The paper summarizes the author’s experience of conducting economic scientific research. Economic scientific research is understood as both an analysis of economic phenomena and research purchased on the market of research services. The former are not subject to ethical dilemmas. It is a professional approach backed by sound economic theory that is important. The latter, regardless of who purchases research services, pose a risk of ethical dilemmas and conflicts of interest. The area of potential risk is connected to expectations of organizations purchasing research services. In most cases organizations are interested to receive objective assessments or recommendation necessary to take decisions. Ethical conflict appears when the destination of research is lobbing or a company’s image creation. The results of research may be used as an instrument of competition. It is thus vital that a research organization should judge the ethical dimension of undertaken research tasks. Research projects being socially beneficial should be definitely undertaken. In controversial cases, the conviction of the rightfulness in the ethical dimension ought to be decisive. In all cases the principal rule should be aiming at achieving scientifically objective assessments and opinions.

Ubóstwo jest problemem globalnym, który zawsze towarzyszył ludzkości. Współcześnie zjawisko to najczęściej dotyka rodzin wielodzietnych, a jego skutki najbardziej uderzają w dzieci. Brak środków na zaspokojenie podstawowych potrzeb bytowych stanowi zagrożenie dla ich zdrowia i prawidłowego rozwoju, jest przyczyną zaniedbań wychowawczych i powodem społecznego wyobcowania. Dzieciństwo w biedzie prowadzi często do przejmowania złych wzorców i powielania stylu życia poprzednich pokoleń. Moralnym obowiązkiem społeczeństwa oraz zadaniem władz publicznych jest udzielenie wsparcia osobom i rodzinom znajdującym się w trudnej sytuacji materialnej. Pomoc tę państwo zapewnia poprzez redystrybucję wytworzonych dóbr. Socjalnoprawna ochrona rodziny zabezpieczona jest przez system świadczeń wyrównujących nie tylko dochody, ale i deficyty społeczne.
Poverty is a global problem which has always affected mankind. Nowadays it troubles predominantly numerous families. Its negative effects can be observed mostly with children. Lack of financial means to satisfy basic living needs poses a threat to their health and proper growth, induces parental negligence and causes social isolation. Childhood in the environment of poverty frequently leads to copying wrong patterns of behaviour as well as adopting the lifestyle of previous generations. It is the moral obligation of society and the responsibility of public authorities to support individuals and families who face a difficult financial situation. Help is offered by means of the redistribution of manufactured goods. Social and legal protection of families is secured through the benefit system, which settles not only proceeds level but also social deficits.

Objectives Legislators and policymakers have expressed strong interest in intervention programs to reduce dependence on social disability benefits. Hybrid: ambulatory followed by home-based cardiac telerehabilitation – hybrid cardiac rehabilitation (HCR) seems to be a novel alternative for standard cardiac rehabilitation for patients with cardiovascular diseases (CVD) as a form of pension prevention paid by the Social Insurance Institution (SII). The kind of professional status may bias the motivation to return to work after HCR. The aim of our study was to evaluate whether the professional status can affect the effects of HCR. Material and Methods One hundred fifty-two patients with CVD referred by the SII for a 5-week HCR were qualified for the study. Patients (87.7% males), aged 57.31±5.61 years, were divided into 2 subgroups: W) white-collar employees (N = 22) and B) blue-collar employees (N = 130). To evaluate functional capacity, an exercise test on a treadmill was used. Results The number of days of absence in the cardiac rehabilitation program did not differ between the groups (mean ± standard deviation – B: 1.09±3.10 days, W: 1.95±3.64 days). There were significant improvements (p < 0.05) in measured variables after HCR in both (W and B) groups (max workload: 8.21±2.88 METs (measured in metabolic equivalents) vs. 9.6±2.49 METs, 7.76±2.51 METs vs. 8.73±2.7 METs, resting heart rate (RHR): 77±16.22 bpm vs. 69.94±12.93 bpm, 79.59±14 bpm vs. 75.24±11.87 bpm; double product, i.e., product of heart rate and systolic BP (DP rest) 10 815.22±2968.24 vs. 9242.94±1923.08, 10 927.62±2508.47 vs. 9929.7±2304.94). In group B, a decrease in systolic blood pressure (BP syst. – 137.03±17.14 mm Hg vs. 131.82±21.13 mm Hg), heart rate recovery in the 1st minute after the end of peak exercise (HRR1) (99.38±19.25 vs. 93.9±19.48) and New York Heart Association (NYHA) class (1.22±0.53 vs. 1.11±0.36) was observed. In group W, a decrease in diastolic blood pressure (BP diast.) at rest was observed (88.28±9.79 mm Hg vs. 83.39±8.95 mm Hg). The decrease in resting HR was significantly greater in group W (69.94±12.93 vs. 75.24±11.87, p = 0.034). Conclusions Hybrid cardiac rehabilitation is feasible and safe with high adherence to the program regardless of the patient’s professional status. Professional status did not influence the beneficial effect of HCR on exercise tolerance.

This article addresses the issue of the employers’ obligations to fulfil the employees’ life, social, and cultural needs, in particular the employers’ right to resign from those obligations in times of crisis. The author examines the Polish law in search for legal regulations constituting framework for those obligations and analyses their nature. Some of those obligations are not enforceable, which means that the employees cannot bring court action against the employers to fulfill them. The article focuses on the obligations that are enforceable and explains how the employers may legally resign from fulfilling them. The article takes into consideration the standard methods of resignation as well as those introduced by the anti-crisis regulations.

Jedynym z rozwiązań, jakie wprowadza tarcza antykryzysowa w celu ochrony interesu pracodawcy w warunkach epidemii koronawirusa i wywołanego nią kryzysu ekonomicznego, jest możliwość zawieszenia obowiązku tworzenia i funkcjonowania zakładowego funduszu świadczeń socjalnych oraz obowiązku wypłaty świadczenia urlopowego. Możliwość taka została wprowadzona art. 15ge tarczy antykryzysowej. Celem artykułu jest dokonanie pogłębionej i krytycznej analizy tej regulacji. Jest to bowiem regulacja bardzo szczególna, a niektóre jej aspekty budzą poważne teoretyczne i praktyczne zastrzeżenia.
One of the solutions introduced by the anti-crisis shield to protect the interests of the employer in the conditions of the coronavirus epidemic and the economic crisis it causes is the possibility of suspending the obligation to establish and operate the company's social benefits fund and the obligation to pay holiday benefits. Such a possibility was introduced in art. 15ge of the anti-crisis shield. The purpose of this article is to make an in-depth and critical analysis of these provisions. It is a very specific regulation, and some of its aspects raise serious theoretical and practical reservation.

Relacje między podatkami i składkami, zarówno na poziomie prawa krajowego, jak i prawa europejskiego, są niedookreślone, co powoduje m.in. problemy związane z koordynacją świadczeń społecznych w ramach UE, a w konsekwencji – ograniczenie unijnej swobody przemieszczania się osób. Istnieje więc rosnąca potrzeba wprowadzenia – wspartych wskazaniami z badań i opiniami ekspertów – zmian w przepisach UE określających obszar koordynacji z uwzględnieniem świadczeń podatkowych. W treści przedstawiono wybrane wyniki prac europejskiej sieci niezależnych ekspertów (projekt FreSsco) dotyczące definiowania i relacji między składkami i podatkami. Odniesiono się do występujących w prawie krajowym państw europejskich podatków celowych i podatków naznaczonych społecznie. Wskazano na relacje między tzw. świadczeniami podatkowymi a świadczeniami społecznymi, na rozwiązania w prawie unijnym ukierunkowane na gwarancje bezpieczeństwa socjalnego obywateli UE korzystających ze swobody przemieszczania się, w tym na wybrane przykłady orzecznictwa sądów krajowych i TSUE.
The relations between taxes and premiums or contributions, at the national and European law level, are not precisely determined, which translates into problems related to, inter alia, the coordination of social benefits within the EU and, consequently, limitations in the freedom of movement of persons otherwise declared by/within the EU. Hence, the growing need to introduce modifications in the EU legislation, with support of research-based guidelines and expert opinions, determining the area of such coordination, tax considerations included. The study discusses selected outcome of the efforts of the European network of independent experts (the FreSsco project) which addressed the defining of, and the relations between, contributions/premiums and taxes. The specific targets were the exceptional taxes and ‘socially marked’ taxes. The relations between so-called tax considerations and social benefits have been singled out, along with the EU-law solutions focused on ensuring social security to EU citizens enjoying the freedom of movement––including selected examples of judicial decisions the national courts and the ECJ.

If they suffer privation, which means that they are unable to meet their basic needs on their own, parents are entitled to claim maintenance from their children. On the other hand, the difficult life situation caused by privation, linked with lack of self-sufficiency, is one of the reasons to claim social welfare benefits. Therefore, the same circumstances constitute the basis for financial support from both the family and the public social system. Because the laws do not explicitly define the order in which maintenance ought to be paid, this study attempts to establish the relation between the family’s and the State’s financial obligations. Based on the legal-dogmatic and analytical methods, this article presents: the essence of the right to maintenance and its forms in the Polish Social Welfare Act, the duties of the administrative bodies in bringing actions for maintenance, the consequences of failure in fulfilling maintenance obligations and of unjustified relinquishment of maintenance claims from family members. In the conclusion, the authors stress the primacy of family obligations over the State’s ones, and formulate recommendations for social welfare authorities as regards enforcing the fulfilment of family financial obligations.

The paper presents changes in the solutions of unemployment benefit, introduced in Poland in the years 1990-2013. The author has also undertaken an attempt at determining the influence of these changes on the realization of the income and motivation function of this allowance. As it results from the analysis carried out, in the study period a gradual tightening of the conditions of qualification for the benefit as well as principles for granting the allowance were observed. Consecutive legal regulations led to a limitation in the income function of the benefit and an increase in its motivation function.

The objective of this article is to present the regulation of providing the functionaries of the Internal Security Agency with the pension and sickness benefit in the light of the right to social security guaranteed by the Constitution. For the past few years, Poland has undergone profound changes with regard to the system of social insurance, which primarily has affected the insurance side of the country’s system. The decision as to the actual changes stems from the demographic challenges which determine the economic efficiency of the system. Considering the issue of social justice, the legislator has taken specific legislative actions which result in diametrical changes with reference to normalizing the right to pension for functionaries of the Uniformed Services, inclusive of the Internal Security Agency. Legislative work is being carried out with regard to changes in remuneration rules during the functionaries’ incapacity for work. The author of this article takes into account the constitutional conditionings of the aforementioned modifications in the insurance system.

Opis:
Efficient infrastructure is a prerequisite of, and critical to, development. Only some projects generate a positive rate of return, but all of them should generate positive non-economic impacts and contribute social gains. Social impact is considered as a consequence or effect of decisions or interventions which lead to development. It can also be considered as a social consequence of development. The main problem of social costs and benefits is that the impact is difficult to predict and quantify and can be taken into account differently by authorities, decision makers and project developers. The main purpose of the paper is to identify and demonstrate a concept of the social impact of infrastructure projects. The principal methods used are a review of existing social science literature and surveys based on focus group interviews, devoted stakeholders of infrastructure projects, and their involvement at different stages of the project. The expected result is a set of outputs and outcomes which demonstrates social impacts (costs and benefits) related to stakeholders’ groups of the analyzed project.

The aim of the paper is to analyse controversial situations in the Polish judicial practice relating to performing incidental paid activities in times of sick leave, both by the insured – employees and persons not being employees, especially entrepreneurs. According to the Author’s opinion only social activities or incidental and mainly formal occupational activities can be qualified as the exceptions from the rule of the loss of the right to sickness benefit. Such view is justified by the public character and formality of the system of social security. Situations resulting in a possible loss of sickness benefit should be assessed each time in the context of the principle of proportionality.

The article analyzes the provisions of law and jurisprudence in the aspect of the possibility for the beneficiary to choose a nursing benefit when a special care allowance has already been granted by an earlier decision. The main objective of the article is to indicate the interpretation of the provision used in the previous practice by the authorities and the current problems presented in the jurisprudence of administrative courts that affect the statutory right of a party to choose a benefit. In the author’s opinion, the legislator does not take into account the changing economic and social situation in the adopted legal solutions, which is controversial in practice. The lack of legislative initiative in this regard leaves the judicature with the problem of non-compliance with the provisions. Administrative courts are forced to correct structural imperfections of the social security system in terms of support for carers of people with disabilities, which should not take place in a democratic state, as it is the sole role of the legislator.

The purpose of the article is to demonstrate the significance of the activity run by philanthropic organizations in Poland for the benefit of society and the economy in the light of the social welfare of governmental organizations. Verification of hypotheses was conducted using different research methods: regression analysis, hierarchical cluster analysis, trend analysis, and comparative analysis. The results did not demonstrate a significant relationship between local governments’ expenditures on grants for philanthropic organizations fulfilling tasks on social welfare and local GDP. Despite the fact that the level of expenditure of public entities on social welfare goes up with the growth of the number of PBOs, as do their costs and revenues, the figures do not depend on each other.
