    Opis:
    Discussion of the conscience clause at schools concerns the possibility to refuse the teacher’s actions incompatible with his conscience. This possibility, though questioned by many as unlawful, results from Polish legislation and international law. It is a consequence of freedom of conscience guaranteed by the Constitution of the Republic of Poland and a number of international and national legal acts. There are many situations in which reveals the conflict between the duty of performing a given program or command of educational authorities and their own convictions. They concern mainly the same vision of the school and its functions, school programs and the underlying concept of the human being and interpersonal relationships at the level of professional work of the teacher. In all these situations, the teacher should be a person of conscience, i.e. to follow his voice, which sometimes means opposition to the content of curricula and textbooks, orders of superiors or the prevailing customs.

    Obecnie Świadkowie Jehowy w Polsce są zarejestrowanym związkiem wyznaniowym wpisanym pod numerem 34 do Rejestru kościołów i innych związków wyznaniowych prowadzonego przez Ministra Spraw Wewnętrznych i Administracji. Doktryna związku wyznaniowego Świadków Jehowy, oparta o dosłowne rozumienie słów Pisma Świętego, zobowiązuje członków tej grupy religijnej do przestrzegania licznych nakazów i zakazów, których część odnosi się do problematyki związanej z korzystaniem z usług medycznych. Dzisiejsze zasady postępowania wyznawców Jehowy określone przez Ciało Kierownicze (zasady te podlegały zmianom na przestrzeni czasu) obejmują w zakresie zagadnień medycznych przede wszystkim bezwzględny zakaz poddawania się przez członków zboru zabiegom transfuzji krwi pełnej, natomiast decyzja o poddaniu się przeszczepowi organu lub szpiku kostnego oraz szczepieniu została pozostawiona sumieniu każdego Świadka Jehowy, przy czym poddanie się takim zabiegom nie może spowodować wykluczenia z Organizacji Świadków Jehowy. Na tym tle pojawia się pytanie o postawę jaką winien przyjąć zarówno pacjent – Świadek Jehowy, jak i lekarz – Świadek Jehowy w odniesieniu do powyższych procedur medycznych.
    Nowadays, Jehovah's Witnesses in Poland are religious association registered under number 34 in the Register of churches and other religious organizations conducted by the Minister of the Interior and Administration. The doctrine of the Jehovah's Witnesses religious association, based on the literal interpretation of the words of Scripture, commits the members of this religious group to keep a number of orders and prohibitions. Some of them refer to issues related to the use of medical services. Today's rules forced the Jehovah’s Witnesses not to take transfusion of whole blood. The decision to undergo to procedure of transplantation organ or bone marrow and vaccination has been left to the conscience of every Jehovah's Witness, but the consent to such treatment may not result in exclusion from the Organization of Jehovah's Witnesses. Because of this, appears the question of the attitude which should adopt both the patient - Jehovah's Witness, and the doctor - Jehovah's Witness in relation to these medical procedures.

    The reason of moral conflict between a pregnant woman and a doctor is incorrect understanding principles of ethics and medical provisions. The erroneous course of reasoning often is leading to the contradiction heading fundamental assumption of medical ethics. According to the right to autonomy the acceptance of individual beliefs of the patient is the same important as the concern for her health, therefore one should treat the expectant mother with the respect respecting the sovereignty for her. In spite of the possibility of expressing the own opinion, the liberty of the subject cannot disturb the conscience of the doctor. Every man irrespective of the performed profession has the right to own beliefs, so the doctor can refuse to carry determined medical benefits out because of reported ethical doubts. In the article I’m going to establish the terms and what type of the benefits to explain are medical compulsory for a health service employee. To the purpose of the presentation of ethical problems of the medical conscience clause I will refer to example of abortion.

    Opis:
    The article delivers some critical remarks on recent judgements of Polish courts concerning the so called Lodz printer case. The author attempts to apply ratio decidendi form the US Supreme Court holding in the case of the Masterpiece Cake shop in the circumstances of the Polish case, and evaluate the approach of Polish courts from this perspective. The reasoning provided by Justice Kennedy in the Masterpiece Cakeshop opinion seems convincing and universal in the field of equality v. religious freedom controversies, which makes it a proper guidepost in the examination of disputes such as the Lodz printer case. From the presented point of view, Polish judgements occur as justified in not a very elegant manner, however they seem to be correct eventually. Detailed remarks raised against those judgements concern among others the issue of the interpretation of applied regulations of the Polish Code of Petty Offences and the Polish Civil Code. The Polish Supreme Court’s approach to the interpretation of demands ostensibly stemming from relevant human rights provisions is also questioned.

    Art. 39 ustawy z dnia 5.12.1996 r. o zawodach lekarza i lekarza dentysty stanowi, że lekarz może powstrzymać się od wykonywania świadczeń zdrowotnych niezgodnych z jego sumieniem, z zastrzeżeniem art. 30, z tym, że winien obligatoryjnie udzielić informacji o możliwości dokonania tego świadczenia u innego lekarza lub w podmiocie leczniczym oraz uzasadnić i odnotować ten fakt w dokumentacji medycznej. Lekarz wykonujący swój zawód na podstawie stosunku pracy lub w ramach służby ma ponadto obowiązek uprzedniego powiadomienia na piśmie przełożonego. Lekarz nie może skorzystać z realizacji powyższej normy prawnej, jeśli zwłoka w udzieleniu pomocy lekarskiej mogłaby spowodować niebezpieczeństwo utraty życia, ciężkiego uszkodzenia ciała lub ciężkiego rozstroju zdrowia, oraz w innych przypadkach niecierpiących zwłoki (zob. art. 30 ustawy o zawodach lekarza i lekarza dentysty). Zgodnie z powyższym, lekarze mogą odmówić wykonania świadczeń medycznych niezgodnych z ich właściwie uformowanym sumieniem lekarskim, powołując się na ich przekonania religijne lub moralne. Konstrukcję taką określa się mianem klauzuli sumienia, która pozostaje w sprzeczności z obowiązkiem wymienionym w art. 39 ustawy o zawodach lekarza i lekarza dentysty – udzielenie informacji o możliwości dokonania takiego świadczenia u innego lekarza lub w innym podmiocie leczniczym. W niniejszym artykule podęto próbę odpowiedzi na pytanie: jaka jest odpowiedzialność prawnokanoniczna lekarza za realizację obowiązków ustawowych zawartych w art. 39 ustawy o zawodach lekarza i lekarza dentysty? Czy lekarz zaciąga jakąkolwiek sankcję prawnokanoaniczną, a jeśli tak to jaką za odmowę świadczeń niezgodnych z jego właściwie uformowanym sumieniem przy jednoczesnym zachowaniu spoczywających na nim ustawowych obowiązków? Czy ustawowe obowiązki z art. 39 ustawy o zawodach lekarza i lekarza dentysty noszą znamię współuczestnictwa wobec niedozwolonych moralnie zabiegów medycznych? Rozważania ograniczono do problemowego na gruncie prawa kanonicznego jednego z obowiązków wymienionych w art. 39 ustawy o zawodach lekarza i lekarza dentysty – obowiązku informacyjnego, polegającego na odmowie wykonania świadczenia niezgodnego z sumieniem lekarza (klauzula sumienia) przy jednoczesnym poinformowaniu pacjenta o wykonaniu tego świadczenia u innego lekarza lub w innym podmiocie leczniczym. Obciążenie lekarza obowiązkiem wskazania realnych możliwości uzyskania świadczenia u innego lekarza lub w innym podmiocie leczniczym nie wydaje się właściwe. Powyższa myśl została potwierdzona przez Zespołu ekspertów Konferencji Episkopatu Polski ds. bioetycznych w sprawie klauzuli sumienia z dnia 14 lutego 2014 r., który stoi na stanowisku, że „do zaprzeczenia istocie klauzuli sumienia prowadziłaby sytuacja, gdyby lekarz odmawiając wykonania świadczenia zdrowotnego ze względu na obiekcję sumienia, był zobowiązany do zapewnienia realizacji tego świadczenia przez innego, konkretnie wskazanego lekarza lub podmiotu leczniczego, gdzie takie świadczenie jest wykonywane. Podobny wymóg w zasadzie zmuszałby lekarza do aktywnego poszukiwania miejsca, gdzie pacjent będzie realizować świadczenie. Nie wolno warunkować korzystania z klauzuli sumienia tym, czy lekarz podejmując decyzję o odmowie udzielenia świadczenia zapewni jego realizację przez inną osobę lub podmiot” (pkt 12). Od strony moralnej obowiązek informacyjny zawarty w art. 39 ustawy o zawodach lekarza i lekarza dentysty powoduje w rzeczywistości „złamanie” sprzeciwu sumienia, zmuszając do pośredniego udziału w niezaakceptowanej procedurze, np. w przerwaniu ciąży. Realizacja tego obowiązku przez lekarza jest czynem radykalnie złym i na forum internum jest grzechem. Zaś, od strony prawnej nie możemy jednoznacznie stwierdzić, czy lekarz realizując powyższy obowiązek informacyjny zaciąga karę kanoniczną ekskomuniki latae sententiae na mocy kan. 1398 Kodeksu Prawa Kanonicznego z 1983 r. W tej kwestii należałoby rozpatrywać każdy przypadek z osobna.
    Article 39 of the Law of 5.12.1996 on the professions of doctor and dentist is that your doctor may refrain from performing health provisons being at odds with his conscience, subject to art. 30, he must obligatorily provide information on the possibility of this benefit from another physician or medicinal entity and justify and record this fact in the medical records. A doctor performing profession on the basis of his employment or in the service has a duty to inform the supervisor before-hand. The doctor can not take advantage of the implementation of the above legal standards, if the delay in giving medical aid could lead to danger of loss of life, serious injury or serious health disorder, and in other cases of urgency (see Art. 30 of the Act on professions of doctor and dentist). Accordingly, doctors can refuse to perform medical services incosistent with their  formed medical conscience, referring to their religious and moral beliefs. The structure is called the conscience clause, which is in contradiction with the obligation referred to in Art. 39 of the Act on professions of doctor and dentist – for information on the possibility of such benefit from another physician or other medical entity. In this article, the attempt has been taken to answer the question: what is the physician’s canonicallegislative responsibility for implementation of statutory obligations contained in Art. 39 of the Act on professions of doctor and dentist? Does the physician apply any canonical-legislative penalty, and if so, what’s the refusal of benefits incompatible with his properly formed conscience while having statutory responsibilities? Are the statutory obligations of Art. 39 of the Act on professions of doctor and dentist inconsistent with  morally unacceptable medical treatment?   Considerations are limited to the problem on the basis of canon law, one of the obligations set out in Art. 39 of the Act on professions of doctor and dentist – obligation to provide information involving the refusal of a provision contrary to the conscience of the doctor (the conscience clause), at the same time informing the patient about the implementation of this provision from another physician or other therapeutic entity. Making the doctor liable to the duty to indicate the real possibilities to get health provisions from other doctor or a medical representative seems to be appropriate. The above-mentioned idea has been confirmed by the bioethics experts of the Polish Episcopate on the issue of conscience clause from 14 February 2014 which states: “to deny conscience clause would lead the situation, if the doctor refusing to comply with health benefits due to objection of con-science, was required to ensure the implementation of this provision by another, specifically designated medical or therapeutic entity where such provision is made. A similar requirement would force the physician to actively seek a place where the patient will realize the benefit. The use of the conscience clause cannot be conditioned, whether the doctor making the decision to refuse the pro-vision will ensure its implementation by another person or entity” (point 12). From the moral point of view, the obligation to provide information contained in Art. 39 of the Act on professions of doctor and dentist will actually “break” conscientious objection, forcing the indirect participation in unaccepted procedures, such as abortion. The implementation of this obligation by the doctor is an act radically wrong and the forum internum is a sin. And, from the legal side, we can not unambiguously determine whether the doctor carrying out the above information obligation incurs the penalty of excommunication latae sententiae on the basis of canon 1398 Code of the Canon Law of 1983. Therefore, every case should be examined individually.

    Sprzeciw sumienia to odmowa wykonania obowiązku wynikającego z przepisów prawa ze względu na racjonalnie uzasadniony osąd moralny, który kwalifikuje wykonanie tego obowiązku jako etycznie niegodziwe (obiektywne zło). Prawo do sprzeciwu sumienia – integralny element wolności sumienia – jest konstytucyjnym prawem każdego człowieka. Jak podkreślił Trybunał Konstytucyjny w wyroku z 7 października 2015 r., K 12/14: „prawo powołania się na klauzulę sumienia i w rezultacie prawo do odmowy wykonania czynności sprzecznej z własnym sumieniem stanowi gwarancję wolności sumienia”. Obowiązkiem ustawodawcy zwykłego jest uregulowanie sposobu korzystania z prawa do sprzeciwu sumienia, czyli ustanowienie tzw. klauzuli sumienia. Uchwalony przez Komisję Praw Człowieka, Praworządności i Petycji Senatu RP projekt inicjatywy legislacyjnej dotyczącej ustawy o zmianie ustawy o zawodach lekarza i lekarza dentysty, ustawy o diagnostyce laboratoryjnej oraz ustawy o zawodach pielęgniarki i położnej w zamierzeniu miał uregulować klauzule sumienia w zawodach medycznych oraz jednocześnie zrealizować petycję wzywającą do uchylenia art. 3 ust. 2 ustawy z 17 maja 1989 r. o gwarancjach wolności sumienia i wyznania (generalnie zakazującego powoływania się na sprzeciw sumienia) i kompleksowego wykonania cytowanego wyroku Trybunału. Choć sama inicjatywa zasługuje na aprobatę, to jednak analiza treści projektu dowodzi, że tylko do pewnego stopnia wykonuje wyrok Trybunału, ignoruje żądanie zawarte w petycji oraz obniża ustawowy standard ochrony prawa do sprzeciwu sumienia. Na krytykę zasługuje przede wszystkim propozycja zobowiązania podmiotów leczniczych (w praktyce będą to ich kierownicy, np. dyrektor szpitala) do wskazania realnych możliwości uzyskania świadczenia, którego odmówił lekarz lub pielęgniarka (położna), a w przypadku diagnosty laboratoryjnego – do wykonania zlecenia. Narusza bowiem wolność sumienia, która – jak zauważył Trybunał Konstytucyjny – oznacza także ochronę przed postępowaniem, „które pośrednio prowadzi do nieakceptowalnego etycznie skutku, w szczególności przed przymusem współdziałania w osiąganiu celu niegodziwego” (np. przed obowiązkiem informowania, kto i gdzie może wykonać aborcję), jak również kwestionuje tzw. instytucjonalną klauzulę sumienia, do której respektowania wezwało Zgromadzenie Parlamentarne Rady Europy w rezolucji nr 1763 z 7 października 2010 r.
    Conscientious objection is a refusal to fulfil the obligation that arises from the law due to one’s reasonably justified moral judgment that qualifies fulfilling this obligation as ethically wrong (objective evil). The right to conscientious objection, which is an integral element of freedom of conscience, is a constitutional right of every human being. As emphasised by the Constitutional Tribunal of the Republic of Poland in the judgment of 7 October 2015 (K 12/14): “the right to invoke the conscience clause and, as a result, the right to refuse to perform an act contrary to one’s conscience is the guarantee of freedom of conscience”. Regulating the use of the right to conscientious objection, that is, establishing the so-called conscience clause, is the responsibility of the ordinary legislator. The draft legislation amending the Act on the professions of physician and dentist, the Act on laboratory diagnostics and the Act on the professions of nurse and midwife, adopted by the Human Rights, the Rule of Law and Petitions Committee of the Senate of the Republic of Poland, was supposed to regulate the conscience clause in medical professions, realise the petition to revoke art. 3 para. 2 of the Act of 17 May 1989 on guarantees of freedom of conscience and religion, which generally prohibits the invocation of conscientious objection, and implement the above-cited judgment of the Tribunal in a comprehensive way. Although this initiative deserves approval, the current text of the draft law proves that the judgment of the Tribunal will be implemented only to a limited extent. It ignores the request made in the petition and lowers the statutory standard of protection of the right to conscientious objection. First of all, it is questionable that healthcare entities (e.g., manager of hospitals) would be obliged to indicate real possibilities of obtaining a service refused by a physician or nurse (midwife), and, in the case of a laboratory diagnostician, to perform a service. This is contrary to freedom of conscience, which means, as noted by the Constitutional Tribunal,  protection from conduct “which indirectly leads to an unacceptable ethical effect, [and] in particular [protection] from coercion to cooperate in achieving an immoral goal” (e.g., from the obligation to inform a patient who can perform an abortion and where it can be performed). At the same time, the draft law questions the so-called institutional conscience clause, which the Parliamentary Assembly of the Council of Europe requested to respect in Resolution no. 1763 of 7 October 2010.

    Opis:
    The conscience clause, sometimes also referred to as the right to conscientious objection, is based on the possibility of refusing to comply with a binding legal norm due to its non-conformity with the indications of conscience of the person who invokes its content. Commonly derived, especially in Poland, from Article 53 of the Constitution of the Republic of Poland, this clause initially applied to physicians’ actions. It was also suggested that this clause could form the basis for conscientious objection to an abortion procedure. Drawing on Article 10(2) of the Charter of Fundamental Rights of the European Union, and emphasising the differences in the wording of this provision in different language versions, the article argues that such interpretation of the conscience clause is too narrow and poor. Attention is drawn to the amendments made to the wording of Article 10(2) of the Press Law, where the legislator replaced the journalist’s obligation to follow the editorial policy with the right to refuse to carry out an official order if the journalist believed that they were expected to publish a material that would violate the principles of reliability, objectivity and professional diligence. This solution undoubtedly constitutes the approval of the broadly understood conscience clause explicitly formulated in the Charter of Fundamental Rights of the European Union. The content of Article 10(2) of the EU Charter of Fundamental Rights allows for conscientious objection to apply to actions of the representatives across all professions.

    Opis:
    Freedom of conscience and confession is a right of every human being to profess a chosen religion or not to practice any religion and to practice it freely without consequences in the form of discrimination or privileging. Sometimes the implementation of this right is hindered by institutional solutions, tradition and prejudices, which prompts an individual to take legal steps. In Germany, the courts competent to consider cases in this field are the courts of general jurisdiction in the Länder. The Federal Constitutional Court (Bundesverfassungsgericht) deals with constitutional complaints about violations of the right of freedom of conscience, confession and religion by public authorities, shaping the standards of protection of this right in Germany. The article presents a wide spectrum of judgments regarding discriminatory treatment of a person because of their religion and beliefs, equality of churches and denominations and the state policy towards churches. These judgments prove that religious freedom is not treated by the Tribunal as absolute freedom.
