Opis:
Objective: Demonstration and analysis of the impact of the human factor on the effectiveness of the state defence system. Method: Literature research and critical analysis. Results: The research demonstrates that the human factor is the most important component of the state defence potential. This thesis is corroborated by examples from the history of Poland, and supported with philosophical, ethical and ethnographic considerations. Based on the examination of the selected research group consisting of Polish soldiers, qualities important for Poles, such as honour, righteousness and patriotism, which are at the foundation of the national character of a soldier, have been identified. On the other hand, the article also takes into account negative stereotypes and opinions presented in the literature regarding the national character of the Polish soldier. Conclusions: The conducted research and analysis prove the unquestionable domination of the human factor in state defence and military systems. It has been shown that, apart from the demographic potential and mobilisation capabilities, an important aspect of the human factor for defence is the national character and the morale of the army, which should be prioritised over material aspects. Honour, both in the axiological dimension of the sense of pride, dignity, nobility, and diligence, as well as in the sense of an ethical virtue in people's mentality and the morale of soldiers, shapes consciously determined attitudes and behaviours.

The study is focused on state defence management, in particular its political, strategic and legal-comparative aspects. The issue of managing the defence of the State has been presented from a systemic perspective as a separate system, being a part of a higher system and at the same time containing subordinate elements. Appropriate government documents of a conceptual nature and provisions in the common law on defence management were chosen as the subject for political-strategic and legislative legal analysis. The result of the analysis is a presentation of the key gaps and flaws in the legal solutions that may affect the functioning of the State defence management system in wartime1, in particular those related to the decision-making process of system components. In addition, an attempt was made to assess the implementation of security concepts adopted in Poland over the years, mainly in the field of managing national security and defence.

The article outlines chosen topics of the art of war in relation to the expected raising of state security efficiency. It comprises the chosen theoretical and normative attitudes for security as well as current problems of the art of war. The core of strategy, operational knowledge and tactics with regard to national realities as well as allies’ obligation has been explained. Military operations in today’s conditions as well as joined operations have mentioned.

Artykuł stanowi pokłosie badań prowadzonych przez autora po dokonanym strategicznym przeglądzie bezpieczeństwa narodowego i ukazaniu się Białej Księgi Bezpieczeństwa Narodowego RP. W artykule udokumentowana została dekompozycja systemu obronnego państwa w ramach budowanego systemu bezpieczeństwa narodowego RP. Obecnie stanowi on jeden z podsystemów operacyjnych systemu bezpieczeństwa narodowego, a w skład jego struktury obecnie wchodzą: działania dyplomatyczne; działania w sferze militarnej; działania służb specjalnych (wywiadu i kontrwywiadu) oraz przemysłowy potencjał obronny. Wymienione elementy podsystemu obronnego zostały scharakteryzowane w zakresie celów, pełnionych misji i realizowanych zadań. Podsystem obronny państwa powinien być tak zorganizowany, aby zapewnić nieprzerwane funkcjonowanie organów władzy publicznej zarówno w czasie normalnego funkcjonowania państwa, w tym kryzysu, jak i stanów nadzwyczajnych (stanie wojennym, wyjątkowym, klęski żywiołowej). Zakłada się, że tak skonstruowana struktura systemu obronnego państwa powinna zapewnić utrzymanie zdolności do prowadzenia w pełnym zakresie skutecznych działań obronnych dla przeciwstawienia się wszelkim zagrożeniom (w tym agresji militarnej) dla żywotnych interesów narodowych. Jednakże faktyczna sprawność i wydolność systemu obronnego państwa może być zweryfikowana tylko przez konkretną sytuację kryzysową.
The article is the aftermath of the author’s research made after the completion of the strategic review of national security and the publication of the White Book on the National Security of Poland. This article documents the decomposition of the state defence system in the framework of the national security system of RP being built. Currently, it is one of the operational subsystems of the national security system, while its present structure and composition are: diplomatic actions; activities in the military sphere; operations of special services (intelligence and counterintelligence) and industrial defence potential. These elements of the defence subsystem are characterised in terms of objectives, performed missions and tasks. The state defence subsystem should be organised to ensure the uninterrupted functioning of public authorities both during normal operation of the state, including crisises, as well as states of emergency (state of war, state of emergency, natural disaster). It is assumed that the defence system structure, constructed in such a way, should protect the ability to conduct the full range of effective defence to counter any threat (including military aggression) to vital national interests. However, the actual performance and efficiency of the state defence system can be verified only by a particular crisis.

The contents of this article are focused on presenting the results of research concerning development of the means of air threat as a major determinant of changes in the modernisation of the air defence system in Poland. The establishment and functioning of the defence system largely depends on the geopolitical position of the state, political and economic conditions and the possibility of defence capabilities. It must be dealt with and create it with regard to direct or indirect threats, both military and non-military expenditure. The armed forces increasingly make its readiness and capabilities in combat operations from the modernization of weaponry and logistical support, as well as the personal and material reserves located within the country. A multifaceted, complex nature of defence requires that a defense system was comprehensive, ensure systematic conduct broad (not just military) defensive preparations in the alliances, national and regional levels, which will enable the public to continue socio-economic activities in the most difficult conditions of the war. The cognitive goal of article is to indicate the possible use of existing and future opportunities for converting defence system of the Republic of Poland by using polemology. The practical aim is to identify aspects of polemology that can be used to improve polish defense system. Due to the diverse nature of the dangers and the nature of possible wars and armed conflicts, the defence system should prepare the state and its armed forces to repel any aggression. In the assumptions should be provided for rapid response armed throughout the territory of the state as well as reaching outside the territory of the state.
Tworzenie i funkcjonowanie systemu obronnego w dużej mierze uzależnione jest od geopolitycznego położenia państwa, uwarunkowań politycznych i ekonomicznych oraz możliwości potencjału obronnego. Należy bowiem rozpatrywać i tworzyć go mając na względzie bezpośrednie lub pośrednie zagrożenia, zarówno niemilitarne, jak i militarne. W coraz większym stopniu koncepcje strategii wojennej, urzeczywistnianej w walce zbrojnej, wiążą się z polityką, a niekiedy następuje jej zdominowanie przez strategię. Siły zbrojne coraz bardziej uzależniają swoją gotowość bojową i możliwości prowadzenia operacji i walki od modernizacji uzbrojenia oraz logistycznego wsparcia, a także od rezerw osobowych i materiałowych znajdujących się na obszarze kraju. Wieloaspektowy, skomplikowany charakter obronności wymaga, aby system obronny państwa był kompleksowy, zapewniał systematyczne prowadzenie szeroko pojętych (nie tylko militarnych) przygotowań obronnych w układzie sojuszniczym, ogólnokrajowym i regionalnym, co umożliwi społeczeństwu kontynuowanie działalności społeczno-gospodarczej w najtrudniejszych warunkach wojny. W tym znaczeniu system obronny państwa jest zbiorem wzajemnie powiązanych instytucji, ludzi i urządzeń, łącznie z określonym doktrynalnie mechanizmem ich funkcjonowania, warunkujących bezpieczeństwo państwa. Celem poznawczym artykułu jest wskazanie możliwości wykorzystania obecnych i przyszłych możliwości przekształcenia systemu obronnego Rzeczypospolitej Polskiej poprzez zastosowanie polemologii. Natomiast cel praktyczny stanowi identyfikacja aspektów polemologii, które można wykorzystać do ulepszenia polskiego systemu obronnego. W związku ze zróżnicowanym charakterem zagrożeń oraz charakterem możliwych wojen i konfliktów zbrojnych, system obronny powinien przygotować państwo i jego siły zbrojne do odpierania każdej agresji. W jego założeniach powinna być przewidziana szybka reakcja zbrojna na całym terytorium państwa a także sięgająca poza terytorium państwa.

The global security environment is characterised by the long-lasting situation of low probability of the outbreak of an armed conflict on a large scale and the simultaneously observed increased possibility of local conflicts. There are also noticed significant changes in a typical course of an armed conflict. The dynamic phase of combat activities is shorter and the post-conflict stage of stabilisation and rebuilding activities becomes longer. Tasks connected with the state defences and the preparation of the population and public property for war are the responsibility of all the public authority and administration bodies as well as of entrepreneurs; social organisations and citizens (individuals) – in the scope defined in the laws. The basis for the state defence preparations in the national security system in the course of integration are the defence needs and the defence tasks arising from them. In the current legal circumstances, defence tasks are considered equivalent with tasks connected with the general defence obligation or with the tasks performed as part of the state defence preparations, carried out in times of peace; in the case of an external threat to the state security and in times of war. The objective scope of these tasks fulfilled by all subjects of the state defence system is extremely extensive. This study aims to systematize the subject matter of the state defence preparations in the national security system from the point of view of the classification of defence tasks types and their description.

Inwazja Rosji na Ukrainę utwierdziła polski rząd w przekonaniu, że konieczna jest nieustanna aktywizacja społeczeństwa w dziedzinie obronności państwa. Nieocenioną rolę w tym zakresie odgrywają organizacje pozarządowe, które stały się istotnym partnerem sił zbrojnych w realizowaniu edukacji proobronnej i podnoszeniu zdolności obronnych Polski. W artykule przedstawiono akty prawne umożliwiające działalność organizacji pozarządowych w obszarze obronności Polski, dokonano krótkiego przeglądu literatury przedmiotu oraz zaprezentowano efekty realizowanego przez Stowarzyszenie Aktywności Zawodowej „PASSA” w Kielcach projektu w ramach ogłoszonego przez Ministra Obrony Narodowej konkursu: „Obronność państwa i działalność Sił Zbrojnych RP pn. I Ty możesz służyć Ojczyźnie”. Analiza literatury przedmiotu oraz przedstawione studium przypadku uprawniają do stwierdzenia, że instytucje trzeciego sektora potrafią skutecznie wspierać organy rządowe w działalności na rzecz poprawy obronności państwa.
The Russian invasion of Ukraine convinced the Polish government that permanent mobilizationf Polish people in the state defence is an absolute necessity. The third sector organizations play an invaluable role in this respect, and they have become an essential partner of the country’s defence system as far as their effort to organize suitable educational courses and improvement in upgrading pro-defensive abilities of Polish people are concerned. The article presents legal acts enabling the third sector to act effectively in the field of the state defence, a short overview of the articles concerning the subject as well as the results of the project conducted by the „PASSA” Association of Professional Activity in Kielce. The project was carried out within the competition announced by the Polish Ministry of Defence: „A State Defence and Activity of the Armed Forces of the Republic of Poland: You too can serve your homeland”. The analysis of the subject literature as well as the presented case study justify the conclusion that the third sector organizations can effectively support the government in its effort to improve the state defence system.

Wydarzenia z ostatniej dekady ubiegłego wieku oraz toczące się obecnie konflikty zbrojne potwierdzają, że znacznie skuteczniej radzimy sobie w sytuacjach, do których jesteśmy przygotowani, niż w tych, które nas zaskakują. Należy mieć świadomość, że współczesne zagrożenia i wyzwania są różne od tych z czasów zimnej wojny, a granice pomiędzy bezpieczeństwem wewnętrznym i zewnętrznym, policją i wojskiem, zapobieganiem kryzysom oraz ich rozwiązywaniem stają się sztuczne i niewyraźne. Wymienione czynniki wymuszają ewolucję narodowych systemów bezpieczeństwa w kierunku integracji sił i środków wchodzących w skład tych systemów, umożliwiających wykorzystanie komponentów militarnych i cywilnych na każdym poziomie reagowania (międzynarodowym, krajowym, regionalnym i lokalnym) w czasie pokoju, kryzysu i wojny. Zapobieganie i przeciwdziałanie zagrożeniom militarnym i niemilitarnym zarówno zewnętrznym, jak i wewnętrznym realizują w Polsce odpowiednio do tego przygotowane i funkcjonujące systemy: obronny państwa oraz zarządzania kryzysowego, a także systemy wsparcia bezpieczeństwa narodowego2. Bazę wymienionych systemów stanowią organy, siły i środki powołane do działań o charakterze politycznym, ekonomicznym, wojskowym i innym, skierowane na zapewnienie bezpieczeństwa jednostce, społeczeństwu i państwu. Należy podkreślić, że pomimo braku jednolitych rozwiązań prawnych w obszarze bezpieczeństwa narodowego, wymienionym systemom przyświecają wspólne cele, określone w dokumentach strategicznych , a realizowane w ramach systemu bezpieczeństwa narodowego. Jest on ukierunkowany na przeciwdziałanie wszelkim zagrożeniom państwa, a w szczególności politycznym, militarnym, gospodarczym, ekologicznym, kulturowym, informacyjnym oraz społecznym. Sygnały dochodzące od praktyków oraz analiza literatury przedmiotu wskazują, że obecny stan prawny w zakresie przygotowań obronnych państwa oraz zarządzania kryzysowego rodzi wiele problemów wykonawczych związanych przede wszystkim z podejmowaniem stosownych działań przez organy administracji publicznej oraz przedsiębiorców w czasie pokoju, kryzysu oraz wojny. Treści zawarte w niniejszym artykule stanowią próbę analizy funkcjonowania obu wymienionych obszarów przygotowań państwa w systemie bezpieczeństwa narodowego RP, w aspekcie ich integracji. Przedstawione w artykule propozycje zmian prawnych i organizacyjnych w przedmiotowym zakresie mają istotne znaczenie przede wszystkim dla szczebla terenowego (województw, powiatów i gmin), ponieważ upraszczają i podnoszą efektywność ich działania w czasie pokoju, kryzysu oraz wojny. Mogą one zostać wprowadzone w ramach istniejącego porządku konstytucyjnego, ale proces integracji będzie wymagał zmiany szeregu aktów prawnych, z ustawami włącznie. Based on the events of the last decade of the previous century and the ongoing armed conflicts, it is true to say that people manage situations which they are prepared for much more effectively than ones that constitute a surprise for them. One should be aware that contemporary threats and challenges are different from those of the Cold War period, and the boundary between internal and external security, the police and army, crisis prevention and crisis response is becoming artificial and vague. These factors force the evolution of national security systems consisting in the integration of powers and measures included in these systems, which enable the usage of military and civilian components at every stage of crisis response (international, national, regional and local) in times of peace, crisis and war. Preventing and counteracting military and non-military threats, both external and internal, is performed in Poland by appropriately prepared and functioning systems: the state defence system and the crisis management system, as well as the national security support systems . The basis for these systems is constituted by the bodies, powers and measures appointed to fulfil tasks of a political, economic and military character aimed at ensuring security for individuals, society and the state. It needs to be emphasised that, despite the lack of legal solutions in the field of national security, the above mentioned systems share common goals defined in strategic documents , which are achieved within the national security system. This system aims at counteracting any threats to the state, in particular, political, military, economic, ecological, cultural, information and social ones. The signals given by practitioners, as well as the analysis of reference literature, indicate that the current legal situation in the field of state defence preparations and the crisis management system generate multiple executive problems connected, above all, with the undertaking of appropriate actions by public administration bodies and entrepreneurs in times of peace, crisis and war. This article aims to analyse the functioning of both these fields of state preparations in the national security system of the Republic of Poland, from the point of view of their integration. The legal and organisational changes proposed in this article in the objective scope are of significant importance, above all, for the territorial level (province [województwo], district [powiat] and commune [gmina]), as they simplify and increase the effectiveness of their activity in times of peace, crisis and war. They may be introduced within the framework of the existing constitutional order; however, the integration process will require amending multiple legal documents, including acts. The author is aware that the article does not cover the entirety of issues connected with the integration of state defence preparations and crisis management, and constitutes a contribution to further discussion and research in this respect.

Materiał jest poświęcony kompetencjom, jakie posiadają w województwie zasadnicze organy administracji publicznej w realizacji zadań na rzecz obronności. W odniesieniu do po-szczególnych aktów prawnych autorzy przedstawiają zwłaszcza kompetencje wojewody, który na zarządzanym przez niego terytorium posiada uprawnienia do koordynowania wszelkich działań w sferze militarnej (poza sprawami operacyjnego użycia Sił Zbrojnych RP) oraz niemilitarnej na rzecz obronności. Ważną rolę w tym zakresie odgrywa także dążenie do nadania tym działaniom wymiaru praktycznego. Przyjęcie w Polsce zasadniczego dokumentu strategicznego – Strategii na rzecz Odpowiedzialnego Rozwoju do roku 2020 (z perspektywą do 2030 r.), a przede wszystkim określenie w niej celów działania, kierunków interwencji oraz programów powoduje, że działania poszczególnych instytucji w różnych obszarach – także obronności – są spójne i adekwatne do zidentyfikowanych zagrożeń, wyzwań oraz potrzeb.
The following material is devoted to the competences of basic public administration bod-ies in the voivodeship for the implementation of defence tasks. With reference to individual legal acts, the authors discuss the competences of the voivode, who has the power to coordi-nate all the activities in the military sphere (except for matters of operational use of the Polish Armed Forces) and non-military for defence. An attempt to give these activities a prac-tical dimension also plays an important role in this respect. The adoption of the key strategic document in our country - the Strategy for Responsible Development until 2020 (with a per-spective to 2030), and above all the defining of its objectives, directions of intervention and programs means that the activities of individual institutions in various areas – including defence – are coherent and adequate to the identified threats, challenges and needs.

For the smooth functioning of the defense system of the state, as well as any other system, it is necessary for its elements to cooperate. In particular, interaction in crisis situations (e.g. external threats, attack on the territory of the state) elements belonging to different subsystems. In terms of the subject, the main executive elements of the defense system are civilian and military elements. Bearing in mind the holistic approach to defence matters and the wide spectrum of needs of the Armed Forces conducting a defence operation, it is necessary to draw on non-military resources and capabilities. Prezentowane opracowanie dotyczy relacji cywilno-wojskowych w sytuacjach szczególnego zagrożenia bezpieczeństwa państwa, w tym zagrożeń uzasadniających wprowadzenie stanu kwalifikowanego. W artykule zawarto ocenę aktów prawnych regulujących funkcjonowanie państwa w czasie stanu nadzwyczajnego, ze szczególnym uwzględnieniem zapisów mogących stanowić podstawę dla podejmowania wspólnych działań przez podmioty cywilne i wojskowe. Problematyka stanów nadzwyczajnych uregulowana została w konstytucji, ustawach o stanach nadzwyczajnych i rozporządzeniach wykonawczych do ustaw. Zapisy będące podstawą dla współpracy cywilno-wojskowej stanowią jedynie małą częścią przytoczonych aktów prawnych, nie stanowią zasadniczego przedmiotu regulacji. Natomiast podstawowe zasady i reguły współpracy cywilno-wojskowej określone zostały w dokumentach doktrynalnych Sił Zbrojnych, tj. w dokumentach, które obowiązują jednostki organizacyjne Sił Zbrojnych, a w instytucjach i organach administracji publicznej mogą być jedynie wykorzystywane bez nakazu obowiązywania.
This study concerns civil-military relations in the situations in which there is a special threat to the security of the state, including threats justifying the introduction of a certified status. This article provides an assessment of the legal instruments governing the functioning of the country in an emergency state, with particular focus on the provisions that may form the basis for joint action by civil and military operators. The issue of emergency states was regulated in the constitution, in the laws on emergency states and in implementing regulations. The provisions that are the basis for civil-military cooperation are only a small part of the abovementioned legal acts and they do not constitute their essential subject-matter. The basic principles and rules of civil-military cooperation are laid down in the doctrinal documents of the armed forces, i.e. in the documents that apply to units of the armed forces, which can also be applied in the institutions and bodies of public administration, but then they are not legally binding.

Niniejszy artykuł przedstawia problematykę dotyczącą pozycji ustrojowej wybranych organów państwa (określoną głównie w Konstytucji RP z 1997 r., ale również w aktach prawnych niższego rzędu) w kontekście wykonywania przez te organy zadań w obszarze przygotowań obronnych w czasie pokoju, jak również funkcjonowania ich w sytuacji zewnętrznego zagrożenia bezpieczeństwa państwa i w czasie wojny. Pozycja ustrojowa, w szczególności naczelnych organów państwa, jak również relacje między nimi oraz sprawowane funkcje w obszarze bezpieczeństwa i obronności państwa wynikają w dużej mierze z systemu rządów przyjętego w państwie. W świetle powyższego, niniejszy materiał stanowi podstawę do określenia, czy obecnie przyjęte rozwiązania prawnoustrojowe stwarzają właściwe warunki dla sprawnego funkcjonowania naczelnych organów państwa w sytuacji szczególnego zagrożenia.
The purpose of this study was to investigate the position of certain state bodies/authorities (as defined by the Constitution and other legal acts)in the area of defence preparation in peace, emergency and war time. The position of the state bodies in this area is determined by the adopted system of governance. The study focused on examining whether the adopted constitutional regime creates the appropriate and adequate conditions for the functioning and operating of the state bodies/authorities in the case of emergency.
