    The aim of present paper is a closer analyze of some textual construction which are imitating a legal action at court. The scene of imagined court were popular in medieval dramaturgy, they are often used as a plot for scenic action. A particular case was created by Master Vincentius (12th Cent.): a passage from chronicle which presents a possible staging of court action.

    SPP XXII 95 (early 3rd century ad) is concerned with the leading priests of the sanctuary of Soknopaios, who were arrested on account of the suspicious death of a clothes vendor. Their interrogations, however, brought no result, and now efforts are being made to have them released. In the present papyrus, the head of the office summarises the state of affairs in order to append it as a ‘cover-letter’ to the petition submitted to the strategos.

    „Też nazywam się Franz, niezbyt to odległe od kanalii, już prawie się do tego przekonałem”. Nieznany przypadek odniesienia do tradycji w klasycznym modernizmie. Zbójcy Schillera (1781) i Wyrok (1912) Kafki W lecie 2020 r. zmarł Jochen Schmidt (ur. 1938), jeden z najwybitniejszych niemieckich germanistów. Zasłynął dzięki studiom nad twórczością Hölderlina, Kleista, Goethego i Musila. Jego wielokrotnie wznawiana, dwutomowa Historia Geniuszu (Geschichte des Genie-Gedankens) była impulsem do powstania obszernego komentarza do dzieł zebranych Nietzschego. Do tej pory zwykle pomijano fakt, że jego ostatnia książka, będąca rozrachunkiem z kultem Nietzschego i jego Wolą mocy (Wille zur Macht), zawiera rozdział poświęcony Kafce (Schmidt 95-100). Schmidt odsłania w nim ślady Woli mocy w opowiadaniu Wyrok (Das Urteil). W swojej analizie walki między ojcem i synem dostarcza jednak niezbyt przekonującej wykładni postaci ojca jako figuracji, która spełnia funkcję „preegzystencjalną” i nadrzędną w stosunku do Georga Bendemanna. Niniejszy artykuł odnosi się wprawdzie do starszych badań na twórczością Kafki, otwiera jednak zupełnie nową perspektywę. Po raz pierwszy dramat Schillera Zbójcy (Die Räuber) został tu potraktowany jako pretekst dla opowiadania Kafki, a jego sens jest interpretowany jako koherentne przedstawienie wewnętrznej symulacji procesu emancypacji.   Im Sommer 2020 starb mit dem Germanisten Jochen Schmidt (Jg. 1938) einer der herausragendsten Vertreter seines Fachs in Deutschland. Bekannt wurde Schmidt neben seinen Studien zu Hölderlin, Kleist, Goethe und Musil sowie einem von ihm angestoßenen umfangreichen Kommentar zu Nietzsches Gesamtwerk besonders durch seine mehrfach aufgelegte, zweibändige Geschichte des Genie-Gedankens. Dass das letzte von ihm vollendete Buch, eine Abrechnung mit dem Kult um Nietzsche und dessen „Willen zur Macht“, auch ein Kapitel über Kafka (Schmidt 2016, 95-110) enthält, ist bisher kaum wahrgenommen worden. In diesem Kapitel legt Schmidt Spuren des „Willens zur Macht“ in Kafkas Erzählung Das Urteil frei, gelangt jedoch in der Analyse des Kampfes zwischen Vater und Sohn am Ende zu einer nicht überzeugenden Deutung der Vatergestalt als Figuration einer Georg Bendemann vorgängigen und ihr überlegenen „Präexistenz“. Unter Einbezug der älteren Kafka-Forschung setzt der nachfolgende Beitrag hier neu an: Indem er erstmals Schillers Schauspiel Die Räuber als Prätext für Kafkas Erzählung identifiziert, erschließt er deren Sinngestalt als kohärenter Darstellung der inneren Simulation eines Emanzipationsprozesses.
    In the summer of 2020, Jochen Schmidt (born 1938), one of the most prominent Germans in the field of German studies, passed away. He became famous thanks to his studies on the works of Hölderlin, Kleist, Goethe and Musil. His two-volume work The History of Genius Thought (Geschichte des Genie-Gedankens) was reissued many times and became the inspiration for a comprehensive commentary on Nietzsche’s collected works. Until now, it has generally been overlooked that his last book, which deals with the cult of Nietzsche and his work The Will to Power (Wille zur Macht), also contains a chapter dedicated to Kafka (Schmidt 2016, 95-100). In this, Schmidt reveals the traces of The Will to Power in the story The Trial (Das Urteil). In his analysis of the struggle between the father and the son, however, he does not provide a very convincing interpretation of the father figure as a figuration which fulfils its ‘pre-extentialist’ and superior function in relation to Georg Bendemann. This article refers to older studies on Kafka’s work, yet also opens up a completely new perspective. For the first time ever, Schiller’s drama The Robbers (Die Räuber) is treated here as pre-text for Kafka’s story, and its meaning is interpreted as a coherent representation of the internal simulation of the process of emancipation.

    The right to defence is a very important indicator of the quality of the rule of law. In the Soviet Occupation Zone of Germany, later the GDR, the legal profession underwent a transformation. Individual defence for defendants was not to be totally abandoned, but it was meant to be subordinated to the interest of the socialist state. The academic study, which has served as the basis for this article, shows the development of the legal profession in East Germany. Due to the analysis of a large number (about 1,800) of legal procedures that were carried out in Berlin by the Ministry for State Security (MfS), the course of political trials and the conduct of advocates in such trials have been studied for the first time. Contrary to the show trials of the 1950s, a characteristic feature for the Honecker era was a short secret trial. The trial culture clearly deteriorated, though a reverse trend could be observed since the mid-1980s. The research aim is to analyze how it happened. The recruitment of advocates, their organisation in district bar associations, their education and disciplinary measures were not insignificant. The role of the MfS in exerting control over advocates and political trials has also been studied. Even if there were drastic cases of interference in the proceedings by the MfS – also through secret collaborators – until now, the control of the judiciary by the said ministry in the late GDR was rather overestimated. What was more influential were the so-called “steering meetings”. These assemblies – which were secret and are still underestimated – contributed to the fact that the course of the procedures was quite uniform and conformed to the dictatorship of the Socialist Unity Party of Germany (SED).

    Am 6. April 1945 wurden im Zuchthaus Stein über 220 vorwiegend politische Gefangene sowie drei antifaschistische Justizwachebeamte und der Anstaltsdirektor von nationalsozialistischen Aufsehern und von Volkssturm-, Waffen-SS- und Wehrmachtsangehörigen erschossen, um die von der Anstaltsleitung angeordnete Entlassung aller Inhaftierten zu verhindern. Am selben Tag wurden dutzende weitere Häftlinge in Krems an der Donau und in der Umgebung, auch unter Mithilfe der lokalen Bevölkerung, ermordet (‚Kremser Hasenjagd‘). 2015 erschien mit ROBERT STREIBELs Roman April in Stein die erste literarische Auseinandersetzung mit diesem NS-Endphaseverbrechen. Wie sich der Autor diesem Themenkomplex nähert, soll nach einem Abriss der Geschehnisse in Krems-Stein im April 1945 und ihrer Darstellung in der medialen Berichterstattung über den Volksgerichtsprozess im August 1946 erörtert werden.
    6 kwietnia 1945 r., w więzieniu Stein nazistowscy nadzorcy, członkowie Waffen-SS, Volkssturmu i Wehrmachtu zastrzelili ponad 220 więźniów (głównie politycznych) a także trzech antyfaszystowskich urzędników sądowych i dyrektora więzienia. Chcieli w ten sposób zapobiec uwolnieniu wszystkich więźniów, zarządzonemu przez kierownictwo zakładu. Kilkudziesięciu kolejnych więźniów – z pomocą okolicznej ludności – zostało zamordowanych w okolicach Krems nad Dunajem (‘̜Polowanie na zające w Krems’). W roku 2015 ukazało się pierwsze literackie rozliczenie z tą ostatnią fazą zbrodni nazistowskich: powieść ROBERTA STREIBLA April in Stein (Kwiecień w Stein). Artykuł informuje krótko o wydarzeniach w Krems i Stein w kwietniu 1945 r. oraz o medialnych sprawozdaniach z procesu sądowego, jaki odbył się w sierpniu 1946 r. Następnie analizuje sposób przedstawienia tej problematyki w powieści.
    On 6 April 1945 over 220 political prisoners from the Stein Penitentiary as well as three antifascist prison guards and the prison director were shot by Nazi guards and members of the Volkssturm, the Waffen-SS and the Wehrmacht in order to prevent the release of all prisoners as ordered by the prison management. The same day in Krems an der Donau and its surroundings dozens of inmates were killed with the active participation of the local population (this event became known as the ‚Kremser Hasenjagd‘ – lit. ,Krems hare hunt‘). ROBERT STREIBELs’ novel April in Stein, a literary exploration of this atrocity committed during the final months of the war, was first published in 2015. After a brief outline of the events that took place in Stein-Krems in April 1945 and their representation in media coverage of the War Crimes Trial before the Austrian People’s Court in August 1946, this paper will discuss how the author approaches this range of complex topics.
