    The article indicates the features of space ascribed to the literary protagonists who can be regarded as outsiders. Three types of figures of an “outsider out of necessity” have been selected: a rogue/scoundrel, a homosexual and a chav. For each of these figures—and they are characteristic for the Polish latest prose—distinctive dominant space is attributed, which defines, in different ways, and simultaneously brings out the limiting one-dimensionality and, tragic in its expression, the seclusion associated with the condition of “outsiders out of necessity”. With reference to a rogue/scoundrel especially important is flattening (certain “one-dimensionality”) of the disintegrating landscape. In the case of homosexuals there dominates a closed space of one’s own house (flat). For chavs, in turn, characteristic are labyrinth-like districts of urban ghettos.

    Opis:
    The article concerns the possibilities to assess the effectiveness of bank services basing on an analysis of their interest margins, and its aim is to show the informational capacity of those measures. The first part of the article discusses theoretical issues related to setting various types of interest margins and on their basis specifying interest margin discrepancies. Then results of empirical research are presented which were conducted basing on the data from quarterly financial reports of selected WSE listed banks in 1998-2009. The analysis covered the shaping of all the discussed values in time, both for the bank sector as a whole and in relation to particular banks.

    Subiect of the paper is the problem of predicting sea-going ship resistance and/or horsepower in real operating conditions. Attention is drawn first of all to the need and possibility of revising the very much outdated but still used "service margin" method, which consists in adding an arbitrary percentage margin to the value of resistance or horsepower, relatively precisely determined for the calm water conditions. A negative impact in this respect is shown of the generally used delivery-acceptance procedures, where particular importance is attached to the ship propulsion tests on the "measured mile". The need of revising the "service margins" is a consequence of an obvious need for most efficient ships from the technical as well as economic point of view. Secondly, it is a "must" of permanent improving the ship design quality - the adequacy and accuracy of design methods. The work presents the "wave service margin" coefficient models. It is assumed that they may contribute to the necessary rationalization of the procedure of real ship resistance and/or horsepower determination. The work is based on the results of resistance tests of a series of ships designed within the Baltecologicalship project. The tests were carried out in the Chair of Ship Theory and Design of the Faculty of Ocean Engineering and Ship Technology, Gdansk University of Technology.

    The titled „margins” of the Polish as a foreign language textbooks can be the subjects which are less attractive, “worse” or sensitive (for example a poverty, a corruption, taboo), and also which concern the opposition own-foreign showing the second part of this opposition as a “worse”. These last margins should be avoided in the communicative textbooks, as they are based on the idea of an egalitarianism and individualism. However, the examples from the latest Polish as a foreign language textbooks which are presented in this paper prove it is not always successful. It is surely caused by the bias of the Polish nation which considers everything that is different or foreign to be simply the “worse”. It can also be said that the characteristic features of the Polish language are a christianism and xenophobia.

    Centralni kontrpartnerzy po kryzysie finansowym 2007+ stali się jednymi z kluczowych dostarczycieli usług obsługi transakcji dokonywanych przez uczestników rynku finansowego. Podjęte inicjatywy w zakresie reformy rynku kapitałowego sprawiły, że coraz większa część transakcji rozliczana jest przez CCPs, co decyduje o ich rosnącym znaczeniu systemowym. Z tego względu coraz większego znaczenia nabierają mechanizmy stabilizowania sytuacji CCP w razie wystąpienia szoków. Klasycznym przykładem takiego rozwiązania jest kaskadowe pokrywanie strat w razie niewypłacalności członka rozliczającego CCP. W artykule odniesiono się również do najnowszych zagadnień związanych z ustanawianiem procesu resolution dla centralnych kontrpartnerów.
    After recent financial crisis 2007+, central counterparties have become one of the key services providers for handling the transactions of financial market participants. The capital market reforms have resulted in the growing share of transactions that are cleared by the CCPs. For that reason, the activity of CCPs has gained systemic significance, i.e. problems in the functioning of CCPs can easily trigger the materialization of systemic risk and lead to a systemic crisis. As a consequence, reliable mechanisms for stabilizing the CCP’s situation become increasingly important in the event of shocks. A classic example of such a solution is the cascade of losses in the event of the insolvency of a CCP’s clearing member. The article deals also with the latest issues related to the resolution process for central counterparties.

    This paper presents the results of a study examining whether empirical patterns and trends in international trade in services are in line with those for the international trade of goods. The author conducts static and dynamic analyses of Polish international trade in services using firm-level data. The results suggest that exports of services are dominated by large companies. Most of them have been on the market for a long time. Usually, they export one specific type of services to a single market. The value of service exports is growing due to the firms’ net intensive margin. All the results are similar to empirical observations made with respect to international trade in goods.
    W artykule zawarto wyniki sprawdzenia, czy prawidłowości dotyczące funkcjonowania firm obecnych w handlu towarami, wynikające z teorii handlu międzynarodowego i badań empirycznych, występują również na rynku usług. Przeprowadzono statyczną i dynamiczną analizę międzynarodowego handlu usługami przy wykorzystaniu danych jednostkowych dla Polski. Wyniki badania wskazują, że w międzynarodowym handlu usługami największe znaczenie mają firmy duże, działające na rynku przez dłuższy czas. Najwięcej firm eksportuje jeden rodzaj usług w jednym kierunku. Wzrost wartości polskiego eksportu usług dokonuje się głównie przez kontynuowanie związków już istniejących (net intensive margin). Prawidłowości zaobserwowane dla polskiego handlu usługami są zgodne z wnioskami płynącymi z badań empirycznych dotyczących międzynarodowego handlu towarami.

    "Aftermath", after-Gross and the fans of PolishnessAftermath was released in the late 2012. Its director, Władysław Pasikowski, had previously been famous for his violent action films with strong male protagonists. He has also written some of the most sexist dialogues in the history of Polish cinema, as well as a number of lines, often obscene, which have become catchphrases and slogans present every day in the pop culture.His latest film, however, tackles a completely different issue – this thriller-cum-western tells a story that is decidedly contemporary, but nevertheless inspired by the events that took place in Jedwabne (described by Jan Tomasz Gross in his book Neighbors). Aftermath does not attempt to provide a reconstruction of the events that took place “on the margins of the Holocaust” (including Jedwabne). However, it clearly hints at the issue of the Polish contribution to the extermination of Jews and the impact of the conspiracy of silence having been broken. The film gave rise to a heated debate, which rippled through the Polish media for as long as two months after its release. This article is an attempt to analyse and interpret the words and ideas that appeared in the debate. „Pokłosie”, poGrossie i kibice polskościWraz z końcem 2012 roku odbyła się premiera filmu fabularnego Pokłosie w reżyserii Władysława Pasikowskiego. Ten bardzo popularny polski reżyser znany był dotychczas przede wszystkim z mocnych filmów sensacyjnych o twardych mężczyznach. Zasłynął także jako autor bodaj najbardziej seksistowskich dialogów w polskim kinie oraz rozmaitych i częstokroć wulgarnych kwestii wypowiadanych przez bohaterów, z których wiele do dziś funkcjonuje w popkulturze na prawach popularnych cytatów.W swoim najnowszym filmie Pasikowski sięgnął jednak po zupełnie inny temat. W konwencji thrillera z elementami westernu opowiedział historię jak najbardziej współczesną, ale w zdecydowany spósob zainspirowaną wydarzeniami w Jedwabnem, opisanymi przez Jana Tomasza Grossa w książce Sąsiedzi. Pokłosie nie stanowi jednak próby faktograficznej rekonstrukcji tego, co działo się na „obrzeżach Zagłady”, w tym również w Jedwabnem, lecz jednoznacznie dotyka problemu polskiego współudziału w zagładzie Żydów i konsekwencji związanych ze złamaniem ukonstytuowanej wokół tego faktu społecznej zmowy milczenia. Film wywołał gorącą dyskusję, która toczyła się w ogólnopolskich mediach przez niemal dwa miesiące od jego premiery. Podstawowym celem artykułu jest próba analizy oraz interpretacji słów i myśli wypowiedzianych w czasie jej trwania.

    Casimir the Great’s Flying Circus presents: ‘The narrowest house in the world – an event on a global scale’. Historical re-enactment on the occasion of the 70th anniversary of the Aktion ReinhardtThe article provides a multifaceted analysis of the Keret House as an artistic installation and a cultural event. The construction is placed in the analytical context of Jeremy Bentham’s panopticon, Le Corbusier’s machine for living, Krzysztof Wodiczko’s Pojazd dla bezdomnych (Vehicle for the Homeless), Big Brother and XTube. Other interpretative contexts are: the history of the Warsaw ghetto, the Aktion Reinhardt as well as the ensemble of issues connected with the third phase of the Holocaust (i.e. “the margins of the Holocaust”): the history of Jewish hideouts, the hunt for the Jews (Judenjagd), the plunder of Jewish mobile and immobile property, the Polish part of the biography of Etgar Keret’s parents. From such a perspective, the Keret House takes the form of a macabre historical re-enactment. The analytical framework comprises Erving Goffman’s stigma theory as well as the history of the attitude of the Polish majority towards the Jewish minority. With increasing frequency, anti-Semitic symbolic violence assumes the form of philosemitic symbolic violence. The poetics of gift and the category of “a Jewish writer with a sense of humour” function as an instrument of blackmail that place the individual subjected to it in a situation with no way-out. In Polish majority culture, the image of Jews as guests, which corresponds to the representation of Poland as home and Poles as hospitable hosts, heirs of the myth of King Casimir the Great, plays the same role. The Keret House proves to be a machine for the reproduction of the Polish majority narrative about the majority attitude of Poles towards Jews, also during the Holocaust. Kolejne konteksty interpretacyjne to historia warszawskiego getta, Akcja Reinhardt i zespół problemów związanych z trzecią fazą Zagłady (the margins of the Holocaust): historia żydowskich kryjówek, polowanie na Żydów (Judenjagd), rabunek żydowskich ruchomości i nieruchomości, polska biografia rodziców Etgara Kereta. W tej perspektywie Keret House przybiera postać makabrycznej rekonstrukcji historycznej. Ramy analizy wyznacza teoria piętna Ervinga Goffmana oraz historia stosunku polskiej większości do żydowskiej mniejszości. Antysemicka przemoc symboliczna coraz częściej przybiera postać symbolicznej przemocy filosemickiej. Poetyka daru i kategoria „żydowskiego pisarza z poczuciem humoru” pełnią funkcję narzędzia szantażu, stawiając poddaną mu jednostkę w sytuacji bez wyjścia. Taką samą rolę odgrywa dominujące w polskiej kulturze większościowej wyobrażenie Żydów jako gości, któremu odpowiada obraz Polski jako domu i Polaków jako gościnnych gospodarzy, spadkobierców mitu króla Kazimierza Wielkiego. Keret House okazuje się maszyną do reprodukcji większościowej polskiej opowieści o stosunku Polaków do Żydów, także w okresie Zagłady.     Memory acquired. The conception of the Polish experience of the Holocaust as collective trauma in the light of a revision of the concept of bystanderThe paper provides a reconstruction and proposes the deconstruction of the conception of the Polish experience of the Holocaust as collective trauma. The analytical framework is based on the revision of concepts such as Polish witness (bystander/onlooker – according to Hilberg) and indifference on the part of Polish majority society towards the persecution and murder of the Jews. The text postulates that the concept of indifference as well as that of the non-Jewish witness (bystander/onlooker) be dropped from the standard terminology used when describing the Holocaust. It proposes that the concept of the non-Jewish witness (bystander/onlooker) be replaced by the concept of participating observer – with a different understanding from that established within cultural anthropology.Thus, watching would be a form of activity, a way of having an influence on the events, of agency, and therefore participation. A significant part of my argument includes an attempt to address the question of the construction of watching during the Holocaust. From this it follows that watching constitutes the most basic form of power (droit de regard – according to Foucault and Bourdieu). Therefore, the question arises of whether or not one can describe the margins of the Holocaust within the terms of panoptic reality (le panoptisme – according to Foucault). A further question under consideration is whether one can depict the dominant majority as an unofficial authority wielding something akin to social control over the completion of the Holocaust understood as the German Nazi system of persecution and extermination of the Jews.The argument also foregrounds the actual functions of the concepts of the non-Jewish witness (bystander/onlooker) and indifference as well as the idea of the Holocaust as a trauma for the non-Jewish witness (bystander/onlooker). These functions resulted several times in the elimination of the historical concrete and its societal-cultural conditions from the field of vision. In this sense, the conception of unacquired memory (i.e. the Polish trauma of the Holocaust) would be a strategy for acquiring the memory of the Holocaust in such a way that it does not endanger the dominant narrative about the past and the identity of the majority. Furthermore, the paper proposes the deconstruction of the concept of Polish-Jewish dialogue by identifying the phenomena of false symmetry and false universalization that frequently result in defining anti-Semitism and the Holocaust within the categories of a groups conflicts. The inspiration to undertake such a critical analysis came from the paradigmatic work by Michael C. Steinlauf, Bondage to the Dead: Poland and the Memory of the Holocaust, published in 1997. (The Polish-language edition entitled Pamięć nieprzyswojona. Polska pamięć Zagłady [Memory unacquired. The Polish memory of the Holocaust] came out in 2000, translated by Agata Tomaszewska.) Pamięć przyswojona. Koncepcja polskiego doświadczenia zagłady Żydów jako traumy zbiorowej w świetle rewizji kategorii świadkaArtykuł przedstawia rekonstrukcję i proponuje dekonstrukcję koncepcji polskiego doświadczenia Zagłady jako traumy zbiorowej. Kontekst analityczny stanowi rewizja takich kategorii, jak: polski świadek Zagłady (bystander/onlooker – za Hilbergiem) i obojętność wobec Zagłady. Tekst postuluje wykreślenie kategorii obojętności ze słownika opisu Zagłady. Kategorię świadka (bystander/onlooker) proponuje zastąpić kategorią obserwatora uczestniczącego w rozumieniu innym niż przyjęte w antropologii kulturowej. Spojrzenie stanowiłoby tutaj formę aktywności, oddziaływania, sprawczości (agency), a więc uczestnictwa. Istotna część wywodu to próba odpowiedzi na pytanie o konstrukcję owego spojrzenia stanowiącego najbardziej podstawową formę władzy (le droit de regard – za Foucault i Bourdieu). Pojawia się pytanie, czy obrzeża Zagłady można opisać w kategoriach rzeczywistości panoptycznej (le panoptisme – za Foucault). Kolejna rozważanakwestia to, czy większość dominującą można ukazać jako nieformalną instancję sprawującą rodzaj kontroli społecznej nad kompletnością Zagłady jako niemieckiej zbrodni państwowej.W centrum namysłu znajdują się także dotychczasowe funkcje kategorii świadka (bystander/onlooker), kategorii obojętności oraz koncepcji Zagłady jako traumy nieżydowskiego świadka. Funkcje te niejednokrotnie bowiem polegały na eliminacji z pola widzenia historycznego konkretu i jego społeczno-kulturowych uwarunkowań. W tym sensie można mówić o koncepcji pamięci nieprzyswojonej (polskiej traumy Zagłady) jako strategii przyswojenia pamięci Zagłady w sposób niezagrażający dominującej opowieści o przeszłości i tożsamości grupy większościowej. Tekst proponuje ponadto dekonstrukcję kategorii dialogu polsko-żydowskiego ze wskazaniem na zjawiska fałszywej symetrii i fałszywej uniwersalizacji, których częstą konsekwencją jest definiowanie antysemityzmu i Zagłady w kategoriach konfliktu międzygrupowego. Inspiracją do podjęcia namysłu była paradygmatyczna praca Michaela C. Steinlaufa Bondage to the Dead: Poland and the Memory of the Holocaust z 1997 roku, której polskie wydanie – zatytułowane Pamięć nieprzyswojona. Polska pamięć Zagłady – ukazało się w roku 2001 w tłumaczeniu Agaty Tomaszewskiej.

    Przedmiotem artykułu jest analiza prawna zakazu pobierania od dostawców innych niż marża handlowa opłat za przyjęcie towarów do sprzedaży w sieciach handlowych sprzedawcy na gruncie przepisów ustawy o zwalczaniu nieuczciwej konkurencji oraz orzecznictwa Sądu Najwyższego, sądów powszechnych i doktryny, w szczególności w kontekście dopuszczalności pobierania od dostawców przez sieci handlowe rabatów, bonusów i opustów.
    This conference paper presents a legal analysis of the prohibition to charge suppliers fees other than a commercial margin for accepting goods for sale in accordance with the provisions of the Combating Unfair Competition Act, judgments of the Supreme Court, general jurisprudence and legal literature. Considered in particular is the admissibility of the use by retail chains of different categories of bonuses, rebates or discounts in their relations with suppliers.
