The opinion deals with the enhanced cooperation in the area of a unitary patent protection system in the European Union, particularly the establishing of a Unified Patent Court. The author examines the consequences of Poland’s participation and non-participation in this agreement in the context of the situation of natural and legal persons. He claims that the implementation of a unitary patent protection may raise doubts as to the compliance of this agreement with the Constitution of the Republic of Poland in relation to resolution of disputes over infringements of patent rights. He also stresses that, currently, Polish citizens may apply for patent protection from the European Patent Office.

The opinion is focused on the comparison of the existing model of patent protection resulting from Poland’s accession to the European Patent Convention with the an enhanced cooperation requirements in the area of a unitary patent protection system in the European Union, in relation to a Unified Patent Court. The issue of the commercialization of patents, as an exemplification of the industrial property, is mostly considered at the microeconomic level. Patent commercialization belongs to the innovation management process, which takes place in innovative organizations. Such microeconomic research approach does not take into account the phenomenon of the intellectual property simultaneous spread and use of scientific and technical knowledge in the economy. These observations lead to undertaking research on the commercial use of patents in the economy. The aim of this paper is to present the research results of the patent licensing as one of the forms of commercialization in the selected European countries in the long time period. The main purpose of undertaken research was to identify and measure the patent licensing dynamics, which is part of the one of the major research related to identify and structure recognition of patents commercialization stream. To achieve this purpose, the collection of patent metadata for the member states of the European Patent Office was used, as well as the author’s own concordance IPC→NACE table. As a result of the research, some of the European countries were identified as leading, in terms of the number of licensed patents, the dynamics spread of patent property in the European economy that was set, and the branches were established, in which the emerging new industrial solutions are the subject of commercialization with the use of license contracts.

Recent empirical research has provided compelling evidence that the proliferation of intellectual property rights (IP) and the fragmentation of patent rights among different patent holders have created barriers to innovation and impediments to the commercialization of scientific discoveries. Legal and economic scholars have suggested that due to the rising number of patent applications, the limited resources in patent offices around the world and the lack of sufficient time to prior art search, examiners have failed to conduct thorough patent examination processes. Moreover, researchers have linked the growing number of overlapping intellectual property rights to the tragedy of the anticommons and to the concept of patent thickets. Multiple studies have been performed in order to develop measures that could verify the existence of patent thickets and to better understand the social and economic impact of fragmentary patent owners. When it comes to the energy sector, the problem of patent thickets is now even more important. As the technological innovation in this sector increases and the energy-related patenting continues to grow, it has been argued that the issue of patent thickets may have a direct impact on investment decisions and the long-run development of this sector. This paper presents an overview of literature on the definition of a patent thicket and summarizes some of the possible factors causing thickets to arise. Additionally, it discusses the recent developments in patent thicket measures and patent thicket identification methods.
Wyniki prowadzonych w ostatnim czasie badań empirycznych wskazują, że rozprzestrzenianie praw własności intelektualnej (Intellectual Property – IP) oraz fragmentacja praw patentowych wśród różnych posiadaczy patentów stwarzają bariery dla innowacji oraz powodują utrudnienia w komercjalizacji odkryć naukowych. Prawnicy i ekonomiści zasugerowali, że ze względu na rosnącą liczbę zgłoszeń patentowych, ograniczone zasoby w urzędach patentowych na całym świecie oraz brak wystarczającego czasu na uzupełnienie aktualnego stanu wiedzy w danej dziedzinie, osoby odpowiedzialne za ich weryfikację nie były w stanie przeprowadzić szczegółowych badań patentowych. Ponadto wyniki przeprowadzonych badań wskazują na powiązanie rosnącej liczby nakładających się praw własności intelektualnej do tzw. tragedii prywatnego zawłaszczenia i koncepcji chaszczy patentowych. Przeprowadzono wiele badań w celu opracowania narzędzi i miar, które mogłyby zweryfikować występowanie chaszczy patentowych oraz lepiej zrozumieć społeczny i ekonomiczny wpływ właścicieli fragmentarycznych praw patentowych. Problem chaszczy patentowych jest istotny dla sektora energetycznego, ponieważ staje się on coraz bardziej innowacyjny. W konsekwencji kwestia chaszczy patentowych może w znacznym stopniu wpłynąć na jego długoterminowy rozwój. Niniejszy artykuł przedstawia przegląd literatury dotyczącej pojęcia chaszczy patentowych oraz omawia wybrane czynniki powodujące wzrost udziału chaszczy patentowych. Ponadto w artykule omówiono najnowsze osiągnięcia w odniesieniu do mierników chaszczy patentowych oraz metod ich identyfikacji.

W artykule przedstawiono procedurę udzielania ochrony patentowej w kontekście polskich przepisów z uwzględnieniem wykorzystania sztucznej inteligencji. Prawo patentowe jest jedną z głównych dziedzin prawa własności przemysłowej i definiowane jako zespół norm prawnych regulujących stosunki związane z ochroną patentową, dotyczącą innowacji technicznych, w tym w szczególności wynalazków. Kształtowanie ochrony patentowej ma swoje bezpośrednie przełożenie na rozwój gospodarki oraz dobrobytu w kraju. Podnoszenie świadomości wśród społeczeństwa w tym zakresie przysparza wymierne korzyści dla państwa. Usprawnienie tej procedury poprzez udział sztucznej inteligencji w zakresie przede wszystkim analizy dokumentacji zgłoszeniowej zasadniczo skróci czas oczekiwania na rozstrzygnięcie sprawy, a tym samym zwiększy liczbę składanych zgłoszeń na wynalazki.
The article describes the Polish procedure for the grant of a patent involving the use of artificial intelligence. Patent law is one of the main areas of industrial property law and is defined as a set of legal provisions regulating patent protection and concerning new technologies, especially inventions. The type of patent protection a country has impacts on its economic growth and prosperity. Raising social awareness in this area brings a substantial return for the state. The enhancement of this procedure by applying artificial intelligence especially for data processing should shorten the waiting time for the settlement of applications for a patent, and encourage more inventors to submit an application for a patent.

The purpose of the paper is to present the Patent Box, a tax instrument for creating innovative potential which is becoming increasingly popular in EU economies, and to analyze what impact a Patent Box can have on the level of innovation of a country’s economy. To achieve this objective, two research methods are used: critical analysis of the literature and quantitative research. The literature studies involved presenting the operation mechanism of Patent Boxes and justifying (based on the theory of economics) the usage of such instruments in creating the innovation potential of an economy. The quantitative research consisted in analyzing the relationship between Patent Box instruments possessed by individual EU countries within their tax systems in the years 2011–2015 and the level of innovation in these countries expressed as outcome indicators based on the number of patents. The conducted analysis allowed the author to validate the hypothesis that the Patent Box has an effect on the level of innovation in EU countries. In Polish scientific literature there are relatively few publications addressing the issue of the operating mechanisms of the Patent Box or the economic effects resulting from the application of this kind of innovative tax policy tool. Considering the importance of innovation in making economic growth processes more dynamic, there is a need to undertake further research in this scope. The conducted research facilitates exploration of both the theoretical and empirical knowledge of the issue. Its conclusions might also prove useful in the scientific debate concerning the support provided by the state to the private sector in Poland in their efforts to embark on innovative activities.

This paper presents legal regulations aimed to create unitary patent protection envisaged in Regulation (EU) No 12572012 of the European Parliament and of the Council implementing enhanced cooperation in the area of the creation of unitary patent protection, and Council Regulation (EU) No 1260 2012 implementing enhanced cooperation in the area of the creation of unitary patent protection with regard to the applicable translation arrangements. Since both regulations are closely connected with the Agreement on a Unified Patent Court, the latter will also be discussed. After a brief presentation of the current state of affairs in individual EU Member States regarding patent protection under European patents and national patents regulations, the legal construct of a European patent with unitary effect adopted in Regulation No 1257 2012 is analysed, with subsequent analysis of the content of the rights conferred by to European patents with unitary effect (i.e. the right to prevent the direct use of the invention and the right to prevent the indirect use of the invention). The last part of the analysis covers limitations of the effects of a patent. It is emphasised that the provisions regulating both the content of the patent and its limitations will not only apply to European patents with unitary effect, but will extend to include the ‘classical’ European patents as well. A critical opinion of the three legal acts is formulated. It is argued that once Poland ratifies the Agreement on a Unified Patent Court, European patents with unitary effect will come into force in Poland, and this will result in highly undesirable legal and economic consequences, and be particularly disadvantageous for small and medium-sized enterprises. Further, handing over jurisdiction over patent-related matters to the Unified Patent Court will also bring negative consequences and, what is more, there are serious reasons to believe that doing so would be contrary to Poland’s Constitution.
Celem artykułu jest przedstawienie regulacji prawnych zmierzających do utworzenia jednolitej ochrony patentowej, przewidzianych w rozporządzeniu Rady i Parlamentu Europejskiego nr 1257/2012 wprowadzającym wzmocnioną współpracę w dziedzinie tworzenia jednolitego systemu ochrony patentowej oraz w rozporządzeniu Rady nr 1260/2012 wprowadzającym wzmocnioną współpracę w dziedzinie tworzenia jednolitego systemu ochrony patentowej w odniesieniu do mających zastosowanie ustaleń dotyczących tłumaczeń. Ze względu na ścisłe powiązanie obu rozporządzeń z umową międzynarodową mającą utworzyć nowy system rozstrzygania sporów patentowych analizie została poddana również wspomniana umowa międzynarodowa, tj. Porozumienie w sprawie Jednolitego Sądu Patentowego. Po zwięzłym przedstawieniu obecnego stanu ochrony patentowej w państwach członkowskich Unii Europejskiej, wynikającej z patentów europejskich i patentów krajowych, autorka analizuje 1) konstrukcję prawną patentu europejskiego o jednolitym skutku, przyjętą w rozporządzeniu nr 1257/2012; 2) treść praw przyznanych patentem europejskim o jednolitym skutku, na którą składają się: prawo zakazania bezpośredniego korzystania z wynalazku oraz prawo zakazania pośredniego korzystania z wynalazku. Ostatnia część tej analizy obejmuje ograniczenia skutków patentu. Jak podkreśla autorka, przepisy regulujące treść patentu i jego ograniczenia dotyczyć będą nie tylko patentów europejskich o jednolitym skutku, lecz także „klasycznych” patentów europejskich. Autorka formułuje krytyczną ocenę wymienionych aktów prawnych. Jeśli Polska ratyfikuje Porozumienie o Jednolitym Sądzie Patentowym, patenty europejskie o jednolitym skutku będą obowiązywać w naszym kraju, co będzie miało wysoce niekorzystne konsekwencje prawne i gospodarcze, zwłaszcza dla małych i średnich przedsiębiorstw. Wysoce negatywne konsekwencje wynikać będą również z faktu przekazania przez Polskę jurysdykcji w sprawach patentowych na rzecz sądu międzynarodowego, którym będzie Jednolity Sąd Patentowy. Dopuszczalność przekazania kompetencji w tej dziedzinie budzi poważne zastrzeżenia co do zgodności z Konstytucją Rzeczypospolitej Polskiej.

Due to the fact that clusters should implement the idea of an open innovation model, the paper focuses on the role of Lower Silesian clusters in promoting knowledge flow between enterprises and other network participants, which are measured by the numbers of joint inventions and patent citations. On the basis of the analysis of national and international patent applications, it has been found that few inventions of enterprises are created in cooperation with other cluster members as well as that enterprises refer to the knowledge of other cluster members in their patent descriptions to a limited extent, which in general does not support the thesis that cluster membership contributes to the intensification of knowledge-diffusion processes.

The article presents the specificity and the content of patent literature. It describes the structure of the patent documentation, possibilities of access to the scientific and technical, legal and economics information which that literature contains, and possibilities of using this information. Koncepcja wspólnej ochrony patentów w Unii Europejskiej ma już dosyć długą historię sięgającą lat sześćdziesiątych XX wieku. W grudniu 2012 roku Parlament Europejski przyjął dwa rozporządzenia, które umożliwią wdrożenie jednolitego patentu w 25 państwach Unii Europejskiej, w tym w Polsce. Celem wprowadzenia w życie tych regulacji jest szybsza procedura wydawania patentu. Polegałaby ona na złożeniu wniosku w jednym z trzech języków Europejskiego Urzędu Patentowego, tj.: w angielskim, francuskim lub niemieckim przez wynalazcę do Europejskiego Urzędu Patentowego, a następnie otrzymaniu dokumentu, który obowiązywałby we wszystkich krajach, jakie przystąpiły do konwencji. Jednak okazuje się, że wdrożenie tego systemu w Polsce nie jest tak jednoznacznie pozytywne i spowoduje bardzo wiele zagrożeń, a zwłaszcza kosztów, które mogą stanowić znaczne obciążenie przede wszystkim dla małych przedsiębiorstw.
The concept of a common patent protection in the European Union has already had quite a long history dating back to the 1960s. In December 2012, the European Parliament adopted two regulations that will enable the implementation of the common patent in 25 European Union countries, including Poland. These regulations were introduced so as to streamline the procedures for obtaining patents. They would consist in submitting an application, written in one of the three languages of the European Patent Office, i.e. English, French or German by the inventor of the European Patent Office, and then receiving a document which would be valid in all the countries that have acceded to the Convention. Apparently, however, the implementation of this system in Poland is not unambiguously positive and will create many risks, particularly costs which may be a burden felt especially by small enterprises.

Tematem coraz częściej poruszanym w literaturze ekonomicznej są innowacje. Wiele opracowań dotyczy ich opisu czy zwrócenia uwagi na ich rolę we współczesnych gospodarkach. W pracy podjęto próbę wyodrębnienia poszczególnych grup państw w Europie z punktu widzenia aktywności patentowej. Podział dokonany został z wykorzystaniem metod statystycznych - w tym głównie funkcji dyskryminacyjnej. Przedstawiona analiza pozwala charakteryzować poszczególnych uczestników oraz zwrócić uwagę na różnice w prowadzonej polityce innowacyjnej w różnych państwach.
The subject, which is more and more frequently discussed in economic literature, is innovation. A lot of elaborations refer to its description and importance in modem economies. In this paper an attempt is made to separate particular country groups in Europe on the basis of patent activity. The division has been made with the usage of statistical methods - mainly discriminant function. The analysis presented in the paper allows characterizing particular participants and drawing one’s attention to the differences in innovative policy conducted in different countries.

Istota wyczerpania prawa z patentu polega na tym, że dalsze korzystanie z przedmiotów ucieleśniających rozwiązanie chronione patentem pozostaje poza kontrolą uprawnionego z patentu. Wyczerpanie będzie miało co do zasady zastosowanie tylko do tych konkretnych egzemplarzy, które zostały już przez uprawnionego wyprodukowane i wprowadzone do obrotu. Kontrowersyjna pozostaje jednak kwestia zakresu dozwolonych działań nabywcy w ramach używania przedmiotu wytworzonego według patentu, a niestanowiących naruszenia praw z patentu. W dobie cyfryzacji szczególnej wagi nabiera pytanie, w jaki sposób należy traktować reprodukcję wprowadzonych na rynek i chronionych patentami na sposób produktów oraz w jakim zakresie działanie takie może korzystać z instytucji wyczerpania. Kwestią o zasadniczym znaczeniu, na którą próbował odpowiedzieć niemiecki Sąd Najwyższy (BGH) w wyroku w sprawie MPEG-2 Videosignalcodierung, jest to, czy i na jakich warunkach niematerialne przedmioty mogą stanowić bezpośrednie produkty sposobu wytwarzania. BGH uznał, że sekwencja danych przedstawiająca obrazy wideo może być uznana za bezpośredni produkt wytworzony według patentu na sposób w rozumieniu niemieckiej ustawy patentowej. W związku z tym będzie ona korzystać z pośredniej ochrony patentowej, która obejmie również nośnik danych, na którym dane wytworzone zgodnie z opatentowanym sposobem zostały utrwalone. Dodatkowo rozciągnie się na nią również efekt wyczerpania.
The essence of patent right exhaustion lies in depriving the patent holder of control over further use of objects embodying the patented solution. Exhaustion will, fundamentally, apply only to those specific objects which have already been produced and marketed by the rightholder. It remains however controversial which actions of the purchaser conducted within the scope of use of product obtained by the patented process would be found legitimate and would not constitute patent infringement. In days of digitization, the possibility of reproduction of previously marketed and protected by patented processes products and exhaustion thereof seemto be a fundamental question. A key issue that the German Supreme Court tried to respond to in MPEG-2 Videosignalcodierung case was whether or not, and on what terms, intangible products may constitute direct products obtained by the patented method. The court assumed that a data sequence representing video images might be considered as a direct product obtained by the patented method in the light of the German Patent Act. Therefore, it will fall within indirect patent protection together with a data carrier on which data generated in accordance with the patented method has been recorded. They will also undergo anex haustion effect.
