Artykuł przedstawia instytucję dobrej wiary w polskim prawie cywilnym. Przedstawiono w nim próby zdefiniowania dobrej wiary, a także określono kto z ochrony dobrej wiary korzysta i kiedy owa wspomniana ochrona ustaje. Przybliżono także historyczne zażyłości dobrej wiary i ich wpływ na dzisiejsze ukształtowanie tej instytucji, ze szczególnym uwzględnieniem dzisiejszej regulacji stypizowanej w Kodeksie cywilnym z 1964 roku, a także próby zmian zaprezentowanych przez Komisję Kodyfikacyjną Prawa Cywilnego działającą przy Ministrze Sprawiedliwości w 2008 roku. Ponadto wymienione i skategoryzowane zostały odpowiednio przepisy, w których ustawodawca różnicuje określone skutki prawne w zależności od działania w dobrej albo złej wierze albo od istnienia dobrej wiary i podano konkretne przykłady. Przedstawiono również domniemanie prawne poprzez domniemanie dobrej wiary. Opisana została również instytucja złej wiary w kodeksie rodzinnym i opiekuńczym względem unieważnienia małżeństwa.
The article present the institution of good faith in the Polish civil law. It presents the attempts of defining good faith and also describes who benefits from the protection of good faith and when the protection ceases. The article provides historical understanding of good faith and its impact on today’s shape of this institution with particular emphasis on present regulation stipulated in the Civil Code of 1964. There are also indicated the attempts of changes proposed by the Civil Law Codification Commission operating at the Minister of Justice in 2008. The regulations have been listed and categorized regarding which the lawmaker differentiates particular legal consequences that depend on acting in good or bad faith or on the existence of good faith, along with specific examples. The legal presumption of good faith is also described. An institution of bad faith was also presented in the family and guardianship code taking into account the procedure of annulment of marriage.

The presentation shows the polemics of French travellers: Chappe d’Auteroche and Philip Mason, who reveal the secrets of Russian mirage during their journeys to Russia of Catherine II. The Orthodox faith and the institution of the Orthodox Church, which alongside the despotism of the authorities turn out to be the major source of Russia’s gloomy history, are at the heart of their reliable and insightful analyses. Revealing the weaknesses of the faith, it is the religion where they discover a hidden spring of Russian politics, which made the nation become the slavish peasants taught only to humble if confronted with force. Devoid of freedom or authority, the Orthodox Church, fully dependent on secular power, serves the despotic ruler.

In mysticism, I am mostly interested in emanations of some type of intensity of existence, which abstracts from the biological one. Revoking a treaty with time results in a puzzling personal experience, the story of which can be treated as an existential lesson. In mysticism, the truth becomes known through faith. It finds its source in love, which is the soul’s response for the salutary love of God directed at it. As a refusal of the demands of human nature, mysticism offers an entrance into the realm of the spirit and transcendence. The latter is approached by man through a sacrifice of love, which cleanses him of the ontological stain and guilt. The first stage of this peregrination is purification. It is an act of conscience stimulated by the vision of Christ’s passion, foreseeing death and inevitable Judgement. Purification is an encouragement for contrition and responsibility going beyond the temporal limits. In the second stage of the journey to God (illumination), a prayer for grace of life under the aegis of the cross substitutes the lament over oneself. It will be a life of humility, contemplation and doloristic imitation, crowned with love understood as following the intention of God.

The aim of this paper is to present the development of the legal concept of good faith in European legal tradition by means of claim in case of building on someone else’s land – art. 231 § 1 of Polish Civil Code. This claim pretends to be an exception to the superficies solo cedit – rule, offering some possibility to avoid its strict results. The paper takes particularly Polish and Austrian regulations into consideration. The author describes the history of meaning of good faith from roman law until today. He indicates the Germanic origins of the claim from art. 231 § 1 and the influences of Austrian Civil Code (ABGB) § 418. The paper contains a review of statements of doctrine and Polish Supreme Court in 20th century. The described example is also a model of application of historic-comparative method in legal sciences.

Opis:
Incorporating the rules inspired by the Roman condictio ob turpem causam into modern regulations of unjustified enrichment provokes criticism. Such regulations are diversified into several models but mostly invoke controversies. The main goal of this paper is evaluating these critical opinions and doubts repeated in legal discourse using historical and comparative methods. Author focuses on five issues: usefulness of condictio ob turpem causam in the light of works of ius commune jurists; doubts concerning the principle in pari turpitudine melior est conditio possidentis; different approach of various European legislators to the idea of condictio ob turpem causam; relation between regulations of unjustified enrichment and unenforceability of agreements contrary to the o law and good customs; importance of the restitution of payments contrary to the law and good customs for today’s legal practice. The conclusions of such analysis allow to admit that doubts concerning the continuation of the Roman condictio ob turpem causam are justified. From the other side, in times of multicultural societies and increasing number of legal regulations the growth of disputes resulted from the payments contrary to law and good customs can be observed. The rejection of repayment based on the contrary to the objective good faith offers – according to the author – the best compromise between weak points of Roman condictio ob turpem causam and challenges of modern practice. In the legal reasoning it is expressed by the maxime „no one shall be heard, who invokes his own guilt”.Incorporating of this maxime into the unjustified enrichment is all the more justified when higher could be in legal practice doubts concerning the acceptability of rejection of restitution of the payment with has been made without legal ground but in the contrary to the principle of good faith.

This article is discussing certain issues concerning the liability within the reliance interest under modern Polish civil law having as a background and a starting point Prof. Czachórski’s considerations over the idea of culpa in contrahendo, the reliance and expectation damages, their contemporary meaning in Polish Law of Obligations and also some present opinions of Polish legal doctrine on the essence and functions of the precontractual responsibility. The structure of the presentation is twofold. The first, shorter section gives a brief overview of the Professor Czachórski’s opinions about the legal character of the reliance interest presented in His two eminent articles published in the 60-ies of the XXth century and his comparative analysis of the differences & discrepancies among the German, Swiss and Polish civil law regarding the notions: Vertrauensinterese and Erfülungsinterese, the scope of their application in case of damages, the existence of individual prerequisites which would determine the obligation to pay compensation and their legal source. The second section is divided into five subsections in which I analyze actual problems concerning the present character of the liability based on the reliance interest and its evolution under Polish law well anticipated by Professor Czachórski, among others, the general idea of the fault in contracting (culpa in contrahendo), the legal consequences of the unsuccessful formation of contract procedure, the reliance as a delictual or “the third truck” (sui generis) liability, the grounds and further sense of the division between the reliance and expectation interest and the scope of reliance damages. The fifth subsection refers to the possibility of indemnification of non-pecuniary damages suffered ante contractum and the sixth concerns the interesting problem, only mentioned by Professor Czachórski – the aggrieved person’s contribution to the emergence or increase of the reliance damages. De lege lata the Polish Civil Code is clearly harmonized with the recent European interpretation of culpa in contrahendo regulating it explicitly (art. 72 § 2) as an autonomous source of the liability for the frustrated confidence (trust), resulting from the common obligation to negotiate loyally and in a good faith.

Significant imbalance in the rights and obligations of the parties to a consumer contract term is, together with good faith, a fundamental pillar of substantive protection against unfair terms. It is the primary tool provided by Council Directive 93/13/EEC of 5 April 1993 on unfair terms in consumer contracts with a view to mitigating differences in bargaining power between professional traders and consumer on the ever-expanding capitalistic market within the EU. The paper comprehensively reviews the meaning of the “significant imbalance” element by reference to a cross-section of judgments handed by the CJEU and Polish courts. Generally, albeit with a few notable exceptions, the former court has engaged in a subjective-objective exercise aimed at discovering what the balance of rights and obligations would have been between the parties in the particular dispute at hand had it not been for the purportedly unfair clause. Besides that, the requirement has been utilized to impose ad bolster a host of information duties levied on traders so that protection is extended to cases where the consumer is unaware of their rights or are deterred from enforcing them due to procedural obstacles or prohibitive costs of judicial or administrative proceedings. The requirement of significant balance, rooted in the idea that the disproportion of market power between the parties to a disputed term necessitates government or judicial intervention to achieve or restore contractual equilibrium, is shown from a plethora of angles: its ideological foundations, practical connotations, its emphasis on consumer vulnerability and approach to economic power. Assistance and inspiration re gleaned from Polish jurisprudence where numerous questions either unanswered by the CJEU or left to the consideration of national courts, particularly the relation between reasonableness, on the one hand, and significant imbalance and good faith on the other, as well as between significant imbalance and good faith, have been tackled.
