Opis:
International public opinion, especially European one, is focused on the issue of migrants reaching Europe from the Near East. Due to the scale of migration, southern neighborhood draws attention of decision-makers and the public of individual EU member states. For some countries, the number of migrants has become a problem of social nature (e.g. approximately a million migrants reaching Germany in 2015). However, the fact that a war rages on in Donbas, right beyond the EU’s eastern border, cannot be disregarded as the conflict fosters further migration problems (internal and international migration). Russo-Ukrainian conflict in Donbas has changed the perception of Ukraine’s internal situation. The conflict pertains not only to the issue of hard security (e.g. military capabilities), but touches upon soft security as well i.e. in this case, the issue of migration (both international, and one associated with Internally Displaced Persons, IDPs). It is noteworthy that events of the Euromaidan revolution resulted in one of the more violent transformations, not only in the post-Soviet space, but also continental Europe. In addition, Russia’s destabilization of eastern Ukraine and annexation of Crimea undeniably constitute the greatest European security crisis since the Balkan war of 1990s. Undeniably, when faced with economic, military and social problems (e.g. IDPs), Ukraine will not be able to manage the situation on its own without external financial aid.

The study analyses the technical efficiency and the efficiency change of 193 community hospitals and polyclinics across Ukraine, for the years 1997 to 2001. These facilities are a subset of the medical institutions in rural Ukraine; they are identical w.r.t. their function in the health system and share the same departmental structure. The data comprise the number of physicians and the number of nurses employed in the departments as well as the polyclinics attached to the hospitals, the number of inpa- tient and outpatient admissions as well as the number of surgical procedures, lab tests and x-rays performed. Finally, the number of deaths and deaths after surgery are used as quality proxies. We employ an order-m estimator, a robust nonparametric technique to assess the ef- ficiency of health care providers as well as possible changes of their productivity. The efficiency scores are calculated with an output-oriented model. Efficiency scores are close to unity for hospitals whereas polyclinics are somewhat less efficient. The Malm- quist index exceeds unity for three out of four periods for both hospitals and polyclinics indicating improved productivity on average.

The main problems connected with the functioning of electric energy market in Ukraine include: losing control over part of the energy infrastructure and raw material resources due to the annexation of the Crimea and civil war in the eastern part of the country, excessive energy dependency on Russia, too low energy prices, unstable political situation, corruption and oligarch-oriented economy. The starting point for the Ukrainian electric energy in the reform era should be considered as critical: considerable part of the infrastructure is outdated and used in an inefficient way and traditional system of providing such raw materials as gas, coal or enriched uranium has broken down, which makes it difficult to obtain energy independence and self-sufficiency from Russia. The answer to all those recognized problems and potential threats is the programme of profound reforms and changing of the model of functioning of electric energy market, whose main aim is modernization and making the system market-oriented as well as its full integration with the European system.

The article presents current tendencies related to juvenile delinquency in Ukraine based on data from the 2016–2017 period. Quantitative juvenile delinquency indices differ substantially from quantitative adult crime indices. This is primarily caused by the fact that the former apply to a four-year period (14–18 years of age), while the latter apply to the period after reaching the age of majority. Differences between juvenile and adult crime also manifest in the form of e.g. the nature and degree of social harm inflicted by the crimes, which is determined by the age of the perpetrators. Their age is not only related to the socio-psychological profiles of offenders, but also their position in society (which is why juvenile delinquency does not encompass e.g. economic crimes, professional offences etc.). The article presents the fundamental determinants of juvenile delinquency, based on the premise that a thorough analysis of crimes committed by persons under 18 years of age is necessary to effectively combat the phenomenon in Ukraine. The article also identifies the major methods currently used to prevent and counteract this type of crimes.

The article investigates changes in the religious sphere of Ukraine since the beginning of the military conflict in Donetsk and Luhansk regions. The use of religious rhetoric to justify the annexation of the Crimea and to invade part of the Ukrainian territory has caused a serious shift in the religious self-identification of a considerable number of Ukrainians. These changes are manifested at several levels. On the personal level there was the reorientation of the most faithful to the pro-Ukrainian religious organizations or to the rejection of religion in general. At the institutional level there was an ambivalent effect. On the one hand, it triggered a series of parish conversions that caused new religious conflicts. On the other hand, it intensified the search for ways to consolidate Ukrainian churches. All these changes put on the agenda of Ukraine several challenges related to the defence of religious rights and freedom and defence of national security. The article is based on various sources produced by churches and their leaders, latest sociological data, and reports of human rights organizations and religious studies institutions.

The article characterizes contemporary Polish language newspapers in Ukraine and discusses some language features of the texts in reference to language norms that are applied in Poland. Material gathered mostly from the press but also from some other sources (questionnaires, spoken texts etc.) reveal some specific features of pragmatic language norms applied by members of the Polish community in Ukraine. The thesis is specifically on language etiquette norms and explains the different criteria used in Polish language as it is used in Poland, compared with abroad. Data gathered by the author leads to the conclusion that the Polish language etiquette norm as defined by linguists would differ significantly from the norm as defined by average Polish language speakers in Ukraine.

Although community organizing as a method of social work began to develop in Ukraine in the 1990s, but unlike individual and group social work, the attempts to introduce it into the activities of social welfare institutions and non-governmental organizations were unsystematic and not very successful. The aim of the article is to determine the possibilities of Polish experience of community social work implementation in Ukraine, taking into account the ongoing reform of local self-government. The study, the results of which are presented in the article, was designed as a so-called desk research and based on the results of the comparative analysis of Ukrainian and Polish scientific publications, documents, official websites, etc. The historical background of community social work development in Ukraine is outlined, the analysis of Ukrainian legal acts regarding norms and principles on community organizing is conducted. The article provides an overview of Ukrainian concepts and models of community social work. Particular attention is paid to the possibilities of Polish experience’ application, while implementing community organizing into practice of social welfare institutions as well as of NGOs. Possible structural and institutional changes related to the implementation of community organizing in social work practice and its benefits for the revitalization programs were analyzed. Polish experience of establishing a nationwide circle of community social work professionals was described. The author concludes that the challenges and barriers arising before community social work in both countries are quite similar and assumes that it is reasonable to take into account Polish experience, while implementing community organizing in Ukrainian realities.

The legislation of Ukraine on agricultural lands turnover is one of the most conservative in the world, prohibiting alienation of most types of agricultural lands. This prohibition is likely to be lifted soon, but there are intense debates whether foreigners should be allowed to purchase agricultural lands. By virtue of Article 145 of the Association Agreement between Ukraine and the European Communities Ukraine has a duty to implement the principle of free capital movement, in particular by abolishing restrictions on acquisition of land by foreign citizens and companies (Articles 22, 81, 82 of the Land Code of Ukraine). In case Ukraine fails to introduce the necessary amendments, the provisions of Article 145 of the Association Agreement should be applied directly. The formal unconditional obligation of our country to remove the said obstacles to free capital movement serves its best interests. Today, turnover of agricultural lands in Ukraine should be very dynamic, and it should be governed by general rules applicable to immovable property.

The energy sector is a strategic industry of each state. Energy industry is one of the most important regulated fields at the EU level and a crucial direction of cooperation between the EU and Ukraine. EU legislation, primarily directives and regulations from the Third Energy Package, prescribe requirements in respect of the legal status of national regulatory authorities in the fields of energy and natural gas. Ukraine, as a full-fledged member of the Energy Community, as well as in line with the EU‒Ukraine Association Agreement, shall institute laws and regulations necessary for the implementation of those requirements. In particular, EU legislation stipulates requirements with regard to the independence of national regulatory authorities from other state authorities during the exercise of their regulatory powers. In recent years, Ukrainian public authorities have undertaken steps to develop and approve a legal framework in order to implement the requirements of EU energy legislation, in particular those related to the legal status of national regulatory authorities. The approval of the Law of Ukraine on the National Energy and Communal Services Regulatory Commission in 2016 was one of the critical achievements in this direction. However, the new Law has not solved the problem of the constitutional legal status of the energy regulator. The Constitution of Ukraine’s provisions specifying the powers of the President of Ukraine and the Verkhovna Rada of Ukraine as against permanent independent regulatory authorities (e.g., pertaining to the establishment, appointment and dismissal of members, accountability) shall be amended in order to bolster the principle of independence of national regulatory authorities in the energy sector as prescribed by EU legislation.

The article covers the doctrinal issues of judicial precedent and case law in the legal doctrine, substantiates the need for formalization and official recognition of the actual role of the decisions of the supreme courts in similar cases. Traditional doctrinal delimitation and contrasting case law and judicial practice leads to refuse of taking into account the positive experience of the functioning of case law in common law countries. Taking into account such experience would help to satisfy the demands of the court practice in raising the significance of the decisions of the supreme courts in similar cases. In Ukraine, as in many post-Soviet countries, there is a tendency to refuse explanations of legislation on the basis of summarizing of court practice, and at the same time formalization and official recognition of the bindiness and normativity of decisions of the supreme courts in specific cases. In this regard, the peculiarities of the introducing and development of the case law of the Supreme Court in Ukraine at various stages are analyzed. Also highlighted their positive and negative aspects.

Additional complicating factor in bilateral relations between national minority and the home state is different political status of Lithuania, Belarus and Ukraine and different processes of transformation the consequence of which is differentiated state of political relations of Poland with its eastern neighbours. Lithuania, like Poland, is a member of EU, Ukraine, outside the structures of European integration, pursued a variable foreign policy, depending on the ruling options and the economic situation, and Belarus, because of internal policy which is unacceptable in the EU countries, is located on the political periphery of Europe.

The aim of the article is to present the comparative view of the political position of the constitutional courts in three states of the Eastern Europe: Belarus, Ukraine and Moldova. The author discussed the circumstances of creating the model of the constitutional judiciary within the period of Soviet Union and then the characteristics of modern constitutional courts in the said countries was presented. The following aspects were compared: constitutional basis of constitutional judiciary functioning, the legal definitions of the constitutional courts, the entitled bodies to appear in court, the presence of the constitutional complaint institution, the scope of courts competence, criteria and the mode of selecting the judges. The major differences as to functioning of these bodies were indicated, including its limited role in the political system in Belarus and its increasing role in Ukraine which ought to be related to ongoing democratic reforms.
Celem artykułu jest zaprezentowanie w ujęciu porównawczym pozycji ustrojowej sądów konstytucyjnych w trzech państwach Europy Wschodniej: Białorusi, Ukrainie i Mołdawii. Autor omawia okoliczności kształtowania się modelu sądownictwa konstytucyjnego w okresie Związku Radzieckiego, następnie zaś cechy współczesnych sądów konstytucyjnych w wymienionych państwach. Porównano następujące kwestie: konstytucyjne podstawy funkcjonowania sądownictwa konstytucyjnego, definicje legalne sądów konstytucyjnych, podmioty uprawnione do występowania przed sądem, obecność instytucji skargi konstytucyjnej, zakres kompetencji sądów, kryteria i tryb wyboru sędziów. Wskazano na istotne różnice w funkcjonowaniu tych organów, w tym jego ograniczoną rolę w systemie ustrojowym Białorusi oraz rosnącą rolę na Ukrainie, co należy wiązać z toczącymi się demokratycznymi reformami.
