    From 1 January 1999, in force in Poland a three–tier structure of local government : municipal government , county government , the provincial government . Tasks that perform individual units of local government are divided into their own tasks and commissioned . Local government is a separate territorial units in the structure of the state, created by law relationship of the local population.     Opis:
    In 2009 and 2010 Poland and Germany are celebrating some important anniversaries - 20 years of the first free elections and the fall of the Berlin Wall. These jubilees inspire research aiming at taking stock of developments having unfolded over this time. Since the economic cohesion is high on the EU agenda, examining international and interregional differences seems an important research task. This article aims at evaluating and comparing σ-convergence (diminishing discrepancies of GDP p.c.) in Poland (1995-2005) and Germany (1992-2006) on three NUTS levels. Preliminary results point to inequalities regularly diminishing in Germany, however, growing in Poland. A tentative reasoning suggests that increasing values of regional differences observed in Poland might be a temporary phenomenon.

    The paper has two main objectives: the first is to present an overview of the phenomenon of multi-word items in English, and discuss their prevalence in native speaker usage. The second is to discuss how proficient non-native speakers of English, and in particular those who are training to become translators, may benefit from classroom training that increases awareness of the primary role of chunks and other multiword units in native-like speech. It is argued that classroom training may tend to emphasise grammar rules and lexis over building a repertoire of multi-word items; more practise in this area may improve fluency, conserve energy, and enhance long-term language learning among adult foreign language users with nuanced foreign language performance goals.

    Dotacje celowe, jako źródło dochodów jednostek samorządu terytorialnego (jst), są oceniane krytycznie. Zarzuca im się między innymi to, że: ograniczają samodzielność finansową jst oraz nie stwarzają odpowiednich bodźców do zwiększenia przez nie wysiłku dochodowego, poprawy efektywności gospodarowania środkami publicznymi i wzrostu odpowiedzialności za podejmowane decyzje. Remedium na niedostatki tych dotacji jest zmiana podejścia do konstrukcji dotacji. W literaturze postuluje się dofinansowywanie działalności jst w formie dotacji zorientowanych na sprawność/rezultaty, czyli dotacji wynikowych. Ich istota polega na uzależnieniu otrzymania dotacji i jej wysokości od osiągnięcia przez jst określonych wyników, przy jednoczesnym pozostawieniu beneficjentowi pełnej swobody w definiowaniu sposobu wykonania zadania i uzyskania tych wyników. Rozliczanie jst za uzyskane wyniki, a nie za wydatkowanie środków, przywodzi na myśl koncepcję budżetu zadaniowego. Zbieżność pomiędzy tym budżetem a wymienionymi dotacjami jest podstawą do postawienia tezy, zgodnie z którą upowszechnienie budżetowania zadaniowego w sektorze finansów publicznych w Polsce będzie bodźcem do racjonalizacji systemu dotacji budżetowych dla jst. Jeżeli tak się stanie, wprowadzenie dotacji wynikowych będzie wartością dodaną budżetu zadaniowego.
    The award of grants as a source of revenue for local and regional self-government units are criticized because they limit their financial autonomy, and do not create adequate incentives to either increase their fiscal effort, improve the efficiency of public expenditure or increase accountability. The literature proposes the co-financing of the activities of local government units in the form of grants focused on performance/results. These types of grant are called performance-oriented grants. A local government unit will receive these grants if it achieves specific results. In contrast to traditionally awarded grants, the local and regional self-government unit has the freedom to define how to perform the task and get the required results. Local government units being evaluated on results, not on total spending, is reminiscent of the concept of performance-based budgeting. The coincidence between this budget and such grants is the basis for the thesis that the dissemination of performance-based budgeting in the public finance sector in Poland will be an incentive to the rationalization of grants for local and regional self-government units. If this happens, the implementation of performance-oriented grants will provide added value to performance-based budgeting.

    Budżet zadaniowy jako narzędzie nowego zarządzania publicznego jest wdrażany w Polsce od niedawna w sektorze finansów publicznych. W artykule przedstawiono istotę budżetu zadaniowego jako nowoczesnego zarządzania finansami jednostek samorządu terytorialnego, które ma się przyczyniać do poprawy efektywności gospodarowania środkami publicznymi. Dokonano wskazania korzyści i zagrożeń płynących z wdrożenia budżetu zadaniowego, w szczególności w kontekście wykorzystania przez samorządy środków UE, oraz pokazano metodykęjego tworzenia.
    Performance budgeting as a tool of New Public Management has been implemented in Poland recently in the public finance sector. The paper presents the essence of performance budgeting as a modern method of managing the finances of local government units, with the aim of improving the efficiency of public expenditure management. It also indicates the benefits and risks resulting from the implementation of performance budgeting, in particular in the context of the use of EU funds by local governments, as well as presenting the methodology for its creation.

    Opis:
    Judicial capacity consists in the transposing of substantive law subjectivity to proceedings under civil law in a form allowing valid proceedings closing with a judgment, said proceedings involving the participation of a specific entity. A party without capacity for the status of specific subjective rights or legal relationship cannot expect to participate in a valid trial closing with a judgment. Three categories of entities with general legal capacity – private individuals (natural persons), legal persons, and organisational units as stipulated by provisions of Article 64 §11 of the Civil Proceedings Code – have been equipped with judicial capacity, as they can be party to legal relations constituting the subject of action. The participation of such entities in proceedings under civil law – while potentially concerning any case – shall only apply to cases under civil law wherein entities as duly indicated act to protect their legal circumstances associated with events potentially occurring prior to the commencement of judicial proceedings. They should only appear as parties in civil cases involving their activities on their own behalf and to their own benefit.
