    Opis:
    Extension of the scope of the application of contemporary intellectual property rights for the newer objects under protection is a noticeable trend. Plant genetic resources are gaining more and more protection among the new intellectual property which is the object of rights to intangible assets. The concept of plant genetic resources has been defined in a number of international instruments such as the Convention on Biological Diversity, or the International Treaty on Plant Genetic Resources for Food and Agriculture. In the general context the term ‘plant genetic resources’ relates to any genetic material of plant, in particular applied for its propagation. The characteristic feature of plant genetic resources thus defined is that they are subject not only to one form of protection of intangible property, but they could find protection based on the rules pertaining to the exclusive right of plant varieties, patents, or the rights protecting from unfair competition. Such wide protection of plant genetic resources can pose controversies towards developing biotechnological monopolies concerning maintenance of food security. However, the role of legal regulations is searching for a balance between the need to support implementation of modern technologies relating to development of genetic resources and the respect to interests of society.

    Opis:
    Tematem artykułu są uwarunkowania związane z działalnością przedsiębiorstw, a zwłaszcza kwestie związane z generowaniem przez nie wartości, które decydują o sukcesie rynkowym. Z uwagi na otoczenie, a także dla realizacji koniecznej i pożądanej strategii, niezbędne jest zwrócenie uwagi na własność intelektualną, na którą składają się posiadane przez przedsiębiorstwa prawa wyłączne (w tym patenty), jak i na zagadnienie kapitału ludzkiego zaangażowanego w tworzenie, rozwijanie i praktykowanie tej własności intelektualnej oraz znaczenie zasobów ludzkich pod kątem posiadanych przez przedsiębiorstwa kompetencji rynkowych. Celem artykułu jest określenie roli oraz znaczenia własności intelektualnej oraz kapitału intelektualnego dla funkcjonowania oraz efektywności przedsiębiorstw. Jako metodę badawczą zastosowano analizę literatury przedmiotu, po czym dokonano zestawienia i syntezy przytoczonych zagadnień oraz wyciągnięto wnioski. Poczynione na potrzeby niniejszego artykułu działania pozwoliły dostrzec duże znaczenie zdefiniowanej oraz uregulowanej prawnie własności intelektualnej dotyczącej konkretnych, odpowiednio spisanych rozwiązań. Jednocześnie wykazano znaczącą rolę zasobów ludzkich posiadanych przez podmioty gospodarcze oraz wzajemne powiązanie oraz oddziaływanie wymienionych składowych, które nieodłącznie wpisują się w istnienie oraz efektywne funkcjonowanie przedsiębiorstw. W ramach zastosowanej metody badawczej dokonano przeglądu literatury przedmiotu, zestawiając ze sobą składowe własności intelektualnej w przedsiębiorstwie przyczyniające się w sposób znaczący do generowania przezeń wartości, takie jak posiadanie i/lub korzystanie z chronionych prawem rozwiązań oraz obecność odpowiednio wykwalifikowanego potencjału pracowniczego.
    A basis for this theme are conditions connected with the enterprises’ activity, with a focus on the issues associated with a generation of the value, as they predominantly constitute the market success of the business entities. Considering the environment and the market conditions, as well as for implementing the necessary and desired market strategy by the enterprises, it is essential paying particular attention to a calculable aspect of intellectual property involving the entities’ exclusive rights (including patents), as well as to an issue of a human capital engaged in creating, development and performing of this intellectual property and a significance of the human resources as such for the particular entities as to the owned market expertise. An objective of this study was precising of the role and an estimation of the relative importance of intellectual property and intellectual capital for the functioning and effectiveness of the enterprises. As a test method it was used an analysis of the respective literature, following which summarising and synthesis of the provided issues were done and the conclusions drawn. Made for the purposes of this development activities allowed to notice a great importance of the defined and legally regulated intellectual property concerning the particular, appropriately written solutions, while simultaneously demonstrating a prominent role of human resources.
