Opis:
Promoting the rule of the law is a national responsibility. The obligation to ensure legality and advance human rights rests on the national government. This article analyzes how federalism, a system of distributing power among subnational entities, can promote this national goal. The article explores how states in the United States have played an important role in encouraging the federal government to enforce the law and safeguard rights. By means of resistance, cooperation, and redundancy, states have moved the United States closer to rule-of-law ideals. The state action sometimes takes the form of litigation, with states bringing suit against the federal government. Such suits have particular significance in challenging illegal inaction by the national government, as when the federal government fails to enforce environmental laws. Litigation by states may overcome standing barriers that would limit such suits by private individuals. States may also engage in direct action by pursuing their own policies that promote the rule of law. In these areas, the states may oppose the federal government, cooperate with the federal government, or act in an independent, parallel manner. What unites all of these modes and instruments of state-federal interaction is that the goal of states is to influence national policy. The state action may begin within the boundaries of a particular state, but what motivates the state initiative is a vision applicable to the nation as a whole. The ultimate aim of state action is not local divergence, but national uniformity. Federalism serves not as a license for local deviation from national norms, but instead as a means for states to engage actively in creating policy at a national level. In this way, independent state activity can indeed promote the national obligation to promote the rule of law throughout the country.

Opis:
The article describes the appliance of law in French and Polish legal systems and the role of jurisprudence in both jurisdictions. In France and Poland the functioning of general clauses is completely different and the aim of the paper is the presentation of thinking about law in both states by depiction of literature and judgements. As the example I chose the clause of ordre public due to the vast differences in operation of the institution in both legal systems. It is a general clause being one of foundations of French civil law whereas in Poland it functions only in very limited range. In French law the main regulation is included in Article 6 of Code civil. The further rules refering to ordre public in the field of contract law are placed in art. 1102 and 1162. In 2016 there was the reform of law of obligations in Code civil and the legal status before and after were presented. Ordre public is effectively used by jurisprudence in a number of cases in French civil law. Due to rare changes in Code civil French courts have much more freedom in deciding about legal cases than the Polish ones. French state very deeply interferes into the economy so the courts must be provided with legal instruments in order to deal with the problems and apply the rule of law to each case. In Polish law ordre public existed in art. 55 of Code of obligations (freedom of contract) but nowadays we can find only in Article 7 of international private law. Ordre public is the field of international private law is vital but courts are very cautious in its appliance, limiting its usage only to a few cases, such as denial of registration a homosexual union into civil registry. Why Polish courts are so uneager to use the clause? In our legal culture the judges are wary of general clauses and the operation of ordre public is just one of examples. This proves a different usage of general clauses in both legal systems and difference in legal cultures. French jurisprudence has an immense effect on the shape of law, courts actively apply the clause of ordre public while in Poland the verdicts are cautious. Way of thinking about law differs in both states despite the common heritage of Roman law and belonging to the tradition of civil law. In France the freedom of deciding about the cases in the major value while in Poland this certainty of verdicts is believed to be the most important principle.

Opis:
The article presents some results of preparing a Polish translation of Thomas Hobbes’s first important work, Elements of law, natural and politic. I focus on explaining various meanings of the term “conception” as it is used by Hobbes in this writing. In his philosophy Hobbes uses the term in three different ways. The first of them refers to sense (or sensation) and image arising on sense organs as a result of the movement of external bodies mechanically affecting them. In its second meaning “conception” is understood as imagination, described also as a decaying sense. According to the third use of the term, “conception” is a state of understanding of something, or possessing a conception caused by speech (complex imagination). Such an undertaking makes it possible to reconstruct the development of the meaning of the term within the philosophy of Hobbes and the relation between his early and later writings, namely Elements of Law, Leviathan and De Corpore.

He associated development of many institutions of law specifically with social needs. The article also provides insight into certain aspects of how E. V. Vaskovsky interpreted the social meaning of various civil law institutions, as well as different restrictions of legal rights to the shared benefit. It is shown that the scientist believed that court activities related to justice administration are of particular social importance. It is also underlined that E. V. Opis:
The article is devoted to the views of Professor E. V. Vaskovsky on the system of Russian civil law of the late XIX beginning of XX centuries. Giving a presentation on the civil law system E. V. Vaskovsky, first of all, emphasizes the feasibility of isolation in a special section of the general part. The most important parts of civil law system, he believes property law, law of obligations, family law and inheritance law, constitute a special part of civil law. Author composed of sections, which are section of the special part of civil law, including the rights materialized, embodies the bearer. Summing up the views of E. V. Vaskovsky on the system of civil law, it should be noted that along with the traditional inclusion of family law, the novella is extremely large character that took place in the end of XIX century in the field of legal regulation of intellectual creativity, and found in it reflected. Further, the article presents a generalized analysis of the current system of the Russian civil law. The concept of the civil law system, all also based on the division into the general and special part. Now, however, in the civil law system is allocated a number of subbrunches. Selecting subbrunches of the modern civil law associates with the isolation of each of them with their own general part. Currently, the structure of the special part of civil law includes the following subbrunches: corporate law; property law; inheritance law; law of obligations; the law of “intellectual property”; commercial law. Historical experience has shown that the “materialized rights” that E. V. Vaskovsky also singled out in the structure of the special part of civil law did not subbrunch of the modern Russian civil law, as the rapid development of the stock exchange trade resulted in the so-called “dematerialization” of securities, which is the main instrument of the stock market. Currently, the data set of rules should be considered as one of the most important institutions of commercial law as a subbrunch of modern civil law.

Opis:
The article draws attention to one remarkable feature in the perception of the Hermann Cohen doctrine in Russia, namely special attention on the part of Russian philosophers of the twentieth century to the turn of the ethical theories of the founder of the Marburg school of neo-Kantianism. In Russia, the most representative approach to the analysis of Cohen’s ethical theories is one conducted from the perspective of the philosophy of law. Ethical theories of the Marburg philosopher were in the center of scientific debate of the most famous Russian theorists of law – P.I. Novgorodtsev, B.A. Kistyakovsky, E.V. Spektorsky. The appeal rights of Russian theorists to analyze ethical problems Cohen highlighted the relation of law and morality. The central theme of the arguments in this respect was the theme of ethics orientation of the Marburg philosopher on jurisprudence. Of particular importance in view of the historicist and positivist tendencies that prevailed at the end of the 19th century in legal science in Russia, was rehabilitation of Cohen’s and his followers’ the concept of “natural law”. The main drawback of the criticism coming from Russian theorists of law in relation to Cohen is that their approach to the ideas of this great German thinker is not systematic enough, attempting to consider their ethical views independently from other parts of their philosophical constructions.

His fame as a material civil lawyer and, in particular, as a civil lawyer-educator, somewhat less; even in Russia, the star of his civil-name is eclipsing by other many civil stars, more bright and flashy. The article attempts to at least partially fix this obvious injustice – tell about “The Handbook of Civil Law” by Evgeniy Vaskovsky. Unfortunately, the Handbook was left unfinished: it was limited to only two parties – the General Provisions and the Rights in Rem. Despite this fact, as well as those one hundred thirty years that have passed since its publication, “The Handbook of Civil Law” by Evgeniy Vaskovsky continues to be more than relevant, useful and even instructive piece not only academic, but also scientific as well as practical destination.

The article concerns the place of the English Great Charter of Liberties in the teaching of law in Poland. The presentation of the ways of describing this document and its provisions in the most important Polish handbooks on the history of political systems, is preceded by the short historical analysis of the position (still significant) of the history of law in the curriculum of the teaching of law at Polish universities. The English Magna Carta from 1215 became one of the most important documents in the history of constitutionalism. This privilage, delivered to the English barons by king John Lackland, began to play, since the XVIIth century, the foundamental role for the concept of civic liberties and then became the basis of English parlamentarism. In that double sense Magna Carta has for 200 years been present in the education of Polish lawyers. In the article the author analizes from that viewpoint the content of the most influent Polish handbooks on the history of political systems as well as on constitutional law.

Human dignity in the Polish law is considered as the basis for the system of rights and freedoms regulated in Chapter II of the Constitution of 1997. In turn, the rule of law is a principle of constitutional democracy respecting human rights. Procedural rules focus on the manner in which the state operates, also in relation to individuals. Procedural justice as a principle derived from the rule of law can be defined as a set of values whose guarantee in legal norms and implementation in procedural practice affects their fairness and enables their positive evaluation. The jurisprudence of the Constitutional Tribunal considers the principle of procedural fairness as one of the principles of the rule of law and binds it with the right to court which means exactly: 1) the right of access to court, 2) the right to really fair procedure, 3) the right to court judgment, and 4) the right to appropriate shape of the system of the authorities examining cases. Appropriate shaping (fairness) of the procedure within the meaning presented by the Constitutional Tribunal ensures in particular that the parties of proceedings have: the right to be heard; the right to obtain a justification of the decision, which prevents arbitrary action of the court; ensured predictability of the proceedings; guarantee of procedural measures balancing the position of the parties; ensured the control of the decision by a superior instance; guarantee of impartiality of the judge. Meeting these requirements guarantees respect for dignity of a man as a participant in the proceedings.

Opis:
The paper aims to study the work of Leon Petrazycki and analyze modern Ukrainian scholars’ opinions on Petrazycki’s scientific achievements. This study focuses on Petrazycki’s work, his psychological theory, in particular, in view of our own perspective on the law and within the framework of our theological and sociological theory, which considers the law as a social life phenomenon and regards moral imperative of the Almighty God as the basis of law. Every civilization communicates moral imperative through sacred writings (the Ten Commandments in Christian Bible, six hundred and seven rules in Jewish Torah, seventy-two rules in Muslim Quran). It is within the framework of this moral imperative that the society and the state develop the law. The paper addresses the modern absurdity and at the same time antinomy of law, lying in the fact that there is more and more law in the society but less and less law in life of an individual due to the fact that states rapidly upscale rulemaking, but laws are becoming less accessible to an individual. This study draws on conceptual issues of Petrazycki’s theoretical heritage, fundamental principles of his psychological theory, as well as connection between law and morality, described by Petrazycki, which are the spiritual heritage of society. The most important issues of Petrazycki’s work, in our opinion, are studying the nature of law, balance of emotion and intellect, official and intuitive, desirable and actual components in law, as well as subjective and objective law, law policy and power. The paper reveals that assessment of Petrazycki’s work in modern Ukrainian legal studies is ambivalent: from sharply critical (Prof. P. Rabinovich), compliant with Russian (O. Timoshina (St. Petersburg)) approach and critical yet positive perception of Petrazycki’s psychological theory (S. Maksymov, O. Merezhko, M. Kuz, O. Stovba) to admiration for Petrazycki’s genius, whose work was ahead of his time (I. Bezklubyi, N. Huralenko, V. Dudchenko, O. Rohach, M. Savchyn, V. Tymoshenko). Thus, the research findings suggest that Petrazycki’s work belongs not only to the past, but also to the present and future of jurisprudence, sociology, psychology, economics. Further in-depth analysis of Petrazycki’s heritage will contribute to more accurate diagnosis of urgent legal issues in social development of modern Ukraine, real assertion of personocentrism as a postulate of contemporary theoretical jurisprudence and guidelines for public authorities, as well as practical solution to many controversial scientific and legal issues.
