Opis:
The Author of the article sets as a research goal the diagnosis of the role of the ideological factor and objective structural conditions in the evolution of regulated capitalism on the European continent. In the text the European social model was characterized, the influence of globalisation on the regulated European capitalism was analyzed, the challenges of demography which are posed for the social structures, the job market and social security in Europe were discussed. The Author analysed the changes happening on the European job market since the 1980s in the field of institutional solutions, position of the employee, policy tools for the job market. The convergence and divergence dynamic in the development of the European social policy and the role of the EU institutions in managing the problems of modern Europe were analysed. Finally the influence of the Eurozone’s economic crisis on the EU social policy was diagnosed. In order to operationalise the research, historical and comparative methods will be used as well as institutional analysis and social index analysis.

This article aims synthetically to refer to discussion between Polish academiclawyers about the controversies regarding to reduction of a specified sum in “agreed or stipulated payment for non-performance” in art. 484 § 2 of Polish Civil Code. These conclusions, resulting from the analysis of Polish private law - will be referring to the same reduction-clause in three selected acts of contracts model law: UNIDROIT Principles of International Commercial Contracts, the Principles of European Contract Law and the Draft Common Frame of Reference. The last part of this article contains the conclusions de lege ferenda from comparative analysis.

In 2010, the capital of Haiti was devastated by an earthquake that seemed to provide the opportunity for the country, as well as foreign donors, to put Port-au-Prince on the track of an ordered, planned urban policy, in line with its multi-risk context. Prior to the earthquake, the lack of a legal framework for urban planning was called into question. In its wake, speeches making the capital the emblem of a new ‘sustainable’ start have flourished. The European Union, the main donor of funds for Haiti, has embarked on a programme of support for reconstruction, but with what results three years later? The paper proposes to approach the limitations of the ‘sustainable city’ model, conditioned by spatiotemporal continuity. The systemic functioning underlying urban sustainability clashes with the context of Port-au-Prince, where spatial division and temporal discontinuity are determinant. In spite of itself, aid and its operation by projects, seems to enforce urban fragmentation and dissonance.

Opis:
This paper canvasses some of the limitations and possible negative consequences of globalization of criminal procedure. The references to specific examples in this paper assume generally the framework of the legal systems of the European Union and its member states. This, however, is done with the idea in mind that at least some of the remarks made here could be also relevant in a wider international context, when other legal systems are taken into consideration. In the paper, particular attention is paid to possible negative consequences of globalization tendencies. Assuming this perspective was intentional, in order to draw the reader’s attention, references are made to those issues which are especially important from the point of view of legal certainty of an individual but seem to attract less attention in the literature on the subject than general analyses of the phenomenon of synergy of legal systems and the benefits stemming therefrom.
