Władza – choć tak może być odczytane brzmienie tytułu tej pracy – nie jest fenomenem przeciwstawnym kulturze. Jest ona bowiem wytworem kultury właśnie, albo jak się niekiedy twierdzi, osiągnięć cywilizacji. Skoro władza jest wytworem kultury, to nie może być traktowana jako zjawisko od niej odrębne i niemające związków z wzorcami kultury, które wskutek tego mogą być determinantami instytucjonalnych i funkcjonalnych cech władzy. Kultura i jej wytwory (m.in. wiedza, prawo, religia, moralność itp.), podobnie jak inne fenomeny społeczne mogą być czynnikami stymulującymi działalność władzy, albo być czynnikiem tę działalność stabilizującą bądź ją ograniczającą w ramach wzorców (norm) przez nią wytworzonych. Społeczeństwa nieustannie dokonują wyborów w zakresie przyswajania, modyfikowania i odrzucania wzorców kultury.
Authority – even though the title of this paper may suggest so – is not a phenomenon opposing culture. It is actually a product of culture or, as sometimes said, of the achievements of civilisation. Since authority is a product of culture, it may not be treated as a phenomenon isolated from it, without any ties with cultural patterns, which may – as a result – act as determinants of the institutional and functional qualities of authority. Culture and its products (including knowledge, law, religion, morality, etc.), like other social phenomena, can become factors stimulating the exercise of authority, or act as factors to stabilise or curb this exercise within the framework of the patterns (norms) it has created. Societies make constant choices in terms of adopting, modifying, and rejecting various cultural patterns.

This text attempts to present the legal structure of parental authority. It is a historical description. Describes all elements of parental responsibility. Both substantive and procedural issues. First and foremost, in the text, parental authority was introduced in Polish law. The analysis has been subjected to the following terms: parental control, the content of power, deprivation, suspension, restriction and cessation of parental authority. The boundaries of that power are outlined. The problem of the Polish law concerning the family. The most important issues related to mutual rights and family responsibilities and relationships between parents and children who are not dependent on parental responsibility are discussed. The basic features of proper parental responsibility are shown. The issue of parental responsibility has been approximated.

The subject matter of the essay is the tasks of the President of the Energy Regulatory Authority in relation to energy policy in Poland. The essay is divided into two parts. The first part presents basic information about the national regulatory authority, regulation and kinds of energy policy. The second focuses on the tasks of the President of the Energy Regulatory Authority in various areas, such as: energy effectiveness, energy security, renewable forms of energy and competition in the energy market. The article examines the tasks carried out by the President in the past and those which must come into force in the future to modernize the Polish energy market. Finally, the author thrashes out the legal relations between the functions of the President of the Energy Regulatory Authority and the aims mentioned in Polish energy policy. The author pays special attention to the problems of liberalisation in the energy market in Poland.

In Poland the position of a leader of political party Law and Justice has become the most important position in the country. His will has the power of law. The boundary between his will and the will of a state has blurred. The leader holds unlimited power, although he does not hold any public position. He is beyond legislative, executive and judiciary. The constitutional rule of control, complementing and hindering was replaced by charismatic power of the leader of Law and Justice. The power in Poland is held by one man. The „new law order” (Constitutional Court, National Council of the Judiciary of Poland, common courts, Supreme Court, prosecutors office) serves political purposes of the leader of Law and Justice. That is the reason for judges exchange in Poland. Lawlessness has become law. Law has been turned into a political instrument and it was done in the most vulgar way. Law serves Law and Justice’s political purpose, with disregard and disrespect to constitutional values. The system of constitutional values is not relevant for Law and Justice in the process of establishing law. A system based on autocracy is created. The main legislative competence is held by the leader of Law and Justice. Systematically, with absolute consistency, a totalitarian regime is built, where legislative and executive is under control of one man, who himself remains out of constitutional control and has no constitutional responsibility.

President of the Energy Regulatory Office
Opis:
This article presents the duties and powers of the President of the Energy Regulatory Office as the national regulatory authority of Poland within the scope of implementing the Third Energy Package. The article closely examines the changes and omissions connected with implementing the regulations of the Third Liberalization Package. Such implementation has not been fully executed. The biggest shortages are visible in two fields: the realization of the aims of Articles 35 and 37 of Directive 2009/72/EC. Concerning Article 35 of the Directive, the changes to the legal position of the President of URE (i.e., loosening his ties with the sphere of governmental administration, something strongly advocated by negative developments which have taken place in the legal and constitutional status of the authority over the last six years) have not been implemented.
Le Troisième Paquet Énergie contient plusieurs dispositions qui exigent une adaptation au système juridique du pays. Parmi les plus importantes dispositions de la directive 2009/72/CE du Parlement européen et du Conseil du 13 juillet 2009 relative aux règles du marché intérieur de l’électricité se trouvent celles qui concernent le renforcement de la position juridique des autorités de régulation dans les États membres. De plus, aux termes du règlement (CE) n° 713/2009 du Parlement européen et du Conseil du 13 juillet 2009, le Troisième Paquet Énergie a institué une nouvelle autorité – l’Agence de coopération des régulateurs de l’énergie, dont les compétences auront un impact sur le fonctionnement du marché intérieur de l’énergie électrique et l’activité d’autorités de régulation du pays. Quant à l’adaptation des dispositions mentionnées du Troisième Paquet Énergie au système juridique polonais, il faut faire remarquer que seulement certaines d’entre elles ont été transposées en vertu des derniers amendements de la loi « Droit de l’énergie ». Il faut également souligner que l’adaptation des dispositions de la directive 2009/72/CE renforcera de manière significative la position juridique du Président de l’Autorité de régulation de l’énergie, notamment par le rétablissement du mandat à durée déterminée de sa fonction et le renforcement de son indépendance.

The paper aims to discuss Polish terms that name authority bodies under the administrative law and their English equivalents. The Polish terms under analysis appear in the first Division of the Polish Code of Administrative Procedure of 14 June 1960 and the English equivalents of each Polish term researched have been suggested in the Polish Code of Administrative Procedure translation into English. The research problem is to determine the translation methods applied and to verify whether translation methods used in the Polish-English translation of the above terms which have been determined as culture-specific items appear among translation methods applied when translating culture-specific elements suggested by Hejwowski (2007). Furthermore, to verify whether the mentioned translation methods appear among the translation methods discussed by Weston (1993) which are recommended to be applied while translating legal terms. The theoretical part of the paper includes a presentation of the definitions of a legal term, culture-specific item and the classification of translation methods by Hejwowski and Weston. The research stages include the comparison of definitions of source elements and definitions of their equivalents, as long as they appear in monolingual English law dictionaries.
Badanie ma na celu omówienie polskich terminów, które nazywają organy prawa administracyjnego oraz ich ekwiwalentów angielskich. Terminy polskie poddane analizie występują w pierwszym Dziale Kodeksu Postępowania Administracyjnego z dnia 14 czewca 1960 (KPA), natomiast omawiane ekwiwalenty zostały zastosowane w tłumaczeniu polskiego KPA na język angielski. Celem analizy jest określenie technik przekładowych zastosowanych w przekładzie elementów źródłowych oraz potwierdzenie lub zaprzeczenie tezie, zgodnie z którą techniki zastosowane w przekładzie omawianych elementów nacechowanych kulturowo występują w klasyfikacji technik zaproponowanych przez Hejwowskiego (2007) do stosowania w przekładzie elementów nacechowanych kulturowo. Ponadto należy zweryfikować, czy zastosowane techniki pojawiają się w klasyfikacji technik tłumaczeniowych wyróżnionych przez Westona (1993), służących do przekładu terminów prawnych. W części teoretycznej przedstawiono m.in. definicję terminu prawnego, elementu nacechowanego kulturowo oraz klasyfikacje technik tłumaczeniowych Hejwowskiego i Westona. Na etapy badania składa się m. in. porównanie definicji elementu źródłowego oraz jego ekwiwalentu, jeżeli występuje on w jednojęzycznym słowniku prawa angielskiego.

The article discusses the issue of soft law and its role in the functioning of supranational competition networks. It draws from the assumption that international cooperation is crucial for competition authorities around the world and that the most efficient and comprehensive form of such cooperation takes the form of supranational competition networks. For networks, establishing common standards in the form of soft law is essential for development of the network and the deepening of cooperation between network members. The article concludes that supranational soft law has its eminent advantages like informality, flexibility, and accessibility which allow it easily to respond to the changing needs of authorities and stakeholders, and to adapt to evolution of the economic and regulatory environment. However, the problems of legitimacy and transparency in the process of establishing soft law rules are yet to be resolved.

The public administration of the European Union (EU) is a sui generis multi-level structure under constant development. After five decades of successful functioning, the European Union still lacks a coherent and comprehensive set of codified rules of administrative procedure at all levels. The existing acquis related to European administration and administrative procedures is fragmented, sector specific and although it is based on the constitutional principles of the democratic traditions of its Member States, such coincidence is often insufficient for the present requirements of good administration. The EU basically relies on indirect administration, while a growing number of cooperation forms exists of the competent authorities that aims to ensure efficacy of execution and to overcome diversity of non-harmonised legal areas. The aim of this paper is to place the European Competition Network (ECN) in this structure, explore and examine its legal nature as it is probably the most advanced example for such cooperation. The ECN incorporates and reveals the major procedural law questions of European administration; it is a rather successful form of cooperation, and although its core issues fail to correspond to the fundamental requirements of European administrative procedures, there seem to be positive changes in the evaluation of soft law and the functioning of the system.
L’administration publique de l’Union européenne (UE) est une structure sui generis aux plusieurs niveaux de l’évolution constante. Après cinq décennies de bon fonctionnement, l’Union européenne (UE) ne dispose toujours pas de l’ensemble cohérent et complexe de règles codifiées de procédures administratives à tous les niveaux. L’acquis existant relatif à l’administration européenne et aux procédures administratives est fragmenté et spécifique au secteur. Même si l’acquis est fondé sur les principes constitutionnels des traditions démocratiques des États membres, une telle coïncidence est souvent insuffisante par rapport aux exigences actuelles d’une bonne administration. L’UE s’appuie essentiellement sur l’administration indirecte alors qu’il existe un nombre croissant de type de coopération entre les autorités compétents afin d’assurer l’efficacité de l’exécution et de surmonter la diversité entre des domaines du droit non-harmonisés. L’objectif de cet article est de placer le Réseau européen de la concurrence (ECN) dans cette structure, d’explorer et d’examiner sa nature juridique, car il s’agit probablement de l’exemple le plus avancé de ce type de coopération. Le REC intègre et révèle les principales questions de droit procédural de l’administration européenne. Il est une forme de coopération plutôt fructueuse, et bien que ses enjeux essentiels ne correspondent pas aux exigences fondamentales des procédures administratives européennes, il semble y avoir des changements positifs dans l’évaluation du soft law et du fonctionnement du système

Artykuł powstał na podstawie monografii autora pt. Teoria władzy. Niniejsze opracowanie dostarcza kompleksowych teoretycznych objaśnień dotyczących zjawiska władzy. Jest to studium teoretyczne, którego ustalenia pozwalają lepiej zrozumieć przedmiotowy fenomen, a także oferują założenia ontologiczne i epistemologiczne gotowe do dalszych badań zarówno teoretycznych, jak i empirycznych. Przedstawione rozumienie władzy stanowi dowód niezbędności zintegrowanych badań politologiczno-prawniczo-socjologicznych.
The article is based on the author’s monograph The Theory of Authority. This paper provides complex theoretical explanation concerning the phenomenon of authority. It is the theoretical study, findings of which let to understand this phenomenon better, as well as offer ontological and epistemological assumptions ready to be verified through further theoretical and empirical research. The presented understanding of authority proves the necessity of integrated political, legal and sociological research.

In Ukraine the subject under analysis has been studied not enough. Some aspects of this issue have been researched by V. Gorbatenko, O. Kostenko, I. Kresina, O. Merezhko, N. Onishchenko, M. Teplyuk, Y. Shemshuchenko, O. Yushchyk. Polish scientists, such as T. Biernat, E. Kustra, R. Piotrovski, V. Staskevich, P. Vinchorek, S. Vronkovska, E. Vrublevsky have analyzed different models of law creation. It has been described two making law concepts: rational and developmental. The first concept determines law as a tool of the political authority for realization their aims. The authority always supposes, that it understands society needs better. This concept is grounded on belief that the social life can be regulated by consciousness and rational thought. According to the developmental concept the interaction between politics and law are multilevel and ambiguous. The making law process depends on activity of members of parliament and also legal possibilities of other people to influence on this process. Nowadays experts, lawyers, politicians are writing about poor quality of law. In Ukrainian and Polish scientific thought has appeared such notion as “inflation of law”. It means the negative phenomenon in the legislative process: the process of law creation that does not correspond to the real society needs. The norms of law, which regulate one object of social relation, are contradictory; responsibility for non-fulfillment of some functions is not defined; there is an ambiguous formulation of notions in law. Besides, some politicians and lawyers consider that enacting normative legal acts can immediately solve all problems. This process is called „instrumentalization of law”. The politicians and lawyers overlook customs, moral norms, traditions and agreements. Both processes – “inflation of law” and „instrumentalization of law” take place in Ukraine and Poland. Personal and professional competencies of individuals by whom the state policy and law are formed may be defined as the most important for Ukrainian and Polish societies. The factors which influence on their professional qualities are studied in this article. The way of getting power, the term in office and the ability to determine strategy of a state are analyzed in both countries. The law can be effective, if society is involved into discussion.

Consular law is a set of norms governing the establishment of consular relations and opening consular offices of another state. This is a branch of law that is not unambiguously classified, falling both under international law and national law. It is a highly consolidated, incorporated, and also a recently codified branch of public international law in which the international element undoubtedly dominates. Under the surface, however, one can find more or less highly developed national legislation (German consular law, Italian consular law) which is not a mere concession to international legal norms (especially the Vienna Convention on Consular Relations) but are often separate sets of norms, collected into other directly related, linked to or even closely related national legislation. Given the functions performed by the consular post and the organisational integration of consular authorities into the system of state bodies, it is subsequently possible to classify national consular law into the branch of administrative law.

In view of the subject matter of this opinion, based on views founded on the doctrine of Polish constitutional law and on the jurisprudence of the Constitutional Tribunal and the Supreme Court, it can be concluded that the legislator should regulate by law, among other matters, the following matters reserved for statutory regulation (the principle of exclusivity of the act): regulations concerning citizenship and the rights, freedoms and duties of the individual, as well as the basic competences, principles of how public authorities are organised and function. On the basis of this assumption, it was examined whether there is any indication to the legislator from the constitutional norms relevant to the judicial authority. The following were taken into account: the right to a fair trial (Article 45), the principle of the separateness and independence of the judiciary (Article 173), the principle of bi-instantiality of court proceedings and the principle of statutory determination of the system and jurisdiction of courts (Article 176), the principle of the presumption of competence being assigned to common courts (Article 177), and the principle of the non-removability and non-transferability of judges (Article 180). On the basis of an analysis of these constitutional norms, it was concluded that the Constitution of the Republic of Poland enforces statutory regulation of the organisational structure and the material, local and appeal jurisdiction of common courts, and only allows for entrusting specific matters to be regulated by executive bodies by means of a regulation. In the event of any doubts as to whether a given case should be classified into the category of specific matters, the principle of exclusivity of the Act applies.

Opis:
This article discusses the current position of the supreme nuclear regulatory authority in Poland – the President of the National Atomic Energy Agency (PAA President) in the structure of government administration in the light of provisions of the Polish Constitution and of international and European law, taking into account the principle of independence of nuclear regulatory authorities. A particular attention was paid to the critical analysis of the current subordination of the PAA President to the supervision of the minister responsible for the environment. Based on the arguments relating to the importance of the tasks of the PAA President and their importance for national security, their multifaceted character in relation to various sectors of government administration, as well as on the basis of comparative and historical ones, it is postulated to restore the supervision of the Prime Minister over the PAA President.
