Opis:
This article examines the judgment intervening effect. It is an effect of a judgment issued in the dispute in which third-party intervened in support of a party to that dispute or in which third party acceded to the dispute upon notice. That effect operates in further proceeding between an intervenor and supported party or between summoned party and party who filled a notice. The judgment intervening effect has a procedural nature and may not be disposed by parties. Upon that effect judgment’s sentence and its factual and legal grounds are binding. The effect operates to the benefit as well as to the detriment of involved parties. Judgment intervening effect is taking into consideration ex officio and may be waived in exceptional circumstances.

In this context, the social responsibility of the university is worth deeper reconsideration. It is the Higher Education Institutions (HEIs) along with the local community that shoulder the responsibility for creating a unique response to the present challenges in order to suit best the needs of all the stakeholders.

The first part of the article is devoted to the development of the definition of private tutoring – the third sector of education; research results are discussed in the micro and macro factors. The second part is devoted to selected negative and positive effects of private tutoring. Then, the third part presents the results of selected studies devoted to tutoring (teaching assistants), which are sponsored by the governments (or local governments, self-governance or autonomy) and, therefore, they are subject to the laws of the market. The presentation starts with an international survey “Monitoring tutoring”, in which nine countries participated: Azerbaijan, Georgia, Mongolia, Ukraine, Slovakia, Poland, Lithuania, Bosnia and Herzegovina and Croatia. Studies were conducted in the school year 2004/2005. For education in Poland it was a special year – the last year of separation between the Matura (matriculation examination) and entry exams to universities, also the last year of the internal Matura exams. After analysis of selected results of “Monitoring tutoring”, discussed the research will be conducted under the School Self-learning Centre for Civic Education and the local “barometer tutoring” in Kwidzyn, a town of around 40 thousand inhabitants in northern Poland. The fourth part discusses the legal and institutional contexts of tutoring in France, Finland, the other Scandinavian countries as well as South Korean parents’ struggle for the right to decide about their children’s tutoring.

Abstract The school's main task is to assist children in their comprehensive development. The implementation of this task requires an individual approach to a student, taking into account the student’s abilities, interests, development rate, and cognitive activity. In order to meet these requirements, teachers seek organizational solutions facilitating individualization of the didactic process. One of the concepts that the Dalton Plan is referring to because of many of its advantages is the attitude to the individual needs of the child. It ensures actual individualization of the education process, leading to independent learning of a child, which guarantees the success of students in lifelong learning This article presents the results of a study on perception of independence by students who were given the opportunity to develop it. For the students’ independence it is important how the teachers identify students’ independence abilities. This teachers' attitude can foster or inhibit the children's natural drive to develop independence in many areas. The article points to the role of the teacher’s preparation for implementation of pedagogical concepts because the superficial implementation, without a thorough, broad understanding of its principles, will not bring the expected results.

Opis:
The courts of modern countries do not want to use the monopoly in the area of deciding about investments or sports cases. Henceforth, in time appeared a construction of alternative forms for solving such a dispute. They constitute an open category of proceedings solving sports disputes, which are undergoing a big evolution in some countries nowadays. Their common characteristic is the interference of a neutral third party (for example an arbitrator), with a purpose to present or propose to the parties a solution of a dispute. Arbitration is often thought as a quick and efficient method for determining controversies. The modern law prescribes formal and substantive requirements for the arbitration agreement, which must be made in writing. The requirement of a written form is also satisfied if in a contract between parties, they refer to a document containing a clause with a decision to resolve their dispute in arbitration, provided that such a contract is made in writing and the reference incorporates that clause into the contract. The principal problem related to the arbitration agreement “per relationem” or “by reference” lies in the consensual character of such agreement whereas the form of the agreement has been found to be a preliminary question to this matter. In the article the author analyses the institutional basis for obligatory arbitration in past and currently. This type of arbitration may be forced by a law, a third party (e.g. international sports federation) or a party of the legal relationship.

The purpose of this article is to present the provisions of the draft Act of 10 July 2017 on space activities and the National Register of Space Objects, adopted by the Ministry of Development and Finance, in the context of solutions adopted in selected European countries and in international public law in the era of the development of the space sector (New Space). The main research hypothesis is the question whether the proposed legal regulation constitutes a solution meeting the challenges of the 21st century. The proposed regulations have been analysed in detail in terms of the rules of licensing of space activities, the registration of space objects and liability for damage inflicted by them, as well as in terms of third party insurance with reference to solutions adopted in France, Finland and Holland and the international standard. The formaldoctrinal method and the comparative law method have been applied in the analysis. The conclusion contains the assessment of the Polish space law provisions under analysis, which have been found to be in principle correct and relatively coherent. It has been stressed that, in general, the assumptions of the Polish draft act comply with the international law standard and the legal regulations of selected European countries. Nevertheless, the absence of regulations concerning, for example, the issue of suborbital space flights or space mining, and insufficient regulations concerning the protection of space environment (space debris) have been evaluated critically. A thesis is presented in the conclusion whereby, despite the deficiencies noted, the Polish draft space law is a real answer of the lawmaker to the challenges involved in the development of the space market and is a regulation appropriate for the 21st century.

The Author of the article sets as a research goal the diagnosis of the role of the ideological factor and objective structural conditions in the evolution of regulated capitalism on the European continent. In the text the European social model was characterized, the influence of globalisation on the regulated European capitalism was analyzed, the challenges of demography which are posed for the social structures, the job market and social security in Europe were discussed. The Author analysed the changes happening on the European job market since the 1980s in the field of institutional solutions, position of the employee, policy tools for the job market. The convergence and divergence dynamic in the development of the European social policy and the role of the EU institutions in managing the problems of modern Europe were analysed. Finally the influence of the Eurozone’s economic crisis on the EU social policy was diagnosed. In order to operationalise the research, historical and comparative methods will be used as well as institutional analysis and social index analysis.

The article describes the history of a specific type of the University of the Third Age which was developed in Poland and spread out to other countries in the region. The author describes the genesis of this type of education as well as the criteria which governed changes in educational institutes for seniors. Above all, the article discusses the innovative solutions, education practices, and trends which initiated the post-2000 boom in adult education in Poland. The author summarizes and structures the experience gained while working as the Director of the University of the Third Age at the University of Wroclaw in years 2006–2016, with particular reference to the national and international perspective. Remarks of the reflexive practitioner are compared and contrasted with ultra-local trends and take the form of meta-analysis. The results lead to one fundamental conclusion – in Poland a specific model for the education of seniors was formed. We may describe it as bottom-up, democratic, holistic and flexible.
