    Local governments in the Western Balkan countries are dependent on central governments’ transfers, with low fiscal autonomy and limited efforts for own-source revenue mobilisation. The paper identifies that besides central government transfers, other significant factors in determining municipal own-source revenues include central and local public investment, current expenditures, human development index, and population density. Municipal own-source revenue is adversely affected by intergovernmental transfers, implying their de-incentivising effect in collecting local revenues. Local capital expenditure is a significant and strong determinant with a higher strength than central government investments, suggesting their importance for local fiscal autonomy. The human development index as a composite measure, unlike GDP per capita, positively affects the municipal fiscal autonomy.

    The aim of the research was to establish the most important economic and administrative factors that had shaped the possibility of using available sources of financing of public investment projects. The analysis was concentrated on attempts to identify and asses the process of regulating general value of public investment at the municipal level. Significant difficulties in maintaining a stable level of financing for the development tasks were rooted mainly in changes in economic conditions, particularly the financial crisis, and from changes in the aces and scope of the EU funds during the programming period 2007–2013.

    Opis:
    The experience of systemic transformation in Poland and the progressing socio-economic development prove that the importance of organizational units classified conventionally as a part of the public sector has increased significantly. It turned out that during rapid economic and social changes, the development of technical and social infrastructure became one of the drivers of development. In the conditions of the market economy in Poland, two important areas related to the functioning of the public sector have come to the fore: quantification of objectives and tasks necessary for the proper functioning of the state and society and ensuring efficient sources of financing these tasks. In this paper the aim of the research was to analyse and assess the financial situation of municipal territorial self-government units in Poland in 2007–2015. The research results clearly indicate the existence of differences in the level of budget revenues between differentiated territorial self-government units in the years 2007–2015. In that time the budget revenues of communes increased and significant positive changes in the budgetary situation of municipal local government units took place, in almost all regions these incomes doubled. This increase was accompanied by persistence of disproportions between less developed regions and regions that were economically and socially developing faster. In the discussed period, we had to deal with the improvement of the income situation of the budgets of local government units, with the simultaneous increase in the differences in the level of income with all the consequences associated with this for future development.

    Sektor samorządowy jest w wielu krajach istotnym inwestorem publicznym. W Polsce udział wydatków inwestycyjnych tego sektora w wydatkach publicznych stanowi ponad 50%. Porównując wydatki inwestycyjne samorządu terytorialnego w Polsce z pozostałymi krajami OECD można stwierdzić, że są one jedne z najwyższych. Celem artykułu jest przedstawienie wielkości oraz kierunków inwestycji sektora samorządowego w Polsce na tle krajów OECD w latach 2007—2013 oraz ich znaczenia w kreowaniu aktywności gospodarczej.
    In many countries, the local government sector is an important public investor. In Poland, the share of investment outlays of this sector in public expenses constitutes more than 50%. Comparing the investment expenditure of the local government in Poland with other OECD countries, it can be inferred that the Polish rates are among the highest ones. This article aims at presenting the investment size and direction of the local government sector in Poland compared to the OECD countries in 2007—2013 and their importance in the creation of economic activity.
    Сектор местных органов власти во многих странах является важным общественным инвестором. В Польше доля инвестиционных расходов этого сектора в государственных расходах составляет выше 50%. Сопоставление инвестиционных расходов местного самоуправления в Польше с остальными странами ОЭСР показывает, что они являются одними из самых высоких. Целью статьи было представление размера и направлений в области капиталовложений сектора местного самоуправления в Польше на фоне стран ОЭСР в 2007—2013 гг, а также представление значения в создании экономической активности.

    Przedmiotem opracowania jest analiza determinant wpływających na konkurencję fiskalną w kontekście poprawy dobrobytu społeczności lokalnej oraz atrakcyjności inwestycyjnej. Zależność między terytorialną alokacją dobrobytu społecznego oraz wykorzystaniem instrumentów fiskalnych wymaga rozważenia trzech kwestii. Po pierwsze, niezbędne stanie się ustalenie społecznych i gospodarczych czynników skłaniających władze lokalne do konkurencji fiskalnej oraz weryfikacja kryteriów politycznych i uwarunkowań prawnych zdolności władz lokalnych do konkurencji. Po drugie, konieczna jest ocena wydatków samorządów jako zmiennej polityki władz lokalnych biorących udział w konkurencji fiskalnej. Po trzecie, działania władz lokalnych w konfrontacji z decyzjami władz centralnych w wymiarze ekonomicznym wymagają ustalenia zarówno założeń, jak i narzędzi służących efektywności wydatków publicznych.
    The paper analyses the determinants of fiscal competition, and their impact on the attractiveness of investment. The crucial problem is the influence of local public expenditures (as instrument for fiscal competition) and private investment on territorial allocation of welfare. The interdependence between providing local public goods and the efficiency of fiscal competition influences the discussion of three issues. The first one, it is crucial to indicate both socio-economic and political as well as legal criteria of fiscal competition. The paper distinguish a propensity of local governments to compete form a capacity for compete. The propensity to fiscal competition depends on attributes of local society and local economy. Legal regulations provided by central government as well as political frameworks determine the capacity of local governments to compete. The second issue takes into consideration evaluation of local expenditures as means of fiscal competition. The last one comes from local government spending, in details the measurement of its efficiency.

    The role of repayable sources in financing local governments’ expenditure in rural areas in Poland was examined. The analyses showed that during years 2005-2009 the expenditure of local governments in rural areas was rising. An especially high increase was observed in 2009. The shares of the investment expenditure in total expenditure were at 20% for 2005-2008 but in 2009 it rose noticeably. The local governments use credits, loans and municipal bonds for financing expenditure. Except for 2009, the ‘new’ credits and loans financed mainly repayment of ‘old credits’, only in 2009 less than 50% of ‘new credits’ value was used for repaying old debts. The debt of local governments in rural areas rose quickly but in examined years the payments of interest were not a problem and took less than 1% of budget incomes. In the future, it can change because of the expected increase of debts and, moreover, the interest rates could rise noticeably.

    Celem artykułu jest wykazanie pogwałcenia konstytucyjnej zasady adekwatności środków finansowych w stosunku do nałożonych na jednostki samorządu terytorialnego w Polsce zadań. Poruszonym w artykule problemem badawczym jest poziom decentralizacji finansów publicznych w kontekście aktywności inwestycyjnej JST i ich poziomu zadłużenia w latach 2007–2016. Wywód podzielono na pięć części, tj. analizę literaturową dotyczącą adekwatności dochodowej JST w Polsce, metodologię badania; studium przypadku województwa małopolskiego, w tym analizę danych statystycznych dotyczących wydatków majątkowych i zadłużenia samorządów oraz wnioski. Analiza studium przypadku pozwoliła zaobserwować większą aktywność inwestycyjną samorządów gminnych aniżeli powiatowych. Ponadto zauważono istotne dysproporcje dotyczące zadłużenia pomiędzy gminami miejskimi i wiejskimi o tej samej nazwie oraz pomiędzy samorządem gminnym i powiatowym. Zasadniczym wnioskiem zawartym w artykule jest konieczność reformy organizacji terytorialnej kraju; bardziej efektywnego podziału dochodów i kompetencji pomiędzy jednostki samorządu terytorialnego oraz decentralizacji finansów publicznych w Polsce.
    The aim of the article is to show off the lack of adequacy of financial resources in relation to the tasks imposed on local self-government units (LGU) in Poland. The scientific problem discussed in the article is the level of decentralization of public finances in the context of local government units investment activity and the level of their indebtedness in 2006–2016. The study was divided into five parts, i.e. literature analysis on LGU income sources, metodology, case study of the Malopolskie Voivodship, including statistical analysis of property expenditure and local government debt and conclusions. Analysis of the case study allowed to observe higher investment activity of municipalities and poviats. In addition, significant disproportions were noted regarding the debt between urban and rural municipalities with the same name and between the municipalities and poviats. The basic conclusion contained in the article is the necessity to reform the territorial organization of the country; more effective division of income and competences between local government units and further decentralization of public finances in Poland.

    There is a widespread and increasing interest in public-private partnership (PPP) in Poland as a mean of implementing public investment projects, resulting from the fact that the funds that are available to local governments, or EU funding, are not sufficient to meet all the investment needs. In the paper a comparative analysis of the size and structure of the public-private partnerships in the EU countries, with a particular focus on the Polish market is presented. Possibilities of investments based on public-private partnerships on rural areas are specified. The paper examines the recent trends in the PPP's market and describes how these changes and development may affect the infrastructural improvement on rural areas.

    Akcesja Polski do Unii Europejskiej dała możliwość korzystania z instrumentów polityki regionalnej. W wyniku alokacji środków unijnych zrealizowano wiele projektów infrastrukturalnych. Ich realizacja miała niewątpliwie wpływ na wynik finansowy oraz wielkość zadłużenia samorządów. Okres wysokich inwestycji to zapotrzebowania na zewnętrzne źródła finansowania, w tym środki dłużne współfinansujące projekty unijne. Wynikiem tych procesów był wykazany wzrost zadłużenia gmin i miast na prawach powiatu. Wielkość inwestycji oraz poziom zadłużenia poszczególnych jednostek były silnie zróżnicowane, tak pod względem ich charakteru, jak i lokalizacji.
    Poland’s accession to the European Union has enables the use of regional policy instruments. As a result of the allocation of EU funds, many infrastructure projects have been implemented. Their implementation has undoubtedly affected the financial results and amount of debt of local governments. The period of high investment means a demand for external sources of financing, including debt financing for co-funding of EU projects. The presented increase in indebtedness of municipalities and cities with county right has been a result of these processes. The size of the investment and the level of indebtedness of the individual units varied widely, both in terms of their character and location.

    Kościoły i inne związki wyznaniowe w Polsce mają zagwarantowane prawo do posiadania i zakładania cmentarzy, co stanowi jeden ze sposobów prowadzenia ich misji. Teren, na którym ma zostać założony cmentarz, zgodnie z przepisami dotyczącymi planowania i zagospodarowania przestrzennego, musi zostać przeznaczony na ten cel. Zakładanie cmentarzy, zgodnie z ustawą o gospodarce nieruchomościami stanowi cel publiczny. Przepisy prawa polskiego przewidują dwa sposoby lokalizacji inwestycji celu publicznego, mianowicie w drodze decyzji w sprawie lokalizacji inwestycji celu publicznego oraz w miejscowym planie zagospodarowania przestrzennego. Są to dwa zupełnie odmienne tryby, wydawane w drodze dwóch odmiennych procedur. W przypadku decyzji organ nie może odmówić jej wydania po spełnieniu przez wnioskodawcę określonych warunków, ani też uzależniać jej wydania od spełnienia warunków nieprzewidzianych przepisami prawa. Natomiast w procedurze uchwalania miejscowego planu zagospodarowania przestrzennego organ gminy, korzystając z tzw. władztwa planistycznego, ma większą swobodę w ustalaniu przeznaczenia terenu i rozmieszczaniu inwestycji. Choć lokalizacja cmentarzy w drodze decyzji w sprawie lokalizacji inwestycji celu publicznego jest niezgodna z ustawą o cmentarzach i chowaniu zmarłych, była trybem powszechnie stosowanym w praktyce wielu gmin. Pomimo braku legalności takiego postępowania, należy stwierdzić że jest ono nie tylko bardziej przychylne związkom wyznaniowym, ale stanowi pełniejszą gwarancję realizacji ich praw. Przedmiotem niniejszego opracowania jest ustalenie kwestii obligatoryjności miejscowego planu zagospodarowania przestrzennego dla lokalizacji cmentarzy wyznaniowych, ocena obowiązującego stanu prawnego w tym zakresie, oraz rozstrzygnięcie o dopuszczalności skargi na bezczynność organu w przedmiocie nieuchwalenia miejscowego planu zagospodarowania przestrzennego w sprawie lokalizacji cmentarza wyznaniowego.
    Churches and other religious organisations in Poland have the right to possess and establish religious cemeteries, which constitutes one of the methods of conducting their mission. Territory on which the cemetery is to be established, in accordance with the provisions on the spatial planning and land development, has to be intended for this purpose. Establishment of cemeteries, in accordance with the act of the real estate economy, is public purpose. Provisions of the Polish law provide two ways of investment location of the public purpose, namely by a decision on the location of the public purpose investment and in the local spatial management plan. These are completely different methods, conducted under two different procedures. In case of the decision, the authority cannot neither refuse to issue positive decision after satisfaction of certain terms and conditions by the applicant, nor make the decision dependent on fulfilment of the conditions, which are not provided by the law. In the procedure of adoption of the local spatial management plan on the other hand, commune authority, using the so called planning power, has greater freedom in designing areas and investments location. Though establishment of the cemeteries by issuing a decision on the location of the public purpose investment is not consistent with the act on cemeteries and burying the dead, it has been used in practice by a lot of authorities. Despite the lack of legality of this practice, it should be noted that it is not only more favourable to the religious organisations, but also constitutes a better guarantee of the implementation of their rights. The subject of this elaboration is the determination of the issue of the obligatory the local spatial management plan for location of religious cemeteries, evaluation of the current legal status in this area, and the settlement of the issue of the admissibility of the complaint on the inactivity of the authority in case of lack of adoption of local spatial management plan for religious cemetery.

    Opis:
    : The main aim of this paper is to present the relationship between public-private partnerships (PPPs) and the development of Central and Eastern European Countries’ (CEECs) regions in the context of investment attractiveness. Based on desk research – a case study of 90 PPP projects and a literature review – the paper explores the effects of PPP projects on the investment attractiveness of CEE regions. It provides a brief overview of the challenges facing CEECs due to the modest infrastructure with a high degree of wear or due to the high level of gross government debts at the level of local government units (LGUs). It also presents a synthetic summary of the institutional environment of the CEECs necessary to support the development of PPP projects as well as the necessary changes in PPP legislation to foster the regional development of CEE regions in the context of investment attractiveness. Moreover, LGUs in Poland do not take advantage of the synergy effect (to increase regional development) from adapting PPP projects to their regional development or innovation strategies.
    Głównym celem niniejszego artykułu jest zaprezentowanie związku pomiędzy partnerstwem publiczno- prywatnym (PPP) a rozwojem regionalnym Europy Środkowo-Wschodniej w kontekście potencjalnej atrakcyjności inwestycyjnej regionów Europy Środkowo-Wschodniej. Na podstawie badań desk research, studium przypadku n = 90 projektów PPP i przeglądu literatury przedmiotu zbadano wpływ projektów PPP na rozwój regionalny Europy Środkowo-Wschodniej w kontekście atrakcyjności inwestycyjnej tych regionów, które realizują projekty PPP. Ponadto dokonano przeglądu kluczowych wyzwań, jakie stoją przed państwami Europy Środkowo-Wschodniej, a są związane m.in. z niewystarczającym poziomem rozwoju infrastruktury, którą cechuje wysoki stopień zużycia czy wysoki poziom długu publicznego brutto, w szczególności na poziomie jednostek samorządu terytorialnego (JST). Artykuł przedstawia również syntetyczną charakterystykę ram instytucjonalnych, państw Europy Środkowej i Wschodniej, niezbędnych do wspierania rozwoju PPP oraz przedstawia propozycje koniecznych zmian regulacji w zakresie PPP, aby przyspieszyć rozwój regionalny Europy Środkowo-Wschodniej w kontekście atrakcyjności inwestycyjnej. Ponadto JST w Polsce nie wykorzystują efektu synergii (dla wzrostu rozwoju regionalnego) z dostosowania realizowanych projektów PPP do regionalnych strategii rozwoju czy innowacji.

    Opis:
    The aim of this article is to introduce non‑budgetary methods of financing public investments. The author bases her insights on professional experience from Poznań City Hall. In the first section the alternative forms of funding and implementation for public services are discussed. Next, the author presents the approach which was adopted by the city of Poznań regarding public‑private partnership projects. The examples of municipal investments implemented in Poznań within the public‑private partnership formula, such as Thermal Recycling Facility for Municipal Waste are given. The author also discusses legal basis, financial schemes and identifies challenges to such investments.

    Opis:
    Glosa dotyczy skutków prawnych zatwierdzenia planu generalnego lotniska użytku publicznego. Chodzi o konieczność zawieszenia postępowań w sprawie ustalenia warunków zabudowy dla inwestycji znajdującej się na obszarze objętym planem generalnym, do czasu uchwalenia miejscowego planu zagospodarowania przestrzennego zgodnego z planem generalnym. Aprobując stanowisko zawarte w wyroku Naczelnego Sądu Administracyjnego, w glosie przedstawiono także postulaty zmian w przepisach ustawy Prawo lotnicze dotyczących planów generalnych lotnisk, a także w powiązanych z nimi przepisach dotyczących powierzchni ograniczających przeszkody lotnicze. Argumentacja Autora opiera się na rozróżnieniu możliwych instrumentów prawnych, przewidzianych w przepisach prawa lotniczego, dla zabezpieczenia rozwoju infrastruktury lotniczej.
    The gloss discusses legal consequences of the approval of a general plan of a public airport.It concerns the necessity of suspending proceedings in the case of determining the conditionsof investment developments in the area covered by a general plan until the zoning schemeis adopted in accordance with this general plan. Approving of the stance expressed in thejudgement of the Supreme Administrative Court, the gloss also presents calls for amendmentsto the provisions of Act: Aviation Law concerning general plans of airports, as well as therelated provisions concerning areas limiting aviation obstacles. The author’s argumentsare based on the distinction between possible legal instruments laid down in aviation lawregulations in order to ensure the development of aviation infrastructure.
