Opis:
The Act on Management of Agricultural Property Stock of the State Treasury contains a regulation on contractual obligations imposed on the purchaser of an agricultural property acquired from the Agricultural Property Stock of the State Treasury. These obligations are not imposed on the purchaser by operation of law, however, there is a requirement that they have to be included, in certain cases of acquisition detailed in the provisions of the Act, in the content of the real estate sales agreement. The sales agreement has to stipulate that the purchaser is prohibited from selling the real estate for a period of 15 years from its acquisition; the purchaser is obliged to conduct agricultural activity on the purchased property; and that during this period, the purchaser may not encumber the property with any mortgage. Any violation of the aforementioned stipulations shall result in the purchaser’s obligation to pay an amount equal to 40% of the property’s sale price. In addition, the legislator has introduced the obligation to pay this amount in the event that the purchaser makes any false statement or representation as to the origin of the funds allocated to the purchase of the real estate. The provisions relating to the issues raised in the article cause a number of interpretative doubts as to their correct understanding. In particular, this applies to the legal nature of the obligation to pay an amount equal to 40% of the price of the purchased real estate property.

Agricultural Property Stock of the State
Opis:
Ziemia w rolnictwie stanowi jednocześnie najważniejszy środek produkcji i przedmiot pracy. W Polsce średnia powierzchnia gospodarstwa rolnego w 2015 r. wynosiła 10 ha użytków rolnych. Tymczasem, by osiągnąć wynagrodzenie za pracę takie samo jak poza rolnictwem, potrzeba 30 ha ziemi rolniczej. Stąd występuje duży popyt na ziemię. Jednym ze sposobów zaspokojenia tego popytu jest dzierżawa ziemi. W zależności od tego, kto jest właścicielem ziemi, wyróżniamy dzierżawy międzysąsiedzkie dotyczące gruntów prywatnych i dzierżawy działek ziemi z Zasobu Własności Rolnej Skarbu Państwa. Te dwa rodzaje dzierżaw mają swoją specyfikę i w sposób istotny różnią się od siebie. Dzierżawcy ziemi płacą na rzecz ich właścicieli czynsze dzierżawne. Ich wysokość szybko rośnie i wykazuje duże zróżnicowanie. Dzierżawa ziemi jest w polskim rolnictwie ważnym sposobem koncentracji produkcji i zmian struktury agrarnej. Ze względu na skomplikowany charakter problem dzierżawy ziemi rolniczej wymaga uregulowania prawnego w formie ustawy.
In Poland agricultural land is both the most important means of production and the subject of labour. In 2015, the average farm area in Poland was 10 ha of agricultural land. Stanisław Urban 37 Nevertheless, it takes 30 ha of agricultural land to reach salary levels equal to those obtained in other branches of national economy. Thus the demand for agricultural land is high. Land tenancy constitutes one way of satisfying that demand. Depending on the nature of the ownership of the land, we distinguish between inter-neighbourly tenancy of privately-owned land and the tenancy of the land which is administered by the Agricultural Property Stock of the State Treasury. These two kinds of land tenancy have their own peculiarities and differ from each other significantly. Leaseholders of agricultural land pay the rent to its owners. The rent levels are rising sharply. Furthermore, a distinctive polarisation of payments for the various kinds of tenancy has been observed recently. In Poland, land tenancy is a significant way of production concentration and agrarian structure transformation. Taking into consideration its complex nature and a lot of potentially contentious problems it poses, the question of land tenancy needs to be regulated in the form of a legal act.

The paper begins by emphasizing the fact that, on a historical scale, one can have several views of the relationship that has existed over time between ethics and capitalism, namely: missionary, ‘Nietzschean’, critical, and ‘regulatory’. It is argued that, nowadays, the capitalization of the contributions supplied, over time, by the four views embraces the form of two modern diametrically opposed perspectives, i.e.: on the one hand, there is the interpretation given by the neo-classical school of thought (mainstream economics) and, on the other hand, it comes to the interpretation given by the Austrian praxeological economic school (libertarian economics). The emphasis of the analysis is put on the assertions developed by the last one, libertarian thinking, that insists on the necessity to operate with a well-defined distinction between the legal level of the matter, the ethical level and the moral one. At the core of the libertarian analysis there is the understanding of the capitalist system being naturally impregnated by ethical values. And this intrinsic ethical nature of capitalism is organically bound to the sphere of the ownership-type relationship. In line with the understanding of the economic system, based on the institutions of the free market as representing ethical capitalism per se, the paper argues that the realities of the world today show governmental interventionism as a main factor that supports non-ethical economic behaviour. As a consequence, the more limited government intervention is, the greater the chance of ethical capitalism, that is, voluntary, non-conflictual and non-aggressive economic market relationships. Under such conditions, a ‘minimal state’ institutional arrangement (that is, the legitimate use of power by the state is limited to preventing fraud or the use of force; it does not include the power to tax or to confiscate property) is the basic condition for the existence of an ethical capitalism that works, which is to say that the chance of an economic system based on ethical values stands in people’s willingness to be part of such an evolution in society that aims to minimise the role of the state. Further, the paper argues that any historical analysis on how societies asserted such a willingness outlines the expression of a secular and unshaken option for growing rather than diminishing state involvement in the economy. It is about people’s perennial preference for the state, namely for the organization of society based on state interventionism (respectively, their preference for the coercive order imposed by the state authorities, order based, through its own nature, on the subjugation of private property and the aggression against individual freedom), with a preference for the government intervention over the organization of a society based on free market functioning (which is equivalent, in fact, to their rejection of a voluntarily and spontaneously non-violent order, based on the observance of private property and individual freedom, brought about by the free functioning of markets). In the last part of the paper there are put forward for discussion the possible explanations for this perennial preference for non-ethical capitalism, the analysis focusing on two directions: firstly, on that of social ontology; and then, on that of human psychology.
