In the discussion on the future of the EU, the topic of differentiated integration has become a strategic issue, with different variants beginning to appear as modus operandi of the European Union, which has become a subject of controversy among Member States. Significantly, the debate on differentiated integration began to be accompanied by reflections on disintegration. This article attempts to define disintegration on the assumption that it should be defined through the prism of integration, and that such a defining process can not be limited to concluding a one-way contrast between disintegration versus integration and vice versa. This is due to the assumption that the European Union is a dichotomous construct in which integration and disintegration mutually exclude and complement each other. This dichotomy is most evident in the definition of integration and disintegration through the prism of Europeanisation top-down and bottom-up processes that generate, reveal, visualize, stimulate integration mechanisms what allows to diagnose their determinants. dyskusji o przyszłości UE strategicznym wątkiem stała się kwestia integracji zróżnicowanej, której różne warianty zaczęły jawić się jako modus operandi Unii Europejskiej, co stało się przedmiotem kontrowersji między państwami członkowskimi. Co istotne, debacie poświęconej integracji zróżnicowanej zaczęły towarzyszyć rozważania na temat dezintegracji. W niniejszym artykule podjęta została próba zdefiniowania dezintegracji przy założeniu, że powinna być ona definiowana poprzez integrację, a także iż tak zaprojektowany proces definiowania nie może ograniczać się do wnioskowania o jednotorowej przeciwstawności dezintegracji względem integracji i vice versa. Wynika to z przekonania, że Unia Europejska jest konstrukcją dychotomiczną, w której integracja i dezintegracja wzajemnie się wykluczają i uzupełniają. Dychotomia ta najpełniej przejawia się w definiowaniu integracji oraz dezintegracji przez pryzmat procesów europeizacji w wymiarze top-down i bottom-up, które generują, ujawniają, uwidaczniają, stymulują mechanizmy integracyjne co pozwala zdiagnozować ich determinanty.

The article is an attempt to analyse self-efficacy as a factor positively influencing a reaction to a traumatic event. There are three possible states which occur in response to trauma: lack of adaptation, adaptation, and a post-traumatic development. Coming from the assumptions of the functional perspective of psychological defense mechanisms, the feeling of selfefficacy is seen as enabling a task-oriented approach to trauma and perceiving it not only as a danger but also as a challenge. It allows to see a bigger perspective which helps not to fixate only on the traumatic event. The article describes several directions of shaping the self-efficacy in children’s education and proposes a few practical methods of shaping the self-efficacy among children.

The main aim of this article is to provide a critical analysis of selected provisions of the Directive and Regulation in respect of the capital requirements for banking and finance sector in the European Union. It focuses on the analysis of the following aspects: (i) proposed regimes, mechanisms and legal structures creating the European framework on the capital requirements; (ii) implications of the new legislation for the banking sector and for the national regulatory authorities; (iii) certain similarities between the Third Basel Accord prepared by the Basel Committee on the Banking Supervision and the proposed EU capital requirements package; and (iv) implications of the legislation for the Polish banking and finance sector. As the global financial crisis reshaped the approach to the banking institutions throughout the world, the authorities started to be more concerned about the safety and creation of certain mechanisms preventing the sudden issues of the banks and financial institutions, which were in consequence resolved by the taxpayers. The cooperation between EU authorities and the Basel Committee on Banking Supervision resulted in the creation of the new framework on the capital requirements for the European Banking sector. To a certain extent, the EU proposal is a part of global, legal framework setting out harmonized rules ensuring the general stabilization in the banking and finance sector. It also constitutes a continuation of the EU policy on ensuring the safety of the European banking and finance sector.

The complex system of decision-making in the Council of the European Union has many specific features which require explanation. This article presents a constructivist approach to this problem and focuses on the influence of socialisation. First, it explains why inquiry into the decision-making in the Council from the constructivist perspective is justified and then proposes the use of process-tracing, a method that allows to trace causal mechanisms linking the effects of socialisation and the characteristics of decision-making in the Council. Second, a typology of socialisation mechanisms and effects is presented. The third section is an attempt to use the inductive variety of process-tracing in order to explain certain qualities of decision-making in the Council. The final section outlines the theory-oriented approach to process-tracing, which could follow from the presented conceptualisation and explains the need to include the constitutive aspects of socialisation within the causal framework of process-tracing research.

The present paper discusses the outcomes of research realised as part of the ‘Recognising and encouraging the development of aptitude for learning mathematics in older kindergartners and primary school pupils’ project. To start with, data concerning the occurrence of mathematical giftedness in older pupils is offered together with an explanation of the reasons for the previous lack of interest in the issue of inclinations for mathematical giftedness in children. Subsequently, I present a description of the mental traits of older kindergarteners which indicate their inclination for mathematical giftedness. I also go on to outline the research programme on the basis of which I managed to: (a) develop diagnostic methods for determining the inclination for mathematical giftedness in children, (b) estimate the number of children manifesting an inclination for mathematical giftedness and children endowed with an inclination for outstanding mathematical giftedness, (c) determine the reasons why groups of children manifesting their mathematical giftedness become significantly reduced after the first months of education. Finally, I discuss the critical periods crucial for developing inclinations for mathematical giftedness in children. I additionally provide an explanation of why it is impossible to fix the neglected cultivation of an inclination for an aptitude in mathematics in the subsequent years of school education.

At the current stage of the European integration, the problems occurring as a result of the coexistence of the European private law, including contract law, and the national legal systems, find their origins in the differences in legal concepts underlying these legal orders, defined by different goals and hierarchies of values. In European private law, the tendency to protect the weaker party of the contractual relationship is stronger than in national legal systems, or at least some of them. This results from the fact that the European legislator confers particular importance to the consumer protection, employment, public health and access to the public utility services (transport, telecommunications and Internet services, energy). In these very fields, European law limits the parties’ formal autonomy in order to guarantee their actual autonomy. The regulatory functions of the European law determine the content of legal relationships in order to compensate the “deficiency of equality” by strengthening the weaker party and limiting the professional’s rights. By these means a perspective based on the distributive axiology rather than on the commutative function typical for the civilistic relationships is being introduced into private law. This trend is reflected in the EU Court of Justice case-law. The abovementioned tendencies clearly correspond with the ongoing evolution of the national systems of private law under the influence of European law. In other words, the impact of the European law is getting stronger, and this not only by way of introducing new regulations, but also due to the alteration of the methods of legal interpretation and applying the law, by putting emphasis on the wider context of legal mechanisms. This process leads more and more often to consequences, which legal scholars use to characterize as a “publicization” or “constitutionalisation” of the private law.
