Am Beispiel der Pitavalgeschichte des Marquis de la Pivardiere ist der Beitrag der asymmetrischen Verhorsituation im Inquisitionsverfahren gewidmet1. Untersuchungsrichter und Protokollant verdichten die Aussagen der Magde des Marquis zu einer juristisch belastbaren Erzahlung des Tathergangs. Gezeigt wird, wie sich in der Fassungsgeschichte (Gayot de Pitaval, Friedrich Schiller, Neuer Pitaval) der Wandel zum reformierten Strafprozess spiegelt. Der in den Akten dokumentierte Manipulationsvorwurf dient bei Gayot zur Mahnung an eine formstrenge Durchfuhrung des Verfahrens, wahrend Schiller darin einen anthropologisch verwertbaren Einblick in die Psyche des Tatersubjekts erkennt. Der neue Pitaval disqualifiziert das Inquisitionsverfahren im Ganzen, um ihm die preu.ische Rechtspraxis entgegen zu stellen.
Using the cause célèbre of the Marquis de la Pivardiere, the article is dedicated to the asymmetrical situation in the inquisitorial hearings of witnesses. The inquisitor and the transcript condense the testimony of the Marquis’ maids into a legally usable narrative. It is shown how the individual versions of this story (Gayot de Pitaval, Friedrich Schiller, Neuer Pitaval) reflect the historical change to the reformed criminal process. In Gayot’s case, the accusation of manipulation documented in the records serves as an admonition to conduct the trial with strict formality, while Schiller recognises in it an anthropologically revealing insight into the psyche of the delinquent. Der Neue Pitaval disqualifies the inquisition procedure as a whole to oppose the Prussian legal practice. - Źródło:
