On 23 March 2017 the Sejm (the lower chamber of the Polish Parliament) passed the Act on Amending the Criminal Code and Numerous Other Acts23. In the reasons appended to the draft bill it was asserted that the law intended “to introduce into Polish substantive, executive and procedural criminal law amendments with a view to enhancing the effectiveness of mechanisms employed to deprive offenders of the benefits they accrued as a result of committing a crime”. This paper sets out to present a construction of Article 45 of the Polish Criminal Code as amended and to assess the correctness of the amendment, particularly in the context of the Polish Constitution and the Directive 2014/42/EU of the European Parliament and of the Council of 3 April 2014 on the freezing and confiscation of instrumentalities and proceeds of crime in the European Union.

The article tries to provide an answer to whether it is possible and viable to establish a universal criminal law applicable worldwide. The author focuses on the relationship between culture and law. Special attention is devoted to the area of criminal law and the influence of cultural backgrounds in different societies, which makes an impact on controversial topics, and sometimes becomes a subject matter of penal law. The article considers issues linked to philosophy of law and comparative law, seeking answers in various doctrines and worldviews. It contains some reflections about globalization, considering it as a material process related to the evolution of legal orders. In conclusion, the author sets out to describe the evolution that has led to the creation of the existing system of international criminal law, and attempt to predict the future of legal cooperation in criminal matters.

Social pedagogy is closely linked to the law as an instrument of social control where criminal law is a result of a certain effort to solve or control social problem. This problem is currently about increasing number of delinquent youths which has its own specifics. The aim of the paper is to point out, with the help of critical legal analysis, the difficulty of effectively solving (controlling) this problem with the help of criminal law, which determines what will be criminalized, what will be decriminalized or outside the interest of criminal law. It turns out that some measures lead to the rise of experts and their power, unintended results, and violation of the principle of innocent until proven guilty.

Human dignity is a well-known concept among Western countries since after World War II, when states, in an effort to create a new platform of cooperation with a view to guaranteeing peace, were looking for an axiological foundation of the new order. The findings described in the article may serve to underpin the following notions, which have to be the object of further research on relations between the human dignity principle and rules of criminal liability, guilt in particular. First, the “guilt standard” is obligatory, whenever a state intends to punish a person. Second, punishment can be meted out only to an offender with an ability to bear responsibility. In other words, only a person whose characteristic derived from the principle of dignity is fully actualized can be punished. Third, punishing should be preceded by an analysis of the degree of guilt. The more eager the perpetrator was to act against the legal system and against the values protected by it, the severer punishment should be meted out. Finally, law should provide for exclusion of culpability when the human dignity principle demands one to act in a manner that is outwardly criminal, but was committed due to a motivation that ought to be excused in the light of the dignity principle.

Security and law practice in Slovakia is confronted with the phenomenon of rejecting the performance of extraordinary service on the one hand and the potential of performing a voluntary military service. This study outlines the rules that have created full gender equality, starting from the first generation of human rights to equal treatment and then positive discrimination, also briefly referring to the theoretical foundations. The study also points out areas where, besides ius cogens, the disadvantages of women in everyday practice have remained particularly significant. Thus, the second part of the study addresses the main issues of criminal law and workplace discrimination, supported by examples. It is deemed necessary due to issues of labour law and criminal justice practice illustrating most clearly why ensuring equality before the law does not suffice. At the same time, the need for much more gender-sensitive legislation and legal redress is being formulated, especially in the areas mentioned above.

W artykule przedstawiono przestępstwo napaści i znieważenia przedstawiciela obcego państwa. Punktem wyjścia czynionej analizy jest regulacja prawa międzynarodowego publicznego, która określa dyrektywy kształtowania przepisów karnoprawnych wobec przestępstwa tzw. „obrazy dyplomatycznej” w państwach-stronach Konwencji o zapobieganiu przestępstwom i karaniu sprawców przestępstw przeciwko osobom korzystającym z ochrony międzynarodowej, w tym przeciwko dyplomatom. W artykule autor wskazuje na międzynarodowy charakter regulacji art. 136 k.k. Opis znamion typu czynu zabronionego poprzedzony został syntetycznym rysem historycznym. W opracowaniu zamieszczono dane statystyczne odnoszące się do częstotliwości popełniania przestępstwa tzw. „obrazy dyplomatycznej”.
The article presents a crime of diplomatic assault and slander on a representative of a foreign country. The paper begins with an analysis of the public international law which gives directions of criminal law legislation regarding a crime of ”diplomatic slander” in each state being a party to the Convention on the Prevention and Punishment of Crimes against Internationally Protected Persons, including Diplomatic Agents. The author pays attention to the international character of article 136 of the Polish Penal Code. A brief historical information precedes a description of features of a prohibited act. The article provides statistical data about a frequency of committing a crime of the so-called ”diplomatic slander”.

This paper canvasses some of the limitations and possible negative consequences of globalization of criminal procedure. The references to specific examples in this paper assume generally the framework of the legal systems of the European Union and its member states. This, however, is done with the idea in mind that at least some of the remarks made here could be also relevant in a wider international context, when other legal systems are taken into consideration. In the paper, particular attention is paid to possible negative consequences of globalization tendencies. Assuming this perspective was intentional, in order to draw the reader’s attention, references are made to those issues which are especially important from the point of view of legal certainty of an individual but seem to attract less attention in the literature on the subject than general analyses of the phenomenon of synergy of legal systems and the benefits stemming therefrom.

W artykule wykazano, że obecne przepisy są skutecznie omijane przez firmy pożyczkowe i banki dzięki dużej pomysłowości tych instytucji w zakresie ustanawiania dodatkowych opłat i prowizji pobieranych od konsumentów. Praktyki stosowane przy udzielaniu kredytów i pożyczek zanalizowane w artykule dowodzą, jak trudne do zdefiniowania i skodyfikowania są regulacje i procedury antylichwiarskie.
The aim of this article is presentation of the characteristics of anti-usury regulations in Poland, and diagnosis of the existing market conditions as far as consumer credits and loans are concerned. The article demonstrates that the existing regulations are effectively circumvented by loaning companies and banks, with use of their significant creativity in creating extra fees and commissions charged to customers. The practises used when granting credits and loans, analysed in the article, show how difficult it is to define and regulate the anty-usury rules and procedures.

The subject is the 2013 draft law, that was to amend the Polish Penal Code of 1997, but was finally abandoned. It concerned implementation of the „objective attribution of an effect” concept, an equivalent of German „objektive Zurechnung”. Numerous types of crimes (so-called „przestępstwa materialne”) are causally defined and their definitions fit only the cases where the cause-effect relationship (sc. between human behaviour and the effect specifically prescribed by law) is present. For the complete fulfilment of crime existence of the cause-effect relationship is a necessary condition, but from the point of view of equity it can be regarded an insufficient condition. Therefore the „objective attribution” idea proposes some additional limitations to criminal responsibility for an effect of a human behaviour. The paper discusses five criteria (limiting conditions) proposed so far: (1) the behaviour must cause harm to some „legal value” through breaking a legal norm that’s purpose was protecting just the same value (norm purpose identity condition); (2) the harm must result from the same causal mechanism, for which the legal norm was intended (mechanism identity condition); (3) the behaviour must bring on a substantial increase of risk of such harm (increase of risk condition); (4) the harm would not happen if the behaviour did not break the norm (negative test condition); (5) the harm was predictable for a hypothetical „reliable person” being in identical conditions („objective predictability” condition). These conditions are logically independent, i.e. neither none is implied by any other nor none is excluded by any other. They can all potentially be „building blocks” for the legal future construction. Of the further three proposed conditions one is only subsidiary („substantial breach of the norm”), one is redundant and unnecessary („adequacy of causal course”) and one is practically undesired („socially accepted increase of risk”). Polish Common Courts and the Supreme Court have appealed to the „objective attribution” concept in criminal cases for over 15 years, though infrequently. Such a practice has only partial and unclear legal basis (now it is Article 9 § 2 of the Penal Code). The would-be amendment to the Penal Code would not remove the previous doubts. What is more important, the proposed amendment was premature, as the set of conditions listed above allows to design many different versions of the „objective attribution”, and so far there is not a common acceptance for a particular one.

The aim of this article is to present the development of Polish and EU regulations on child pornography. Four amendments to the Polish Criminal Code, which were passed with the purpose of effecting tools to protect children, are strictly connected with the changes in the EU law – from the Green Paper of 1996 to Directive No. 2011/92/EU of the European Parliament and of the Council. The paper presents the current definition of child pornography, the understanding of which has evolved since the 90s. Changes in the EU law and the Polish regulations can be divided into three stages – first attempts at specifying instruments on child protection, widening the scope of the definition of child pornography and stiffening sanctions for child pornography. Amendments tothe Polish Criminal Code reflect the actual tendency to adopt more precise tools to prevent children from sexual exploitation. However, it does not lead to desired effects. Child pornography is a growing problem due to the relentless technological development but current regulations in their casuistic form are not a suitable tool to combat sexual exploitation of children.

The article analyses the legal character of stadium ban. Interpretation of the legal regulations shows that there are a few aspects of stadium ban: administrative, criminal and civil. The author considers the character of stadium ban from administrative, criminal and civil perspectives. Moreover, the author points out two judgments which were held by the Constitutional Court in this regards. The article focuses on a few legal issues, for example regarding to legal basis of the stadium ban. The legislator introduced for mixing together the various elements of criminal law, civil and administrative. The stadium ban is stipulated by a private entity. The stadium ban has criminal character, but the appeal of it is subject to administrative law. Therefore the stadium ban’s regulations are unconstitutional.

The combined decisions of the UK Supreme Court and Judicial Committee of the Privy Council in R v. Jogee; Ruddock v. The Queen caused upheaval in the English law on criminal complicity. The Supreme Court/Privy Council decided that the law on criminal complicity „took a wrong turn” 33 years ago in the Privy Council ruling in Chan Wing-Siu which concerned a controversial doctrine of parasitic joint enterprise liability. According to the said doctrine, if A and B set out to commit a crime X (e.g. robbery) and B foresees that A might commit crime Y (e.g. murder) in the course of committing crime X, B will be liable for crime Y, even if he does not intend that crime Y be committed. The mere fact of foresight on B’s part is enough for him to be criminally liable. Decision in Jogee; Ruddock is of seminal importance as it overturned the doctrine of parasitic joint enterprise liability. It is doubtful, however, to what extent the Supreme Court has resolved the problems that have bedeviled this area of law. This article presents in outline the English law on criminal complicity and attempts to assess the changes that were introduced in Jogee; Ruddock. A number of issues still call for further refinement and resolution. It appears, however, that the emphasis the Supreme Court put on intention as a required standard of fault, draws, at least superficially, the continental (Polish and German) and English criminal law closer together in terms of mens rea requirements for secondary liability.

Conduction of antiterrorist operation on the territory of Ukraine actualizes the necessity of more active integration into the existing system of international cooperation in the prevention and response to the terrorism for our state. International system of response to the international terrorism is based on the principles of prevention, detection and cessation of terrorist acts, liquidation or minimization of consequences which may be the result of their making. In general, the fight against terrorism provides for the complex of specialized measures of economic, political, legal, operative, organizational, technical and other nature, aimed at the elimination, weakening or neutralization of conditions and factors facilitating the acts of terrorism.

The topic of the article is the issue of witnesses gained through turning state’s evidence as extraordinary evidential sources in a criminal procedure. The main matters discussed in the article are the genesis of turning state’s evidence law and solutions in this matter proposed by different countries.
