    Success in the work of the public administration is a result of the quality of human resources. Increasing efficiency in the management of human resources is based on motivation, and it is an important part of ensuring sustainable development of the municipality and its administration. The paper explores and analyzes the motivation of the staff and managers of municipal administration. It is structured in three parts: theoretical and methodological foundations of motivation, motivation profile and competences; analysis of results of a survey among employees of the municipal administration; summary and conclusions.

    The audit of providing appropriate management of municipal waste by public administration bodies was carried out on NIK’s own initiative, in relation to the introduction of a new system for municipal waste treatment. The system is based on selective collection of waste from property owners, and then on their management in regional systems for municipal waste processing. The audit was additionally justified with press information according to which, for instance, not all regions of municipal waste management had been equipped with appropriate systems. Also, in some regional waste management plans, the status of a regional system was often granted to systems that did not meet the legal requirements or had too low capacity, and in many municipalities irregularities existed as for delivering waste to the regional municipal waste systems which, consequently, hampered their functioning. What is more, municipalities did not provide sufficient supervision of the companies that collected, processed and neutralised municipal waste, as a result of which the amount of municipal waste transported to garbage dumps has increased.

    W ostatnich latach można zauważyć wzrost znaczenia badań nad doskonaleniem potencjalnej sprawności funkcjonowania i zarządzania instytucjami samorządowymi. Sprawnie działająca administracja samorządowa jest jednym z podstawowych czynników wpływających na jakość życia mieszkańców. Celem artykułu jest ocena poziomu rozwoju i struktury potencjału instytucjonalnego urzędów gmin miejskich w woj. podkarpackim w 2014 i 2019 roku. W artykule wykorzystano metodykę Analizy Instytucjonalnej przygotowaną przez Małopolską Szkołę Administracji Publicznej Akademii Ekonomicznej w Krakowie. Wyniki badań pokazują niski poziom rozwoju potencjału instytucjonalnego badanych urzędów gmin miejskich w obu analizowanych latach. Najkorzystniejsza sytuacja występowała w następujących obszarach: organizacji i funkcjonowania urzędu, partycypacji społecznej i stymulowania rozwoju społecznego oraz współpracy między jednostkami samorządu terytorialnego. W odniesieniu do przyszłych badań zaprezentowana w artykule metodologia, wraz z uzyskanymi wynikami, może się przyczynić się do dokonywania podobnych analiz w przyszłości, a także stanowić przedmiot zainteresowania badań poznawczych i wdrożeniowych.
    In the recent years, there has been an increase in the importance of research on improving the potential efficiency of functioning and managing local government institutions. Efficiently functioning local government administration is one of the basic factors influencing the quality of residents' life. The purpose of the article is to assess the development level and structure of institutional potential of municipal offices in Podkarpackie Voivodeship in 2014 and 2019. The article uses the Institutional Analysis methodology prepared by the Małopolska School of Public Administration of the Cracow University of Economics. The research results showed a low level of institutional potential development of the surveyed municipal offices in both analyzed years. The most favorable situation can be observed in the following areas: organization and functioning of the office, social participation, and social development stimulation, as well as cooperation between territorial self-government units. In respect to future research, the methodology presented in the article, together with the results obtained can be contributory to a similar analysis in the future and serve as the subject of interest for cognitive and implementation research studies as well.

    Głównym celem niniejszego artykułu jest szczegółowe przedstawienie najważniejszych zagadnień związanych ze statusem personelu urzędniczego radomskiego Magistratu (Zarządu Miejskiego) w latach 1915-1939. Uwagę skupiono tutaj przede wszystkim na dokładnym omówieniu podstawowych praw i obowiązków przysługujących każdemu urzędnikowi, chociażby z racji tego, że wywierały one duży wpływ na ich pracę oraz powierzone im zadania. Ponadto ukazano, w jaki sposób dochodziło do mianowania i zawiązania stosunku służbowego, jaki statut posiadał sam urzędnik miejski, na jakie kategorie był dzielony, oraz wreszcie jakiej podlegał odpowiedzialności służbowej w przypadku niewywiązywania się ze swych powinności. W artykule poruszono również bliżej sprawy wykształcenia i kwalifikacji personelu urzędniczego, a także jego przygotowania pod względem praktycznym oraz teoretycznym do pełnionych funkcji.
    The main purpose of this article is to present the most important issues related to the status of clercical staff Radom Magistrate (Municipal Board) in the years 1915-1939. Attention is focused here mainly on detailed discussion of basic rights and obligations held by each official, even because of the fact that they exert a strong influence on their work and the tasks entrusted to them. No less important was the show that I had the same status of magistrate officer and which was divided into categories. The article also touched closer to the matter of education and qualifications of clercical staff as well as the preparation of the practical and the theoretical to the functions performed. Attention was also paid to the issue of organized training courses, through which sought to create a modern administrative staff.

    The monograph produced by M. Mycielski discusses the policy pursued by the government of the Kingdom of Poland toward the Seymiks and commune assemblies and toward the elections to the Chamber of Deputies and the Voivodship Councils that were carried out in the Seymiks and commune assemblies in 1817-1830. The monograph shows the authentic functioning of the electoral assemblies, thereby proving that the Polish nation regarded the State as their own institution and that the electoral assemblies secured the sense of national sovereignty. The first chapter presents the administrative provisions that were of binding force in the 1820s. The chapter discusses also their origin as well as those of their versions that were rejected. It points to the entire bills that never came into force. The next chapter tries to show how numerous the electoral assemblies were. The third chapter, in its turn, analyses the governmental activities in the area of electoral practices and the problems arising from them. In this chapter there were discussed inter alia the right to vote, the method of proposing the candidates, casting and counting the votes, locations for holdingg the electoral assemblies, organizing feasts, drawing up the lists of candidates for the respective posts, and also nullifying the incorrectly held Seymiks and electoral assemblies. The fourth chapter was designed to characterize the direct involvement of the authorities in the electoral struggle. The latter tended toward eliminating the candidates of the opposition and promoting those that were supported by the authorities, the candidates for the members of the House of Deputies and those for the Voivodship Councils being at stake. The author of the monograph tried also to demonstrate the effectiveness of the described activities and show the causes of success or failure of administration in this area

    The purpose of this article is to present the next stages of formation and functioning of local government in the former Polish Kingdom in the years 1915-1939 on the example of the city of Radom. The subject of the research has also show the shape of the political Borough of each term and acting collectively Municipal (Municipal Board) and their internal rules of organization. Municipal government in Radom started to shape up, like the rest of the Polish Kingdom, only during the First World War. The first act fully regulate this issue in the austro-hungarian occupation (under which in 1915, he was Radom) regulation was the Supreme Commander of the Army on 18 August 1916, relating to the ordination of urban Kielce, Lublin, Radom and Piotrkow. After Poland regained independence municipal government existed in the entire country but, depending on the individual districts of the state he was very diverse, both in terms of organizational and systemic. In the area of former Congress former russian legislation slowly began to replace the polish administrative solutions . The result has become the issue by the Chief of State decree of 4 February 1919 on the municipal government, offering the chance to create a modern administrative apparatus in the country. However, the idea of creating a dynamic extension from the municipal government began to slowly break down. Visible has a tendency to limit the autonomy of urban authorities and the role of the social factor in the local administration which resulted in the issuance of the law of 23 March 1933 on the partial change of the system of local government.

    The paper is concerned with the scope of the concept an ‘individual public administration matter requiring attention,’ which is disputable both in literature and in case law. Determinations made in this respect affect the applicability of Article 39.4 of Communal Self-Government Act concerning the commune council’s ability to delegate its competences of an executive body to executive bodies of the commune’s auxiliary units and other parties. According to certain doctrines, an individual public administration matter must be equated with the scope of the concept of ‘administrative decision’ within the meaning assigned to it through the Act – the Code of Administrative Procedure. The article shows that this view is a consequence of identifying the concept of ‘resolving’ with handling individual public matters. However, not every individual public matter requires a resolution as to the legal consequences of the given facts. A major part of individual matters are handled through actual activities that do not require any issuance of an administrative decision. The article further includes discussion of whether delegation of competence to attend to certain matters should at the same time require express authorisation to take actions which are instrumental to the expressly delegated competences, actions which are functionally linked to these competences, and the rationale behind express delegation, as well as taking actions being the obligation of entities implementing public tasks (e.g. issuing certificates/statements of fact, or undertaking actions governed by Disclosure of Public Information Act).
    Artykuł dotyczy spornego w literaturze oraz orzecznictwie zakresu pojęcia „wymagająca załatwienia indywidualna sprawa z zakresu administracji publicznej”. Ustalenia w tym zakresie rzutują na zakres zastosowania art. 39 ust. 4 ustawy o samorządzie gminnym, który dotyczy możliwości przekazywania przez radę gminy kompetencji organu wykonawczego na organy wykonawcze jednostek pomocniczych gminy i inne podmioty. Według niektórych poglądów sprawa indywidualna z zakresu administracji publicznej utożsamiana musi być z zakresem pojęcia „decyzja administracyjna” w rozumieniu nadanym mu ustawą Kodeks postępowania administracyjnego. W artykule wykazano, że pogląd taki jest rezultatem utożsamiania pojęć „rozstrzyganie” z załatwianiem indywidualnych spraw publicznych. Tymczasem nie każda publiczna sprawa indywidualna wymaga rozstrzygania co do skutków prawnych danego stanu faktycznego. Znacząca część spraw indywidualnych załatwiana jest drogą dokonywania czynności faktycznych, niewymagających wydawania decyzji administracyjnej. W artykule zawarto także rozważania dotyczące tego, czy przekazanie kompetencji do załatwiania określonych spraw wymaga jednoczesnego wyraźnego umocowania do dokonywania działań o charakterze instrumentalnym w stosunku do wyraźnie przekazanych kompetencji, działań funkcjonalnie z nimi powiązanych, a także zasadności wyraźnego przekazywania oraz do podejmowania działań, do których zobowiązane są podmioty realizujące zadania o charakterze publicznym (np. kwestia wydawania zaświadczeń czy dokonywania działań uregulowanych ustawą o udostępniania informacji publicznych).

    W niniejszym artykule przedstawiono analizę funkcjonowania e-administracji w urzędach miejskich w województwie śląskim w Polsce. Oceny dokonały osoby niepełnosprawne o różnym stopniu niepełnosprawności, w różnym wieku i o zróżnicowanym wykształceniu. W Polsce osoby niepełnosprawne, tak samo jak osoby sprawne, muszą załatwiać wszelkie sprawy urzędowe. Ważne jest, aby wszyscy klienci, a w szczególności osoby niepełnosprawne, mogły większość spraw załatwić, nie wychodząc z domu. W niniejszym artykule postawiono następującą hipotezę: Częstsze wykorzystanie narzędzi elektronicznych do komunikacji z urzędem prowadzi do wzrostu zadowolenia klienta niepełnosprawnego z funkcjonowania e-administracji. Celem publikacji była analiza funkcjonowania e-administracji w województwie śląskim, w zakresie możliwości wykorzystania jej przez osoby niepełnosprawne. Kolejnym celem było określenie, jaki wpływ na percepcję usług e-administracji ma rodzaj niepełnosprawności oraz wykorzystywanie narzędzi komputerowych przez daną osobę niepełnosprawną.
    The article presents an analysis of e-administration functioning in municipal offices in the Silesian Province in Poland. It was evaluated by handicapped people with various degrees of disability, at different ages and different education. In Poland the disabled, similarly to abled-bodied people, have to run different errands in offices. It is important that all these clients, in particular the handicapped, could arrange things without leaving home. In the article the following hypothesis has been formulated: More frequent use of electronic tools for communication with the office leads to increased satisfaction of the disabled client with the functioning of e-dministration.

    The article is an attempt to look at the current local security’s shape, its contemporary conditions, possibilities and limitations. The influence of the socio-political environment on the condition of local security is a regular phenomenon, provided that this environment creates optimal conditions for the shape of the security of local communities. Factors changing this environment are often beyond local communities that have no impact on this environment. In Polish conditions, ‘locality’ is related to the activities of local government units. Municipalities and counties are local self-government communities. These units have the greatest impact on the formation and activity of smaller formal and informal local communities. The author’s intention is to note these positive and negative conditions of local security, with an indication of the entities exerting the greatest influence on local security.

    Opis:
    Zagadnienie kształtowania lokalnej administracji terenowej w Polsce w latach 1945-1952 należy do jednego z ciekawszych w historii powojennej. Z jednej strony mamy formalnie istniejący samorząd terytorialny, z drugiej zaś pojawia się nieznany dotąd na ziemiach polskich radziecki model administracyjny – rady narodowe. Połączenie samorządu terytorialnego i rad narodowych przez władze zagmatwało sytuację administracyjną w Polsce. Hierarchiczny układ rad, tzn. podporządkowanie rad niższego szczebla radom wyższego szczebla oznaczało odejście od jednej z podstawowych cechy samorządu terytorialnego – decentralizacji, czyli niezależności danego szczebla struktury w stosunku do szczebla usytuowanego wyżej. Skład osobowy rad narodowych nie był ustalany w drodze wyborów, a jedynie o proces delegowania przez tzw. organizacje demokratyczne ściśle związane z ruchem komunistycznym.
    The shaping of the local administration system in Poland in the years 1945-1952 is one of the most interesting issues in the post-war history. On the one hand, there is a formally existing local government system, but on the other hand, there appears a Soviet administrative model of national councils, previously unknown in Poland. The combination of the systems of local government and national councils authorities confused the administrative situation in Poland. The hierarchical arrangement of councils, i.e. the subordination of lower-level councils to higher-level ones, meant a departure from one of the basic features of local government, i.e. the independence of a given level of the administrative structure in relation to the level located above it. The composition of national councils was not determined by way of elections, but only by a process of delegation by so-called democratic organisations closely linked to the communist movement.
