This article presents television news as a rhetorical act. Television news is understood as an account of an event usually comprising of a short introduction and a few minutes of film footage (sometimes referred to as the editorial), created as a result of the work of reporters, broadcast on television, usually as one of the elements in the structure of a news magazine, but also as an element of the programme blocks of news television channels. Television news functions in the media as one of the elements of the strategic actions of media broadcasters, focused on specific purposes, including image-building and political and economic goals. News is created as a response to specific events, it fulfils the need for information, but also serves the creation of a certain image of the world, focusing attention on certain aspects of reality, evaluating it, persuading viewers of the importance or unimportance of certain events. It plays an informative, creative, conceptual, stimulating, evaluative and ultimately aesthetic role. In order to achieve these objectives it is appropriately constructed, taking into account the characteristics and needs of the recipient and the ethos of the broadcaster. In this sense, it is therefore a “rhetorical” act – intentional, deliberate, constituting a response to a specific situation (it is historically, socially and politically conditioned) and addressed to specific recipients.

Currently, the concept of terrorism, which in recent years has intensified so much, it is still difficult to define, there are huge inconsistencies in both its defining and application. For many years, terrorism was linked with geographically and culturally distant countries, but the 20th and 21st centuries changed the face of this phenomenon, which did not resist globalization and has become one of the major problems that befits to face the modern world. The issue of terrorism, although investigated by many eminent scientists, and even though there are a great many scientific achievements in this subject, it is still a difficult problem and raises a lot of confusion of a legal-dogmatic nature, which the Author tried to highlight herein. The article presents the analysis of the concept of terrorism and illustrates the problems associated with the broad catalogue of definitions of this term. The main problems preventing continued unification of definition are presented. Furthermore, the text assumes the analysis of the legal state instrumental for combating terrorism, with particular focus on terrorist crime contained in the Polish Penal Code.

The object of analysis is the amended art. 28 § 1 of the Penal Code, which stipulates that „whoever commits an act while being in justifiable error as to a circumstance constituting a feature of an prohibited act, shall not commit a crime”. The new regulation of 28 § 1 of the Penal Code is the next attempt to statutorily define the concept of an offence based on the methodology of a strict separation of the object of evaluation from the evaluation itself, that is, primarily a radical separation of mens rea of a prohibited act from guilt. Therefore, the authors of the change have consistently attempted to eliminate all normative attributes from the scope of „recklessness” and „negligence”. This is a result of the view that assumes a pure descriptive character of the set of criminal offence features (Ger. „Tatbestand”) including subjective features (offences of intentional and unintentional character). In this context, acts committed while being in justifiable error as to a circumstance constituting a feature of a prohibited act exclude guilt, however the fulfilment of the features of criminal acts of unintentional character is limited to the fulfilment of objective features (a consequence of the concept of the unintentional character of an offence as a plain negation of intent). The negative wording of art. 1 § 3 of the Penal Code, the objective and general interpretation of the term found in art. 9 § 2 „could have foreseen” (a transfer of the so-called objective foreseeability to the category of objective attribution) and the concept of committing an act while being in justifiable error as to a circumstance constituting a feature of a prohibited act excluding guilt lead, in the area of unintentional character of an offence, to the presumption of guilt on the basis of the fulfilling only the objective features of a criminal act. The author of the article demonstrates the inaccuracy of this argument for a strictly descriptive character of the features of a prohibited act, and in particular the features of intent (intentional character of an offence). The object of intent (a feature of a criminal offence) has a evaluative character (evaluation), therefore determining intent can generally constitute a premise for accepting guilt (intended), unless the circumstance of excluding guilt exceptionally occurs. In the case of an unintentional character of an act, such a relation does not occur, and the guarantee functions (the rule of positive establishment of the perpetrator’s guilt) thus require subjective (specific and individual evaluation) interpretation of the premise „could have foreseen” found in art. 9 § 2 of the Penal Code.

Problematyka istnienia „specustaw”, obok aktów prawnych będących częścią systemu prawnego, jest przedmiotem licznych rozważań zarówno przez przedstawicieli nauki prawa, jak i praktyków. W niniejszym opracowaniu starałem się kompleksowo omówić istotę i rolę „specustaw” w polskim systemie prawa. Rozważania ujęte w przedmiotowym opracowaniu mają na celu wykazanie, czy akty normatywne nazywane „specustawami” są pożądanym i koniecznym zjawiskiem w polskim systemie prawa. Ponadto omawiane opracowanie ma za zadanie wskazać przesłanki i motywy, którymi kierował się polski ustawodawca, uchwalając wskazane akty normatywne. Jako że omawiana problematyka jest tematem aktualnym i złożonym, w swoim opracowaniu korzystałem z licznych opracowań naukowych oraz informacyjnych.
The problems related to the existence of ‘special legal acts’ as part of the Polish legal system is a popular topic of discussions between Polish scientists and practitioners in the field of legislation. In my elaboration, I discuss the essence and role of ‘special legal acts’ in Polish legal system. Considerations of this subjective elaboration aim to show that ‘special legal acts’ are an eligible and vital phenomenon in the Polish legal system. Moreover, the discussion in question is aimed at specifying the motives of the Polish legislator for legalising the aforementioned legal acts. Since the problem discussed in this paper is complex and up-to-date, I have used numerous scientific and informative resources.

Opis:
Set of regulations extracted in the systematics of normative act shall be accompanied by headings. Headings of systematics unit includes the name of the individual, the ordinal number and the signal inscription, which contains the characteristics of team rules. Name of entity together with its ordinal number identifies the unit and show relationships, in which remains the unit to other systematics units in this normative act. The signal inscription is an expression of metalinguistic and identifies a set of rules included in the systematics unit, based on semantic criteria. The essay proposes a typology of methods for creating signals inscriptions. The signal inscriptions occurring in the Polish legal language allowed the determination of terminology (nomenclature) signal inscriptions and to discuss the terms of ownership, including ownership of logic and language (grammar). Shows the diversity and originality of the vocabulary used in the signal inscriptions compared to the vocabulary of the entire legal language and general language.

The aim of this paper is to present the main solutions adopted in Polish act of July 7, 2005 on lobbying activity in the law-making process, with particular emphasis on the dysfunctions of this regulation. Despite the hopes of reducing corruption in public life and ensuring the transparency of the decision-making process, the discussed act deserves a critical evaluation. Among the many weaknesses, some must be especially identified: the act ignores the possibility of lobbies influencing the law-making by the President, the parliament bodies, the National Broadcasting Council and the decision-making bodies of local self-government and local government administration bodies; public hearing procedure; defective definition of lobbying activity and the size of penalties for violation of the lobbying regulations. Moreover, actual effects of the act were presented, which prove the thesis that Polish lobbying act can be assessed as “apparent regulation”.

The article deals with three main ideas. (1) The philosophical roots of punishment in modern criminal law are the same in countries that very much differ among each other as far as the level of severity of their systems is concerned. It is therefore something else than just philosophical roots that have an impact on criminal and penal policy of a country. Those other possible elements are then discussed. (2) The philosophical roots of punishment in modern criminal law often refer to the Hammurabi rule: “eye for an eye”, and are read as a justification for severe punishment. The article questions this assumption and proposes an interpretation which seems to be much closer to Hammurabi’s original idea. (3) Countries with differences in criminal and penal policy might introduce equally wrong laws abridging the core human rights when they resort to dehumanization practices and moral disengagement. It is especially possible when fear of foreign cultures and terrorism prevails. An example of such legislation, an aviation law in German and Poland, is discussed.

The paper describes the regulations of the Council of Europe concerning medical powers of attorney and permissibility of such powers of attorney under Polish law. The author tries to consider whether a medical power of attorney is capable of functioning within the boundaries laid down under the current regulatory regime or whether new agency provisions are necessary. The paper discusses the interpretation of Article 95 § 1 of the Civil Code and the notion of “nature of a legal act”. At the end of the article a reference is made to the European legal tradition as a common ground for Polish and Ukrainian law.

Polska regulacja problematyki partii politycznych ma swoją specyfikę. O ile szczegółowo regulowane są zasady finansowania tych podmiotów, to jednak pozostałe kwestie normowane są w ustawie stosunkowo ogólnie. Dotyczy to także sfery tworzenia partii politycznych oraz ich likwidacji. W artykule Autor zwraca uwagę na problemy, które pojawiają się w tym kontekście. Problemem takim jest brak wyraźnie zarysowanych granic pomiędzy partiami politycznymi i stowarzyszeniami, co szczególnie widoczne jest w odniesieniu do ugrupowań o lokalnym charakterze. Zresztą godne podkreślania jest też to, że uczestniczenie w wyborach nie jest, w świetle prawa polskiego, wyznacznikiem, który mógłby takie wyróżnienie stanowić. Świadczy o tym brak konieczności wykreślenia z ewidencji partii politycznych tych z nich, które permanentnie nie biorą udziału w procedurach wyborczych. Ponadto istotną kwestią jest też brak możliwości zrzeszania się w stronnictwach politycznych osób, które nie posiadają obywatelstwa polskiego, co jest niezwykle istotne w kontekście praw wyborczych obywateli Unii Europejskiej zamieszkujących na terenie Rzeczypospolitej Polskiej.
The Act of 27th June 1997 on Political Parties has its own characteristics. While the rules for the financing of these entities are regulated in detail, however, other issues are regulated relatively general in that Act. The a author draws attention to the problems that arise in this context. One of that problems is the lack of well-defined boundaries between political parties and associations, which is particularly evident in relation to groups of local character. Besides, it is also worth emphasizing that participation in elections is not, in the light of Polish law, the determinant, which could constitute such a distinction. No need for removal from the register of political parties, which are permanently not participate in the procedures for the election is the best proof. In addition, an important issue is also the inability to associate in political parties people who do not have Polish citizenship. It is extremely important in the context of electoral rights of the people, who are the EU citizens and who are living in the territory of the Republic of Poland.

The aim of this article is to reconstruct links between Union’s legislative power and foreign policy of the European Union. Presented analysis focuses on legal aspects of that issue. The hypothesis of the article assumes that even though the range of legal links between EU’s legislative institutions and the realm of Union’s foreign policy is wide, these institutions within the policy in question only to a limited extent perform legislative function as defined by treaties and understood as law-making in accordance with particular (marked with certain standard of transparency and democratic legitimization) treaty procedure. The verification of this hypothesis is based on a dogmatic-legal method and requires the analysis concerning the nature of Union’s foreign policy, the identification of Union’s legislative institutions (organs) and functions and the legal links between them and the Union’s foreign policy.

The article presents selected aspects of the functioning of social welfare in Poland in the interwar period. The first part focuses on the key legal acts for the social welfare system created from the basics, i.e. the Social Welfare Act of 1923, as well as legal acts regulating the work of social carers, as well as those separating the assistance competences of individual levels of state administration. The second part presents fragments of theoretical works of key importance for the development of the social welfare discourse in the Second Republic of Poland. In turn, the third part shows practical aspects of the system's functioning. The authors tried to show both systemic problems that did not allow for fully effective functioning of social welfare, as well as the importance of the solutions introduced, which for the first time in the history of Poland guaranteed citizens access to basic social benefits from the state.

Any information relating to an identified or identifiable natural person is considered personal data, and as such, is protected by data protection laws. There are, however, a few specific categories of personal data related to the intimate sphere of life, the processing of which is, in principle, prohibited, unless one of several exceptions occurs. Although, early data protection regulations distinguished the state of health as specific category of data, genetic data were not treated as such. Therefore, in the light of Convention 108 (adopted in 1981) and Directive 1995/46, genetic data were treated as “ordinary” personal data. The Polish Data Protection Act from 1997 went further than the Directive 95/46 and listed “genetic code” among specific categories of data. However, the term “genetic code” was not defined in the Act and in practice caused a lot interpretation problems. The General Data Protection Regulation, adopted in 2016 and replacing national laws, including Polish data Protection Act, enumerates genetic data among specific categories of data. In the light of the GDPR “genetic data” means personal data relating to the inherited or acquired genetic characteristics of a natural person which give unique information about the physiology or the health of that natural person and which result, in particular, from an analysis of a biological sample from the natural person in question.

Celem artykułu jest omówienie, a jednocześnie merytoryczne opracowanie, przesłanek nieważności czynności prawnej, jakimi są pozorność i obejście prawa. Artykuł zawiera zwięzłe przedstawienie postulatów prezentowanych w doktrynie oraz orzecznictwie sądów polskich. Całość rozważań poprzedza wstęp mający charakter zarysu terminologicznego, który ułatwić ma percepcję zawartych w niniejszym opracowaniu treści. W toku przedstawionych rozważań, mających charakter analizy porównawczej, badaniu ulega teza dotycząca wyłączenia możliwości dotknięcia jednej czynności prawnej wadami pozorności i obejścia prawa jednocześnie. Ostateczne konkluzje prowadzą do wniosku, że nie można z całą pewnością wykluczyć sytuacji, w której czynność prawna dyssymulowana zmierza do obejścia prawa.
The aim of this article is to elaborate and substantially develop premises of invalidity of an act in law, which are circumvention of the law and ostensibility. The article contains concise description of demands presented in the doctrine and judicature of Polish courts. The aforesaid deliberations are preceded by an introduction to the nature of general overview of terminology, which aims to make the cognition of contents concluded in this elaboration. In the course of referred considerations, further verification of a possibility of one act in law being both a circumvention and an ostensibility was made. Said deliberation was based on a comparative analysis between these institutions. The above draws to a final conclusion that one cannot fully exclude a situation in which ostensible legal action results in the circumvention of the law.
