    Apostolic Letter Motu Proprio of Pope Francis, Mitis Iudex Dominus Iesus, institutes in art. 2 Ratio procedendi, a new procedure for the pre- -judicial also called pastoral inquiry. It should take place “in diocesan and parish structures for separated or divorced faithful who have doubts regarding the validity of their marriage or are convinced of its nullity”. It should also lead to getting know the situation of those persons and gathering all useful for the possible judicial course information. It seems that a legislator completely consciously calls the procedure investigatio praeiudicialis in contrast to investigatio praevia presented in can. 1717 – 1719 CIC and in DC, art. 120, §1. They are different according to both, the nature and proceeding and it is not possible to mix or substitute them. Following submission will constitute a comparative analysis of investigatio praeiudicialis included in art. 2 Ratio procedendi CIC/MIDI; investigatio praevia included in art. 120, §1 DC as well as investigatio praevia included in can. 1717-1719 CIC.

    In regard to a growth of a phenomenon of the pentecostalization of Christian religion and an increase of  interest connected with rites of exorcism, it is worth reminding the legal norms concerning a ministry of an exorcist at the Church. Following article constitutes an attempt to systematize those norms as well as to set general criteria according to the power of exercise the rite of exorcism. For this purpose, the following Church documents: the 1983 Code of Canon Law, Roman Ritual De exorcismis et supplicationibus quibusdam, Indications of Polish Bishop’s Conference for priests who fulfill the ministry of exorcist, the Letter of Congregation for the Doctrine of the Faith Inde ab aliquot annis and the instruction of that Congregation Ardens felicitatis, have been subjected to detailed analysis.

    Wraz z rozwojem oraz powszechnością środków komunikacji elektronicznej, w praktyce sądowej zauważyć można wzmożoną aktywność stron polegającą na przedkładaniu różnego rodzaju dokumentów (np. skany SMS-ów, wydruki poczty elektronicznej) jako materiał dowodowy. Wartość dowodowa takich materiałów często bywa wątpliwa lub wręcz znikoma, przede wszystkim ze względu na trudności z weryfikacją ich autentyczności. Bywa jednak, że tego typu dowód okazuje się przydatny dla sprawy. Celem niniejszego przedłożenia jest próba krytycznej oceny przydatności dokumentów prywatnych jako dowodu w kanonicznym procesie o stwierdzenie nieważności małżeństwa.
    Together with an improvement and universality of means of electronic communication, there is noticeable growth of parties’ activity consisting of submitting different kinds of documents (e.g. text messages’ scans or electronic mail’s prints) as evidence in jurisprudence. Evidential value of such materials is often doubtful or even insignificant, first of all, because of difficulties with verification of their authenticity. It happens, however, that this type of evidence proves useful for the case. The aim of present submission is a try of critical assessment of private documents’ suitability as proof in canonical trial for marriage nullity.

Mając na uwadze znowelizowane przez Konferencję Episkopatu Polski normy prawne dotyczące przygotowania do małżeństwa oraz ochrony danych osobowych niniejszy artykuł systematyzuje temat zapowiedzi przedmałżeńskich w aktualnym porządku prawnym Kościoła katolickiego w Polsce.
    According to can. 1067 of the Code of Canon Law „The Episcopal Conference should issue norms relating the examination of spouses, the marriage banns and other opportune means to accomplish the investigations necessary before marriage, so that the parish priest, following them diligently, may assist in the marriage”. Taking into account the legal norms regarding preparation for marriage and the protection of personal data amended by the Polish Bishops’ Conference, this article systematizes the topic of premarital announcements in the current legal order of the Catholic Church in Poland.

    Rozpatrywanie spraw o nieważność małżeństwa z tytułu niezdolności, o której w kan. 1095 KPK, w procesie skróconym wciąż budzi wiele wątpliwości. Są one związane przede wszystkim z tematem biegłych sądowych. Niniejszy artykuł jest propozycją praktycznego rozwiązania tej kwestii, polegającą na możliwości ustanowienia biegłego sądowego asesorem. W tym celu szczegółowej analizie zostały poddane przepisy prawne dotyczące biegłych sądowych oraz urzędu asesora w procesie kanonicznym.
    Considering cases for marriage nullity in virtue of inability described in can.1095 CIC, in the briefer process, still raises many doubts. They are connected, first of all, with a topic of court experts. The present article is a proposition of a practical solution to that issue consisting in a possibility of assigning a court expert to assessor.For this purpose, rules of law concerning court experts as well as the office of assessor in a canonical process had been analyzed in detail.

    The central part of cases to declare the nullity of marriage is investigation. Code of Canon Law enumerates following evidence: the declarations of the parties, proof through documents, witnesses and testimonies, experts, judicial examination and inspection, presumptions. Among these the most popular in cases to declare the nullity of marriage are undoubtedly witnesses and testimonies. It is true that can. 1549 CIC prescribe very wide the possibilities of using these means, however not everyone might be a witness. Among few categories of people unable to witnessing at court, the law enumerates inter alia, priests. However this inability is not absolute and it results from the specific character of pastoral ministry. Main interest of present compilation is an analysis of can. 1548 CIC and can. 1550 CIC according to cleric persons. An inability to witnessing at court resulting from the secrecy of confession, and exemption from obligatory testimonies resulting from conducting sacred ministry, are two basic categories limiting the possibility of calling a clergyman in testimony. The present compilation comprises an attempt of analysis of practical usage of these legal norms.

    Pojęcie bonum familiae, choć samo w sobie nie jest kategorią prawną, pojawia się coraz częściej w kontekście procesów o stwierdzenie nieważności małżeństwa. Stało się również przedmiotem przemówienia Ojca Świętego Franciszka do pracowników Trybunału Roty Rzymskiej na inaugurację roku sądowego (29 stycznia 2021 roku). Papież w swoim przemówieniu zwraca uwagę na dwie kwestie: z jednej strony bonum familiae nie jest i nie może być rozpatrywane jako przyczyna nieważności małżeństwa, z drugiej jednak strony może i powinno być uwzględniane przez sędziów kościelnych w rozstrzygnięciach procesów o nieważność małżeństwa. Niniejszy artykuł, po zdefiniowaniu pojęcia bonum familiae, podejmuje próbę interpretacji papieskiego przemówienia w kontekście kan. 1691 § 1 KPK/83. Praktyczną aplikację stanowi zachęta do przypominania stronom procesów o nieważność małżeństwa o ich moralnych i cywilnych zobowiązaniach względem siebie i potomstwa.
    The notion of bonum familiae, although it is not a legal category in itself, appears more and more often in the context of nullity of marriage processes. It has also become a subject of an address of His Holiness Pope Francis to the officials of the Tribunal of the Roman Rota for the inauguration of the judicial year (the 29th of January, 2021). The Pope draws attention to two issues: on the one hand, bonum familiae is not a reason and it cannot be considered as the reason of nullity of marriage, on the other hand, however, it can and it should be taken into consideration by the canonical lawyers in adjudications of the nullity of marriage processes. In this article, after defining the concept of bonum familiae, an attempt of interpretation of the Pope’s address has been undertaken within the context of can. 1691 § 1 CIC/83. An incentive to remind the parties to the process of nullity of marriage about moral and civil obligations towards each other and their offspring, provides a practical application.
