This article attempts at analysing the current and drafted legal regulations concerning court executive officers and execution as well as the civil procedure as regards the court executive officers’ legal status. Allowance is made for their hybrid position in the system: on the one hand, they perform public authorities’ functions; on the other hand, they conduct activities in a self-employed capacity, based on full business risk related e.g. to the high personnel and material costs.

Opis:
School performance and also further life and career successes depend on the development of executive functioning. The development of executive functions has a greater influence on school readiness than intelligence quotient or a preliminary level of mathematical or reading skills. The article presents the program of the Executive Functions Development Stimulation, which aims to support the child in the area of basic competencies connected with the process of learning and problem-solving capacities. The program is based on an innovative concept of working with children using the method of Executive Functions Integration, which employs an innovative tool – interactive floor.

The article poses a question about the existence of the rule of separation of powers in the EU institutional system, as it is suggested by the wording of the treaties. The analysis led to the conclusion, that in the EU institutional system there are three separated functions (powers) assigned to different institutions. The Council and the European Parliament are legislative powers, the Commission and the European Council create a “divided executive”. The Court of Justice is a judicial power. The above mentioned institutions gained strong position within their main functions (legislative, executive, judicial), but the proper mechanisms of checks and balances have not been developed, especially in the relations between legislative and executive power. These powers do not limit one another in the EU system. In the EU there are therefore three separated but arbitrary powers – because they do not limit and balance one another, and are not fully controlled by the member states.

Opis:
Many Americans and outside observers assume that the United States of America was founded upon a cluster of principles known as the “Rule of Law”. Indeed, Articles I, II, and III of the United States Constitution of 1789, purportedly establish the rights and authorities of three co-equal branches of government: the legislative, executive, and judicial branches. Adherence to the Rule of Law in the United States, however, has a much shorter history. During the 18th, 19th and early 20th centuries, the President of the United States – leader of the executive branch—often ignored or contradicted decisions by the judiciary when it served their ambitions. Monumental architecture and actions by early Justices on the U.S. Supreme Court also testify that the judiciary was the least respected branch in the U.S. government. Not until 1954 with the landmark U.S. Supreme Court decision of Brown v. Board of Education and its vigorous enforcement by the President of the United States – nearly 200 years after America’s founding – can the United States accurately be described as a nation that consistently follows the Rule of Law. With the repeated questionable and unconstitutional tactics deployed by the Trump administration, however, this period of the Rule of Law in the United States is waning. To prevent its continued decline, the Rule of Law in the United States (and elsewhere) must be vigorously protected and nurtured. For in the end, the Rule of Law is merely an idea, a belief that must be acted upon to be realized. When not constantly protected and cultivated, the Rule of Law can and will wither.
