Opis:
Nowadays terrorism is becoming an increasing world-wide problem. To prevent and combat terrorist activities various national and international measures are implemented, however thereby often innocent people are killed or suffer infringements of their legal interests. This article deals with the question of how far counterterrorism can go and if even the sacrifice of innocent civilians is accepted, if the struggle against terrorism requires this. Since 9/11 the topic of shooting down a hijacked passenger aircraft that threatens to crash into a building on the ground, has caused heated discussions. Is it lawful and therefore allowed to kill innocent in order to save others? Or shall the perpetrator be excused and therefore exempt from punishment? This article shows the legal situation as well as the current opinions in Germany and Austria and aims to make a contribution to the solution of this legal problem.

The subject of the article is to describe the advantages of the new type of consent used for biobanking human biological samples which is dynamic consent. This consent will be described through the prism of the Italian study, CHRIS study. The biggest advantages of this consent is the possibility of its access to specific scientific research and broad information to the patient about the purpose of using his biological sample and data. The basic assumption is that the consent given by the donor should not be of a invariable nature (it is not written on stones), but it should be dynamic.

Blood taking is a medical procedure which requires a valid consent from patients. This problem may be considered in terms of many different aspects. The statement that the circumstances and aims of this medical procedure exert an influence on law serves as a good starting point. Blood donation is regulated by different rules than blood sampling. Moreover, yet another principles are applied when HIV test is performed. Additionally, blood taking is regulated in civil proceedings. To sum up, in each case a consent of blood taking is a necessary, yet not an exclusive component. It, however, ascertains that medical procedures are followed according to the law. In that way, the legislator protects patients’ fundamental rights.

From a statistical point of view, minor motherhood is a rarity. Getting a job, a college degree, and later decent work are priority in view of procreation decisions. Data show that in developed countries, women are becoming mothers for the first time in later life. The purpose of this article is to try to draw attention to the causes and above all the effects of too early maternity. The age of 13-15 is not suitable for being a mother, primarily because of lack of emotional and social maturity. Most often the juvenile mothers are daughters of teen, unmarried mothers, growing up in families with low education and without father's authority, in which this model of life is passed on to the next generation who are social welfare beneficiaries. Therefore, motherhood at a young age should raise the anxiety of educators and increase their scientific interest in this problem.

The paper describes the regulations of the Council of Europe concerning medical powers of attorney and permissibility of such powers of attorney under Polish law. The author tries to consider whether a medical power of attorney is capable of functioning within the boundaries laid down under the current regulatory regime or whether new agency provisions are necessary. The paper discusses the interpretation of Article 95 § 1 of the Civil Code and the notion of “nature of a legal act”. At the end of the article a reference is made to the European legal tradition as a common ground for Polish and Ukrainian law.

Opis:
The subject of the article is the analysis of the rights of donors donating their biological samples to biobanks in the 21st century. Issues regarding donor rights have been analyzed since the 1980s, however, changing times, creating Big Data databases as well as evolving legal awareness of donors meant that today the role of donors in the biobanking process should be perceived differently. Donors become active subjects of scientific research which is connected with the need to answer questions about the obligations to inform them about the results of scientific research conducted on their samples or incidental findings. Likewise, the combination of data registers and the creation of Big Data basis require the re-thinking of terms such as the protection of personal data of donors or the anonymisation of their data. These issues are imposed by negligence or complete lack of legal regulation of the biobanking, which makes the legal protection of the rights of donors dependent on the will of a particular biobank. All these phenomena result in the necessity of new approaches to the rights of donors and their inclusion in the future legal regulation.
