To the concept of a family farm, constituting under article 23 of the Constitution, the basis of the agricultural system, the legislator refers in a number of legal acts. Among these laws are those that are of particular importance for the structural transformation of agriculture, and also concern trading of agricultural land. In the essay it was attempted to determine the place of a family farm in this legal regulation. Analysis carried out in this field shows there is a lot of inconsistency in enacted in this area legal regulations. The legislator refers primarily to proprietary market, builds a model of agricultural holding mainly on property law, while in the Act on forming rural system indicates that the family farm is a farm run by, for example, the leaseholder. Family farm is treated rather instrumentally to agricultural trade, rather than as a value that should be subject to special protection.

The subject matter of the family farm protection can and should be considered on the ground of 1) provisions of the Constitution of the Polish People’s Republic of 1997 and 2) regulations of common legislation. The first part of the article deals with the notions of the legal character of Article 23 of the Constitution, the notion of property in Article 21 whose character is of political directive and Article 64 of the Constitution whose contents are formed by the citizen’s right to property. The provision of the latter article finds its place with no conflict in the network of the Civil Code notions. Constitutional provisions related to property are concise and are formulated on two planes: subject’s right law (Article 64) and object’s law (Articles 23, 20 and 21). They allow to recognise the existence of other types of property, agricultural property among others, which requires marking its limitations and the scope of protection. The relation of the act on the creation of agricultural system to the provision of Article 23 of the Constitution as well as its other regulations is with respect to the question about the shape of property transformations in agriculture in the conditions of market economy in Poland, where the family farm would be under special protection. The answer may be negative since the act does not meet the prerequisites accepted in its preamble. In the second part of the article there was made an attempt to present legal means of the protection of the family farm de lege ferenda postulating 1) the introduction of new contents of Article 23, the correction of Article 21 ( possibly 64) of the Constitution, 2) the change (broadening) the subject of the act on the creation of agricultural system as well as determining explicitly its place in the provisions of agricultural law and joining legislative activities marked in the ‘Green Book’ in the part on agricultural property turnover, 3) considering the introduction of debt recovery provision, and 4) testamentary distribution, with the reservation of the family farm protection.

The new act on agricultural system was passed on 5 August 2015. It will enter into force on 1 January 2016, thereby repealing the Act on Agricultural System that has been in force since 16 July 2003 and has been repeatedly criticised. Providing the rationality of the legislator’s action, judging by the real and not merely declared need and willingness of factual improvement of not merely the conditions of living in the countryside, but also, most of all, the improvement of still little productively and economically efficient regional structure of premises, it could be expected that there will be new solutions which will effectively implement the aims pointed in article 1 of the act. Unfortunately, the Act of 2015 is mostly based on actions prescribed in the previous regulation in terms of the control of real estate transactions, not introducing any new solutions. The main function is sealing the real estate and counteracting the purchase of agricultural real estates by European Union citizens. The new act on agricultural system should regulate the entirety of agricultural system and be the specific constitution of agricultural activity. Subordinating the act to one aim makes the postulate of entire regulation of the agricultural activity still present. The remarks applied for the previous act of 2003 can be also related to the new regulation, because the basic issues concerning the internal organisation of a premise, the status of particular members and the protection of the premise workers rights were not raised in the act and the improvement of agricultural structure and the reinforcement of the Polish agriculture or introducing solutions which couldprovide Polish farmers honourable existence are raised merely on the margins of main provision of the law. There is no doubt that despite passing the new law on agricultural system there is still lack of modern and comprehensive regulations involving agricultural issues.

The historical turning point of the year 1989 led to fundamental changes in agricultural policy towards a free market economy and respect for private property. Liberal tendencies caused the resignation on the restrictions in trade and favouritism of the state ownership. Characteristic for the entire period of 1989–2009 was a progressive polarisation of the farms. Despite a slight annual decrease in the total number of farms, the area of the farms in two size groups: up to 2 hectares and above 20 hectares can be observed, including the biggest increase in the 30–50 hectares group. Such observation indicates that a dichotomous division into small farms, producing only to meet their own needs and organised agricultural enterprises, able to produce goods in substantial amounts existed. At the same time a slow process of concentration advanced, causing the increase of the average farm size. While the first 15 years since 1989 till 2004 could be recognised as a clear polarisation period, the last five years show a decline in the quantity of the smallest farms, up to 2 hectares shall, but still the tendency of the rising growth of the biggest farms can be noticed. It should be examined whether this process is associated only with the overall improvement of the economic situation after the year 2004, which supported the process of concentration or maybe also the consequence of the law on the formation of the agricultural system on 11th April 2003. Additionally it seems that the possibility of acceleration of the concentration processes could result from the creation opportunities for farmers in other sectors of the economy or in increasing the profitability of farming itself. Effective instrument capable of achieving this objectives are the programs carried out under the Common Agricultural Policy, althought it carries the risk of over-redistribution of resources, which can lead to a decrease in investment caused by excessive fiscal burdens needed to finance the agricultural projects. The main goal shall be the creation of large number of efficient farms capable to production and investing. This could be achieved through the implementation of mechanisms that will promote improvement of farm structure, e.g. by reducing the phenomena of unreasonable division of farms and facilitation of integration of the neighbourhood farms. As an interesting proposal must be considered a statutory pre-emptive right in favour of landowners adjacent to the property being sold as well as the exclusion of marginal agricultural land for non-agricultural purposes. The key problem seems to be the improvement the profitability of agriculture, which shall accelerate the process of concentration. Following the regulations of the Polish Constitution the family farms shall become support. Criterion for determining the existence of preferences shall be therefore the economic efficiency, regardless of the size of the area farm, included in legal regulations as a criterion of ensuring an adequate farm operating income. Such criterion could set the direction of transformations in agriculture as a whole, with particular emphasis on structural changes.

The Act on the Termination of Sale of Real Estate Owned by the Agricultural Property Stock of the State Treasury and on the Change of Certain Acts of 14 April 2016 thoroughly amended the Act on the Formation of Agricultural System of 11 April 2003, due to the introduction of entirely new principles of agricultural land acquisition. It considerably broadened the scope of the Act’s application, incorporating into it, inter alia, acquisition of real estate resulting from inheritance or specific bequest. Limitations do not pertain to the bequeather’s close relatives or in the case of intestacy. The fulfillment of the aims of the Act can hardly be noticed in the new resolutions concerning inheritance, while the turnover in the case of the testamentary inheritance is unnecessarily complicated. Imprecise regulations of the Act do not state how and when the obligation to inform the Agency of Agricultural Real Estate about the acquisition of the real estate by inheritance should be fulfilled. Moreover, regulations concerning inheritance of stocks and shares in capital companies and rights and responsibilities in partnerships require the legislator’s intervention.

Provisions of the Polish Act on Shaping of the Agricultural System pose a number of doubts as to their interpretation. In its resolution adopted on 22 June 2017, the Supreme Court decided that an owner of an agricultural property, to whom the 10-year trading prohibition applies, as referred to in Art. 2b par. 2 of the Act, is allowed to trade it within that period for the benefit of a closely related person. This opinion raises doubts, as it has no legitimate authorisation in the legal provisions. Furthermore, the functional arguments put forward by the Supreme Court do not provide sufficient justification for the above-mentioned conclusion. In the author’s opinion, a number of problems emerging from Art. 2b of the Act on Shaping the Agricultural System could be solved through a functional, flexible interpretation of the prerequisite of “material reasons, irrespective of the buyer”, which underlies the court’s consent to the disposal of the real property by an owner burdened by trading prohibition.

On 14 April 2016, the Polish Parliament adopted the Act on suspending the sales of properties from the Agricultural Property Stock of the State Treasury and amending several other acts. By doing so, it decided to materially amend the Act on shaping of the agricultural system of 11 April 2003 that had been effective by that time, by founding a new, strict regime of trading in agricultural property in Poland that came into force as of 30 April 2016. Already upon drafting the new legal solutions, a number of remarks and reservations were made in the public debate and during the consultation process. It was pointed out that once it becomes effective, the bill considered by the Parliament would actually “freeze” agricultural property transactions in Poland, become a threat to execution of the right to inherit, and undermine the right ongoing interests initiated by law entities. These were some of the reasons why, in the course of legislative proceedings, the legislator decided to apply exclusions from the new legal regulations concerning trading in agricultural property. The objective of this article is to identify and characterise selected exclusions applied by the legislator, as well as to explain uncertainties related to interpretation with regards to legal norm hypotheses that specify the application scope of the implemented legal solutions.
Uchwalając ustawę z dnia 14 kwietnia 2016 r. o wstrzymaniu sprzedaży nieruchomości Zasobu Własności Rolnej Skarbu Państwa oraz o zmianie niektórych innych ustaw, parlament zdecydował o wprowadzeniu do dotychczas obowiązującej regulacji – ustawy z dnia 11 kwietnia 2003 r. o kształtowaniu ustroju rolnego – istotnych zmian, ustanawiających z dniem 30 kwietnia 2016 r. nowy, rygorystyczny reżim obrotu nieruchomościami rolnymi w Polsce. Jeszcze na etapie projektowania nowych rozwiązań prawnych dochodziło w debacie publicznej oraz w procesie konsultacji do zgłaszania uwag i zastrzeżeń, ze wskazaniem, że procedowany w parlamencie projekt ustawy po wejściu w życie „zamrozi” w istocie obrót nieruchomościami rolnymi w Polsce, zagrozi realizacji prawa dziedziczenia i zniweczy słuszne interesy w toku, podjęte przez podmioty prawa. Między innymi z tych względów ustawodawca w trakcie postępowania legislacyjnego zdecydował się na zastosowanie wyłączeń spod nowych zasad obrotu gruntami rolnymi. Celem artykułu jest identyfikacja i charakterystyka zastosowanych przez ustawodawcę wybranych wyłączeń oraz próba wyjaśnienia wątpliwości wykładniczych dotyczących hipotez norm prawnych określających zakres stosowania wprowadzonych rozwiązań prawnych.

Article 2b of the Act on Formation of the Agricultural System of 11 April 2003 is the source of a wide range of interpretation discrepancies and practical problems. In the commented on resolution, the Supreme Court settled the issue of the sale of agricultural property by the buyer before the end of the period provided for in art. 2b para. 1 of the Act to a close person within the meaning of art. 2 point 6 of the Act, indicating that it does not require the consent of the court issued on the basis of art. 2b para. 3 of this Act. The position of the Supreme Court deserves approval. The solutions introduced so far are sufficient in the prevention of speculative risk and the restrictive interpretation of this provision would be disproportionate to the intended purpose. The resolution of the above-mentioned issue by the Supreme Court should be positively assessed, however, the wording of art. 2b of the Act is still a source of many interpretative difficulties that need to be resolved. This applies, for example, to the insufficiently clear drafting of art. 2b para. 1, an unclear interpretation of art. 2b para. 3 and the narrowed circle of close persons in the definition contained in art. 2 para. 6.

The article presents the relations between the legislator’s activities aimed at the formation of the agricultural system structure and the instruments for the planning and spatial development of rural areas. The agricultural system may be defined as a set of internal and external legal, economic and social relations concerning the operation of agricultural farms. Among the external relations, an essential role is played by the relations resulting from the spatial situation of agricultural farms, directly associated with the use of land and other natural resources. During the interwar period these relations were structured correctly in both the constitution and statutory law. The structure of rural space was formed with due account of the interests of not only farmers, but also other users of the space, as well as the developmental needs of urban settlements. These relations were considerably disturbed during the communist era because of the concept of agriculture socialisation, which left a permanent mark on rural space. Liberalisation of agricultural property trading as of 1 October 1990 and unavailability of appropriate instruments in planning and spatial development laws supported the harmful phenomenon of rural space being used for non-agricultural purposes. Rural space shrank against the principle of sustainable development. The amendment of the Agricultural System Structure Formation Act, made on 14 April 2016, is an opportunity to bring back the proper relations between formation of the agricultural system structure and formation of the rural space structure.

The paper presents an analysis of the variation in the number of insured farmers and beneficiaries using the agricultural insurance system in 1991-2015. The current system of farmers’ social insurance did not create good conditions for changes in the agrarian structure of farms or to develop more non-agricultural economic activity in rural areas. It should be emphasized, however, that the Polish agricultural policy assumes that a family farm is a basic entity functioning in agricultural structures, and the contributions of economically active insured farmers, supplemented by a budgetary subsidy, financials of benefits. Considering the issue of social insurance for farmers, it is worth pointing out that since the protection of farm workers it has undergone some evolution, as evidenced by the above data on the change in the number of insured persons in relation to the number of beneficiaries.

It is difficult to imagine socio-economic relations without property. Ownership can be understood differently: narrowly – as a right within the meaning of civil law and broadly – as in fact any right belonging to a person that together with other rights forms property of this person. Therefore, ownership is of interest to almost all branches of law, including constitutional law. As a consequence, ownership can be regarded as a single right, especially within the meaning of the Civil Code, or as institution that includes ownership rights and associated obligations. Nowadays, these obligations become more and more important because property is regarded as a social function and not only as an absolute right of the owner. The social perspective of ownership makes the property differentiated by its object. In this way various legal regimes of ownership are created, including agricultural property of great social significance. Agricultural property is a basic element of the agricultural system that is constitutionally based on a family farm. The state, shaping the agricultural system in the assumed way, regulates the agricultural system accordingly. This is done, among others, by the Act of 2003 on the shaping of the agricultural system that also defines a family farm. However, the Act, contrary to its title, regulates only the transfer of ownership of agricultural lands and farms. The provisions of the Act raise serious objections both in terms of assumptions and in terms of applied legal solutions. The source of these defective regulations, after the transformation of the political system at the turn of the 1980s and 1990s, is a fact that in Poland the model of the agricultural system has never been developed.

The legal structure of agricultural property has been the subject of discussion in the doctrine of agricultural law and the matter of numerous court decisions. This issue, however, still raises a lot of controversies. The problem occurs in the Civil Code regulation itself (art. 461 of the Civil Code), in which the concepts of agricultural real estate and agricultural land were wrongly identified. It should be clearly indicated that only agricultural property is a category of ownership, while this attribute does not refer to the notion of agricultural land. It should also be noted that there is no criterion of area in the Code definition of agricultural real estate. From such a perspective, it is difficult to reconcile the possibility of conducting manufacturing activity in agriculture with the use of any agricultural property regardless of its area. Besides, the weakness of the spatial planning system makes the determination of the nature of property, in particular when it loses its agricultural character, a very complicated process. Despite the mentioned shortcomings of the legal regulation, the Code definition of agricultural property should be universal and common. However, modifications of this definition introduced in specific provisions make use of multiple regulations dysfunctional.

Rozporządzenie Rady (WE) nr 1782 z 2003 roku, zastąpione rozporządzeniem Rady (WE) nr 73/2009 z dnia 19 stycznia 2009 roku, zobowiązywało państwa Unii Europejskiej do utworzenia, do końca 2007 roku, „Systemu Doradztwa Rolniczego” (FAS – Farm Advisory System). Zadaniem doradztwa w ramach FAS jest pomoc doradcza rolnikom w dostosowywaniu gospodarstw do minimalnych wymogów wzajemnej zgodności. Wymagania wzajemnej zgodności w państwach członkowskich, jak i podstawowe założenia organizacji FAS zdefiniowane zostały w oparciu o jednolite prawo wspólnotowe.
Council Regulation (EC) No. 1782 of 2003, replaced by Council Regulation (EC) No. 73/2009 of January 19, 2009, obliged the European Union countries to create, by the end of 2007, the "Farm Advisory System" (FAS - Farm Advisory System). The purpose of FAS advisory services is to provide advisory assistance to farmers in adapting their farms to the minimum cross-compliance requirements. Cross-compliance requirements in the Member States, as well as the basic assumptions of the FAS organization, have been defined on the basis of uniform Community law.

Opis:
W opracowaniu przedstawiono – w ujęciu historycznym – informacje o kształtowaniu i przemianach systemów doradztwa, a ponadto o tworzeniu systemów wiedzy i innowacji rolniczych. Wskazano na źródła powstawania instytucji doradczych w wybranych krajach, o typach dominujących form organizacyjnych i ich umiejscowienia w strukturze sektora rolnego. W ramach WPR kraje członkowskie UE zostały zobligowane do stworzenia jednolitego systemu FAS, poprzez który wyznaczano cele i zadania doradztwa, ale nie formy organizacyjne. Scharakteryzowano System Wiedzy i Innowacji Rolniczych w niektórych krajach, który miał stanowić sieć powiązań instytucjonalnych, począwszy od ośrodków naukowych i badawczych, poprzez upowszechnianie i wdrażanie, a na rolnikach kończąc. Przedstawiono nowe propozycje SCAR dotyczące usług doradczych i instytucji edukacyjnych. Zasygnalizowano znaczenie EPI dla wdrażania innowacji rolniczych.
The study presents - in historical terms - information about shaping and transformation of advisory systems, and also creating knowledge systems and agricultural innovations. The sources of advisory institutions in selected countries, types of dominant organizational forms and their location in the structure of the agricultural sector were pointed out. Under the CAP, EU member states were obliged to create a uniform FAS system through which objectives and tasks of counseling were set, but not organizational forms. The System of Knowledge and Agricultural Innovation in some countries was characterized, which was to constitute a network of institutional connections, starting from scientific and research centers, through dissemination and implementation, and ending with farmers. New SCAR proposals for advisory services and educational institutions were presented. The significance of the EIP for the implementation of agricultural innovations has been indicated.

Opis:
The Polish legislator introduced a series of mechanisms limiting the possibility of turnover of agricultural real estate. The amendment to the Act on the Formation of Agricultural System, binding since 30 April 2016, has introduced several limitations in the acquisition of agricultural real estate. The rule has been adopted that only an individual farmer may be the acquirer of farming land, which excludes e.g. a commercial law company. These limitations also apply to the division of inheritance. The acquisition by relatives is not subject to the restrictions contained in the discussed regulation, but the inheritance by non-relatives is only possible under the statutory requirements. In the division of inheritance, the estate may be acquired by an individual farmer, or by other subjects who obtained the approval of the President of the National Center for Support of Agriculture. The inclusion of the above clauses in the inheritance section is not understandable and does not serve any purposes defined in the preamble to the law. It unnecessarily complicates the turnover. Fortunately, the most common divisions of inheritance, i.e. those in which relatives participate, are excluded from these constraints.
