The author, on the basis of chosen examples, discusses the influence of the crisis in the Universal Church in the 15th century on the conduct of the inhabitants of the Polish Kingdom. A particular emphasis was put on the analysis of the period of so called the Schism of Basel between 1439 and 1449, nevertheless, the period of Pisa and Constance Councils have not been omitted. The author does not only focus on the conduct and attitudes of secular and church elites but also tries to investigate how the religious condition in the Universal Church affected common subjects of Polish monarchs. The author uses examples from the life of townspeople and various monastic communities or religious orders. He extensively elaborates on pardons granted by councils, popes, cardinals and bishops. The author also emphasises the difficulties in interpreting some source documents. The documents dating from the time of the Council of Basel have been subjected to closest scrutiny. The issue so far has not been extensively discussed in subject literature, which motivated the author to try and get some insight into the problem. This is why in effect, only the most interesting aspects for the author have been reflected in the work. Undoubtedly they require further analysis and research especially including manuscript sources.

This article contains an analysis of the codicological context and circumstances surrounding the writing of the oldest city record of Chojnice. This volume is the most important source of information about the town’s medieval history. It is in the State Archive in Bydgoszcz in the section devoted to Documents of Chojnice under signature no. 33. The date of its writing has provoked controversy among scholars, as the date of 1436 was often misread as 1466. The author discusses and analyzes the structure of the volume, the phases of its production, and dates the paper on the basis of an analysis of the dating ofthe water marks. These water marks confirm that volume began to be kept in the 1430s and subsequent pages were sown in as the pages of the manuscript were filled up. It is a typical record of entries kept simultaneously by the council and the town court; it was kept through to the 1640s. The introductory section of the volume is unique. There the councilors present in minute detail the motives behind starting it. They call it a book of memory, one that aims to preserve a memory of official matters, court cases, and transactions entered into. The author also considers the circumstances that could have influenced the late establishment of the record – only in 1436 – and points out the self‑awareness of the members of the town council as guardians of the memory of the town’s history.

The powers of the chairman of the communal council, as provided for in Article 21a, are clearly defined in terms of subjective and objective matter. Official instructions of the chairman of the communal council may be addressed only to the employees of the communal l office who perform organizational, legal and other tasks related to the functioning of the communal council, committees and councilors. An instruction given by the chairman of the communal council to prepare a draft resolution is in accordance with the law, if the right to a legal initiative regarding resolutions belongs to the powers of the chairman of the communal council.

Ustawodawca w Kodeksie Prawa Kanonicznego z 1983 r. stanowi, że ci, którzy otrzymali święcenia, zdolni są do sprawowania, zgodnie z przepisami prawa, władzy rządzenia, która jest w Kościele z Bożego ustanowienia. W wykonywaniu tej władzy mogą współdziałać wierni świeccy, zgodnie z przepisami prawa (kan. 129). Autor analizuje w artykule podstawy współdziałania we władzy rządzenia wiernych chrześcijan świeckich oraz ich uczestnictwo w organach kolegialnych Kościoła partykularnego, tj. w radzie ds. ekonomicznych, radzie duszpasterskiej i radzie mediacyjnej.
The legislator in the Code of Canon Law of 1983 states that those who have received sacred orders are qualified, according to the norm of the prescripts of the law, for the power of governance, which exists in the Church by divine institution. Lay members of the Christian faithful can cooperate in the exercise of this same power according to the norm of law (can. 129). In the article the author analyzes the basics of the cooperation of faithful lay faithful in the power of governance and their participation in the collegial organs of the particular Church, i.e. the finance council, the pastoral council and the mediation council.

The diocesan Bishop, taking care of part of the Church entrusted to him, is supported by subsidiary bodies, which may be single or collective. To a single organ, equipped with ordinary vicarious power are: general vicars, curates bishops, judicial vicar. A collegial body composed of many people as a college work for the good of the Church. The purpose of this paper is to present the collegial structures in the diocese, where there is an obligation on the bishop by the legislature dipped. Therefore discussed are: the Council of Priests, the College of Consultors and the Council on financial matters. All of the colleges in the diocese are an important link between the diocesan bishop of the whole presbytery and the laity, for the joint development of the Church of Christ.

Rev. Wincenty Skrzetuski, an outstanding political writer, lawyer and historian, has published an interesting characteristics of the Permanent Council (Rada Nieustająca), a new central institution established in Poland in 1775-76. These remarks were published in his handbook Prawo polityczne narodu polskiego (The Constitutional Law of Polish Nation). A big part of these remarks was dedicated to one of the most important prerogatives of the Permanent Council – the interpretation of existing laws by passing resolutions about them. Skrzetuski was stressing the importance of creation of the Council, which in his opinion was a kind of the first central government in the Polish – Lithuanian Commonwealth. The final legal shape of the Permanent Council was a result of a compromise between the King’s tendencies to strengthen his political power and his opponents from the republican party. In Skrzetuski’s opinion the competence of the Permanent Council to interprete the existing laws had big importance for legal practice and was useful for the unification of laws. This competence was strongly criticized and even Skrzetuski was stressing that it was used in too many cases, especially in those which didn’t have to be interpretated.

The Second Vatican Council did not pay in full any instrument of catechesis, as it took place at the Council of Trent and Vatican I but many are expressed in the constitutions and decrees were the inspiration for catechetical renewal that Pope Paul VI called “green branch of a tree, which is Church”. The next Synod of Bishops in Rome were devoted to the issue of evangelization and catechesis in a changing world, and they issued the apostolic exhortations outlined principles of dynamic development of these processes. Bowing to the demands of the fathers of the Synod of 1983 on the development of the Catechism of the Church, John Paul II appointed editorial team, which, under the direction of Cardinal. J. Ratzinger, developed and the 30th anniversary of the Council issued the Catechism of the Catholic Church. Under the infl uence of inspiration and achievement preachers council and the catechism of the anthropological orientation Catechism was that on the day of promulgation of the pope declared one of the “most important events of modern history of the Church”. It quickly became a best-seller in many countries around the world and also a summary of the renewal of the Church of the twentieth century.

The resolution published below has replaced earlier resolutions from 1945 and 1946. They were published in the previous volume of “Miscellanea Historico-Iuridica”. Important changes were introduced by the resolution. The most significant was that the Ministry of Justice was no longer a legislative centre of the Ministry Council and the functions were transferred to the Office of the Prime Minister. This change is long-lasting, since even now the Office is responsible for the internal legislative procedure in the Ministry. The resolution shows that the legislative process (especially process of preparing bill for the Sejm to pass) was more and more complicated.

In the opinion of the author of the opinion, a communal council may include in a communal statutes issues related to interpellations and questions submitted by councillors. The provisions of the statutes in this respect may not repeat or modify the provisions of the Act on Communal Self-government, in particular the statutes of the commune may not provide for any other form of submission of these documents than a written one. There are no legal obstacles to including in the agenda of a session of the communal council an item concerning the information on the number of submitted interpellations and questions by councillors, their contents and the answers given to them.

The opinion indicates that from the literal wording of Article. 1 and 2 of the Act on the Social Dialogue Council one may, prima facie, conclude that the procedure of giving opinion by the Council is to be applied to all the bills and drafts of other law enactments whose scope of regulation contains the issues referred to in Article. 1. However, on the basis of these provisions of the Act, it is not possible to precisely define which bills and drafts are subject to opinion-giving procedure. According to the author, government bill – irrespective of the referral for an opinion to employers’ organizations and trade union organizations – must be submitted for opinion to the Social Dialogue Council.

The main goal of this article is to show how John Henry Newman’s Mariology and thought on Blessed Mary penetrated into the Mariology of the Second Vatican Council. To begin with, the author outlines the context of Newman’s theological activity as well as the context of the last Council. Subsequently, selected aspects of Newman’s mariological reflection are discussed as they emerge in the conciliar documents. The author then advances a theological assessment of Newman’s conceptions which found their way into the documents of the council.

The article presents the issues related to the appointment or dismissal of municipal bodies in the supervisory proceedings. The article presents the concept of the university developed in the mid-nineteenth century by Cardinal John Henry Newman. Newman believed that the university should provide pure and universal knowledge. He was against the professionalization of academic education. According to Newman, the task of universities was to “introduce to life in society” and to “adapt to the world.” This idea grew out of European optimism and a deep belief that teachers and students were part of the same intellectual community. Newman’s concept retains its value because it is rooted in the legacy of humanistic ideal of the education present in the university from very beginnings of this institution. As we know from history university was a place for gaining universal knowledge. However, disturbing cracks can be seen in this idea, which is related to the commercialization and parameterization of the education process. Both lead to deep pathologies of academic life. We see these changes not only in Poland, but also in Western Europe and the United States. After the change of the political system in 1989, Polish universities were significantly degraded and the status of an academic teacher decreased dramatically. The only remedy is to restore universities to the autonomy they deserve and to move away from attempts to politicize or ideologize them.
