In 1997, Poland has ratified the Convention on the Rights of the Child, the project of which has been submitted in 1978 (UNICEF). Almost two hundred countries around the world have signed up the Convention, thereby committing themselves to respect the rights of the child in various dimensions of social life. The right to education is one of the fundamental rights of the child. It also concerns foreign children, who, as a result of migration, have settled down in Poland. The number of immigrants is not as high as in the countries that have built their empires on colonialism. Polish literature raising the issue of education and the rights of foreign children to it is not comprehensive and is based on the publications on the rights of children and cross-cultural education. The main aim of the dissertation is to approximate the literature of the subject with attention to their practical use.

Opis:
Discussions about the support system for children experiencing violence have been taking place both on an international forum as well as locally in Poland. (Zmarzlik, 2011; Wójcik, 2013; Jarosz, 2007; Jarosz, 2008; Jarosz, 2018; Dąbrowska, 2012). The questions about who should undertake tasks in this area and what their scope and type should be are still unresolved. Individuals who work with abused children agree that teachers may be an important link in the support system due to their role. The purpose of the current study is to examine the tasks of the school in the context of the experience of children growing up in a family with a problem of domestic violence. In contemporary discourses on preventing domestic violence against children, the active participation of the children themselves in creating solutions in this area is increasingly emphasized. Due to the participatory and emancipatory character of the project, the current research represents the paradigm of qualitative methodology and, within it, the assumptions of radical humanism. The final result is a description which includes answers to the above research questions and an analysis of legal and statutory actions aimed at social emancipation through education and participation of individuals experiencing domestic violence. In light of international standards of support for abused children, education can and should play a significant support role. Education and participation are considered significant factors in the social emancipation of children - victims of domestic violence - and their families. However, in the perception of individuals experiencing violence, schools do not effectively fulfill their role in this respect. It seems that the place a teacher will take in the process of supporting abused children and their families will depend largely on how the teachers themselves define their own role, as well as on the appropriate legislative solutions for their education. I think that the curricula of teachers’ studies should not only include obligatory exercises in cooperation procedures and communication skills workshops, but they should also address issues shaping active attitudes towards the situations the teachers will find themselves in over the course of their careers.

Opis:
The European Convention on Human Rights, establishing The European Court of Human Rights, constitutes the key document relating to human rights protection. Romania ratified the Convention on 20th June, 1994. Human rights are basic rights and freedoms each individual is entailed to. They include the right to live and be free, the freedom of speech and the right to an equal treatment in terms of legislation. Generally, the situation relating to the human rights in Europe is considered to be good. Belorussia, classified by The Economist as an authoritarian country, appears to be a problematic case in that respect. The Convention also deals with children’s rights, which it views as equal to human rights. The Constitutions of countries such as Poland, Romania or Brazil contain regulations relating to children’s rights. In 2004, Romania ratified the act on the protection and promotion of children’s rights, pointing out that children deserve special treatment and protection. A helpline for children’s rights protection was set up, offering consultation on the protection of children and family. In many cities in Romania a helpline offering temporary assistance to children was also set up. Relevant social services are ready to intervene without delay following their notification by phone.
Kluczowym dokumentem dotyczącym ochrony praw człowieka w Europie jest Europejska Konwencja Praw Człowieka, powołująca Europejski Trybunał Praw Człowieka. Rumunia ratyfikowała Konwencję 20 czerwca 1994 r. Prawa człowieka są podstawowymi prawami i wolnościami, które przysługują wszystkim jednostkom, stanowiąc prawo do życia, wolności, wolność słowa, równego traktowania w obliczu prawa. Ogólnie ocenia się, że sytuacja dotycząca praw człowieka w Europie jest dobra. Problematyczna w tym kontekście wydaje się być Białoruś, klasyfikowana przez „The Economist” jako kraj autorytarny. Konwencja zajmuje się także prawami dzieci, stawiając je na równi z prawami człowieka. Wiele krajów zawarło ochronę praw dzieci w swoich konstytucjach, w tym m.in. Polska, Rumunia, Brazylia i inne. W 2004 r. Rumunia przyjęła ustawę odnoszącą się do ochrony i promocji praw dziecka, wskazując m.in., że dziecko zasługuje na szczególnego rodzaju ochronę i traktowanie. Uruchomiono m.in. linię telefoniczną służąca ochronie praw dziecka, oferującą bezpłatne informacje z zakresu ochrony dzieci i rodziny. Na terenie Rumunii w wielu miejscach uruchomiono również linie telefoniczne służące doraźnej ochronie dzieci. Stosowne służby ds. socjalnych są zdolne – po wpłynięciu zgłoszenia telefonicznego – do niezwłocznego podjęcia stosownej interwencji.

In recent years, in particular after 2015, tenths of thousands of unaccompanied children have arrived in Europe, mostly in Greece and Italy, escaping from war, conflicts and other hardships they were faced with in their countries of origin. A considerable number of them are very young (under 14 years) and extremely vulnerable. The challenge for Europe, in line with the obligations deriving from UNCRC, is to offer them a safe, appropriate environment to live and to carefully examine and protect all their rights, including their protection from violence and exploitation and access to education, health and social participation. In this direction and following EU action plans and decisions, European states are expected to further share responsibilities, collaborate and take all appropriate measures to fully protect the rights of these children.

The aim of this article is to present the development of Polish and EU regulations on child pornography. Four amendments to the Polish Criminal Code, which were passed with the purpose of effecting tools to protect children, are strictly connected with the changes in the EU law – from the Green Paper of 1996 to Directive No. 2011/92/EU of the European Parliament and of the Council. The paper presents the current definition of child pornography, the understanding of which has evolved since the 90s. Changes in the EU law and the Polish regulations can be divided into three stages – first attempts at specifying instruments on child protection, widening the scope of the definition of child pornography and stiffening sanctions for child pornography. Amendments tothe Polish Criminal Code reflect the actual tendency to adopt more precise tools to prevent children from sexual exploitation. However, it does not lead to desired effects. Child pornography is a growing problem due to the relentless technological development but current regulations in their casuistic form are not a suitable tool to combat sexual exploitation of children.

Opis:
This article comprises a synthetic general review, presentation analysis and assessment of interpretation and efficiency of main legal sources of protection of children’s rights in international, European and Polish home law. As well as other problems of social and individual safety of children and youth, against of all forms of violence and abuse, social orphanage and other pathologies, aimed at building of a general common feelings of their safety in everyday life and activities. Authors present the two complementary spheres of organized institutional protection, prevention and intervention of children’s rights, based on the most important sources of law and asses their implementation and functioning in practice in Poland. The first sphere of the Polish model and system of protection of children’s rights, based on both legal and material guarantees and instruments, are public – state and territorial self-governing administration authorities, dedicated organs, institutions such as Ombudsman of children’s rights, regional and local centers of social care, safety and protection of family life and all forms of intervention in case of all forms of crises, violence and abuse of children and youth. The second complementary spheres of very dynamic manifold activities and social initiatives of various NGO’s and informal groups and individual persons, aiming at effective protection of children’s rights. These nongovernmental activities, both initiate, stimulate and control different forms of real prevention, protection, intervention and defense of children and their rights and counteracting all forms of social orphanage, violence and abuse in social relations with children and adolescents in different domains of our life, as well private and public. Their main aim is increasing of the feeling of safety of children and youth in Poland on the grounds of proper implementation and interpretation of respective legal regulations

Opis:
Proces wychowania dziecka jest niezwykle odpowiedzialny i nierzadko stwarza różnorodne dylematy. Określone relacje rodzinne podlegają konstytucyjnej ochronie, zwłaszcza w zakresie sfery prywatności rodziny, z podkreśleniem poszanowania prawa rodziców do wychowania dzieci zgodnie z własnymi poglądami i przekonaniami. Z drugiej strony przepisy tej samej rangi gwarantują poszanowanie praw i wolności samego dziecka, zobowiązując do ich przestrzegania wszystkie osoby odpowiedzialne za dziecko. Niekiedy pojawia się więc problem z zachowaniem odpowiednich relacji pomiędzy uprawnieniami rodziców a uprawnieniami dzieci oraz innych osób mających wpływ na dziecko. Celem opracowania jest analiza zakresu praw rodziców wynikająca z wykonywania władzy rodzicielskiej, ze szczególnym uwzględnieniem poszanowania autonomii dorastającego dziecka oraz wskazanie zalecanych zasad kształtowania właściwych relacji pozwalających na bezkolizyjne stosowanie praw zarówno rodziców, jak i dzieci poddanych władzy rodzicielskiej.
Summing up normative conceptions and doctrinal arguments on the relations between parental right to bring up their children and the rights of the children and their progressive autonomy as the child grows up, I believe the advisable thesis is that a child should participate and be a partner in a family life, as well as their school life, and treating them subjectively should be a starting point for their whole education and upbringing. The child’s development stimulated by exchanging experiences and mutual dialogue seems to be the most optimal pattern. Accordingly, constitutional and statutory parents’ rights and child’s freedom prove that they are not antagonistic, but aim at the best for the child’s own good. Both parties of these specific family relations ought to strive for mutual understanding and harmonized family life. Shaping such educative actions requires thus profound knowledge on mutual relationships of managing a child’s development in normatively defined limits.
