Opis:
The main purpose of this paper is to define the boundaries of the principle of impartiality of public authorities in matters of personal conviction and out-looks on life, expressed in article 25 paragraph 2 of the Polish Constitution of 1997. At its very root, the concept of the liberal state is strictly related to the idea of human dignity. For that reason, a democratic state ruled by law can not remain absolutely impartial in some branches of its activity, as far as the most important values represented in the Polish Constitution are concerned. For ex-ample, apart from the inherent and inalienable dignity of the person, the legisla-tor is bound to protect public morals. Moreover, article 13 of the Polish Consti-tution excludes totalitarian programmes and ideas from public spaces. Finally, the author notices that it is not a duty of the state to regulate all matters. On the contrary, in the liberal state there should be a vast space for the citizens’ initia-tive, especially if axiology is involved.

The aim of the study is to identify and evaluate dynamic capabilities in implementing the strategy of the State Forests National Forest Holding. The study reviews the literature related to the strategy and construct of dynamic capabilities, presents a synthetic approach to the strategy of the State Forests National Forest Holding for 2014−2030, followed by a discussion on the essence and role of dynamic capabilities in implementation strategy of the State Forests National Forest Holding. The conclusions of the study indicate the directions of improvement of the strategic management system of the State Forests National Forest Holding. The analysis enabled the conclusion that the actions taken by the forest district offices have a significant impact on the implementation of the strategic objectives of the State Forests National Forest Holding. According to the respondents, the forest districts have the greatest impact on achieving the goal of ensuring the sustainability of forests (forests as the most important element of the environment), and the smallest to build competences in the field of modern, well−managed and efficient organization. The respondents claimed that the significant importance of dynamic capabilities for State Forests National Forest Holding to achieve strategic objectives, with key capabilities in this area that can be attributed to the stage of looking for opportunities. At the same time, the results indicate that in the process of achieving strategic goals, human resources and skills as well as financial resources and skills are crucial, while the impact of structural resources and skills is the weakest.

I intend to contribute to the memento of an important trend in Polish pedagogy, abandoned after the war. In my opinion, it should be included in pedagogy and education. It is necessary both in pedagogy and pedagogical practice to educate for critical political wisdom. In the face of the disarray of political structures and the language of public debates, it is necessary to develop the capacity for an independent position, over partial divisions and fighting. The subject of political pedagogy was practiced with a gusto in the 1930s.

In the proposed draft position the author points to the incompatibility with the Constitution of Article 2 of the Act amending the Act on the State Fire Service in the section containing the phrase “in the accounting period immediately preceding the entry into force of this Act”. In the explanatory memorandum, the author points out that internal differentiation of the officers of the so called uniformed services is acceptable from the perspective of the constitutional principle of equality and is supported inter alia by the specific nature of the service these officers and specificity of the risks they undertake. In the opinion of the author, the legislature should uniformly regulate the legal status of all officers. Moreover, the proceedings in relation to the remaining scope should be discontinued due to the inadmissibility of rendering the judgment.

The remit of public service broadcasting includes the obligation of universal programming, which covers all kinds of programmes such as culture, news, entertainment and sport. Several European Union documents stress the special role of Public Service Broadcasting (PSB) in society and acknowledge a far-reaching autonomy of Member States to define and finance their national system of public service broadcasting. All European countries have defined remits for their public service broadcasters. The definition of the mission of PSB in Poland is only related to the activity of the public radio and television. Also the way PSB gives account for its programme activities, and the control of the way PSB fulfils its remit. Theme channels are part of the remit of public service broadcasting. These channels are considered as important and almost self-evident activities of PSB. Nevertheless there is a need for such provisions to define the mission of PSB in Poland. This is necessary to further specify the criteria used to determine whether a service of theme channels which are transmitted by the public television is of an economic or a non-economic nature. This is the most important because of the requirements of state financing of public service broadcasters. These transparency requirements are internal accounts corresponding to different activities – public service and non-public service activities must be separated.

The European integration raises hopes for the future of united Europe, but it does not solve all the current problems of individual Member States. One of them is to protect the rights and interests of the State Treasury of individual European Union’s countries. Therefore, each country has its own system of protection of these interests also towards the European Union’s countries. This situation is far from the perspective of unification of the European Union’s interests. In Poland, the State Treasury Solicitors’ Office deals with the legal protection of the rights and interests of the State Treasury.
Integracja europejska rodzi nadzieje na przyszłą zjednoczoną Europę, ale też nie rozwiązuje wszystkich bieżących problemów poszczególnych państw członkowskich. Jednym z nich jest ochrona praw i interesów Skarbu Państwa poszczególnych państw unijnych. Stąd też każde państwo posiada własny system ochrony tych interesów również wobec państw unijnych. Ta sytuacja jest daleka od perspektywy ujednolicenia interesów unijnych. W Polsce prawną ochroną praw i interesów Skarbu Państwa zajmuje się Prokuratoria Generalna Skarbu Państwa (PGSP).

The article deals with the issue of using on a non–contract basis properties from the Agricultural Resources of the State Treasury managed by Agricultural Property Agency. Above–mentioned problem is regulated in the art. 39b of the act on management of agricultural property owned by State Treasury. General provisions regarding to the problem of payment for using thing without contractual basis is governed by Civil Code, but the legislator introduced that special provision referring to the legal consequences of possessing state–owned properties. Author states that the result of the literal interpretation of art. 39b leads to unjust results and violates axiological values associated with this regulation. There are no axiological justification to assume that the possessor acting in good faith should be treated in the same way as possessor acting in bad faith. Only the result of functional interpretation is acceptable, because it leads to conclusion that possessor acting in good faith is not obliged to pay for using property without contractual basis.

Institutions of the Tribunal of the State and constitutional responsibility were seen by the communist regime as irrelevant and unnecessary in a socialist system. The Supreme People’s State officers had only held a political responsibility before the Communist Party. Appointment the Tribunal of the State in March 26, 1982 and the introduction constitutional responsibility to the political system had to be regarded as an unexpected move by the communist authorities. The political decision on this issue was taken in the face of tumultuous events of August 1980 and born of the “Solidarity” movement, which was a threat to the hegemonic position of the Polish United Workers’ Party. In a public and inside the party came up a mainstream of the clearing. On each side could be heard voices of dissatisfaction of the way in which the state and the national economy were routed by the Political Bureau and the government. Changes at the highest echelons of power were not sufficient to calm these moods. Society and the masses of party members called for the public trial of those, who were responsibility for bringing the country to the economic crisis. In this way, the Tribunal of the State had become a tool in the hands of the new communists leaders, designed to achieve the political goals.

Opis:
The Principality of Sealand was founded on the abandoned military platform on the North Sea. Because of its location beyond the British territorial waters, it was not the point of interest of the British authorities. In 1960s and 1970s, the Principality have got its national emblems and constitution. Despite of this initial development, most of the citizens moved from the platform to mainland because of hard conditions of life. The most dangerous threat for the Principality existence was the declaration of widening British territorial waters zone up to 12 NM (Nautical Miles), but no British troops or navy ship tried to disturb Sealand’s sovereignty. Despite ‘not disturbed’ status, the Principality is not the state in the meaning of the international law. It has not got its territory nor people, because officially the platform is the Ministry of Defence property and all of Sealand’s citizens live in the mainland now. The Principality has not been recognized by any state or international organization, so it has no possibilities to take part in international relations. From the legal point of view, the Principality is not only a state, but even quasi-state, however, it could be recognised in the future as a virtual micronation, although it is not a legal category.

The principle of independence of the state and religious associations is one of the main normative directives of religious relations in contemporary Poland. It has ideological roots not only in Catholic social teaching, but also in the liberal doctrine. The juridization of this principle is especially a reaction to the reality of absolutist, authoritarian or totalitarian regimes that essentially limit the freedom of religious communities. Since the end of the 20th century, the principle of independence of the state and the church has found a permanent place in the constitutionalism of a number of European secular (non-religious) states and some Latin American states. It is often accompanied by the principle of the autonomy of the state and / or religious associations and their cooperation. The principle of independence of the state and religious associations has a rich content and produces concrete political consequences. In a narrow sense, it means the internal self-government of the above-mentioned entities. In broad terms, the following aspects can be distinguished: organizational, normative, functional and ideological-symbolic. The principle in question means, in particular, that the state does not interfere in religious matters. It is incompetent in this respect. On the other hand, religious associations do not institutionally enter the sphere of public rule. The principle of independence is a guarantee of the freedom of conscience and of conscience and religion. It serves to shape a democratic socio-political system. It does not exclude the cooperation of the state and religious associations.

The reason for writing the text was many controversial statements of the author of the book. The article evaluates the structure, sources, and factual contents of the monograph by Urszula Wasilewicz. The author notes important shortcomings of the work and takes issue with several claims made in the book. Author used the method of analysis and synthesis and the method of individual cases. In this way unfounded some of Urszula Wasilewicz’s statements were shown.
Motywem do napisania niniejszego tekstu było wiele kontrowersyjnych stwierdzeń Autorki opiniowanej książki. W artykule oceniono publikację Urszuli Wasilewicz, biorąc pod uwagę takie aspekty, jak jej konstrukcja, podstawa źródłowa i zawartość merytoryczna. Zwrócono uwagę na istotne braki w pracy oraz podjętego polemikę z niektórymi stwierdzeniami Urszuli Wasilewicz. Autor zastosował metodę analizy i syntezy oraz metodę indywidualnych przypadków. W ten sposób ukazano bezzasadność niektórych konstatacji Autorki.
