Opis:: W pracy podjęto próbę oceny wpływu wsparcia finansowego w ramach WPR na sytuację dochodową rolników indywidualnych w krajach Europy Środkowej i Wschodniej, co stanowi cel główny tej publikacji (z uwagi na brak wyczerpujących danych pominięto w analizie Bułgarię i Rumunię). Kolejnym celem artykułu jest przybliżenie zasad finansowania rolnictwa i obszarów wiejskich w UE oraz przedstawienie skali wsparcia przyznanego krajom Europy Środkowej i Wschodniej w bieżącym okresie planowania budżetowego, tj. w latach 2007–2013. W pracy wykorzystano informacje takich instytucji, jak IERiGŻ, FAPA, a także statystyki FADN. Analiza empiryczna przeprowadzona została z wykorzystaniem modeli panelowych, a także podstawowych mierników struktury, korelacji i dynamiki.

Opis:: The article presents basic rules regarding to the evolution of legal mechanisms affecting the competitiveness of agriculture in Europe. Market mechanisms such as agricultural intervention, private storage subsidies or emergency aid measures have been analyzed. Author also pointed out the mechanisms whoch influence the profitability of agriculture, the level of unemployment, or the possibility of creating groups of agricultural producers. A possible framework was also defined for making analysis of the need to participate in the definition of European agricultural policy after 2020. It was pointed out that competitiveness and selection of legal mechanisms which can improve it, still would be one of the more important in this process.

Opis:: Modern legal studies recognise the usefulness and necessity of distinguishing agricultural law norms. As part of the analysis of the legal impact of agricultural law norms, the phenomenon of publicization is also pointed out, which means a gradual increase in public legal regulations within the framework of agricultural law norms. As part of this phenomenon, not only do administrative norms gain in importance, but also programme norms within the framework of the implementation of the Common Agricultural Policy. The aim of this article is to assess the scope of legal impact of programme norms in agricultural law, determining the objectives to be achieved in the market and income policy and the structural policy in agriculture and rural areas, in particular through an attempt to establish the legal character of the Rural Areas Development Programme as an act of the application of EU and national programme regulations. The author presents and justifies the position that the normative provisions of the Rural Areas Development Programme, due to its role, construction and manner of enactment, should be classified as mandatory legal provisions.

Opis:: The article presents selected planned legal instruments for the implementation of the Common Agricultural Policy after 2020. Special legal analysis has been made of mechanisms to increase the competitiveness of agriculture and preserve the elements of impact on the environment and climate. The analysis by observing the current evolution of the CAP and the effects of choosing individual legal instruments to implement it has been made. Recommendations regarding possible legal solutions on the basis of Polish law in the area of possible needs of farmers has been also included.

Opis:: Payment for agricultural practices beneficial for the climate and the environment (payment for greening) is a new component of the direct payment system. It is part of the system of direct payments obligatory for implementation by the Member States of the European Union. The aim of its introduction is to improve the impact of the Common Agricultural Policy on the environment, mainly in the area of biodiversity and climate. All Member States are required to establish an integrated system of management and control (IACS), including the administration of Land Parcel Identification System (LPIS), established on the basis of maps or documents and with the use of the techniques of computerized geographical information system, preferably aerial or satellite images. The aim of this study is to characterize the LPIS as a tool for the implementation and verification of the proper application of the regulations regarding the practice of greening within the Common Agricultural Policy.

Opis:: Pending the entry into force of the Common Agricultural Organization of Agricultural Markets in 2007, there were twenty one coexisting industry market organizations as defined in the relevant basic EU regulations. Merging in one legal act the provisions of several dozen other EU regulations and looking at the single European market in a holistic and not sectoral way, illustrates the current way of running the Common Agricultural Policy, which seeks to comprehensively address the problems of the European agricultural market. From 1st September 2017, there has been a National Support Center for Agriculture, which took over the tasks of two liquidated agencies: the Agricultural Property Agency and the Agricultural Market Agency. Adaptation of the Polish legislation within the framework of agricultural policy will have to take into account the changes taking place in the Common Agricultural Policy in the future. From 1st October 2017, the sugar-producing quota system which existed for the last 50 years, setting the limits for individual Member States of the European Union, was terminated. This was the last system of agricultural quotas within the European Union. Following the harmonization of the Polish legislation with European standards, we are aware of the fact that the EU law is constantly facing changes.

Opis:: The article refers to the issues of various instruments of agricultural income support. They apply in the situation of risk occurrence in agricultural production and are regulated by both EU and Polish legislation. The article particularly concerns the proposal made by domestic legislator which aims to establish several income support funds. They would be a source of farmers’ remedies and support when the crises’ situation appears. The author states that the formulated income stabilization tool is the complementary one to the proposed EUs’ solutions and may contribute to the economic situation of some farmers in the future.
