Artykuł dotyczy aktualnego problemu bezprawnej profanacji obiektów religijnych i świątyń oraz odpowiedzialności karnej za takie działania zgodnie z Kodeksem karnym Ukrainy. Autor zwraca szczególną uwagę na definicję legalną czynów bezprawnych wobec obiektów religijnych i świątyń. Autor opisuje i analizuje obiektywne i subiektywne cechy charakterystyczne bezprawnych działań przewidzianych w art. 178 i 179 Kodeksu karnego Ukrainy, a także wskazuje ich konsekwencje prawne. Artykuł ma charakter interdyscyplinarny na pograniczu prawa karnego oraz wyznaniowego.
Der Aufsatz behandelt die aktuelle Problematik der gesetzeswidrigen Schändung religiöser Objekte oder Heiligtümer und deren strafrechtliche Konsequenzen gemäß des Strafgesetzbuches der Ukraine. Besondere Aufmerksamkeit gilt dabei der juristischen Definition rechtswidriger Handlungen gegen religiöse Objekte oder Heiligtümer. Der Autor beschreibt und analysiert objektive und subjektive Merkmale der entsprechenden strafrechtlich relevanten Taten gemäß Artikel 178 sowie 179 nach dem ukrainischen Strafgesetzbuch und deren Straffolgen. Der interdisziplinäre Aufsatz bewegt sich im Grenzbereich zwischen Kirchen- und Strafrecht.
The article is devoted to the topical problem of illegal acts (offences) against religious structures and temples and criminal liability for such acts under the criminal law of Ukraine. Special attention is paid to the legal principles and features of the concepts of the subject and object of such illegal acts. The characteristic features of subjective criteria of unlawful acts perpetrated against religious structures and temples are highlighted and described. Having analysed the aforesaid criteria of such offences under Articles 178 and 179 of the Criminal Code of Ukraine, the author casts more light on some of such offences. The article is of interdisciplinary nature at the interface of criminal law and denominational law. - Źródło:
