    Opis:
    Funding innovative projects is one of the most serious problems faced by business owners in Poland. Therefore, due to the difficulties of obtaining external sources of financing, crowdfunding may constitute a new source of fundraising for innovative ventures. Therefore, crowdfunding – as a way of raising capital for projects – is the subject of the discussion in this article. The research aim of the article is to identify and evaluate crowdfunding platforms as well as the innovative projects carried out by these platforms in Poland in 2014-2016. The first part characterizes crowdfunding as a source of funding innovation and presents the nature of crowdfunding, its characteristics and models. The empirical part is based on inductive-deductive inference, desk research, i.e. the analysis of crowdfunding market in Poland in two research periods and a case study analysis. The article shows the results of the research on the Polish crowdfunding market in 2014-2016. The author also presents a case study of funding innovation on the Kickstarter.com platform by a Polish company Sher.ly.

    A considered problem is a valuation of real estate. It is important to specify their exact market value, which is the result of several factors. Valuation of property is made on the basis of information and transactions on the local market. Moreover, the valuation always is based on the data of the similar properties. A comprehensive set of data is needed for these reasons. It is quite confusing because the number of transactions on the local market often is not sufficient. The purpose of this paper is to present a method for multicriteria valuation of real estate. This procedure is based on the Analytic Hierarchy Process (AHP) and the Goal Programming (GP). It was designed especially for valuation in situation in which information are limited. The proposed method was used for the valuation of the real estate located on Warsaw.

    Opis:
    Public participation, understood as activity being aimed at involving citizens and nongovernmental organizations into the public life, into decision-making processes, the forming of public policies and into the performance of public tasks, is one of key elements of the Good Governance conception. Also in Poland it is possible to observe increasing an interest in solutions, having a positive effect on a quality and the effectiveness of governing the public sector in last years. Specially solutions based on increasing the level of efficient use the civil potential. Amongst numerous of legislative projects, such initiatives appear as: increasing the influence of citizens on using public funds; using available instruments of the participatory democracy (e.g. public consultation, referendum); creating forums of the public debate; increasing the access to public information; improving the information and the opinion exchange between citizens and the authorities; creating or bringing into play functioning of support units of the local self-government and the institution of the civil dialogue; and the like. However, implementing and practical using of proposed instruments of the public participation are coming across a number of problems: lack of interest, lack of the support or resistance of political environments; administrative barriers; imprecise rules of functioning of non-governmental organizations, financial-property condition of the NGO’s sector. It is main conditioning of the public participation and causes of delays and impediments in for her functioning and the development.

    Artykuł przedstawia problematykę możliwości zwolnienia lekarza z tajemnicy zawodowej po śmierci pacjenta przez osoby pacjentowi bliskie. Znowelizowane brzmienie ustawy o zawodach lekarza wprowadziło do systemu prawnego uprawnienie pacjenta do wyrażenia sprzeciwu wobec ujawnienia informacji związanych z jego leczeniem po jego śmierci. Legislacyjnym novum jest również ustanowienie sądowego trybu wyrażenia zgody na ujawnienie tajemnicy w trzech określonych przypadkach, tj. w sytuacji sporu między osobami bliskimi zmarłego pacjenta, w sytuacji wątpliwości lekarza co do tożsamości osób podających się za osoby bliskie oraz gdy pacjent za życia wyraził swój sprzeciw wobec pośmiertnego ujawnienia związanych z nim informacji. Autorzy przybliżają procedurę wyrażenia zgody sądowej w tychże przypadkach, która oparta jest przede wszystkim na odpowiednich regulacjach postępowania nieprocesowego zawartych w Kodeksie postępowania cywilnego. Jednocześnie artykuł, oceniając znowelizowane przepisy, wskazuje na istniejące wciąż kontrowersje i zagrożenia związane z ochroną tajemnicy lekarskiej po śmierci pacjenta.
    The article discusses the issue of releasing the physician from the duty of professional secrecy after patient’s death by their close relatives. The amendment of the Act on medical professions implemented the patient’s right to object to the disclosure of information related to their treatment process after their death. A legislative novelty is also the possibility to reveal the confidentiality by the court in three circumstances, i.e.: in case of dispute between relatives of a deceased, reasonable doubt of a doctor regarding the identity of alleged relatives and the patient’s objection expressed during their lifetime regarding the release of information related thereto. The authors describe the procedure of granting consent in court in the above situations, based on appropriate regulations of non-litigious proceedings set forth in the Code of Civil Procedure. The article also indicates and evaluates amended regulations, and points to current controversies and threats to medical privilege after patient’s death.

    Artykuł porusza problematykę prawnej dopuszczalności chirurgicznego zabiegu „zmiany płci”, poprzez wyłączenie odpowiedzialności karnej lekarza. Tematyka zabiegu uzgodnienia płci budzi kontrowersje w obszarze prawa karnego z punktu widzenia wyłączenia bezprawności dokonania tego rodzaju zabiegu. Część badaczy stoi na stanowisku, że to zjawisko powinno być traktowane jako zabieg medyczny i w konsekwencji opowiada się za pierwotną legalnością chirurgicznej zmiany płci. Z drugiej strony, powyższe stanowisko jest niekoherentne z tendencją do zaprzestania klasyfikowania transseksualizmu jako choroby psychicznej, która ma na celu ograniczenie stygmatyzacji osób transpłciowych. Tym samym należy zaprezentować inne koncepcje uzasadniające wyłączenie bezprawności zabiegu adaptacyjnego wypracowane przez polską naukę prawa karnego, które są związane z tematyką kontratypów. Owe koncepcje obejmują przede wszystkim kwestie zgody dysponenta dobrem oraz stanu wyższej konieczności. Jednocześnie, rozwiązania prezentowane przez doktrynę nie wydają się być adekwatne dla praktyki w tym zakresie, co uzasadnia konieczność omówienia potencjalnych zmian legislacyjnych w analizowanym obszarze.
    This paper contains an analysis of the legality of the sex reassignment surgery by excluding criminal liability of a doctor. The issue of sex reassignment in the area of criminal law raises controversies due to the exclusion of the unlawfulness of doctor’s activity. Some scholars share the point of view that presented matter should be concerned as a medical treatment and thus be recognized as primarily legal. Nevertheless, such standpoint may be incoherent with the tendency to exclude transsexualism from the catalogue of mental diseases and to prevent transgender population from stigmatization. Therefore, Polish doctrine of criminal law aims at finding other potential solutions in order to exclude unlawfulness of doctor’s behavior. Consequently, the theories of justifications are presented, particularly with an analysis that concerns the consent of the owner of the good and the force majeure concept. However, presented solutions do not seem to be adequate and comprehensive enough, hence the authors concluded with the necessity of legislative activity in this sphere and eventually pointed out possible de lege ferenda postulates.
