Opis:
Since 1 may 2004 Poland was obligated to adopt rules of the European Union law (acquis communautaire). Domestic courts must apply appropriate regulations two different legal orders . Cooperation with European Court of Justice (ECJ) could be the best solution to achievement accordance of treaties obligations and national law. One of the most popular method, provided for article 234 Treaty establishing the European Community, are preliminary questions. In according with european jurisdiction, polish administrative courts could use this mechanism to adjudicate . In many situations courts have to refer to the ECJ for a preliminary ruling a question on the interpretation european union law. On the other hand some cases should be decided by domestic jurisdiction, but even than ECJ is obligated to present his point of view. Although litigant party could not influence on court he can use regulations provided by domestic legal procedure, for example he can lodge a complaint against suspension of legal proceedings. Put preliminary questions into practice shows how consequences will bear a parties europeanization domestic law.

Opis:
The Protocol No. 30 on the application of the Charter of Fundamental Rights of the European Union to Poland and to the United Kingdom, so called “British-Polish Protocol”, annexed in 2007 to the Treaties by means of the Lisbon Treaty, led to many interpretational disputes about its legal status and consequences for application of the Charter in Poland and United Kingdom. However, the Court of Justice of the European Union (CJEU), continuing the protection of human and fundamental rights contained in the Charter, dispels some doubts concerning the Protocol significance through its case law. Judgment of the CJEU of December 21, 2011 in joined cases N.S. (C-411/10) v Secretary of State for the Home Department et M. E. and Others (C-493/10) v Refugee Applications Commissioner and Minister for Justice, Equality and Law Reform, as well as Advocate General’s Verica Trstenjak opinion delivered on September 22, 2011, confirms the normative content of art. 51 of the Charter of Fundamental Rights, so that the applicability of the Charter in the United Kingdom or in Poland is unchallengeable. Significance of the Advocate General’s Juliane Kokott’s opinion, delivered on December 15, 2011, in case General Prosecutor v Łukasz Marcin Bonda (C-489/10) should not go unnoticed. It states that Protocol No. 30 cannot be seen as an opt-out clause, but shall be regarded as having only clarifying character and as construction guidelines. Broad scope interpretation of the Charter was what CJEU called in the case Åklagaren v Hans Åkerberg Fransson (C-617/10). It allowed to develop common standards for the interpretation and application of European Union fundamental rights.

Opis:
At the current stage of the European integration, the problems occurring as a result of the coexistence of the European private law, including contract law, and the national legal systems, find their origins in the differences in legal concepts underlying these legal orders, defined by different goals and hierarchies of values. In European private law, the tendency to protect the weaker party of the contractual relationship is stronger than in national legal systems, or at least some of them. This results from the fact that the European legislator confers particular importance to the consumer protection, employment, public health and access to the public utility services (transport, telecommunications and Internet services, energy). In these very fields, European law limits the parties’ formal autonomy in order to guarantee their actual autonomy. The regulatory functions of the European law determine the content of legal relationships in order to compensate the “deficiency of equality” by strengthening the weaker party and limiting the professional’s rights. By these means a perspective based on the distributive axiology rather than on the commutative function typical for the civilistic relationships is being introduced into private law. This trend is reflected in the EU Court of Justice case-law. The abovementioned tendencies clearly correspond with the ongoing evolution of the national systems of private law under the influence of European law. In other words, the impact of the European law is getting stronger, and this not only by way of introducing new regulations, but also due to the alteration of the methods of legal interpretation and applying the law, by putting emphasis on the wider context of legal mechanisms. This process leads more and more often to consequences, which legal scholars use to characterize as a “publicization” or “constitutionalisation” of the private law.

Opis:
The text explains the role of the Supreme Court in the civil justice system in Germany with reference to a major reform of civil procedure that was enacted in 2001. The reform of access to the Federal Court of Justice aimed at striking a balance between individual justice and public interest. The author discusses the requirements of admissibility of ordinary appeal and appeal on points of law, which may be filed to the Federal Court of Justice. The German legislator has notably renounced the ratione valoris criterion (monetary threshold) and adopted the requirement of the leave to appeal. The power to restrict access to the Supreme Court was conferred on appellate courts. As a consequence, an appeal on points of law may be lodged only if it is admitted by judex a quo. Although the denial of admission is subject to appeal, the text argues that the reasons for admittance ensure that the public interest in uniform adjudication and clarification of law will be duly served.

Opis:
As a result of a thorough analysis of the title issue, the author comes to the conclusion that the Regional Court, cognizing a complaint against a notary’s refusal to carry out a notarial deed contrary to law, does not resolve the legal dispute between the notary and the participant(s) of the requested notarial deed. The notary is not a participant of such a deed, but the refusal to carry it out is a sui generis decision of the notary as to the compliance of this deed with law. For this reason, the proceedings in this matter may be recognized an equivalent of judicial proceedings in a first instance case. However, the notary’s refusal to carry out the deed whose parties intend to give it a notarial form and which the notary recognized contrary to law shall be qualified as a matter as understood by Art. 45 subpara. 1 of the Constitution of the Republic of Poland. Final and binding judgement of the Regional Court as the second instance court on the merit constitutes an act of justice although the court does not resolve the legal dispute, but resolves the exercise of constitutional freedom or human and citizen rights in these matters.
