The long-awaited act of June 10, 2016 on anti-terrorist measures introduced the institution of alert levels to the Polish legal system, i.e. universally applicable law. Unfortunately, in this act we come across the single-sounding phrase “alert levels” in two senses; sometimes as a set of 8 degrees referred to in the act, but sometimes also as 4 alert levels: Alpha, Bravo, Charlie, Delta. Moreover, in this act the abbreviation CRP (CRP alert levels) appears, which is not described anywhere. This article takes a closer look at the origins of today’s alert levels and presents the aforementioned identified issues: the semantic dualism of the term “alert levels” and the ambiguity of the “CRP” abbreviation. The author presents his proposed solutions to these problems in the summary.

Terrorism has become one of the major issues of international criminal law policy. A sudden change of public perception of terrorism has occurred since 9/11 attacks – from regional groups of fundamentalists, terrorists have become an international threat to worldwide security. This fact has profoundly influenced anti-terrorist policies – from responsive actions to rather preventive and forward-looking strategies. As the opposing values of national security and civil liberties render the criminal justice response to be so complex to introduce, this work underlines the significance of balance and proportionality in waging a war on terror. Moreover, an evaluation of legislative mechanisms introduced by the United Nations police makers as well as those adopted in Germany, Poland and Great Britain will be made. Lastly, the work outlines the most common impediments that befall the investigation and prosecution of terrorists. By taking the aforementioned aspects into consideration, it will be determined which fundamental features will most effectively ensure an adequate criminal justice response and preserve the civil liberties derived from the principle of a democratic state ruled by law.

Opis:
Service in a special unit of the Police is extremely tedious, both in physical and mental terms, with very high expectations for their policemen. It cannot arise only from official duties, but – above all – specific lifestyle, which should be the primary stimulus for taking them. It is confirmed by research conducted among policemen-antiterrorists, relating to their motivation in taking service in anti-terrorist subunit of the Police. Studies have also shown that such service is not fully in line with the expectations of the officers, and their priorities change over its course. A lot of factors have impact on it, negatively affecting the attitude of policemen, which were revealed in the study. The results can be used to create such conditions of service, which will reduce or eliminate loss of idealistic motives for taking service in the special unit of the Police.

Opis:
The Territorial Defense Force is of great interest to politicians, the media and public opinion. A great deal of misinformation and misconceptions have arisen about the subject related to the newly created type of the Polish Armed Forces. Therefore, the aim of the article is to familiarize the reader with the role, place and tasks of the Territorial Defense Force in the national system of combating terrorism based on the provisions of the law in force in Poland. The article attempts to determine the opportunities and threats under the provisions of the Act on Anti-Terrorism of June 10, 2016, and the Act amending the Act on the Universal Obligation to Defend the Republic of Poland and certain other acts of November 16, 2016, to the Territorial Defense Force and for the security of the country. Comparative analysis of the legal acts mentioned above seems necessary for a better understanding of the peculiarities of the operation of the Territorial Defense Force in the Polish legal system and the security system.
Wojska Obrony Terytorialnej są przedmiotem dużego zainteresowania polityków, mediów i opinii publicznej. Wokół tematyki związanej z nowopowstałym rodzajem Sił Zbrojnych RP narosło wiele niedomówień i błędnych przekonań. W związku z tym celem artykułu jest przybliżenie czytelnikowi roli, miejsca i zadań Wojsk Obrony Terytorialnej w krajowym systemie zwalczania terroryzmu w oparciu o zapisy obowiązującego w Polsce prawa. W artykule została podjęta próba określenia szans i zagrożeń, wynikających z zapisów Ustawy o działaniach antyterrorystycznych z dnia 10 czerwca 2016 r. oraz Ustawy o zmianie ustawy o powszechnym obowiązku obrony Rzeczypospolitej Polskiej oraz niektórych innych ustaw z dnia 16 listopada 2016 r. dla Wojsk Obrony Terytorialnej oraz dla bezpieczeństwa kraju. Komparatystyka ww. aktów prawnych, wydaje się niezbędna dla lepszego poznania specyfiki działania Wojsk Obrony Terytorialnej w polskim systemie prawnym oraz systemie bezpieczeństwa.

Francuski terroryzm przybiera formy różnych aktów przemocy, jakich dopuszczają się terroryści na terytorium kraju lub za granicą, wobec obywateli francuskich. Charakteryzuje się on specyfiką, która jest ściśle związana z historią oraz aktualną sytuacją polityczną w państwie. Terroryzm jako zjawisko, a zarazem forma broni dla wzrastającej liczby jego zwolenników, doprowadził do utworzenia konkretnego prawodawstwa oraz zestawu środków, do walki z jego negatywnym wpływem na funkcjonowanie społeczeństwa. Złożoność tego zjawiska wymaga intensyfikacji działań organów państwa, w celu zrozumienia go oraz określenia sposobów na przeciwdziałanie i zapobieganie jego wystąpienia w przyszłości. Ostatnie 10 lat na terenie Republiki Francuskiej wyraźnie ukazują, że służby bezpieczeństwa nie potrafiły sobie poradzić z narastającą ilością aktów terroru. Nowa ustawa antyterrorystyczna w Republice Francuskiej jest formą broni, której rząd może użyć w walce z zamachowcami. Jej utworzenie i zastosowanie jest przykładem dla innych państw europejskich, które w przyszłości mogą zaimplikować własne – podobne prawa. Istotą w ramach jej zastosowania będzie nieprzerwana kontrola, przy jednoczesnym poszanowaniu praw i wolności obywateli. Pierwsza ocena funkcjonowania założeń ustawy będzie miała miejsce w 2020 roku. Nowa prawo zwalczające terroryzm ma być krokiem naprzód w walce z niezidentyfikowanym przeciwnikiem.
Terrorism in France takes the form of various acts of violence committed by terrorists against French citizens on the territory of the country and abroad. It is characterized by specificity, which is closely related to history and the current political situation in the state. Terrorism as a phenomenon, and at the same time a form of weapon for the growing number of its supporters, led to the creation of specific legislation and a set of measures to combat against negative impact on the functioning of society. The complexity of this phenomenon requires the intensification of the actions of state organs, in order to understand it and identify ways to counteract and prevent its occurrence in the future. The last 10 years in the French Republic clearly show that the security services were unable to cope with the increasing number of acts of terror. The new anti-terrorist law in the French Republic is a form of weapon that the government can use in the fight against terrorists. Its creation and application is an example for other European countries, which in the future may impose their own – similar laws. The essence within its application will be uninterrupted control, while respecting the rights and freedoms of citizens. The first assessment of the functioning of the assumptions of the act will take place in 2020. The new anti-terrorism law is to be a step forward in the fight against an unidentified opponent.

The essay presents freedom of speech from the perspective of international law regula-tions. The phenomenon of terrorism is one of the most asymmetrical, amorphous and hybrid threats to international security and human rights. The author discusses freedom of speech in the context of anti-terrorism measures. Freedom of speech is a legal and axiological framework of democratic society. The media constitute an important source of information about social pathologies and threats. Terrorists use the media to depreci-ate the law and the state, and to generate chronic fear in society. The essay stresses the fact that a rational and informed approach to human rights should serve as a reference point for anti-terrorism. However, one cannot limit individual freedom in an arbitrary way. Public discourse helps reach an objective perception. This prevents the creation of a multiplied image, pseudo-reality and “double standards” for freedom of speech.

Although in recent years increased the number of attacks carried out by the so-called lone wolves, contemporary terrorist threats are still based on organizational structures that have not only national but also international scope, the number of members of which ranges from several to even several thousand terrorists. It should be emphasized that terrorist organizations are involved in operations all over the world. Although the vast majority of them operate in the Middle East and North Africa, terrorist incidents also occur regularly in other regions, including Europe. The modus operandi of individual groups is rather similar. Still, it is worth paying attention to their ideology, the way they achieve their goals, as well as the support they receive from various institutions and countries. A detailed analysis of contemporary terrorist organizations is also the first step in combating them. Therefore, the issues raised will constitute the basis for further research on the phenomenon of the proliferation of terrorism, and will also be used to develop methods and tools as part of anti-terrorist strategies.
Chociaż w ostatnich latach wzrosła liczba ataków przeprowadzanych przez tzw. samotne wilki, współczesne zagrożenia terrorystyczne opierają się nadal na strukturach organizacyjnych posiadających zasięg nie tylko krajowy, lecz także międzynarodowy, których liczba członków liczy od kilku do nawet kilku tysięcy. Należy podkreślić, że organizacje terrorystyczne są zaangażowane w operacje na całym świecie. Mimo iż w zdecydowanej większości działają na Bliskim Wschodzie i w Afryce Północnej, to regularnie dochodzi do incydentów terrorystycznych w innych regionach, także w Europie. Modus operandi poszczególnych grup jest raczej podobny, niemniej jednak warto zwrócić uwagę na ich ideologię, sposób realizacji założonych celów, a także otrzymywane wsparcie od różnych instytucji i państw. Szczegółowa analiza współczesnych organizacji terrorystycznych jest jednocześnie pierwszym etapem do ich zwalczania. Podejmowana problematyka będzie stanowić zatem podstawę do dalszych badań nad zjawiskiem rozrostu terroryzmu, a ponadto posłuży do opracowania metod i narzędzi w ramach strategii antyterrorystycznych.

The research results presented in this publication aim to identify the basic task areas that are critical in the response of public security institutions to contemporary terrorist attacks. Corresponding to the objective of the research process is the research question - what are the key task areas of public security institutions that will be critical in responding to contemporary terrorist acts? The author assumed in the research hypothesis the existence of such key task areas, initially assigning them to organisational, communication, educational and logistical activities. The research described in the text was based on scientific methods in the form of document analysis, case studies and participant observation. The research results obtained became the basis for developing key task areas that should be taken into account in the preparation of solutions for institutional response to contemporary terrorist acts. The results of the research also concern several universal features of contemporary terrorist attacks, which take into account the diversity of methods and tools used in carrying them out.
Celem badań, których efekty zostały przedstawione w niniejszej publikacji, było zidentyfikowanie oraz wskazanie podstawowych obszarów zadaniowych, które są krytyczne w reagowaniu instytucji bezpieczeństwa publicznego na współczesne zamachy terrorystyczne. Z celem procesu badawczego koresponduje pytanie badawcze – jakie są podstawowe obszary zadaniowe instytucji bezpieczeństwa publicznego, które będą krytyczne w reagowaniu na współczesne zamachy terrorystyczne? Autor założył w hipotezie badawczej istnienie takich kluczowych obszarów zadaniowych, przyporządkowując je wstępnie do aktywności organizacyjnej, komunikacyjnej, edukacyjnej i logistycznej. Badania opisane w tekście oparto na metodach naukowych w postaci analizy dokumentów, analizy przypadków oraz obserwacji uczestniczącej. Uzyskane wyniki badań stały się podstawą do wypracowania kluczowych obszarów zadaniowych, które powinny być uwzględniane w przygotowaniu rozwiązań w zakresie instytucjonalnego reagowania na współczesne zamachy terrorystyczne. Wyniki badań dotyczą także szeregu uniwersalnych cech współczesnych zamachów terrorystycznych, które uwzględniają różnorodność metod oraz narzędzi stosowanych w ich przeprowadzeniu.

Artykuł poświęcony jest problematyce zwalczania terroryzmu. Fizyczne (kinezyjne) zwalczanie terroryzmu nazywane jest w świecie anglosaskim kontrterroryzmem (counterterrorism, CT), w Polsce natomiast nosi nazwę antyterroryzmu (AT), który to termin ma z kolei w krajach zachodnich znacznie szersze znaczenie. Bardzo ważne jest precyzyjne zdefiniowanie czym w istocie jest terroryzm. W obszarze bezpieczeństwa wewnętrznego jest po prostu przestępstwem, natomiast w obszarze działania sił zbrojnych w zagranicznych interwencjach, terroryzm jest utożsamiany z partyzantką i powstaniami. W tekście rozważane są różne obszary przeciwdziałania i zapobiegania zagrożeniu terrorystycznemu, poczynając od planowania architektonicznego, programów prewencyjnych, aż po czarna taktykę AT i ściganie sprawców przestępstw terrorystycznych. Osobną kwestią jest wojskowa koncepcja terroryzmu i jego zwalczania, przyjęta przez NATO, w ramach której siły zbrojne wielu państw lobbują na rzecz zwiększania swoich kompetencji w zakresie bezpieczeństwa wewnętrznego, co może stwarzać realne zagrożenie dla demoliberalnych demokracji.
The article discusses the issues of combating terrorism. Physical fight against terrorism is called in Anglo-Saxon countries counterterrorism (CT). In Poland, the fight against terrorism is called anti-terrorism (AT). This term has in turn in Western countries a much broader meaning. It is important to define precisely what in fact is meant by terrorism. Within the area of internal security, terrorism is simply a crime, while within the territory of the armed forces in foreign interventions, terrorism is identified with insurgency and uprisings. In the text various ways of counteracting and preventing terrorist threats are considered, ranging from architectural planning, prevention programs to the black tactics (CT) and prosecution of terrorist offenses. A separate issue constites the military concept of terrorism and combat adopted by NATO. The armed forces of many countries are lobbying to increase their competence in the field of internal security, which may pose a real threat to freedom and democracy.

Recurrent events of a terrorist character, especially those occurring not in arenas of armed conflict or in countries that are not – at least formally – at war with others, make it necessary not only to consider a redefinition of the state security systems, but also to reflect deeply on the human rights-inspired paradigms accepted hitherto. Regardless of one’s convictions and interpretation of current events, it is difficult to avoid repeating questions concerning the efficiency of public authorities and our legal system in the context of European experiences with terrorism. It is necessary to examine whether the commonly recognized constitutional and human rights standards facilitate the development by the state of instruments aimed at the effective prevention of terrorism. In the process of enacting and applying anti-terrorist laws one must pay heed to the mutual relations between goods protected and violated by a given regulation. As noted above, there is no freedom without security, but also there is no security without freedom. This tension makes a proportionality test very troublesome. The legislator should, above all, harmonize the axiological contexts of the provisions constructed thereby, so that they are orientated towards the protection of both security and freedom.

In the issues of terrorist threats, which constitute one of the most serious threats to national security, numerous state organs and institutions are involved, and the effectiveness in combating terrorism depends to a large extent on the coordination of their activities. Increasingthe competence of state bodies in this area can notlead to disproportionate restrictions in exercising freedoms and rights by citizens. The Anti- Terrorism Act enacted by the Parliament in June 2016 does not provide forsuch guarantees. The article analyses the adopted solutions and indicates regulations that raise the greatest doubts.
W kwestii zagrożeń terrorystycznych, stanowiących jedno z najpoważniejszych zagrożeń dla bezpieczeństwa narodowego, włączone są liczne organy i instytucje państwowe, a skuteczność w zwalczaniu terroryzmu w dużej mierze zależy od koordynacji ich działalności. Zwiększenie kompetencji organów państwowych w tym obszarze nie może prowadzić do nieproporcjonalnych ograniczeń w korzystaniu z wolności i praw przez obywateli. Ustawa antyterrorystyczna uchwalona przez parlament w czerwcu 2016 r. nie przewiduje takich gwarancji. Artykuł analizuje przyjęte rozwiązania i wskazuje regulacje wywołujące największe wątpliwości.

Celem artykułu jest identyfikacja najważniejszych cech polskiego systemu antyterrorystycznego, ze szczególnym uwzględnieniem podstaw prawnych i wymiaru instytucjonalnego. Autor podjął się próby określenia kierunków rozwoju działań AT w Polsce w kontekście zmieniającego się środowiska zagrożenia zamachami terrorystycznymi w Europie. Podjęte rozważania zawierają również ocenę przyjętych rozwiązań AT w konfrontacji ze zmieniającymi się metodami i narzędziami używanymi przez współczesnych terrorystów.
The aim of the article is to identify the most important features of the Polish anti-terrorism system, with particular emphasis on legal bases and institutional dimensions. The author undertook attempts to determine the direction of development of anti-terrorism activities in Poland in the context of a changing environment threatened by terrorist attacks in Europe. The considerations also include an attempt to evaluate the adopted anti- terrorism solutions in confrontation with the changing methods and tools used by modern terrorists.
