The article discusses the level of consumer awareness in the context of growing indebtedness of Polish households. Some claim that low consumer awareness of Poles is one of the reasons for excessive indebtedness. The first part focuses on the definition of consumer awareness, its, importance for consumer choice, and – based on authors’ own research – its level in Polish society. The second part describes the incomes of Polish households from 2008 to 2010. It also shows consumers’ subjective assessment of their financial position and characterises consumer durables used in their households. The third part presents the tendency of Poles to incur debt and their punctuality of repayment. The sources of financing of consumption needs are described along with a scale of excessive indebtedness of Poles. The fourth part of the article focuses on consumer bankruptcy as a solution for the over-indebted consumers and describes current regulations on consumer bankruptcy in Polish law. The scale of their practical application is discussed in reference to Poles’ opinion on consumer bankruptcy, again based on authors’ own research. This part indicates consumer education as an effective instrument against excessive indebtedness.

The article deals with some issues related to consumer (client) protection on the financial market. Legal regulations constantly change in this area. New regulations are introduced, which makes the subject of consumer protection very topical and important, especially with many accompanying transactions on the financial market. The multiplicity of legal acts and the influence of European legislation, especially EU regulations, can lead to many misunderstandings in terms of terminology. An attempt was made to clarify the concepts of consumer and client on the basis of Polish legislation. According to numerous amendments to the regulation, the entities on the market using financial services should make efforts to conduct a correct assessment of its legal situation and the possibility of using the help of institutions. The range of protected entities differ depending on the legal act that is analyzed. The author draws attention to the ways in which the legislator created a definition of a protected entity and the areas in which it provides legal protection. The analysis also includes legal provisions concerning the competences of institutions performing consumer protection functions: the Financial Ombudsman and the President of the Office of Competition and Consumers, which is a body specializing in individual consumer matters, and a public administration body. Their competences and roles, which overlap in certain areas, have been the subject of lively discussion for a time. This was due to the proposed draft act of December 2020, the provisions of which abolished the institution of the Financial Ombudsman, and transferred his competences to the President of the Office of Competition and Consumer Protection. The paper presents the direction of legal changes in the institutional area of consumer protection of financial services, the ratio of such actions, as well as the outlined European legislator’s vision of adequate consumer protection.

The purpose of this article is to provide a theoretical and empirical explanation of how the consumer socialization works with children of 7/8 years. This paper poses questions about the way brands are discussed in social situations in the environment of school class. It explores children’s socializations into consumer-brand relationships and the influence that marketing texts have on their everyday social experiences. The analysis of children’s talk about brands is critical in order to understand the ways that brands (with parents, siblings and peers) socialize them into consumer culture. The first section presents contemporary discussion of children’s consumption phenomena. The second section emphasis on researching with 14 groups of primary Polish pupils in Lublin. It uses data analysis born of in-depth interviews analysis. This study is based on principles of cultural studies and discourse and functional analysis which approach as a means to enhance richness and uniqueness in the area of children’s consumption. In order to understand children’s brand consumption the paper indicates five main functions emerged from the data: 1. Exploring consumer culture through play and gratification 2. Seeking safety in an overabundance 3. Identification and gender socialization 4. Belonging to a group and rivalry 5. Utilitarian functions. Author argues that consumption ideology and their discourses are not increasingly define children’s everyday social experiences. 7/8-year-olds were not a coherent group significantly interested in brands and consumption, but on the other hand, they were not a group that did not interested in them at all. Counter to the (mainly polish) literature children have not extensive knowledge of brands and brands are not so emerging in their lives.

The purpose of the article is to present the issues related to qualifying the costs of a consumer credit, such as commission and fees, to costs associated with the loan period, and thus subject to reduction in the event of early loan repayment. Based on the research, a thesis was formulated that for the correct transposition and implementation of EU law, it is required to ensure the possibility of reducing all costs of a consumer loan, therefore the above costs should be considered related to the loan period and should be proportionally reduced. Methodology: For the purposes of the research, the legal-dogmatic and analytical methods were used. The jurisprudence of Polish courts and the Court of Justice of the European Union was analyzed. The adopted time horizon of the study covered the period from 12/05/2010 to 31/12/2020. The judgments published in the resources of Lex and Legalis Legal Information Systems and the Portal of Judgments of Common Courts as at 31/12/2020 were taken into account. Results of the research: It was found that the judicature largely adopted a broad approach to the problem presented, even before the judgment of the CJEU in case C-383/18, which confirms the thesis adopted for the purposes of the article. Consequently, consumers who have concluded a consumer credit agreement are entitled to a proportional reduction to all costs they had to incur in connection with the concluded agreement. In particular, these are incidental, one-off costs such as commission and preparation fee, which are subjected to reduction.

Nowadays, it is not enough to compete by price anymore. Consumers expect that an online retailer will take care of their needs at every stage of the purchasing process.

In this study the legal status of a consumer as a party to the loan agreement indexed to the CHF is presented. During legal disputes, the subject of many controversies is the existence or the lack of the consumer status. This issue is of high procedural importance as it decides about the formal possibility of applying Article 3851 § 1 of the civil code (k.c.) and relying at the same time on the abusive nature of contractual clauses. In the article, the period that could be examined regarding the consumer status has been discussed in detail, indicating first of all that only the circumstances preceding the conclusion of the agreement and accompanying it influence the status of the consumer as provided under Article 221 k.c. The status of the consumer exists in when the objective prerequisites defined in art. 221 k.c. are fulfilled. The performance of the loan agreement has no direct influence on the issue and circumstances connected therewith and may be applied exclusively for the evidence purposes in the scope of facts and intentions of the natural person upon concluding the agreement. It was also raised that assessing or ‘valuing’ consumers due to the personalfeatures (education, employment, practice) is not allowed and has no legal effect in the context of Article 221 k.c. The pattern “of the enlightened consumer” having its justification in the scope of interpretation of Article 385 § 2 k.c. has no application to the interpretation of Article 221 k.c. nor does the application of Article 3851 k.c. No features of a natural person prejudge either in plus, or in minus the status of the consumer. The fact that the property for which a loan has been taken out will be leased has no influence on the status of the consumer if the consumer being a natural person had a consumer status when concluding the agreement. Pursuant to the lex retro non agit principle the status of a consumer cannot be lost with retrospective force.

The paper discusses the topic of consumer patriotism and is an attempt to connect it with the construct of the old traditional, and the new type of patriotism. Today, electricity is an important factor which ensure socio-economic development and improving the quality of society's life. It's hard to imagine the functioning households without electricity. The individual consumer, as the recipient of consuming electricity in the household must be treated in a special way and must be protected by law. We can see a trend occurring in all countries of the European Union to create instruments to protect individual customers. Energy law uses the new concept recipient acquiring power in the household. The new regulation of the Energy Law creates special protection of consumer rights. It introduces rules: concerning termination of contracts, the disclosure requirements of entrepreneurs energy and the specific rules for dealing with complaints. The legislature in order to protect the consumer has introduced the document constituting a compendium of knowledge about these powers - Collection of Consumer Rights. The energy market is unique, many of the concepts contained in consumer contracts - recipients have a technical nature, so was therefore necessary legislative interference in the consumer's rights.

Pandemia COVID-19 zmieniła zachowania konsumenckie wszystkich konsumentów, także konsumentów seniorów. Artykuł przedstawia zmiany w trendach konsumenckich w grupie starszych konsumentów. Jego głównym celem jest próba odpowiedzi na pytania: czy w porównaniu do czasu przed pandemią nastąpiły zmiany w zachowaniach konsumenckich seniorów, czy pojawiły się zachowania charakterystyczne dla tej grupy oraz które z nich wyraźnie dominują? Do analizy wykorzystano literaturę przedmiotu i raporty Euromonitor International za lata 2017–2022. Na podstawie zaobserwowanych trendów opisano sylwetkę seniora jako konsumenta świadomego swoich wyborów, o wysokim poziomie wiedzy technologicznej, a jednocześnie skupionego na swoich potrzebach i dbającego o zdrowie.
The COVID-19 pandemic was changing the consumer behaviour of all consumers, including of seniors. The article presents changes in consumer trends in the group of older consumers. The main aim of the article is to try to answer the questions: have there been any changes in the consumer behaviour of seniors compared to the time before the pandemic? have there been any specific behaviours for this group, as well as which behaviours have been clearly highlighted? The article considers the literature on the subject and Euromonitor International reports for 2017–2022. Based on the analysis of trends, the profile of the senior as a consumer aware of his choices, with a high level of technological knowledge and at the same time focused on his/her needs and taking care of health was described.

Celem pracy jest wstępna ocena poziomu świadomości klientów na temat praw konsumentów dotyczących reklamacji. Badanie pilotażowe zostało przeprowadzone na terenie Trójmiasta na grupie 113 respondentów w formie sondażu diagnostycznego z wykorzystaniem kwestionariusza ankietowego. Z badań wynika, iż 74,3% konsumentów rynku trójmiejskiego deklaruje, że poziom ich wiedzy kształtuje się na poziomie przeciętnym, słabym lub deklaruje brak wiedzy. Jedynie 12,4% konsumentów jest świadomych tego, do jakich działań mają prawo po dokonaniu zakupu w sklepie i czego mogą żądać od sprzedawcy w przypadku produktu wadliwego. Wiedza konsumentów Trójmiasta na temat przysługujących im uprawnień do reklamacji jest na poziomie niedostatecznym. Wielu konsumentów nie dochodzi swoich praw z powodu braku ich znajomości. Należy prowadzić w większym stopniu akcje promocyjne mające na celu zwiększenie świadomości konsumentów w zakresie ich praw do reklamacji. Artykuł ma charakter badawczy.
The aim of the thesis is to conduct a preliminary evaluation of the level of customer awareness of consumer rights concerning complaints. The pilot study was conducted in the form of a diagnostic survey with the use of a questionnaire in Tricity (Gdansk, Gdynia, Sopot), Poland, where a group of 113 respondents were examined. The research indicated that 74.3% of consumers of the Tricity market declared that their knowledge was at an average, low, or virtually non-existent level; only 12.4% of consumers were aware of what activities they could undertake after making a purchase and what they could demand from the seller in case of a defective product being sold. The knowledge of Tricity consumers about the right to make a complaint, to which they are entitled, is insufficient; as a result, many consumers do not pursue their rights due to their lack of knowledge about this subject. The conclusion is that promotional campaigns should be conducted on a greater scale that would seek to increase consumers’ awareness of their right to make a complaint. The article is of the research nature.
Цель работы – дать вступительную оценку уровня сознательности клиентов в отношении прав потребителей на рекламацию. Пилотажное обследование провели на территории Труймяста (Троегорода) на группе 113 респондентов в форме диагностического зондажа с использованием анкетного вопросника. Из обследований вытекает, что 74,3% потребителей на троегородском рынке заявляют, что уровень их знаний находится на среднем или низком уровне, или же они декларируют нехватку знаний. Лишь 12,4% потребителей знают, на какие действия у них есть право после совершения покупки в магазине, и чего они могут требовать от продавца в случае продукта с изъяном. Знания потребителей из Труймяста в отношении прав на рекламацию, которыми они наделены, находятся на недостаточном уровне. Многие потребители не добиваются своих прав из-за нехватки знания их. Следует проводить в большей степени пропагандистские акции, направленные на повышение сознательности потребителей в отношении их прав на рекламацию. Статья имеет исследовательский характер.

Permanent and unabated interest of the internet users in on-line purchases, constantly encourages further numerous groups of the new net users to take advantage of a vast range of offers on the e-markets. Potential buyers, despite general difference, varied opinions, positions and cultures, subconsciously gather into communities which have one feature in common, namely the reason why they decide to buy on-line. Hereby article presents the most crucial aspects connected with consumer behaviour and all its characteristics. Detailed description of terminology lays the foundations enabling further considerations, creating in thereby the opportunity to deeper analysis of the formulae and notions emerging from this area. Classification of the factors which influence e-consumer behaviour encompasses the key aspects shaping the general profile of the potential buyers of goods on--line. This creates an overall belief concerning particular criteria contributing to the decision making process in e-commerce transactions. Methods of influence appealing to subconsciousness and patterns of behaviour, which are included in each and every advertisement created by a seller and directed at potential buyer, heavily affect the position concerning the selection and consequently, the purchase of the chosen product. Variety of widely understood methods affecting a consumer which exist in the e-commerce, tends to make present techniques modernized, also, to build innovative offers, consequently getting adjusted to potential customers expectations, thus craving bigger profits. Therefore the primary aim of hereby article is to demonstrate the most important aspects of the selected notions accompanied by the reference to current research which enables achieving particular data, with the use of the analysis of e-consumer behaviour, shaped on the basis of the factors and different methods , simultaneously building own techniques.
