The article focuses on the interpretation of the last novel written by Wiesław Myśliwski: Treatise on Shelling Beans (Traktat o łuskaniu fasoli). The author presents a biography of the hero – a musician and homo viator. The novel describes his life and its connections with Polish history in the 20th century. Above all, it presents reflections on the role of music in culture after World War II. In his Treatise on Shelling Beans Myśliwski performs anti-logocentric turn – music is created as a sphere of art which has a/the power of salvation: it could save a human life from destruction and could stop the destruction of rudimental senses which formed European culture.

Artykuł zwraca uwagę na coraz większą rolę Internetu w codziennym życiu i konieczność pracy z nim oraz prezentowania związanego z nim słownictwa podczas lekcji jpjo. Podkreśla, że Internet stanowi najłatwiej dostępne i najtańsze źródło autentycznych tekstów językowych, pozwalających rozwijać nie tylko kompetencje językowe, ale i interkulturowe osobom uczącym się języka na terenie Polski i poza jej granicami. Omawia niektóre możliwości wykorzystania materiałów internetowych podczas lekcji języka polskiego jako obcego na poziomie podstawowym oraz metody pracy z nimi, umożliwiające rozwijanie u słuchaczy sprawności słuchania, mówienia, czytania i pisania. Zawiera też krótką prezentację wybranych programów i projektów internetowych służących do nauki jpjo.
This article draws our attention to the growing importance of the Internet in our daily life and to the necessity of working with it as well as presenting Internet-related vocabulary while teaching Polish as a foreign language. It is emphasized that the Internet provides the most easily available and the cheapest source of authentic texts that enable learners in Poland or abroad to develop not only language skills but also intercultural competence. Some of the possibilities of using the material from the Internet while teaching Polish as a foreign language at an elementary level and the methods of working with it, enabling students to develop skills such as listening, speaking, reading, and writing are discussed in this article. It also includes a short presentation of selected Internet programs and projects that serve as tools for teaching Polish as a foreign language.

W przypadku zakładów energetycznych posiadane urządzenia służące do doprowadzania energii elektrycznej do odbiorców (sieć elektroenergetyczna) najczęściej zlokalizowane są na nieruchomościach niebędących własnością zakładu. Poza tym w celu umożliwienia przyłączenia nowych odbiorców zakład prowadzi lub planuje budowę nowych urządzeń, które również w większości przypadków zlokalizowane będą na cudzych nieruchomościach. W niniejszym artykule przedstawione zostaną skutki, na gruncie podatku od towarów i usług oraz podatku od czynności cywilnoprawnych, umownego ustanowienia w formie aktu notarialnego służebności przesyłu za wynagrodzeniem.
In case of energy plants, the appliances used for providing the recipients with the electrical power, are mostly located on the real estates (plots) that are not owned by the plants. Besides, in order to connect a new recipient, the plant constructs or plans to construct new appliances that again in most cases will be located on the plots, not being owned by the plant. In this article the author presented also the consequences, under the tax on goods and services as well as under the tax on civil law transactions, of the conventional arrangement, in the form of the Notary Deed, to establish the easement of the transmission against remuneration.

Opis:
Studies concerning a social acceptance of violent behaviors in education are an important factor in actions directed to eliminate the problem. Social attitudes towards using violence in educational agenda are an important cultural background of its existence. They are postulated by various reports and recommendations as allowing to monitor conditions of the problem of violence in upbringing, and, indirectly, also its occurrence. The article presents in a form of a report the results of country-wide studies from year 2017 carried out in Polish society. The dynamics of basic parameters of these attitudes, monitored for the last couple of years, is depicted. In a dimension of theoretical context of the text, there is a reference to the newest research regarding drawbacks of physical punishment and a need to counteract those. Data from own research conducted for Children’s Rights Spokesperson show, on one hand, a constantly alarmingly high level of approval of violent behaviors against children used in their upbringing, and on the other hand, there are noticed positive tendencies of a decrease, suggesting generational changes and a turning point in an approval of violence in a relatively short period of time, which suggest an effectiveness of the actions undertaken in order to change the attitudes.

The Polish authorities, before the ratification of the Convention on the Rights of Persons with Disabilities, carried out a thorough analysis of the internal law in order to determine the degree of compliance of its provisions with the provisions of that document. The effects of these analyses have become an important argument for the draft law on ratification of the Conventionsubmitted to the Parliament on the 27th of April 2012 by the Government of our country. In the explanatory memorandum, the Government argued that our country was already ensuring the proper implementation of its provisions, also in the sphere of education. This optimistic view of our legal reality was not shared by everyone. Polemics with declarations propagated by the authorities of the country appeared both before and after the ratification of the Convention, which took place in 2012. They also addressed solutions in the field of education of persons with disabilities, i.e. compliance of the provisions of our educational law and their practical implementation in accordance with art. 24 of the Conventionen titled „Education”. Various parties spoke out, including the Ombudsman, a state body independent of other authorities. Some of mentioned polemics, but also recommendations made during them, are the content of this article.

War on Memorials in Catalonia. What to Do with Commemoration of the Battle of the Ebro The article discusses the conflicts taking place in public life over interpretation of the significance of places of national memory. The author presents them on the example of the dispute that arose in Spain over a memorial in the Catalan city of Tortosa. It commemorates the Battle of the Ebro, the military operation of the largest scale and consequences during the Spanish Civil War. The opponents of the memorial consider it as a testimony to the victory of Francoism and an unsightly and disgraceful element in the urban tissue. They appeal for its liquidation, while those arguing for its preservation and reinterpretation of the symbolic meaning treat it as an architecturally valuable distinguishing feature of the city. The fate of the controversial memorial does not rest solely in the hands of local authorities, but it has become a subject of political disagreement, disputes among residents and non-governmental activities. They are taking place against a background of the current legal basis of historical memory (Law 52/2007 of 26 December), which was developed by the political Left to compensate for the harm done to the victims of the Civil War and the Francoist dictatorship, and to implement changes in public space in connection with the traces of Francoism. However, its content leaves quite a big decision-making margin to the public authorities as to removing the traces of the regime from reinterpretation.

Cyprian Norwid was considered by many researchers a poet of Polish Romanticism. The author of Vade-mecum was ahead of the times in which he lived, announcing and contesting the upcoming modernité at the same time. The aim of the article is not, however, to sum up research conducted so far on the modernity of Norwid’s work, but to show why late Romanticism is such an important category of description of the phenomenon of the author of Vade-mecum and what links his works created in the 1860s and 1880s with the manifestos of the birth of new poetry at the turn of the 19th and 20th centuries.

The result of the codification works that were carried out in the years 1960-1971 on substantive misdemeanour law in Poland was a Code on Misdemeanours of 1971. The measures created in this Code were strongly influenced by the idea of misdemeanours polarization and stratification of responsibilities. According to this idea, severe repression was supposed to be limited to the most serious misdemeanours. Towards other offenders progressive leniency was provided, with non-criminal means replacing them. Under influence of political factors the character of general part of Code on Misdemeanours was determined by provisions which were introduced aimed at severe treatment of serious offenders. Also the specific part was shaped in the repressive spirit. The conditions to realise the assumptions accepted by codifiers of the substantive misdemeanour law were created only after the fall of communist system in Poland, when in 1990 the adjudicating boards were cut off from the influence of Ministry of Internal Affairs and placed in the structures of the Ministry of Justice.

The aim of this paper is to present the main solutions adopted in Polish act of July 7, 2005 on lobbying activity in the law-making process, with particular emphasis on the dysfunctions of this regulation. Despite the hopes of reducing corruption in public life and ensuring the transparency of the decision-making process, the discussed act deserves a critical evaluation. Among the many weaknesses, some must be especially identified: the act ignores the possibility of lobbies influencing the law-making by the President, the parliament bodies, the National Broadcasting Council and the decision-making bodies of local self-government and local government administration bodies; public hearing procedure; defective definition of lobbying activity and the size of penalties for violation of the lobbying regulations. Moreover, actual effects of the act were presented, which prove the thesis that Polish lobbying act can be assessed as “apparent regulation”.

Opis:
The paper discusses working conditions of workers employed on drilling and extraction platforms as provided for in the Act on maritime labour of August 5, 2015 (henceforth Maritime Labour Act) from the viewpoint of the their compliance with the European Union and international law. The author examines the problem of classification of drilling and extraction platforms as non-convention vessels in the provisions of the Maritime Labour Act. The analysis leads to a conclusion that, in the light of the Maritime Labour Convention adopted in Geneva by the General Conference of the International Labour Organization (ILO) on February 23, 2006 (henceforth the MLC) and the Act of September 18, 2001 – the Maritime Code, drilling or extraction platforms shall be regarded exclusively as seagoing merchant vessels and as such are covered by the MLC provisions. Workers on drilling or extraction platforms, which at the same time are seagoing ships, should be considered seafarers in the meaning of the Maritime Labour Act. The subject of the analysis covers also regulations concerning the organization of working time, in particular referring to workers employed on drilling and extraction platforms, with respect to its compliance with the EU labour law and the MLC. The regulation of working time of workers on drilling or extraction platforms as provided for in the Maritime Labour Act should be regarded as incompliant with the provisions of the Council Directive 1999/63/EC of June 21, 1999 and the MLC in the scope in which it permits extension of weekly working time to 84 hours and abandoning of the Labour Code provisions stipulating the minimum weekly rest period. The author concludes that the provisions of the Maritime Labour Act have not implemented the Directive 2003/88/EC of the European Parliament and of the Council of November 4, 2003 concerning certain aspects of the organisation of working time (Directive 2003/88/EC). Finally, the author touches upon the issue of judicial protection and asserting labour rights of workers employed on drilling and extraction platforms. The considerations lead to a conclusion that labour courts have the constitutional grounds for applying the MLC with respect to the working time based on primacy of that international regulation over the respective provision of the Maritime Labour Act. Concluding, the author indicates also that the constitutional rule of social dialogue was infringed during in the law-making process concerning the Maritime Labour Act.
