Opis:
In the light of the current Code of Canon Law, according to Cann. 537, the parish priest is obliged to appoint the parish economic council whose responsibility is to abide by both the common law and the regulations issued by the bishop of the diocese. This paper presents and discusses the current charter of the Parish Economic Council of the Archdiocese of Poznań which was approved on February 20, 2007 by Archbishop Stanisław Gądecki, the Metropolitan Archbishop of Poznań. It is not clear why the Synod of the Diocese of Rzeszów does not mention the idea of the parish economic council. There is no information on the charter of the parish economic council among the charters approved by the Synod. The Canon law, both common and particular, stresses that the parish economic council is a body providing advisory and support services to the parish priests in administering the parish resources. The council consists of 3 to 7 members depending on the size of the parish, and its term of office lasts 4 years. At the same time, it is important to mention that the only legal representative of the parish in terms of the governance of its resources is the parish priest and he is the only person that can make valid decisions in this respect.

Since the beginning of the pontificate of Pope Francis we have heard in his preaching the calling to reform the structures of the church. Bergoglio presented his pastoral-evangelical idea of the functioning of the Church in the exhortation Evangelii Gaudium. Naturally the reform made by the Bishop of Rome also applies to the canon law. Directed by voices of hierarchy gathered at the Synod of Bishops 2014 and the spiritual good of the faithful, who are waiting for an explanation of their canonical situation, 15 August 2015 Pope Francis promulgated the Motu proprio Mitis Iudex Dominus Iesus, to accelerate and simplify the process of annulment of the marriage. Pope wanted the heart of the faithful were not too long enslaved by darkness of doubt because of delays in the judgment. In the center of his reform Pope put the diocesan Bishop, who together with the Bishop of Rome becomes the guarantor of the unity of the Catholic faith and discipline. According to the principles of the reform, the bishop not only organizes and is responsible for the court structure in the local church, but he also has to personally fulfill the task of the first judge of the faithful, for whom he was established a shepherd. The new laws allow the bishop to establish a single judge and introduces the institution of processus brevior, which is provided for particular obvious situations. The only judge in this process is the bishop. It seems that the reform process of marriage, made in the spirit of historical continuity, will bring much spiritual fruit and contribute to the perception of the person the diocesan bishop not only as pastor bonus, but at the same time as iustus iudex.
Od początku pontyfikatu papieża Franciszka słyszymy w jego przepowiadaniu nawoływanie do reformy struktur kościelnych. Swoją pastoralno-ewangeliczną koncepcję funkcjonowania Kościoła Bergoglio przedstawił w adhortacji Evangelii Gaudium. Naturalnie, reforma dokonywana przez Biskupa Rzymu dotyczy również prawa kanonicznego. Kierowany głosami hierarchów gromadzonych na Synodzie Biskupów w 2014 roku oraz dobrem duchowym wiernych, którzy oczekują na wyjaśnienie swojej sytuacji kanonicznej, papież Franciszek 8 września 2015 roku promulgował Motu proprio Mitis Iudex Dominus Iesus tak, by przyspieszyć i uprościć proces stwierdzenia nieważności małżeństwa. Wolą Papieża było ty, by serca wiernych nie były zbyt długo zniewolone przez mroki wątpliwości z powodu opóźnień w wydaniu wyroku. W centrum swojej reformy Ojciec Święty postawił postać biskupa diecezjalnego, który wraz z Biskupem Rzymu staje się gwarantem katolickiej jedności w wierze i dyscyplinie. Według założeń reformy, biskup nie tylko organizuje i odpowiada za strukturę sądowniczą w swoim Kościele lokalnym, ale ma również wypełniać osobiście zadanie pierwszego sędziego wiernych, dla których został ustanowiony pasterzem. Nowe ustawodawstwo daje biskupowi możliwość ustanowienia sędziego jednoosobowego oraz wprowadza instytucję processus brevior, który przewidziany jest w sytuacjach szczególnie oczywistych. Jedynym sędzią w tym procesie jest sam biskup. Wydaję, że reforma procesu małżeńskiego, dokonana w duchu ciągłości historycznej, przyniesie wiele owoców duchowych i przyczyni się do postrzegania osoby biskupa diecezjalnego nie tylko jako pastor bonus, ale jednocześnie jako iustus iudex.

Opis:
The present study is dedicated to the administrative act of the competent person, who has the right to release dimissorial letters by exercising the proper governance in the Church.  This document is necessary for the licit administration of the sacrament of Holy Orders. The eastern legislation that regulates the life of the Eastern Catholic Churches contains a vast number of such ecclesiastical subjects that are provided by the Supreme Legislator with the right to issue such a document. In addition, the Eastern canon law in its rules concerning the sacraments also show the liturgical nature of their celebration. Therefore it can be said that there is a strong and mutual relationship between the canonical norms and the liturgical rubrics among the Eastern Churches.
Il diritto canonico dall’inizio del cristianesimo ha occupato un posto importante nella vita della Chiesa. I Concili ecumenici e sinodi locali, sopratutto nel primo millennio, hanno dedicato l’attenzione non solo alle questioni teologiche che sorgevano nelle comunità cristiane, ma anche ai problemi amministrativi e disciplinari. Basta solo analizzare le norme del concilio di Trullo che sottolineano l’obbligo della severa osservanza della disciplina canonica tra i cristiani. Anche oggi la Chiesa svolgendo la missione della proclamazione del Vangelo nel mondo ha bisogno degli atti amministrativi che possano aiutarLa a svolgere la sua missione in modo più efficace. Il tema delle litterae dimissoriae che sono oggetto di questo studio è una delle questioni che regolano i rapporti tra i Vescovi e tra i Vescovi e i presbiteri e i diaconi. L’esistenza di tale litterae nell’attività amministrativa della Chiesa permette di risolvere alcune delle situazioni relative a coloro che non hanno i requisiti per conferire l’ordine sacro. Inoltre tali litterae, in modo particolare, sottolineano il fatto che ogni presbitero e diacono dopo la propria ordinazione non può avere una certa autonomia nella sua attività pastorale perché è parte costitutiva del presbiterio eparchiale, che sotto la direzione del proprio Vescovo eparchiale, realizza il fine pastorale della Chiesa.

Prior to the modifications brought about by the Motu Proprio, Omnium in mentem, the Code (cann. 1008-1009), aligns the diaconate to the priesthood and the episcopate, without sufficiently highlighting the nature of their distinctiveness. Lo scopo principale dell’articolo è quello di analizzare il discorso latino pubblicato a Padova nel 1642 e pronunciato davanti alla solenne assemblea della nazione polacca presso l’Università di Padova, nella chiesa di Sant’Antonio da Padova, il 7 maggio dell’anno precedente. L’autore del testo fu Stanisław Temberski, canonico e professore all’Università Jagellonica. L’autore dell’articolo presenta brevemente la sua biografia e la sua opera letteraria, quindi analizza il discorso. Evitando valutazioni di carattere letterario del lavoro in quanto tale cerca di presentare le idee in esso contenute e di mostrare come la cultura umanistica caratteristica della prima età moderna permetta all’autore di costruire formule e immagini eloquenti che glorificano il nome della sua patria lodando la gloria del suo santo. La lode della Polonia è inestricabilmente legata alla lode del suo patrono, San Stanislao, vescovo e martire. Nell’orazione di Temberski la tradizione antica e medioevale, la leggenda agiografica sono intrecciate e tutto è elaborato secondo la mentalità dell’autore e i concetti della retorica seicentesca. Il santo martire viene paragonato ad Ercole e il malvagio tiranno responsabile della sua morte viene ritratto come uno strumento di Satana, percepito come “Cerbero infernale”. L’uso che Temberski fa delle sue doti retoriche a fini propagandistici è degno di nota: da un lato manifesta la sua cultura umanistica e si presenta come cittadino della Respublica litteraria, dall’altro, inscrive lo Stato polacco nella lunga tradizione della Respublica Christiana. In questo contesto, mette in evidenza che un Paese che produce uomini così pii ed eroici come il santo vescovo è degno di apprezzamento tra le nazioni d’Europa.
The main purpose of the article is to analyze the Latin speech published in Padua in 1642 and delivered at the solemn assembly of the Polish nation at the University of Padua, in the church of St. Anthony of Padua, on May 7 of the previous year. The author of the text was Stanisław Temberski, a Krakow canon and professor at the Jagiellonian University. The author of the article briefly presents his biography and literary works, and then analyzes the speech itself. Avoiding assessing the literary value of the work as such, she tries to present the ideas contained in it and show how the humanistic culture characteristic of the early modern era allows the author to construct eloquent formulas and images that glorify the name of his homeland by praising the glory of its saint. The laudation of Poland is inextricably linked with the praise of its patron, Saint Stanislaus, Bishop and martyr. In Temberski’s oration, ancient tradition and medieval, hagiographic legend intertwine, and everything is processed in accordance with the author’s mentality and the concepts of seventeenth-century rhetoric. The holy martyr is compared to Hercules and the evil tyrant responsible for his death is presented as an instrument of Satan, perceived as “infernal Cerberus.” Temberski’s use of his rhetorical skills for propaganda purposes is noteworthy: on the one hand, he shows his humanistic culture and presents himself as a citizen of the Respublica litteraria. On the other hand, he inscribes the Polish state into the long tradition of Respublica Christiana. In this context, he makes it clear that a country that produces such pious and heroic men as the holy bishop is worthy of appreciation among the nations of Europe.
