    Opis:
    The Chełmno law (ius culmense) and other legal systems in force protected good reputation. It was reflected for example in the fact of penalizing any kinds of verbal insults and slanders (calumny) which were not supported by appropriate evidence; they were treated as an insult to the legal interest of a human being. It also concerned false allegations of witchcraftt. The subject matter of the article is the practice of adjudicating cases concerning slander (calumny) and including the allegation of witchcraft in smaller towns of the Royal Prussia (the second half of the 17th–18th centuries). On the basis of the judicial files of the town of Nowe nad Wisłą, the author presented the background of false allegations, the model of conduct of the judicial bodies and the catalogue of punishments used by the courts. It constitutes a contribution to a more extensive discussion about trials concerning witchcraft in the Prussian province and other parts of the Polish Kingdom in the early modern period.

    Opis:
    Nous examinons ici la prégnance de l’idée de mépris dans la littérature de la longue Renaissance, mépris ou dédain qui a partie liée avec un vaste ensemble synonymique où tous les termes renvoient à un sentiment de haine ou de dégoût. Ces termes sont toutefois indissociables, comme on peut l’observer dans les textes d’Érasme et de Marie de Gournay, entre autres auteurs, des actions discursives qui découlent du sentiment même de mépris. Au fil du XVIe siècle, et en amont, plusieurs auteurs sont en effet devenus sensibles à l’origine d’une injustice souvent passée sous silence, soit le fait de subir les effets irréversibles de la diffamation, injure qu’on qualifie de « médisance », de « calomnie », de « détraction » et de plusieurs autres termes encore, et laquelle consiste à dérober l’honneur d’autrui par un simple énoncé ou par un témoignage, parfois contraire à la vérité, souvent inexact, et dont les motifs sont rarement charitables. Nous tentons ici de définir les termes et les enjeux du débat.
    This essay examines the evolution of the concept of contempt, which is part of a vast lexicon in which each term relates to the idea of hatred and disgust. Those words are however inherent, as we can observe in Erasmus and Marie de Gournay’s works, among many other Renaissance authors, to speech actions that are a consequence of hatred and disdain. From the Middle Ages to the beginning of the 17th Century, many authors became aware of a brutal source of injustice, and which was often left unpunished, that is the indelible impacts of defamation, a verbal abuse reverberated as fama or slander, calumny, libel and many other synonyms, which fatally attacked honor and reputation – one’s most valued possession – with a slur that was often based on a lie or ignorance, and which rarely aimed at any charitable ends. Our article provides some definitions and aims at identifying the crucial stakes of the debate.
