    Effective land registers ensuring the accessibility of land information are of cru- cial importance for the development of cross-border conveyancing which falls within the scope of free movement of capital in the European Union. Specific to the European countries’ land registration systems is that they diverge consider- ably, the result being that they have not been directly subject to harmonisation so far. Nevertheless, efforts are undertaken to increase cooperation among national land registration authorities and what particularly contributes to achieve this objective is a common tendency towards informatisation. The article presents of assumptions and outcomes of selected information and communication technol- ogies-based projects implemented at the European level in order to streamline cross-border conveyancing by way of interconnecting land registers. On this basis, an attempt has been made to assess the effectiveness of hitherto cooperation initiatives and the prospects for enhancing the integration of real estate markets.

    The development of information technologies offers new possibilities of use of information collected in public registers, such as land registers and cadastres, which play a significant role in establishing the infrastructure for spatial information. Efficient use of spatial information systems with the purpose of a sustainable land management shall be based on en suring the interconnection of different information resources, data exchange, as well as a broad access to data. The role of land registration systems in the context of technological advancement was the subject of the Common Vision Conference 2016. Migration to a Smart World, held on 5–7 June 2016 in Amsterdam. The conference was organized by Europe’s five leading mapping, cadastre and land registry associations, cooperating within a “Common Vision” agreement: EuroGeographics, Permanent Committee on Cadastre, European Land Registries Association, European Land Information Service and Council of European Geodetic Surveyors. The discussion during the conference focused on topics regarding the idea of smart cities, marine cadastre, interoperability of spatial data, as well as the impact of land registers and cadastres on creating the infrastructure for spatial information and developing e-government, at both national and European levels. The paper aims to present an overview of issues covered by the conference and also to highlight some important problems arising from implementing advanced technology solutions in the field of land registration.

    Skutki procesu informatyzacji obejmują znaczące ułatwienie i poszerzenie dostępu do ksiąg wieczystych prowadzonych w systemie teleinformatycznym, co wpływa na realizację zasady jawności formalnej ksiąg wieczystych, a zarazem na wzmocnienie ich podstawowej funkcji społeczno- gospodarczej, polegającej na zapewnieniu bezpieczeństwa obrotu nieruchomościami. Niezależnie od korzyści wynikających z udostępnienia treści ksiąg wieczystych w Internecie postęp technologiczny niesie ze sobą ryzyko przetwarzania zawartych w nich danych w sposób niezgodny z celem prowadzenia ksiąg wieczystych. Doniosłe problemy prawne zaznaczają się na tle konfliktu między jawnością ksiąg wieczystych a gwarantowanymi konstytucyjnie prawami do prywatności i ochrony danych osobowych. Celem artykułu jest przedstawienie w zarysie i poddanie analizie stanowisk instytucji władzy publicznej w kwestii ochrony danych osobowych ujawnianych w księdze wieczystej, jak również niektórych argumentów i postulatów formułowanych w środowisku nauki prawa oraz praktyki w ramach toczącej się dyskusji nad optymalnymi rozwiązaniami prawnymi i technicznymi w dziedzinie dostępu do elektronicznych ksiąg wieczystych.

    Opis:
    The Zwierzyniec Cultural Park (1 100 hectares) is part of the most important fragment of the natural system of Cracow. Together with Wolski Wood it constitutes a limestone horst within the fork of the rivers Vistula and Rudawa. Its range encompasses a number of historical monuments: monasteries and residences, fortifications and mounds built to commemorate Polish national heroes. The whole area is traditionally intended for leisure and fulfils important social functions. Its landscape and natural and cultural conditions create an outstanding spatial complex, essential for the preservation of the attraction of the town of Cracow (population 750 000). Spatial development plans are obligatory in the case of a cultural park. The Zwierzyniec Park has been divided into four planning units: St. Bronislawa II Hill, the Fort Skala II Region, Fort Olszanica and Wolski Wood. In the case of two of the areas - St. Bronislawa II Hill and the Fort Skala II Region - such plans had been devised already prior to the establishment of the park. The merits of these areas are the reason for strong investment pressure, and a high percentage of privately owned land creates a considerable problem. In order to justify the protection projects they are accompanied by detailed conditions, supported by the opinions of researchers, the authors of specialist studies. The plans acknowledged the priority status of the maintenance of the natural environment and landscape while integrating the protection of the former and the cultural environment. Protection is to include the vista connections between the areas encompassed by the plans and the sites of their perception from other parts of town. A boundary between built-up areas and those free of buildings has been demarcated. Principles for protecting formal and historical values have been established together with methods of their use for contemporary functions. The plans render possible the development of multi-generation leisure and entertainment: the preserved elements of the Cracow fort have been included into the municipal system of green areas. Emphasis must be placed on the positive role played by the representatives of the local community as well as the ecological and civic organizations backing the planning process. The Grand Prix awarded at the VI edition of a Competition held by European Council of Town Planners (ECTP) 2006 for a project intended for St. Bronislawa Hill confirms the correctness of the resolutions accepted by the self-government of Cracow.

    In a relatively short period of time we have become accustomed to night time illuminated by sources of light. The culture of the reception of “historical” architectural space, created for the effects of daytime chiaroscuro, is changing. While extracting architectural objects from darkness, we should take into consideration spatial relations with the environment. Illumination should never create elements of space that remain mutually unconnected. In order to co-ordinate illumination on the scale of an urban macro-interior, it is extremely useful to conceive a conceptual project for illumination on a city scale. Finally, the illumination of a given object should be a creation meeting a fundamental condition – the evocation of the cultural values contained within a historical object in the sphere of space and spirit.

    A scientific seminar on protection of numismatic monuments organized by the Faculty of Law and Administration of the University of Opole and the Customs Chamber in Opole with the cooperation of the Financial Law Association „Aureus” took place on 8th September 2011 in Opole. There were two papers presented during the seminar, both accompanied with multimedia presentation. Marcin Sabaciński (National Heritage Board of Poland, Archeology Department) focused on the presentation of institutional system of monuments protection in Poland and Polish legal regulations on protection and care of cultural heritage. Michał Zawadzki (Director of Numismatic Collection of the Royal Castle in Warsaw) gave a paper on the numismatics as a scientific discipline and presented the main types of historical coins, banknotes and other collector’s items as well as the characteristics of the numismatic market in Poland. The participants of the discussion held during the seminar paid attention to the need for closer cooperation among different entities dealing with protection of monuments, as well as for appropriate legislative initiatives in this field.

    Characterized by a substantial diversity and falling within the property law domain, land registration systems have been excluded from the European Union harmonization process. At the same time, however, cross-border access to land registry information is critical for the development of the internal market. Therefore, several ambitious strategies are being pursued at the European level to interconnect national land registers by fully exploiting the possibilities offered by the latest technological advances. This article investigates the effect of transnational cooperation initiatives aimed at interconnecting electronic land registers within the European e-Justice program for the enhancement of the integration of the real estate markets in Member States. In this respect, legal challenges connected with the standardization of land information are addressed from comparative and harmonization perspectives.
