Opis:: Apotropaic behaviours in the Roman system of beliefs required the use of various forms of offerings in order to achieve the expected sacral goal. We may assume, that a full effectiveness of such actions was asserted only by human sacrifice. Along with the development of religious practices the Romans substituted human sacrifice however, in times of serious danger for the Roman community, they would reach for the early sacral experiences. In the system of Roman beliefs extremely important appeared to be the rituals at the turn of the year, which represented the periodic change of the tempus sacrum. Many of the rituals of the turn of the year played the role of lustrative rites, which were extended into practices of liberating the community from sacral miasma and received those rites which represented the destruction of cosmic order and its recovery to the state of primordial chaos. These types of ceremonies might have required a human sacrifice.

Opis:: Wstęp i cel: W pracy przestawiono zasady i reguły zapisu liczb w rzymskim systemie numeracji. Niepozycyjny system numeracji rzymskiej był oparty na zasadzie addytywnej niekiedy łącznie z zasadą substraktywną lub multiplikatywną. Głównym celem pracy jest przypomnienie i uporządkowanie zasad zapisu liczb oraz reguł stosowanych w notacji rzymskiej. Materiał i metody: Materiał badawczy jest oparty wybranych pozycjach z dość obszernej literatury. W pracy stosuje się głownie metodę analizy teoretycznej. Wyniki: W przedstawionych rozważaniach opisano zasady zapisu liczb sposobem rzymskim w zakresie od 1 do 1000, od 1000 do 10⁶ oraz od 10⁶ do 10⁸. Zaprezentowano 14 reguł rządzących rzymskim zapisem liczb. Przedstawiono 62 przykłady ilustrujące omawiane zasady i reguły. Wniosek: Znajomość zasad i reguł zapisu liczb w rzymskim systemie numeracji pozwala na pełniejszą weryfikację poprawności konstruowanego zapisu.
Introduction and aim: The paper presents some principles and rules of coding numbers in the Roman numeration system. Non-positional Roman numeration system was based on the principle of additive sometimes including the principle of subtractive or multiplicative. The main aim of the paper is to organize and remind of coding numbers and rules used in the Roman numeration system. Material and methods: The research material is based on selected items from a fairly extensive literature. The study used mainly the method of theoretical analysis. Results: In the presented considerations has been described some rules for writing method of Roman numbers in the range from 1 to 1000, from 1000 to 10⁶ and from 10⁶ to 10⁸. It has been presented 14 rules describing the Roman number notation. Also has been shown 62 examples to illustrate these principles and rules. Conclusion: Knowledge of principles and rules for writing numbers in the Roman numeration system allows for a more complete verification of the correctness of the constructed record.

Niewiele publikacji dotyczy jednak roli, jaką prawo rzymskie odegrało na Wyspach Brytyjskich. Jednym z istotnych wyjątków są badania Łukasza Jana Korporowicza z Uniwersytetu Łódzkiego. W niniejszym artykule przeprowadzono analizę jego ostatniej książki pt. Prawo rzymskie w Anglii w XVIII wieku. Nauczanie, studia, nauka. Opisuje ona system nauczania prawa rzymskiego w Anglii w XVIII w. oraz rolę, jaką absolwenci studiów romanistycznych w Oxbridge odgrywali w ówczesnym społeczeństwie angielskim. Wskazano przede wszystkim na pionierski charakter recenzowanej pracy, podobna bowiem nie ukazała się jeszcze nie tylko w Polsce, ale i na świecie. Analizując kolejne części książki, dokonano ich krytycznej analizy oraz wskazano na jej silne i słabsze elementy. W konkluzjach wskazano na bardzo wysoki poziom naukowy recenzowanej książki.
Polish research on Roman law is traditionally concerned first of all on the private law and its reception in European legal systems. However, very few publications deal with the role Roman law played on the British Isles. One of the important exceptions is Łukasz Jan Korporowicz’s research from the University of Lodz. This article analyzes his last book entitled Prawo rzymskie w Anglii w XVIII wieku. Nauczanie, studia, nauka. It describes the system of teaching Roman law in England in the 18th century and the role that graduates of Roman studies at Oxbridge played in English society at the time. First of all, the pioneering nature of reviewed work was indicated, as a similar one has not yet been published not only in Poland, but also in the world. By analyzing the subsequent parts of the book, their critical analysis was made and its strong and weaker elements were indicated. The conclusions indicate a very high scientific level of the reviewed book.

Opis:: The article concerns the role of Roman law in the education of Polish lawyers. The author compares the conditions and methods of teaching the law of ancient Romans at law faculties in Poland during the period between the two World Wars with those of today. In conclusion, the author states that Roman law is undoubtedly one of the most important components of ancient culture, which has exerted a speciﬁc inﬂuence on shaping the modern world. The study of Roman law oﬀers a possibility of histori- cal perspective on law, enriches students’ knowledge on the theory and dogmatics of law and teaches the ways of legal thinking. It is impossible to comprehensively under- stand the evolution and functioning of many modern European legal systems, which stem from solutions formerly adopted already in the law of ancient Rome, without the competence derived from the study of Roman law.

The article discusses the problems of determining the starting point of history of the Western Empire in 800 AC and Emperor Charlemagne position towards papacy. In the political (problems with kingship and feudal system) and ecclesiastical (Second Council of Nicaea) contexts are also present very important and more general debates of historians on monistic or dualistic conceptions which form interrelations between popes and emperors.

Opis:: The House of Orpheus at Nea Paphos in Cyprus, a multiphase residential complex excavated a few decades ago, is the subject of an on-going study within the framework of a new project. Recently, the bath suite in the north-eastern part of the house was analysed in detail and this has led to a better understanding of the baths’ layout and technology (such as the water management and heating system), features that confirm the adoption of the western/Italian model, while some of the details remained typical of the Eastern Mediterranean.

Opis:: The aim of this article is to refer Polybius’s political theory, included in Book VI of The Histories, to the history of the rise of the Roman Republic. This theme must have been particularly significant for Polybius. For him, Rome was the most perfect example of a mixed government system, and the aim of describing its history was to show the development of this perfect system. The article presents the mutual relation of theory and history, starting with the period of kingship, up to the emergence of the democratic element, i.e. the moment when Rome acquired the mixed system of government. Both the political and social contexts of the changes are outlined. The analysis suggests that Polybius related his political theory to the history of the state he admired, thus providing the theory with actual foundations. Reconstructing his analysis makes it possible to see the history of Rome in a different light, and to ponder the system itself and its decline, even though the main objective of both Polybius and this article is to present its development.

Opis:: R ola Kościoła katolickiego w trzech ostatnich latach istnienia PRL była znacząca. Po trzeciej pielgrzymce Jana Pawła II wspomniana instytucja wystąpiła jako pośrednik i moderator dialogu między władzami a opozycją. Episkopat konsekwentnie odrzucał kolejne propozycje strony rządowej zmierzające do reformy systemu bez udziału dzia- łaczy zdelegalizowanej „Solidarności”. Zaangażowanie hierarchii kościelnej było nie- zwykle ważne dla doprowadzenia do rozmów „okrągłego stołu” oraz w czasie wyborów parlamentarnych w czerwcu 1989 r., gdy jej wsparcie okazało się kluczowe dla zwycięstwa Komitetu Obywatelskiego i klęski listy rządowej. W tym okresie Episkopat odniósł także bezprecedensowe sukcesy w zakresie relacji państwo–Kościół: uregulowanie swojego statusu prawnego i nawiązanie stosunków dyplomatycznych między Stolicą Apostolską i PRL. Oba osiągnął na własnych warunkach, wykorzystując swoją silniejszą pozycję negocjacyjną. Artykuł przedstawia podejście struktur centralnych Kościoła w Polsce do sytuacji politycznej w ostatnich trzech latach PRL, gdy Episkopat był swego rodzaju akuszerem porozumienia między władzą a opozycją.
T he Roman Catholic Church played a significant role during the last three years of the People’s Republic of Poland. Following the third pilgrimage of John Paul II, the institution acted as a mediator and moderator of dialogue between the authorities and the opposition. The episcopacy kept rejecting subsequent proposals of the government party to reform the system without involving activists of the delegalized “Solidarity” Movement. The involvement of the Roman Catholic hierarchy was hugely important for initiating the “Round Table” talks and during the parliamentary elections of June 1989 when its support turned out to be of key significance for the victory of the Civic Committee and for the defeat of the government party. At that time, the episcopacy also recorded unprecedented successes in the relations between the state and the Church, the regulation of its legal status as well as the Holy See and the People’s Republic of Poland entering into diplomatic relations. It achieved both on its own terms by leveraging its superior negotiation power. The article discusses the approach of the highest hierarchy of the Roman Catholic Church in Poland toward the political situation during the last three years of the People’s Republic of Poland when the episcopacy served as a kind of “midwife” for the agreement between those in power and the opposition.

Opis:: The article focuses on the issue which literary scholars are – to a large extent – well acquainted with, namely the influence of Johannes Immanuel Volkelt’s considerations presented in his work System der Ästhetik on Roman Witold Ingarden’s philosophy of art. By referring to some selected extracts of the first volume, entitled Grundlegung der Ästhetik, the author tries to prove the importance of the German philosopher’s thought, especially for Ingarden’s concept of appearance. A common belief in the hegemony of Husserlian inspiration in this area is questioned, being further supported by the fact that reference to Husserl’s views evolved in Ingarden’s philosophy.
Problematyka artykułu skupia się na kwestii przez badaczy literatury w dużej mierze zapoznanej – randze rozważań Johannesa Immanuela Volkelta zawartych na kartach jego dzieła System der Ästhetik dla filozofii sztuki Romana Witolda Ingardena. Przez odniesienie się do wybranych fragmentów tomu pierwszego, zatytułowanego Grundlegung der Ästhetik, autorka stara się dowieść niebagatelnej roli myśli niemieckiego filozofa zwłaszcza dla Ingardenowskiej koncepcji wyglądów. Utarte przekonanie co do hegemonii Husserliańskiej inspiracji w tym zakresie podaje w wątpliwość, popartą ponadto faktem ewoluowania wskazanej koncepcji w ujęciu krakowskiego filozofa.

Opis:: In the late Roman Empire, the praetorian prefects (praefecti praetorio) were among the most powerful and influential dignitaries. Nevertheless, their elevated position was limited through imperial constitutions (laws) and the personnel policy by the emperor. Another method of exercising supervision over the prefects was the rivalry among high Roman dignitaries. The most dangerous rivals of the praetorian prefects were the masters of the offices (magistri officiorum). In this essay the author attempts to outline how the praetorian prefects and the masters of the offices exerted control of the public postal system (cursus publicus) and how the magister officiorum supervised the office of the praetorian prefect.
W późnym Cesarstwie Rzymskim prefekci praetorio należeli do najpotężniejszych i najbardziej wpływowych dygnitarzy. Jednak ich wysoka pozycja była ograniczona przez samego imperatora: cesarskie konstytucje (ustawy) i politykę personalną. Innym sposobem nadzoru nad prefektami była rywalizacja pomiędzy wysokimi rangą dygnitarzami. W przypadku prefektów praetorio ich najpoważniejszymi rywalami byli magistri officiorum. W niniejszym szkicu staram się pokazać jak prefekci praetorio i magistri officiorum rywalizowali o kontrolę nad pocztą publiczną (cursus publicus) i w jaki sposób magister officiorum kontrolował officium praefekta praetorio.

Opis:: The basic concept of the function of the Archaeological Information System (AIS) is the following: A GIS (Geographic Information System) is integrated into the virtual research environment of the AIS and allows access to external and internal databases through the Internet or intranets. The AIS is utilised for visualisation, analysis, and finally publication of heterogeneous archaeological data (site registries, excavation plans and reports, and photographic records) through the integration of additional open-source tools. This article investigates settlement patterns and the conception of settlement spaces west and east of the lower Oder from the Late Roman Iron Age until the Early Middle Ages. All relevant data from archaeological finds and natural features are condensed into the AIS and analysed as a case study on the use of experimental design of the developed AIS. A pattern of discrete settlement clusters containing multiple individual settlements was identified during the Late Roman Iron Age. These clusters lay exclusively in areas with high natural potential for crop cultivation and animal husbandry. The borderlands demarcating these clusters are partly infertile and partly fertile, indicating that the agricultural potential of the landscape was not wholly responsible for the location of these clusters, but rather that this was done in a planned fashion and based on social concepts. Considerable emigration out of the Oder region occurred in the Migration Period, reaching its high point in the late fifth century A.D. and resulting in a broad desettled region in the sixth and early seventh centuries. First the settlement clusters underwent a process of concentration and only those in optimal natural resource surroundings could continue to exist. Not until the second phase do these clusters dissolve and for a brief time there were only individual settlements lying far away from one another. Interestingly, the repopulation of the Oder region during the Early Middle Ages in the eighth century initially copied the old pattern of discrete settlement clusters. Following the first consolidation phase however settlement formation of the Oder region at the end of this period in the ninth and tenth century was widespread and the previous spatial concept of discrete settlement clusters abandoned.1
Podstawowe założenia funkcji archeologicznego systemu informacyjnego (AIS) są następujące: GIS (geograficzny system informacji) jest zintegrowany z wirtualnym środowiskiem badawczym AIS i umożliwia dostęp do zewnętrznych i wewnętrznych baz danych przez Internet i Intranet. AIS służy wizualizacji, analizie i wreszcie publikacji heterogenicznych danych archeologicznych (spisów stanowisk, planów i raportów z wykopalisk) poprzez zastosowanie dalszych narzędzi z otwartych zasobów. Prezentowany artykuł poświęcony jest rozważaniom nad wzorcami osadniczymi i konceptem przestrzeni osadniczej na zachód i wschód od dolnej Odry od późnego okresu wpływów rzymskich do wczesnego średniowiecza. Wszystkie istotne informacje o znaleziskach archeologicznych i naturalnych cechach krajobrazu zostały razem zestawione w oprogramowaniu AIS i przeanalizowane jako studium przypadku. W późnym okresie wpływów rzymskich stwierdzić można obecność wyodrębniających się wyraźnie zespołów osadniczych, na które składa się po kilka osiedli. Skupiska te położone są wyłącznie na obszarach o dużym potencjale gospodarczym, zarówno z punktu widzenia uprawy roślin jak i hodowli. Rubieże tych skupisk, i przestrzenie między nimi to jednak po części tylko obszary o małej żyzności, co świadczy tym, że uwarunkowania gospodarcze były tylko jednym z czynników wpływających na takie właśnie rozmieszczenie osadnictwa i że istotną rolę w tym względzie musiały odgrywać również czynniki społeczne. Znacząca emigracja z ziem położonych w dorzeczu dolnej Odry ma miejsce w okresie wędrówek ludów, osiągając apogeum w V wieku naszej ery i skutkując trwałym wyludnieniem w szóstym i początkach siódmego stulecia. Proces ten przebiega w dwóch fazach. Początkowo następuje koncentracja osadnictwa połączona z zanikiem całych skupisk osadniczych leżących na gorszych z gospodarczego punktu widzenia terytoriach. Następnie dochodzi do zmniejszenia się gęstości zaludnienia w tych skupiskach, które wciąż funkcjonowały. W rezultacie sieć osadniczą tworzą pojedyncze stanowiska, położone w dużej odległości od siebie. Interesujące jest to, że w początkach powtórnego zasiedlania dorzecza dolnej Odry – w ósmym wieku – sieć osadnicza kopiuje starszy wzorzec z wyraźnie wyodrębnionymi skupiskami osadniczymi. Dopiero w IX i X wieku, wraz ze wzrostem gęstości zasiedlenia, model ten zostaje porzucony i zacierają się granice pomiędzy skupieniami osadniczymi.

Opis:: The gens (clan) was one of the key social institutions in archaic Rome. It has given rise to much controversy in modern scholarship. The history of the Roman clan is one of those areas in which the volume of scholarly literature is out of all proportion compared to the limited evidence. The obscurity of the institution has not prevented imaginative reconstructions. A critical analysis of the sources runs counter to the well-entrenched theory that the gens originated as a prepolitical organisation, which collapsed after the rise of the state. Contrary to the views of numerous scholars that there was once a time when only patricians has clans, there is no evidence for this proposition: the clan system extended to all classes of Roman society. In the past, many descriptions of early Roman agriculture focused on the gentilicial ownership of land. The concept of gentilicial land has, however, fallen out of favour over time, rightly as it seems.

Opis:: There is a phenomenon of law in the Christian Churches. The paper describes and compares functions of law, that is, social effects of legal norms from endogenic laws of the two of them: in the Catholic Church and the Evangelical Church of the Augsburg Confession in Poland. It presents functions, such as: creative and organization function, protective and defending function for the personal rights, function of sharing material burdens and distributing the goods, function of regulation of solving conflicts, repressive function, informative and teaching function, educational function, protective and defending function for the matter of faith, salvation function. The conclusion is that functions of law in both Churches are: elaborated and complicated, mixed in their character and can be divided into the typical functions for the Church as a regular society and as a spiritual one, congruent only to some extent.
W Kościołach chrześcijańskich istnieje zjawisko prawa. Artykuł określa i porównuje funkcje prawa, czyli wywołane przez prawo skutki społeczne zawarte w endogenicznym prawie dwóch Kościołów: Kościoła rzymskokatolickiego i Kościoła Ewangelicko-Augsburskiego w Rzeczpospolitej Polskiej. Te funkcje to: funkcja kreująco-organizacyjna, funkcja ochronno-obronna względem praw osobowych, funkcja podziału materialnych ciężarów i rozkładu dóbr, funkcja regulacji rozwiązywania konfliktów, funkcja represyjna, funkcja informacyjno-nauczająca, funkcja wychowawcza, funkcja ochronno-obronna względem treści wiary, funkcja zbawcza. Wniosek z tych rozważań jest następujący: funkcje prawa w tych dwóch Kościołach są rozbudowane i skomplikowane; funkcje te mają mieszany charakter i mogą być podzielone na funkcje charakterystyczne dla Kościoła jako społeczności ziemskiej i jako społeczności duchowej; funkcje pomiędzy Kościołami są zbieżne ze sobą tylko do pewnego stopnia.

Opis:: Artykuł poświęcono problematyce sądownictwa sędziów przysięgłych w sprawach karnych. W pierwszej części opracowania przedstawiono genezę instytucji sędziów przysięgłych, jak również jej historyczny rozwój. Szczegółowe rozważania poświęcono rzymskim quaestiones, stanowiącym archetyp sądownictwa sędziów przysięgłych. Pogłębionej analizie poddano także anglo-amerykański model sądownictwa sędziów przysięgłych, zarówno w ujęciu historycznym, jak i współczesnym.
The article is devoted to the problems of juror jurisdiction in criminal matters. The first part of the study presents the genesis of the institution of jurors and its historical development. Special attention is paid to Roman quaestiones, that is an archetypical form of juror jurisdiction. An in depth analysis covers as well the Anglo-American model of juror jurisdiction, both from the historical and contemporary perspective.
