The Holy See is the central office of the Roman-Catholic Church and its scope encompasses all the dimensions of the Church: spiritual, theological, legal, and material. Culture is one of the areas in which the Holy See, headed by its supreme authority, the Pontiff, is particularly involved since culture constitutes the space where individuals and particular communities live. As it fulfils its mission in the modern world, the Church encounters various religions and world-views. For several decades the Church has conducted missionary activity in Africa, where about 30% of the total population are followers of traditional African religions, and the lives of 50% are influenced by them. The lack of Holy Scriptures is the distinguishing trait of these religions as the peoples observing them are illiterate. They show great respect for the elders, who uphold the tradition, and for life. Religion in Africa can be regarded as part of culture, which does not view sacrum and profanum as opposites. In the last decades of the 20th century and at the turn of the 21st century, the Catholic Church adopted the paradigm of dialogue as a means of relating to the religious tradition and the culture of Africa. While pursuing this dialogue, the Church follows the guide- lines of the Second Vatican Council (1962-1965), including the Nostra aetate Declaration on the Relationship of the Church to Non-Christian Religions. The Holy See has promulgated a number of documents referring to Africa's traditional religions and cultures. John Paul II signed the Ecclesia in Africa Apostolic Exhortation, and Benedict XVI issued the Africae munus Apostolic Exhortation.The Apostolic documents focus on various of African religions and cultures - such as family, community, ancestors, and faith in God - which can become the subject of dialogue. The documents of the Church emphasise the positive traits shared by all African religions in the sphere of religion, rituals, morals, culture and society. The Holy See proclaims documents and engages in practical activities with a view to overcoming divisions in Africa and building the community of reconciliation, the "new" Africa.

In the first centuries of Christianity a meeting of small communities was considered as the way of resolving conflicts, making important decisions, and seeking God’s will for the community. With the increasing number of believers followed necessary decentralization of ecclesiastical structures so that dioceses could decide on administrative and organizational matters. Clergy assemblies have served these issues and we can consider them today as prefiguration of diocesan synods. Most authors believe that the first diocesan synod assembly took place in France in Auxerre in A.D 578. Over the centuries, the institution of diocesan synod experienced both the flourish moments, as well as the crises. For its definitive fixation in the canonical doctrine should be considered the treaty of Pope Benedict XIV De Synodo Dioecesana published in 1748. The value of the diocesan synod as a legal institution has been confirmed by the Second Vatican Council, which in the Decree Christus Dominus has expressed the wish of synodal fathers that the institution will take on a new life and serve the Church in modern times. The current legislation concerning the diocesan synod is contained in the Code of Canon Law (c.  460-468), as well as in the Instruction of the diocesan synods issued in 1997 by two Vatican congregations. In Poland since the promulgation of the Code in 1983, until the year 2012 31 diocesan synods were held. Some of them took place in the days of communism, the other in a free Poland, which also had an impact on their course. In addition to many historical, ecclesial and pastoral circumstances particularly important was the influence of St. John Paul II,who personally participated in the opening or closing of some diocesan synods.

In view of contemporary threats, the Holy See decided to adapt the law of the Vatican City State concerning intellectual property to the international standards. The new act, published on March 19, 2011, adopts the law of the Republic of Italy in this regard, providing that it is in accordance with the Law of God, canon law and all the international treaties signed by the Holy See. The new act is designed to protect the integrity of the teaching of the Bishop of Rome and the Holy See against improper commercial use, or another use that may be detrimental to the Church. The new law also protects the image and the voice of the Pope, as well as the copyright of the Holy See. The act establishes a Committee for Intellectual Property Rights, which is going to deal with matters of particular importance regarding copyrights.

The Concordat between the Holy See and the Republic of Poland was signed in 1993, but ratified in 1998. Year 2013 marks the 15th anniversary of coming into effect of the bilateral agreement. It is a good opportunity to evaluate its provisions. The paper aims to present one of the pieces of evidence from art. 10 sect. 1 no. 3 of the Concordat, namely, the evidence for registering canonical marriage in the State Civil Registry so that the marriage would be a subject to such effects as a marriage contracted according to Polish law. From the interpretation of the provision in question and application of its norms there arise some theoretical and practical problems. The author tries to solve them and give some postulates de lege ferenda so as to make the law more clear.

Konkordat między Stolicą Apostolską i Rzecząpospolitą Polską został podpisany 28 lipca 1993 r., natomiast ratyfikowany 23 lutego 1998 r. Ta międzynarodowa umowa potwierdziła i uszczegółowiła zasady proklamowane na Soborze Watykańskim II: 1) zasadę autonomii i niezależności Kościoła i państwa; 2) zasadę współdziałania Kościoła i państwa; 3) zasadę wolności religijnej. Konkordat reguluje m.in. następujące sprawy: uznanie osobowości prawnej Kościoła katolickiego i jego jednostek organizacyjnych; swobodę Kościoła w dokonywaniu zmian w strukturze terytorialnej Kościoła; ochronę małżeństwa i rodziny, a zwłaszcza uznanie skutków cywilnych małżeństwa zawartego według formy kanonicznej i współdziałanie państwa i Kościoła na rzecz małżeństwa i rodziny.
The Concordat between the Holy See and the Republic of Poland was signed on 28 July 1993 and ratified on 23 February 1998. This international agreement confirmed and specified the principles proclaimed at the Second Vatican Council: 1) the principle of autonomy and independence of the Church from the State; 2) the principle of cooperation between the Church and the State; 3) the principle of religious freedom. The Concordat regulates among others the following matters: recognition of the legal personality of the Catholic Church and its organizational units, the Church’s discretion in making changes in its territorial structure; protection of marriage and family, and in particular recognition of the civil consequences of a marriage concluded according to the canonical form, and the cooperation of the state and the Church in matters of marriage and family.

In a relatively short pontificate of Pope Benedict XV we can distinguish two stages: the First World War and the first years after its end. To a certain extend the war determined the character of the Pope’s activities, who during the war took measures to stop the fights between the parties of the conflict and after the war he fought to strengthen the position of the Catholic Church in new circumstances. In this way the Pope wanted to prevent the Church dependence on a state or rather a group of states, which wanted to have influence on the life of the Church and the faithful. It can be said that the actions taken by Pope Benedict XV allowed the Church to avoid it.

The earliest mention of relations between the Holy See and Mieszko's I country is the text found on the nonexistent Bolesław Chrobry's tomb. This text speaks about sending young Bolesław Chrobry's heir to Rome, which in usually idnetified with Mieszko's son, possibly held as a German hostage in 973. The connection between the Holy See and Polish missionary bishop Jordan, who was directly answerable to the Pope, is seen as being problematic. Middle-aged sources tell us that Jordan was established as bishop in Mieszko's I country in 968, but it is thought that he was ordained Bishop in 967. It is connected with the handing to Otto I, a sword that belonged to the Saxon rebel Wichmann the Younger. The author tries to connect the choosing of Jordan with the establishment of the archbishopric of Magdeburg. There is evidence that Jordan's nomination happened during synod in Ravenna in April 967. During that synod, the organization of Church structures in Slavic countries was carried out. Because only the Pope could issue the license to prosylete the pagans, the author believes that relations were established before the baptism of Mieszko I.

he judgment of March 31, 2020, file ref. II CSK 124/19, has great social and legal significance. It is the first Supreme Court ruling concerning the civil liability of church legal entities for pedophilic acts committed by a clergyman. The Supreme Court shared the view of the Court of Appeal accepting the liability of church legal persons in the light of all the facts of the case of Art. 430 of the Civil Code (culpability in supervision). However, it convincingly distanced itself from the position of the District Court (court of first instance) that liability under Art. 429 of the Civil Code (culpability in choice) should be taken into consideration. In the justification of the judgment, the Supreme Court conducted a thorough analysis of the premises for the civil liability of church legal persons for the activities of a religious person subordinate to them. In particular, it stated that if the perpetrator acts for personal gain and the performance of the official activity enables him to cause damage, the superior cannot effectively raise the objection that the subordinate caused said damage only in the performance of the entrusted tasks. Thus, the Supreme Court upheld the interpretation of Art. 430 of the Civil Code, assuming the liability of legal persons for damage caused by a subordinate. It distinctly applied this liability to church legal entities. When appointing the adjudication panel of the Supreme Court, impartiality was preserved. On the other hand, doubts are raised regarding the Court’s neutrality in terms of world-view in some parts of its judgment justification. The judgment of March 31, 2020 must be assessed as brave and just. It has the chance to set the course of judicial decisions in matters of the liability of religious legal persons for pedophilic acts committed by clergy acting under their supervision. The justification of the judgment is understandably critical towards the perpetrator and church legal persons superior to him, and also sometimes towards the provisions of the Code of Canon Law. It should be emphasized, however, that the judgment is not an “indictment” against the Catholic Church as such, and even less so against religion.

W dość długi już katalog umów zawieranych po Soborze Watykańskim II przez Stolicę Apostolską z państwami afrykańskimi wpisała się umowa ramowa (Accord-cadre) w sprawach wspólnego interesu (sur matières d’intérêt commun) zawarta 6 listopada 2012 r. z Republiką Burundi. Traktat ten, obejmujący preambułę, 22 artykuły oraz aneks, reguluje szeroki wachlarz spraw interesujących obydwie strony. Stanowi znaczący, jak się wydaje, instrument służący wzajemnemu, obustronnie wzbogacającemu dialogowi kultury z wiarą. Preambuła umowy, obejmująca siedem akapitów, wskazuje cel, przesłanki i okoliczności jej zawarcia. Uzgodnienia zawarte w Umowie ramowej, zawarte w poszczególnych artykułach, dotyczą następujących spraw: zasady ogólne, sprawowanie kultu Bożego, nominacje kościelne, przestępstwa duchownych i osób zakonnych oraz sekrety: spowiedzi i zawodowy, dobra materialne kościelnych osób prawnych oraz duchownych, budownictwo sakralne i kościelne, posługiwanie się przez Kościół środkami przekazu, małżeństwo, zrzeszanie się wiernych, prowadzenie przez Kościół placówek oświatowych i wychowawczych, prowadzenie przez Kościół instytucji dobroczynnych, udział finansowy Państwa w działalności Kościoła na rzecz narodu, opieka duszpasterska nad zaangażowanymi w siłach zbrojnych i bezpieczeństwa oraz nad przebywającymi w zakładach i instytutach zamkniętych, postanowienia końcowe. Należy mieć nadzieję, że umowa Stolicy Apostolskiej i Republiki Burundi, uchylając rozdźwięk między Kościołem a kulturą plemienną tego kraju, stanie się – w jakiejś mierze – skutecznym narzędziem inkulturacji na kontynencie afrykańskim.
Among quite a long catalogue of agreements concluded by the Holy See with African states after the Second Vatican Council there is the framework agreement (Accord-cadre) on mutual interest (sur matières d’intérêt commun) concluded on 6 November 2012 with the Republic of Burundi. The treatise consisting of the preamble, 22 articles and the annex regulates a wide range of matters of interest to both parties. Apparently it is a considerable instrument aimed at mutual dialogue of the culture and faith, which enriches both parties. The preamble of the agreement composed of seven paragraphs features the objective, rationale and circumstances of its conclusion. The arrangements included in particular articles of the Frame- work Agreement deal with the following issues: general matters, exercise of the God’s cult, church nominations, crimes committed by the clergy and members of religious orders, the secret of confession and professional secret, material goods of ecclesiastical legal persons and the clergy, sacral and church buildings, the use of the mass media by the Church, marriage, congregating of the faithful, running educational and fostering facilities by the Church, running charitable institutions by Church, the state’s financial contribution in the activities pursued by the Church for the nation, ministerial care over persons engaged in armed and security forces and over persons staying in closed facilities and institutes, final provisions. It should be hoped that while bridging the differences between the Church and country’s tribal culture the agreement of the Holy See and the Republic of Burundi will become to some extent and effective tool of inculturation on the African continent.

The Belgian courts and the ECtHR treating the Holy See as a state is an over-inter-pretation. The Holy See cannot be treated as a foreign sovereign. This is a historical anachronism. At the very most, we can speak of the so-called ‘spiritual sovereignty’ of the Holy See, which his related to the fact that it is the governing body of the Catholic Church. However, it has no public-law powers over church structures and its followers. The Church is a voluntary international private association of natural persons. It has no administrative power over its members. The Holy See has a superior position over bishops. Therefore, it should also be responsible for the lack of a proper reaction by these church leaders to the sexual abuse of the clergy subordinate to them. In the past, the Catholic Church operated a policy of silence (omerta) based on clericalism. The pontificate of Pope Francis brought about fun-damental changes in this area. However, the judgment of the European Court of Human Rights of October 12, 2021 is procrastinating and will probably trigger what can be termed a ‘chilling effect’. What takes precedence is the good of the influential institution – the Holy See – and not those individuals wronged in their childhood.

Opis:
This paper analyzes political activities of Count M. Tyszkiewicz. The author sets out from an overview of his descent, academic education, and family relationship. Particular attention is devoted to Tyszkiewicz’s involvement in political affairs, formation of his views, as well as social and political undertakings. Another element highlighted here is Tyszkiewicz’s activity as a patron, his contribution to the development of Ukrainian and Polish culture, and relations with Ukrainian politicians and writers at the turn of the 20th century. Furthermore, the author discusses his diplomatic achievement as a representative of Ukraine to the Holy See and the peace conference in Paris. Based on a study of correspondence between Tyszkiewicz and Ukrainian politicians, the author emphasizes his commitment to the Ukrainian cause on the international scene and efforts to seek recognition of the Ukrainian state.
