Opis:: The purpose of the article is to discuss the main problems of Gaston Bachelard’s pedagogical philosophy. The French philosopher explored the fundamental issues of teaching – inter alia, the inquiry of the relations between teacher and disciple that he understood as dialectical exchange, the question about the most effective methods of teaching, the idea of the school as community tending to the same values – in the wide perspective of his philosophical system. Consequently, Bachelard’s philosophy of pedagogy can’t be studied apart from the most important concepts of his philosophy – the epistemological obstacle, the psychoanalysis of the scientific mind, the philosophy of “no”, and the new scientific mind.

Opis:: Artykuł dotyczy wpływu obecnej w anglosaskim systemie prawnym argumentacji obrony przez kulturę na polską aktualną rzeczywistość społeczno-prawną. Wychodząc od streszczenia kwestii, autor analizuje obecny stan prawny oraz przywołuje precedensowe przypadki z polskiej i międzynarodowej praktyki sądowej, aby przedstawić najistotniejszy element zjawiska. Głównym pytaniem, na które autor poszukuje odpowiedzi jest pytanie o to czy tytułowa argumentacja może stanowić kontratyp pozaustawowy, przesłankę złagodzenia odpowiedzialności karnej czy jeszcze coś innego. Próba odpowiedzi odwołuje się do dotąd niedocenianej w Polsce koncepcji sprawiedliwości wyrównawczej.
The article is devoted to the influence of common law legal argumentation called “the Cultural Defense” on the contemporary Polish legal reality. Starting with a summary of the concept, the author analyses current Polish law and focuses on precedents from national and international cases in order to present the most essential elements of the abovementioned phenomenon. The author tries to provide an answer whether the subject in question could be qualified as a non-statutory justification, a premise for the commutation of sentence or something else. An attempt to reply to such a question recalls compensatory justice which in Poland is still underestimated.

Opis:: The Symbiosity of Creation (2012 – ca. 2034) by Jarosław Czarnecki (aka Elvin Flamingo) is an interdisciplinary art and research project which consists of six mobile incubators, whose interiors recreate the natural habitat of three species of ants. The project consists of three part-stories: “The Reconstruction of Non-human Culture”, “The Kingdom of the Shared Quotidian”, and “After Humans. The Biocorporation”, plus the recordings of failed attempts to create the colony collected in the form of “Subterranean Struggle”. As a result of the materials used (in vivo organism) Czarnecki’s work may seem to be a typical bio-art piece. In my text I would like to point out one very important, yet so far overlooked, critical aspect of the project and show Czarnecki’s artistic activities in the light of the theory of paraartistic values contained in the book Reality aesthetics by Maria Gołaszewska.
