia, które wyrażają różnice pomiędzy illokucją a mocą illokucyjną.

In this paper, we propose a directive triangular EBG antenna. This approach is derived from using an EBG surface near to a triangular patch with two grilles. The antenna frequency chosen is the 2.45GHz. The directive antenna is simulated by using HFSS and Electrical model. This proposed antenna presents a very high directivity.

The article looks primarily at the material comprised in the volume edited by A. Piszcz, Implementation of the EU Damages Directive in Central and Eastern European Countries published in 2017 and based on that compares aspects of the disclosure of evidence issue in Bulgaria, Croatia, Czech Republic, Estonia, Hungary, Latvia, Lithuania, Poland, Romania, Slovakia and Slovenia. The purpose of this article is to look into how the process for the disclosure of evidence has evolved in eleven countries of the European Union in light of Directive 2014/104/EU. The article looks at six key issues with regard to disclosure of evidence in light of Directive 2014/104/EU: general procedural issues; procedure for the submission of evidence; criteria for the disclosure of evidence; restrictions on the disclosure of evidence; disclosure of evidence by parties other than the defendant; and consequences of the failure to comply with a request to submit evidence. The article relies on primary data from eleven EU countries from Central and Eastern Europe.

Directive 2013/48/EU of the European Parliament and of the Council of 22 October 2013 on the right of access to a lawyer lays down minimum standards concerning access to a lawyer for suspects and the accused in criminal proceedings, as well as persons subject to the European arrest warrant proceedings. The present article focus on the subject of access to a lawyer at the earliest stage of criminal proceedings – in connection with arrest as well as during proceedings concerning the use of pre-trial detention. Author analyzes in sequence: subjective scope of the right to a lawyer, the right to a lawyer for the person deprived of liberty, confidentiality of communications between the person deprived of liberty and their lawyer. The main statement is that Poland does not meet that standard.

The concept of cyber security has become part of the reality of the late 20th and 21st centuries. This term is understood as a system that blocks threats consisting in destroying, changing and unauthorized interception of data. The importance of the cybersecurity problem was emphasized by making legal regulations in the legislation of many countries around the world, including Poland, the United States, Russia and China, and on the basis of the provisions of state associations or international organizations, which is reflected in the relevant regulations of the European Union. The concept of cyber security is multi-faceted, becoming an object of interest not only to countries or organizations, but also to individual individuals living in given communities. The progressive digitization of many areas of life, regardless of the geographical location of the country, means that the need to ensure the proper and safe functioning of this sphere of reality determines the universality of cyber security.

In October 2019, the European Union adopted the Directive on protecting persons reporting breaches of European Union law, commonly known as the „Whistleblower Protection Directive” (EU Directive). The protection of national policies is beyond the scope of the Directive, as its sole purpose is to encourage people to report "breaches of EU law", ie, to strengthen „enforcement of the Union law and policies in specific areas”. The Directive is not concerned with the protection of workers or employees. The Directive treats whistleblowers as an instrument for reporting irregularities. Another proof of the instrumental approach adopted in the Directive is the lack of any financial incentives for whistleblowers. This article's basic thesis is that despite dynamic and multifaceted changes in the economy of individual countries, the accepted model of whistleblowing in the European Union will depend on repeated multidimensional analysis of the principle of the lawyer's loyalty to the organization. The research presented below aims to prove the validity of the adopted thesis.
