    W artykule przedstawiono analizę esejów Nicoli Chiaromonte w perspektywie teorii skopos. Tłumaczenie tekstu powinno uwzględniać kontekst kulturowy, aksjologiczny, potrzeby odbiorcy. Włoski myśliciel poprzez swoje eseje prowadzi dialog z odbiorcą. W Polsce taką rozmowę rozpoczął Wojciech Karpiński. Inkulturacja zapisków włoskiego aktywisty oddaje jego sposób pojmowania świata, siebie, drugiego człowieka. Pozwalają one na nowo odkryć bogactwo starożytnej, filozoficznej, artystycznej spuścizny, odnaleźć rzeczywistość otaczającą język, którą wyrazi na nowo wartość człowieka.
    The article discusses the essays by Nicola Chiaromonte analyzed from the perspective of the skopos theory. According to this theory, translator of any text should take into consideration the cultural context of work he renders in another language, its axiological aspect as well as requirements of its recipients. The dialogue Chiaromonte had with his Italian readers has been transferred into Polish literary discourse by Wojciech Karpiński. The translations he produced provide their Polish recipients with such a vision of the Italian author, his way of understanding the world, oneself and other people, that the essays in Polish clearly reveal a new usage and intellectual potential of ancient philosophical and artistic legacy.

    Opis:
    Unter vielen Aspekten scheint sich die Rechtsübersetzung besonders gut zur Anwendung der Prinzipien der funktionalistischen Translationsansätze, besonders der Skopos-Theorie von J.H. Vermeer, zu eignen. Jedenfalls könnte sich eine konsequente Durchsetzung des Prinzips der kulturellen Einbettung als unangebracht, sogar als irreführend erweisen, da sie zu Störungen in der durch die Translationshandlung stattfindenden Rechtskommunikation führen kann. In einigen Rechtsgeschäften, wie z.B. in Verträgen, an denen Vertragsparteien aus verschiedenen Staaten beteiligt sind, wird nur ein Rechtssystem als Kommunikationsrahmen definiert (das sog. maßgebende bzw. anwendbare Recht). In solchen Fällen kann man das Prinzip der kulturellen Einbettung nur mit Bezug auf die linguistischen Aspekte des Textes anwenden, in weiterem Ausmaß, d.h. was die Kultur- bzw. Rechtsgrundlage des Textes betrifft, haben aber der Ausgangs- und der Zieltext den selben Referenzrahmen.
    Tłumaczenie prawne w wielu aspektach wydaje się być odpowiednim polem dla zastosowania zasad funkcjonalistycznego podejścia do przekładu, szczególnie zasad teorii skoposu J.H. Vermeera. Mimo to, można także zastanowić się, na ile do tych tekstów odnieść można ujęcie kulturowe, oraz w jakim stopniu może ono wpłynąć (pozytywnie czy negatywnie) na przekład komunikacji prawnej. W niektórych transakcjach prawnych, takich jak umowy międzynarodowe czy tam, gdzie w grę wchodzą podmioty zagraniczne jako strony, tylko jeden system prawny stanowi obudowę komunikacyjną. W takiej sytuacji należy z ostrożnością uwzględniać właściwe założenia podejścia kulturowego tak, by teksty wejściowy i wyjściowy posiadały taką samą ramę referencyjną. 
    In many aspects, legal translation seems to be an adequate domain for applying the principles of the functionalist approaches to translation, especially the skopos-theory by J. H. Vermeer. Nevertheless, an indiscriminate application of the principle of cultural embeddedness could prove questionable, if not misleading, as it may cause disturbance in the legal communication occurring through the translation act. In some legal transactions, such as e.g. international contracts, involving contracting parties belonging to different nations, only one legal system is adopted as the communication framework (i.e. the governing or applicable law). In such cases, the functionalist principle of cultural embeddedness needs to be applied selectively, i.e. only with respect to some linguistic features of the text, while in a broader sense, as far as the cultural and/or legal foundations of the text are concerned, the source and the target text will have the same reference frame.
