Opis:
A few months before the suppression of the Hungarian Revolution in August 1849, Emperor Franz Joseph issued the Constitution of Olmütz, which suspended the Hungarian constitutional order. After 1850, the Viennese Government aimed to unify the legal system in the whole empire, and as part of the process, many Austrian legal norms were imposed by royal decrees upon the Hungarian territories. This led to fundamental changes in the country’s legal system (the customary law as “law in action” took precedence up until 1848), even though it happened unconstitutionally. The worsening state of affairs and the defeat in the Austro-Sardinian War led the Emperor to promulgate a new constitution which became known as the October Diploma in 1860. Accordingly, Hungary regained its former constitutional status, but Franz Joseph ordered the newly reinstated chief justice to assemble a council that should debate over the most pressing issues regarding the administration of justice. There, the most influential lawyers proposed that the Hungarian laws shall be restored – albeit with several compromises. Most members agreed that an absolute and immediate repeal of every Austrian legal norm would certainly violate the rights of the citizens. Therefore, even though this committee did not accept the validity of these laws, the majority of its members argued that some of them must remain in effect until the Parliament will reconvene. Consequently, the Austrian legal norms as “law in books” deeply influenced the “law in action” in Hungary for the years to come.

Opis:
Article 196 of the Polish Penal Code regulating questions of insulting religious feelings is still a matter under discussion and the cause of differences in interpretation. There are several reasons for this. First, the sphere of religious feelings is very diverse and depends on the subjective sensitivity of each believer. This is the basis of the postulate of the research on the predominant social assessment of decisions concerning infringement of the law. Secondly, defi ning what the subject of religious veneration is requires references to specifi c religious groups, which in turn may indicate the different categories of the objects (material, personal, dogmatic, ritual), and this may then cause the problem of distinguishing “the object of religious veneration” and “the objects intended for religious veneration” not specified in the Penal Code. Thirdly, the limits of conflicting freedoms, as a result of their evolution and cultural changes, still arouse new controversies, as the restrictions on freedoms under the law are not suffi cient to resolve all doubts.

Opis:
Law applicable to the protection of the rights of personality rights is regulated by a method of alternative indication with two equivalent connecting factors. The interpretation of these criteria – the place of the infringement of personal rights and the place where the damage occurred – may cause difficulties. The interpretation given by the European Court of Justice in the cases of Shevill and eDate Martinez seems to be the first to be taken into account, although exceptions should be admitted in justified cases. If the effects of infringement of the rights of personality occur in the territory of many states, it is to be assumed that the damage existing in each of them is governed by its legal system. However, this mosaic principle should only be applied where the person requesting the protection indicates the applicable law of the place of effect. If the law of the place of the infringement of personal rights is indicated, the norms of one legal system should be applied.

The legislator has not specify who and how should determine which one will apply. Both the linguistic formulation and functional arguments support the conclusion that it is the right of the claimant. In case of lack of such indication the court should apply the law which is most closely connected to the situation.

Opis:
The ‘Basic Law: Israel as the Nation-State of the Jewish People,’ passed by the Knesset on July 19, 2018. This Article describes the main provisions of the Basic Law; it discusses some of the past history leading to the legislation. It also provides some evaluation as to its effects and speculations concerning its future. Last I use this basic law to make a broader point concerning constitutional legitimation. More specifically I argue that there are two ways to gain constitutional legitimacy: representational and reasons-based. While particularistic values such as the ones entrenched in the basic law gain legitimacy from representation, universalistic values need not rest on representation. I conclude by arguing that given the failure to gain consensual support for the basic law it is an illegitimate attempt to entrench particularistic values in a divisive society. It is only by representing the public as a whole that this law can gain constitutional legitimacy.
